50	50	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	51	SECTION 1. AMENDATORY 21 O.S. 2021, Section 701.9, is
52	52	amended to read as follows:
53	53	Section 701.9. A. 1. A person who is convicted of or plea ds
54	54	guilty or nolo contendere to murder in the first degree shall be
55	55	punished by death, by imprisonment for life without parole or by
56	56	imprisonment for life. A person who is convi cted of or pleads
57	57	guilty or nolo contendere to murder in the first degree, as
58	58	described in subsection E of Section 701.7 of this title, shall be
59	59	punished by death or by life without parole and absent an
60	60	overwhelming amount of mitigating evidence shall not be entitled to
61	61	or afforded the benefit of receiving imprisonment for life or
62	62	deferment of the sentence.

89	89	2. A foreign-born person who, at the time of committing murder
90	90	in the first degree, was present in the United States without valid
91	91	immigration document ation or violated the terms of his or her
92	92	admission to the United States, is convicted of or pleads guilty or
93	93	nolo contendere to murder in the first degree shall be punished by
94	94	death.
95	95	B. A person who is convicted of or pleads guilty or nolo
96	96	contendere to murder in the second degree shall be guilty of a
97	97	felony punishable by imprison ment in the custody of the Department
98	98	of Corrections for not less than ten (10) years nor more than life.
99	99	SECTION 2. This act shall become effective November 1, 2025.
