43	43	Section 1-1109, which relates to adulterated foods ;
44	44	prohibiting the use of certain f ood dyes; updating
45	45	statutory references; and providing an effective

52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. AMENDATORY 63 O.S. 2021, Section 1 -1109, is
54	54	amended to read as follows:
55	55	Section 1-1109. A. A food shall be deemed to be adulterated:
56	56	(a) (1) 1. if If it bears or contains any poisonous or
57	57	deleterious substance which may render it injurious to health; but
58	58	in case the substance is not an added substance, such food shall not
59	59	be considered adulterated under this clause if the quantity of such
60	60	substance in such food does not ordinarily render it injurious to
61	61	health; or (2)

88	88	2. if If it bears or contains any added poisonous or added
89	89	deleterious substance which is unsafe within the meanin g of Section
90	90	1112 of this article; or (3)
91	91	3. if If it consists in whole or in part of a diseased,
92	92	contaminated, filthy, putrid, or decomposed substance, or if it is
93	93	otherwise unfit for food; or (4)
94	94	4. if If it has been produced, prepared, packed, or held under
95	95	insanitary conditions whereby it may have been rendered diseased,
96	96	unwholesome, or injurious to health; or (5)
97	97	5. if If it is the product of a diseased animal or an animal
98	98	which has died otherwise than by slaughter, or that has been fed
99	99	upon the uncooked offal from a slaughterhouse; or (6)
100	100	6. if If its container is composed, in whole or in part, of any
101	101	poisonous or deleterious substance which may render the contents
102	102	injurious to health.
103	103	B. Notwithstanding subsection A, the following food additives
104	104	shall, with respect to any particular use or intended use, be deemed
105	105	to be unsafe:
106	106	a. red dye 3,
107	107	b. red dye 40,
108	108	c. yellow dye 5,
109	109	d. yellow dye 6,
110	110	e. blue dye 1, and
111	111	f. blue dye 2.

138	138	(b) (1) if C. 1. If any valuable constituent has been in whole
139	139	or in part omitted or abstracted therefrom; or (2)
140	140	2. if If any substance has been substituted wholly or in part
141	141	therefor; or (3)
142	142	3. if If damage or inferiority has been concealed in any
143	143	manner; or (4)
144	144	4. if If any substance has been added thereto or mixed o r
145	145	packed therewith so as to increase its bulk or weight, or reduce its
146	146	quality or strength or make it appear better or of greater value
147	147	than it is.
148	148	(c) if D. If it is confectionery and it bears or contains any
149	149	alcohol or nonnutritive article of substance except harmless
150	150	coloring, harmless flavoring, harmless resinous glaze not in e xcess
151	151	of four-tenths of one percent (4/10 of 1%), harmless natural wax not
152	152	in excess of four-tenths of one percent (4/10 of 1%), harmless
153	153	natural gum and pectin; provided, that t his paragraph shall not
154	154	apply to any confectionery by reason of its containing less than
155	155	one-half of one percent (1/2 of 1%) of volume of alcohol derived
156	156	solely from the use of flavoring extracts, or to any chewing gum by
157	157	reason of its containing harmless nonnutritive masticatory
158	158	substances.
159	159	(d) if E. If it bears or contains a coal tar color other than
160	160	one from a batch which has been certified under authority of the
161	161	Federal Act.
