40	40	An Act relating to cockfighting; amending 21 O.S.
41	41	2021, Sections 1692.1, 1692.2, 1692.3, 1692.4 and
42	42	1692.8, which relate to cockfighti ng definitions,
43	43	offenses and penalties; modifying scope of certain
44	44	definition; deleting definition; reducing penalties
45	45	for certain cockfighting offenses; updating statutory
46	46	citations; providing additional penalties; and
47	47	providing an effective date.

52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. AMENDATORY 21 O.S. 2021, Section 1692.1, is
54	54	amended to read as follows:
55	55	Section 1692.1. As used in this act:
56	56	A. "Cockfight" or "cockfighting" is a fight between birds,
57	57	whether or not fitted with artificial spurs, knives, or gaffs, and
58	58	whether or not bets or wagers are made on the outcome of the fight ,
59	59	and includes any training fight in which birds are intended or
60	60	encouraged to attack or fight with one another .
61	61	B. "Equipment used for training or handling a fighting bird "
62	62	includes knives or gaffs, cages, pens, feeding apparatuses, training

90	90	contraband and subject to seizure.
91	91	SECTION 2. AMENDATORY 21 O.S. 2021, Section 1692.2, is
92	92	amended to read as follows:
93	93	Section 1692.2. Every person who willfully instigates or
94	94	encourages any cockfight, upon conviction, shall be guilty of a
95	95	felony misdemeanor. The penalty for a violatio n of this section
96	96	shall be as provided in Section 8 1692.8 of this act title.
97	97	SECTION 3. AMENDATORY 21 O.S. 2021, Section 1692.3, is
98	98	amended to read as follows:
99	99	Section 1692.3. Every person who keeps any pit or other place,
100	100	or knowingly provides any equipment or facilities to be used in
101	101	permitting any cockfight, upon conviction, shall be guilty of a
102	102	felony misdemeanor. The penalty for a violation of this section
103	103	shall be as provided in Section 8 1692.8 of this act title.
104	104	SECTION 4. AMENDATORY 21 O.S. 2021, Section 1692.4, is
105	105	amended to read as follows:
106	106	Section 1692.4. Every person who does any act or performs any
107	107	service in the furtherance of or to facilitate any cockfight, upon
108	108	conviction, shall be guil ty of a felony misdemeanor. Such
109	109	activities and services specifically prohibited by this section
110	110	include, but and are not limited to: promoting or the refereeing of
111	111	birds at a cockfight , advertising a cockfight, or serving as a
112	112	stakes holder of any money wagered on any cockfight . The penalty

139	139	for a violation of this section shall be as provided in Section 8
140	140	1692.8 of this act title.
141	141	SECTION 5. AMENDATORY 21 O.S. 2021, Section 1692.8, is
142	142	amended to read as follows:
143	143	Section 1692.8. A. Every person who , upon conviction, is
144	144	guilty of a felony under any of the provisions of Sections 2, 3, 4,
145	145	or 5 Section 1692.5 of this act title shall be punished by
146	146	imprisonment in the state penitentiary custody of the Department of
147	147	Corrections for not less than one (1) year nor more than ten (10)
148	148	years, or shall be fined not less than Two Thousand Dollars
149	149	($2,000.00) nor more than and not exceeding Twenty-five Thousand
150	150	Dollars ($25,000.00), or by both such fine and imprisonment.
151	151	B. Every person who upon conviction is guilty of any of the
152	152	provisions of Section 6 Sections 1692.2, 1692.3 or 1692.4 of this
153	153	act title shall be punished by imprisonment in the county jail for
154	154	not more than one (1) year, or shall be fined a fine not more than
155	155	exceeding Five Hundred Dollars ($500.00) , or by both such fine and
156	156	imprisonment. For a second conviction, the person shall be punished
157	157	by a fine not exceeding One Thousand Dollars ($1,000.00). For a
158	158	third or subsequent conviction, the person shall be punished by a
159	159	fine not exceeding Two Thousand Dollars ($2,000.00).
160	160	SECTION 6. This act shall become effective November 1, 2025.
