4545 requirements; providing for penalties and suspension;
4646 authorizing Attorney General enforcement; creating
4747 the Vapor Products Compliance Fund; repealing 63 O.S.
4848 2021, Section 1-229.35, which relates to vapor

5858 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5959 SECTION 1. NEW LAW A new section of law to be codified
6060 in the Oklahoma Statutes as Section 1-229.50 of Title 63, unless
6161 there is created a duplication in numbering, reads as follows:
6262 The purpose of this act is to protect public health and safety
6363 by:
6464 1. Ensuring the safety and security of e-liquid and vapor
6565 products manufactured for sale in this state;

9292 2. Ensuring that e-liquid and vapor products manufactured or
9393 sold in this state conforms to appropriate standards related to
9494 labeling, marketing, and appearance;
9595 3. Ensuring that e-liquid and vapor products are not
9696 contaminated by the inclusion of ingredients or other substances
9797 that might pose unreasonable threats to public health and safety;
9898 and
9999 4. Ensuring that e-liquid and vapor products manufactured or
100100 sold in this state are not targeted to appeal to minors.
101101 SECTION 2. NEW LAW A new section of law to be codified
102102 in the Oklahoma Statutes as Section 1-229.51 of Title 63, unless
103103 there is created a duplication in numbering, reads as follows:
104104 As used in this act:
105105 1. "Advertise" means the publication or dissemination of an
106106 advertisement;
107107 2. "Advertisement" includes any written or verbal statement,
108108 illustration, or depiction which is calculated to induce sales of
109109 vapor products, including any written, p rinted, graphic, or other
110110 material, billboard, sign, or other outdoor display, public transit
111111 card, other periodical literature, publication, or in a radio or
112112 television broadcast, or in any other media; except that such term
113113 shall not include:
114114 a. any label affixed to any e-liquid or vapor product, or
115115 any individual covering, carton, or other wrapper of

142142 such bottle that constitutes a part of the labeling
143143 under provisions of this act,
144144 b. any editorial or other reading material in any
145145 periodical or publicatio n or newspaper for the
146146 publication of which no money or valuable
147147 consideration is paid or promised, directly , or
148148 indirectly, by any licensee, and which is not written
149149 by or at the direction of the licensee ;
150150 3. "Commission" means the Oklahoma Alcoholic Bev erage Laws
151151 Enforcement (ABLE) Commission ;
152152 4. "Distributor" means a person who has a permit that:
153153 a. distributes, sells, barters, or exchanges e -liquid or
154154 vapor products in this state for the purpose of
155155 resale, or
156156 b. purchases e-liquid or vapor products di rectly from a
157157 manufacturer or distributor for the purpose of resale
158158 in this state;
159159 5. "E-liquid" means a solution that:
160160 a. contains propylene glycol, vegetable glycerin,
161161 nicotine, nicotine salts and flavorings , and
162162 b. is intended to be used in a vapor pro duct; and
163163 E-liquid does not include cannabis, THC, CBD, or hemp as defined
164164 under the laws of this state ;

191191 6. "Health-related statement" means any statement related to
192192 health and includes statements of a curative or therapeutic nature
193193 that, expressly or by implication, suggest a relationship between
194194 the consumption of e -liquids or vapor products and health benefits,
195195 or effects on health ;
196196 7. "Manufacturer" means a person located inside of this state,
197197 including any repacker or relabeler, that is engaged in
198198 manufacturing e-liquids or vapor products ;
199199 8. "Manufacturing" means the process by which an e -liquid or
200200 vapor product is fabricated, assembled, packaged or labeled, and is
201201 sealed in final packaging intended for consumer use ;
202202 9. "Market" or "marketing" means any act or process of
203203 promoting or selling of vapor products, including, but not limited
204204 to, sponsorship of sporting events, point -of-sale advertising, and
205205 promotion of products specifically designed to appeal to certain
206206 demographics;
207207 10 "Minor" means an individual who is less than twenty -one (21)
208208 years of age;
209209 11. "Packaging" means any receptacle that contains a finished
210210 e-liquid or a vapor product ;
211211 12. "Retailer" means a person, other than a manufacturer or
212212 distributor, who in the ordinary course of the person's regular
213213 trade or business:

240240 a. acquires any form of e -liquid or vapor products for
241241 the purpose of resale to an end consumer , and
242242 b. sells an e-liquid or a vapor product to another person
243243 for money or other consideration ;
244244 13. "Sale" or "Sell" means to exchange or otherwise furnish any
245245 e-liquid or vapor product to any individual of legal age for
246246 monetary value;
247247 14. "Social Media or Social Media Platform " means an online
248248 forum or application that satisfies each of the following criteria:
249249 a. allows users to upload content or view the content or
250250 activity of other users ,
251251 b. employs algorithms that analyze user data or
252252 information on users to select content for users , and
253253 c. has any of the following features:
254254 (1) infinite scrolling,
255255 (2) push notifications or alerts sent by the online
256256 forum, website, or application to inform the user
257257 about specific activities or events related to
258258 the user's account,
259259 (3) displays personal interactive metrics that
260260 indicate the number of times other uses have
261261 clicked a button to indicate their reaction to
262262 content or have share or reposted the conten t,

289289 (4) auto-play video or video that begins to play
290290 without the user first clicking on the video or
291291 play button for that video , or
292292 (5) live-streaming function that allows a user or
293293 advertiser to broadcast live video content in
294294 real-time;
295295 15. "Tamper evident package " means a package having at least
296296 one (1) indicator or barrier to entry that, if breached or missing,
297297 can reasonably be expected to provide visible evidence to consumer s
298298 that tampering has occurred ; and
299299 16. "Vapor Product" means an electronic de vice that converts e -
300300 liquid to a vapor intended for inhalation that may or may not
301301 contain e-liquid.
302302 SECTION 3. NEW LAW A new section of law to be codifie d
303303 in the Oklahoma Statutes as Section 1-229.52 of Title 63, unless
304304 there is created a duplication in numbering, reads as follows:
305305 A. Manufacturers, distributors, and retailers shall comply with
306306 the following requirements:
307307 1. An e-liquid bottle must use a child proof cap that has the
308308 child resistant effectiveness set forth in the f ederal poison
309309 prevention packaging standards, 16 CFR 1700.15(b)(1) ;
310310 2. An e-liquid bottle or a vapor product that contains e -liquid
311311 must use a tamper evident package. The tamper evident package
312312 feature must be designed to remain intact when handled in a

339339 reasonable manner during the manufacture, distribution, and retail
340340 display of the e-liquid bottle;
341341 3. The label on an e-liquid bottle must meet the nicotine
342342 addictiveness warnin g statement requirements set forth in 21 CFR
343343 1143.3; and
344344 4. The package containing the e-liquid bottle or vapor product
345345 must contain the name of the manufacturer or distributor along with
346346 the address of the manufacturer or distributor firmly affixed to or
347347 printed on the package for tracking purposes. A scannable bar code
348348 or QR code located on the package may meet this requirement .
349349 B. A manufacturer, distributor, or retailer of e -liquids or
350350 vapor products shall not sell or offer for sale any e -liquid or
351351 vapor product that:
352352 1. Uses, in the labeling of the product, or its packaging, or
353353 in its marketing materials :
354354 a. the terms "candy", "candies", or variants in spelling
355355 such as "kandy" or "kandeez", (with the exception of
356356 use in the name of a licensee, inclu ding the
357357 licensee's doing business as name),
358358 b. the terms "bubble gum", "cotton candy", "gummy bear",
359359 "gummy worm", "lollipop", or other variants of these
360360 words (with the exception of use in the name of a
361361 licensee, including the licensee 's doing business as
362362 name), and

389389 c. any other terms or phrases which the Commission has,
390390 by regulation, determined has a disproportionate
391391 appeal to minors, provided that such regulation shall
392392 not apply to terms relating to the name of a type of
393393 fruit, such as the term "apple"; the term "mint" or
394394 terms that relate to a type of mint, such as the term
395395 "spearmint"; the terms "menthol" or "ice"; or a term
396396 containing the word "tobacco," such as the term "sweet
397397 tobacco."
398398 2. Uses, in the labeling or design of the product, or its
399399 packaging, or in its marketing materials, images of or references to
400400 cartoons, cartoon characters, superheroes, television shows, video
401401 games, and movies, or other similar characters or references, that
402402 have been primarily used to market products to minors;
403403 3. Uses, in the labeling or design of the product, or its
404404 packaging, or in its marketing materials, trade dress, trademarks,
405405 or other related imagery that imitate or replicate trade dress,
406406 trademarks, or other imagery of food brands or products that have
407407 been primarily marketed to minors such as brands of breakfast
408408 cereals, cookies, juice drinks, soft drinks, ice creams, and frozen
409409 pops; and
410410 4. Uses, in the labeling or design of the product, or its
411411 packaging, or in its marketing materials, trade dress, trad emarks,

438438 or other related imagery that imitate or replicate trade dress,
439439 trademarks, or other imagery of school supplies.
440440 C. A manufacturer, distributor or retailer of e -liquids or
441441 vapor products shall not advertise or market any vapor product
442442 except in the following manner:
443443 1. Advertisements may not be materially false or untrue a nd any
444444 statement contained therein must be consistent with the e -liquid's
445445 or vapor product's labeling;
446446 2. Advertisements may not contain any health or therapeutic
447447 claims;
448448 3. Advertisements on billboard signs must not be within one
449449 thousand (1,000) feet of a primary or secondary school, playground,
450450 or youth center; and
451451 4. Advertisements for e -liquids or vapor products shall be
452452 prohibited on social media as defined in this act unless the
453453 recipient of the content has been age verified by a verified age
454454 gating process.
455455 SECTION 4. NEW LAW A new section of law to be codified
456456 in the Oklahoma Statutes as Section 1-229.53 of Title 63, unless
457457 there is created a dup lication in numbering, reads as follows:
458458 A. The Commission may assess a civil penalty against a
459459 manufacturer, distributor, or retailer for a violation of this act
460460 in an amount that does not exceed Five Thousand Dollars ($5,000.00).

487487 A civil penalty may be assessed in addition to other penalties
488488 allowed under this act.
489489 B. The Attorney General is authorized to investigate and
490490 enforce violations of subsection B in section 3 of this act. Upon
491491 determining that a manufacturer, distributor, or retailer has
492492 violated any provision of subsection B in section 3 of this act, the
493493 Attorney General shall bring a civil action in any court of
494494 competent jurisdiction to :
495495 1. Seek injunctive relief restraining or enjoining any
496496 manufacturer, distributor, or retailer from cont inuing to engage in
497497 activities that violate subsection B in section 3 of this act;
498498 2. Recover civil penalties of up to Ten Thousand Dollars
499499 ($10,000.00) per violation; or
500500 3. Obtain appropriate relief to protect the public interest.
501501 C. Civil penalties collected under this act must be deposited
502502 in the Vapor Products Compliance Fund.
503503 SECTION 5. NEW LAW A new section of law to be codified
504504 in the Oklahoma Statutes as Section 1 -229.54 of Title 63, unless
505505 there is created a duplication i n numbering, reads as follows:
506506 A. The Vapor Products Compliance Fund is hereb y created as a
507507 special fund under state law.
508508 B. The Vapor Products Compliance Fund shall be utilized by the
509509 Commission for enforcement of this act.

536536 SECTION 6. REPEALER 63 O.S. 2021, Section 1 -229.35, is

538538 SECTION 7. This act shall become effective November 1, 2025.
