4040 An Act relating to crimes and punishments; amending

5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. AMENDATORY 21 O.S. 2021, Section 701.9, is
5252 amended to read as follows:
5353 Section 701.9. A. 1. A person who is convicted of or plea ds
5454 guilty or nolo contendere to murder in the first degree shall be
5555 punished by death, by imprisonment for life without parole or by
5656 imprisonment for life. A person who is convi cted of or pleads
5757 guilty or nolo contendere to murder in the first degree, as
5858 described in subsection E of Section 701.7 of this title, shall be
5959 punished by death or by life without parole and absent an
6060 overwhelming amount of mitigating evidence shall not be entitled to
6161 or afforded the benefit of receiving imprisonment for life or
6262 deferment of the sentence.

8989 2. A foreign-born person who, at the time of committing murder
9090 in the first degree, was present in the United States without valid
9191 immigration document ation or violated the terms of his or her
9292 admission to the United States, is convicted of or pleads guilty or
9393 nolo contendere to murder in the first degree shall be punished by
9494 death.
9595 B. A person who is convicted of or pleads guilty or nolo
9696 contendere to murder in the second degree shall be guilty of a
9797 felony punishable by imprison ment in the custody of the Department
9898 of Corrections for not less than ten (10) years nor more than life.
9999 SECTION 2. This act shall become effective November 1, 2025.
