101 | 101 | | SECTION 2. NEW LAW A new section of law to be codified |

102 | 102 | | in the Oklahoma Statutes as Section 1-229.51 of Title 63, unless |

105 | 105 | | 1. "Advertise" means the publication or dissemination of an |
---|
106 | 106 | | advertisement; |
---|
107 | 107 | | 2. "Advertisement" includes any written or verbal statement, |
---|
108 | 108 | | illustration, or depiction which is calculated to induce sales of |
---|
109 | 109 | | vapor products, including any written, p rinted, graphic, or other |
---|
110 | 110 | | material, billboard, sign, or other outdoor display, public transit |
---|
111 | 111 | | card, other periodical literature, publication, or in a radio or |
---|
112 | 112 | | television broadcast, or in any other media; except that such term |
---|
113 | 113 | | shall not include: |

114 | 114 | | a. any label affixed to any e-liquid or vapor product, or |
---|
115 | 115 | | any individual covering, carton, or other wrapper of |

150 | 150 | | 3. "Commission" means the Oklahoma Alcoholic Bev erage Laws |
---|
151 | 151 | | Enforcement (ABLE) Commission ; |
---|
152 | 152 | | 4. "Distributor" means a person who has a permit that: |
---|
153 | 153 | | a. distributes, sells, barters, or exchanges e -liquid or |
---|
154 | 154 | | vapor products in this state for the purpose of |
---|
155 | 155 | | resale, or |
---|
156 | 156 | | b. purchases e-liquid or vapor products di rectly from a |
---|
157 | 157 | | manufacturer or distributor for the purpose of resale |
---|
158 | 158 | | in this state; |
---|
159 | 159 | | 5. "E-liquid" means a solution that: |
---|
160 | 160 | | a. contains propylene glycol, vegetable glycerin, |
---|
161 | 161 | | nicotine, nicotine salts and flavorings , and |
---|
162 | 162 | | b. is intended to be used in a vapor pro duct; and |
---|
163 | 163 | | E-liquid does not include cannabis, THC, CBD, or hemp as defined |
---|
164 | 164 | | under the laws of this state ; |

197 | 197 | | including any repacker or relabeler, that is engaged in |
---|
198 | 198 | | manufacturing e-liquids or vapor products ; |
---|
199 | 199 | | 8. "Manufacturing" means the process by which an e -liquid or |
---|
200 | 200 | | vapor product is fabricated, assembled, packaged or labeled, and is |
---|
201 | 201 | | sealed in final packaging intended for consumer use ; |
---|
202 | 202 | | 9. "Market" or "marketing" means any act or process of |
---|
203 | 203 | | promoting or selling of vapor products, including, but not limited |
---|
204 | 204 | | to, sponsorship of sporting events, point -of-sale advertising, and |
---|
205 | 205 | | promotion of products specifically designed to appeal to certain |
---|
206 | 206 | | demographics; |
---|
207 | 207 | | 10 "Minor" means an individual who is less than twenty -one (21) |
---|
208 | 208 | | years of age; |
---|
209 | 209 | | 11. "Packaging" means any receptacle that contains a finished |
---|
210 | 210 | | e-liquid or a vapor product ; |
---|
211 | 211 | | 12. "Retailer" means a person, other than a manufacturer or |
---|
212 | 212 | | distributor, who in the ordinary course of the person's regular |
---|

247 | 247 | | 14. "Social Media or Social Media Platform " means an online |
---|
248 | 248 | | forum or application that satisfies each of the following criteria: |
---|
249 | 249 | | a. allows users to upload content or view the content or |
---|
250 | 250 | | activity of other users , |
---|
251 | 251 | | b. employs algorithms that analyze user data or |
---|
252 | 252 | | information on users to select content for users , and |
---|
253 | 253 | | c. has any of the following features: |
---|
254 | 254 | | (1) infinite scrolling, |
---|
255 | 255 | | (2) push notifications or alerts sent by the online |
---|
256 | 256 | | forum, website, or application to inform the user |
---|
257 | 257 | | about specific activities or events related to |
---|
258 | 258 | | the user's account, |
---|
259 | 259 | | (3) displays personal interactive metrics that |
---|
260 | 260 | | indicate the number of times other uses have |
---|
261 | 261 | | clicked a button to indicate their reaction to |
---|
262 | 262 | | content or have share or reposted the conten t, |
---|

299 | 299 | | 16. "Vapor Product" means an electronic de vice that converts e - |
---|
300 | 300 | | liquid to a vapor intended for inhalation that may or may not |
---|
301 | 301 | | contain e-liquid. |

302 | 302 | | SECTION 3. NEW LAW A new section of law to be codifie d |

303 | 303 | | in the Oklahoma Statutes as Section 1-229.52 of Title 63, unless |

305 | 305 | | A. Manufacturers, distributors, and retailers shall comply with |
---|
306 | 306 | | the following requirements: |
---|
307 | 307 | | 1. An e-liquid bottle must use a child proof cap that has the |
---|
308 | 308 | | child resistant effectiveness set forth in the f ederal poison |
---|
309 | 309 | | prevention packaging standards, 16 CFR 1700.15(b)(1) ; |
---|
310 | 310 | | 2. An e-liquid bottle or a vapor product that contains e -liquid |
---|
311 | 311 | | must use a tamper evident package. The tamper evident package |
---|
312 | 312 | | feature must be designed to remain intact when handled in a |
---|

345 | 345 | | must contain the name of the manufacturer or distributor along with |

346 | 346 | | the address of the manufacturer or distributor firmly affixed to or |
---|
347 | 347 | | printed on the package for tracking purposes. A scannable bar code |
---|
348 | 348 | | or QR code located on the package may meet this requirement . |
---|
349 | 349 | | B. A manufacturer, distributor, or retailer of e -liquids or |
---|
350 | 350 | | vapor products shall not sell or offer for sale any e -liquid or |
---|
351 | 351 | | vapor product that: |
---|
352 | 352 | | 1. Uses, in the labeling of the product, or its packaging, or |
---|
353 | 353 | | in its marketing materials : |
---|
354 | 354 | | a. the terms "candy", "candies", or variants in spelling |
---|
355 | 355 | | such as "kandy" or "kandeez", (with the exception of |
---|
356 | 356 | | use in the name of a licensee, inclu ding the |
---|
357 | 357 | | licensee's doing business as name), |
---|
358 | 358 | | b. the terms "bubble gum", "cotton candy", "gummy bear", |
---|
359 | 359 | | "gummy worm", "lollipop", or other variants of these |
---|
360 | 360 | | words (with the exception of use in the name of a |
---|
361 | 361 | | licensee, including the licensee 's doing business as |
---|
362 | 362 | | name), and |

398 | 398 | | 2. Uses, in the labeling or design of the product, or its |

399 | 399 | | packaging, or in its marketing materials, images of or references to |
---|
400 | 400 | | cartoons, cartoon characters, superheroes, television shows, video |
---|
401 | 401 | | games, and movies, or other similar characters or references, that |
---|
402 | 402 | | have been primarily used to market products to minors; |
---|
403 | 403 | | 3. Uses, in the labeling or design of the product, or its |
---|
404 | 404 | | packaging, or in its marketing materials, trade dress, trademarks, |
---|
405 | 405 | | or other related imagery that imitate or replicate trade dress, |
---|
406 | 406 | | trademarks, or other imagery of food brands or products that have |
---|
407 | 407 | | been primarily marketed to minors such as brands of breakfast |
---|
408 | 408 | | cereals, cookies, juice drinks, soft drinks, ice creams, and frozen |
---|
409 | 409 | | pops; and |
---|
410 | 410 | | 4. Uses, in the labeling or design of the product, or its |
---|

442 | 442 | | except in the following manner: |

443 | 443 | | 1. Advertisements may not be materially false or untrue a nd any |
---|
444 | 444 | | statement contained therein must be consistent with the e -liquid's |
---|
445 | 445 | | or vapor product's labeling; |
---|
446 | 446 | | 2. Advertisements may not contain any health or therapeutic |
---|
447 | 447 | | claims; |
---|
448 | 448 | | 3. Advertisements on billboard signs must not be within one |
---|
449 | 449 | | thousand (1,000) feet of a primary or secondary school, playground, |
---|
450 | 450 | | or youth center; and |
---|
451 | 451 | | 4. Advertisements for e -liquids or vapor products shall be |
---|
452 | 452 | | prohibited on social media as defined in this act unless the |
---|
453 | 453 | | recipient of the content has been age verified by a verified age |
---|
454 | 454 | | gating process. |

455 | 455 | | SECTION 4. NEW LAW A new section of law to be codified |
---|
456 | 456 | | in the Oklahoma Statutes as Section 1-229.53 of Title 63, unless |
---|
457 | 457 | | there is created a dup lication in numbering, reads as follows: |

458 | 458 | | A. The Commission may assess a civil penalty against a |
---|
459 | 459 | | manufacturer, distributor, or retailer for a violation of this act |
---|
