57	57	BE IT ENACTED BY THE PEOPLE OF THE STATE OF O KLAHOMA:
58	58	SECTION 1. NEW LAW A new section of law to be codified
59	59	in the Oklahoma Statutes as Section 26 -201 of Title 70, unless there
60	60	is created a duplication in numbering, reads as follows:
61	61	A. There is hereby created the Educators ' Professional
62	62	Liability Insurance Program for all employees, including full -time
63	63	and part-time personnel of public schools, as defined in Section 1 -
64	64	106 of Title 70 of the Oklahoma Statutes, and charter schools, as
65	65	defined in subsection D of Section 3 -132 of Title 70 of the Oklahoma
66	66	Statutes.

94	94	B. The program shall provide liability coverage for employees
95	95	up to Two Million Dollars ($2,000,000.00) in coverage per
96	96	occurrence.
97	97	C. The program shall be administered by the Office of
98	98	Management and Enterprise Servi ces (OMES). OMES shall promulgate
99	99	rules to implement the Educators ' Professional Liability Insurance
100	100	Program.
101	101	D. OMES shall be authorized to contract liability insurance
102	102	from a licensed insurer, to create a self -insured risk pool, or to
103	103	use a combination of both.
104	104	E. The insurance carrier providing any portion of liability
105	105	coverage required by this section shall be selected by a competitive
106	106	process.
107	107	F. The Legislature shall provide an annual appropriation to
108	108	cover the costs and any associated premiums fo r the program.
109	109	G. Each school district shall annually notify, in writing,
110	110	eligible employees about the coverage provided by the Educators '
111	111	Professional Liability Insurance Program.
112	112	H. OMES and the State Department of Education shall notify, in
113	113	writing, all eligible employees about the Educators ' Professional
114	114	Liability Insurance Program. The notice shall specifically inform
115	115	employees that coverage is provided automatically as part of their
116	116	employment. The notice shall be given upon hiring and annually
117	117	thereafter.

145	145	I. Nothing in this section shall be construed to exempt a
146	146	school district from any current obligations or duties nor amend or
147	147	alter the Governmental Tort Claims Act in Sections 151 through 172
148	148	of Title 51 of the Oklahoma Statutes.
149	149	SECTION 2. This act shall become effective November 1, 2025.
