4040 An Act relating to cockfighting; amending 21 O.S.
4141 2021, Sections 1692.1, 1692.2, 1692.3, 1692.4 and
4242 1692.8, which relate to cockfighti ng definitions,
4343 offenses and penalties; modifying scope of certain
4444 definition; deleting definition; reducing penalties
4545 for certain cockfighting offenses; updating statutory
4646 citations; providing additional penalties; and
4747 providing an effective date.

5252 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5353 SECTION 1. AMENDATORY 21 O.S. 2021, Section 1692.1, is
5454 amended to read as follows:
5555 Section 1692.1. As used in this act:
5656 A. "Cockfight" or "cockfighting" is a fight between birds,
5757 whether or not fitted with artificial spurs, knives, or gaffs, and
5858 whether or not bets or wagers are made on the outcome of the fight ,
5959 and includes any training fight in which birds are intended or
6060 encouraged to attack or fight with one another .
6161 B. "Equipment used for training or handling a fighting bird "

9090 contraband and subject to seizure.
9191 SECTION 2. AMENDATORY 21 O.S. 2021, Section 1692.2, is
9292 amended to read as follows:
9393 Section 1692.2. Every person who willfully instigates or
9494 encourages any cockfight, upon conviction, shall be guilty of a
9595 felony misdemeanor. The penalty for a violatio n of this section
9696 shall be as provided in Section 8 1692.8 of this act title.
9797 SECTION 3. AMENDATORY 21 O.S. 2021, Section 1692.3, is
9898 amended to read as follows:
9999 Section 1692.3. Every person who keeps any pit or other place,
100100 or knowingly provides any equipment or facilities to be used in
101101 permitting any cockfight, upon conviction, shall be guilty of a
102102 felony misdemeanor. The penalty for a violation of this section
103103 shall be as provided in Section 8 1692.8 of this act title.
104104 SECTION 4. AMENDATORY 21 O.S. 2021, Section 1692.4, is
105105 amended to read as follows:
106106 Section 1692.4. Every person who does any act or performs any
107107 service in the furtherance of or to facilitate any cockfight, upon
108108 conviction, shall be guil ty of a felony misdemeanor. Such
109109 activities and services specifically prohibited by this section
110110 include, but and are not limited to: promoting or the refereeing of
111111 birds at a cockfight , advertising a cockfight, or serving as a
112112 stakes holder of any money wagered on any cockfight . The penalty

139139 for a violation of this section shall be as provided in Section 8
140140 1692.8 of this act title.
141141 SECTION 5. AMENDATORY 21 O.S. 2021, Section 1692.8, is
142142 amended to read as follows:
143143 Section 1692.8. A. Every person who , upon conviction, is
144144 guilty of a felony under any of the provisions of Sections 2, 3, 4,
145145 or 5 Section 1692.5 of this act title shall be punished by
146146 imprisonment in the state penitentiary custody of the Department of
147147 Corrections for not less than one (1) year nor more than ten (10)
148148 years, or shall be fined not less than Two Thousand Dollars
149149 ($2,000.00) nor more than and not exceeding Twenty-five Thousand
150150 Dollars ($25,000.00), or by both such fine and imprisonment.
151151 B. Every person who upon conviction is guilty of any of the
152152 provisions of Section 6 Sections 1692.2, 1692.3 or 1692.4 of this
153153 act title shall be punished by imprisonment in the county jail for
154154 not more than one (1) year, or shall be fined a fine not more than
155155 exceeding Five Hundred Dollars ($500.00) , or by both such fine and
156156 imprisonment. For a second conviction, the person shall be punished
157157 by a fine not exceeding One Thousand Dollars ($1,000.00). For a
158158 third or subsequent conviction, the person shall be punished by a
159159 fine not exceeding Two Thousand Dollars ($2,000.00).
160160 SECTION 6. This act shall become effective November 1, 2025.
