5950 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6051 SECTION 1. NEW LAW A new section of law to be codified
6152 in the Oklahoma Statut es as Section 5-128.3 of Title 70, unless
6253 there is created a duplication in numbering, reads as follows:
6354 A. Beginning with the 202 5-2026 school year, the board of
6455 education of each school district in the state shall spend no less
56+than fifty percent (50%) of its annual budget on instructional
57+expenditures.
58+B. If a school district spends less than fifty percent (50%) of
59+its annual budget on instructional expenditures, it shall increase
60+its instructional expenditures by no less than two percent (2%) each

92-than fifty percent (50%) of its annual budget on instructional
93-expenditures.
94-B. If a school district spends less than fifty percent (50%) of
95-its annual budget on instructional expenditures, it shall increase
96-its instructional expenditures by no less than two percent (2%) each
9787 year until the amount spent on instructional expenditures reaches
9888 fifty percent (50%) of its annual budget.
9989 C. If a school district spends less than fifty percent (50%) of
10090 its annual budget on instructional expenditures and does not
10191 increase its spending as provided in subsection B of this section,
10292 the school district shall receive a written warning notice from the
10393 State Department of Education. The notice shall also be posted on
10494 the website of the school district.
10595 D. If a school district spends less than fifty percent (50%) of
10696 its annual budget on instructional expenditures and does not
10797 increase its spending as provided in subsection B of this section
10898 for four (4) consecutive years after receiving the notice provided
10999 in subsection C of this section, the sch ool district shall increase
110100 compensation for all teachers in the school district by two percent
111101 (2%) for each year in that period in which the school district did
112102 not increase instructional expenditures by a minimum of two percent
113103 (2%). The pay increase r equired pursuant to this subsection shall
114104 be permanent.
115105 E. As used in this section:
106+1. "Annual budget" means a plan of financial operations using
107+revenues contributed from local, state, and federal sources but
108+shall not include revenue received from bond sales, the sale of
109+property or equipment, school fundraisers, or nonprofit organization

143-1. "Annual budget" means a plan of financial o perations using
144-revenues contributed from local, state, and federal sources but
145-shall not include revenue received from bond sales, the sale of
146-property or equipment, school fundraisers, or nonprofit organization
147-contributions or grants; and
148137 2. "Instructional expenditures " means instruction expenditures
149138 as defined by the National Center for Education Statistics, a
150139 federal entity within the United States Department of Education.
151140 SECTION 2. This act shall become effective July 1, 202 5.
152141 SECTION 3. It being immediately necessary for the preservation
153142 of the public peace, health or safety, an emergen cy is hereby
154143 declared to exist, by reason whereof this act shall take effect and
155144 be in full force from and after its passage and approval.
