5454 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5555 SECTION 1. NEW LAW A new section of law not to be
5656 codified in the Oklahoma Statutes reads as follows:
5757 This act shall be known and may be cited as the "Child
5858 Trafficking Protection Act of 2025 ".
5959 SECTION 2. AMENDATORY 21 O.S. 2021, Section 748, as
6060 amended by Section 1, Chapter 20, O.S.L. 2022 (21 O.S. Supp. 2024,
6161 Section 748), is amended to read as follows:

9090 1. "Coercion" means compelling, forcing or intimidating a
9191 person to act by:
9292 a. threats of harm or physical restraint against any
9393 person,
9494 b. any act, scheme, plan, or pattern intended to cause a
9595 person to believe that performing, or failing to
9696 perform, an act would result in serious physical,
9797 financial, or emotional harm or distress to or
9898 physical restraint against any person,
9999 c. the abuse or threatened abuse of the law or legal
100100 process,
101101 d. knowingly destroying, concealing, removing,
102102 confiscating or possessing any actual or purported
103103 passport, labor or immigration document, or ot her
104104 government identification document, including but not
105105 limited to a driver license or birth certificate, of
106106 another person,
107107 e. facilitating or controlling a person 's access to any
108108 addictive or controlled substance other than for legal
109109 medical purposes,
110110 f. blackmail,
111111 g. demanding or claiming money, goods, or any other thing
112112 of value from or on behalf of a prostituted person

139139 where such demand or claim arises from or is directly
140140 related to the act of prostitution,
141141 h. determining, dictating or setting the ti mes at which
142142 another person will be available to engage in an act
143143 of prostitution with a third party,
144144 i. determining, dictating or setting the places at which
145145 another person will be available for solicitation of,
146146 or to engage in, an act of prostitution with a third
147147 party, or
148148 j. determining, dictating or setting the places at which
149149 another person will reside for purposes of making such
150150 person available to engage in an act of prosti tution
151151 with a third party;
152152 2. "Commercial sex" means any form of commercial s exual
153153 activity such as sexually explicit performances, prostitution,
154154 participation in the production of pornography, performance in a
155155 strip club, or exotic dancing or display;
156156 3. "Debt bondage" means the status or condition of a debtor
157157 arising from a pledge by the debtor of his or her personal services
158158 or of those of a person under his or her control as a security for
159159 debt if the value of those services as reasonably assessed is not
160160 applied toward the liquidation of the debt or the length and nature
161161 of those services are not respectively limited and defined;

188188 4. "Human trafficking" means modern-day slavery that includes,
189189 but is not limited to, extreme exploitation and the denial o f
190190 freedom or liberty of an individual for purposes of deriving benefit
191191 from that individual 's commercial sex act or labor;
192192 5. "Human trafficking for labor " means:
193193 a. recruiting, enticing, harboring, maintaining,
194194 transporting, providing or obtaining, by an y means,
195195 another person through deception, force, fraud, threat
196196 or coercion or for purposes of engaging the person in
197197 labor, or
198198 b. benefiting, financially or by receiving anything of
199199 value, from participation in a venture that has
200200 engaged in an act of traf ficking for labor;
201201 6. "Human trafficking for commercial sex " means:
202202 a. recruiting, enticing, harboring, maintaining,
203203 transporting, providing or obtaining, by any means,
204204 another person through deception, force, fraud, threat
205205 or coercion for purposes of eng aging the person in a
206206 commercial sex act,
207207 b. recruiting, enticing, harboring, maintaining,
208208 transporting, providing, purchasing or obtaining, by
209209 any means, a minor for purposes of engaging the minor
210210 in a commercial sex act, or

237237 c. benefiting, financially or by receiving anything of
238238 value, from participating in a venture that has
239239 engaged in an act of trafficking for commercial sex;
240240 7. "Legal process" means the criminal law, the civil law, or
241241 the regulatory system of the federal government, any state,
242242 territory, district, commonwealth, or trust territory therein, and
243243 any foreign government or subdivision thereof and includes legal
244244 civil actions, criminal actions, and regulatory petitions or
245245 applications;
246246 8. "Minor" means an individual under eighteen (18) years of
247247 age; and
248248 9. "Victim" means a person against whom a violation of any
249249 provision of this section has been committed.
250250 B. It shall be unlawful to knowingly engage in human
251251 trafficking.
252252 C. 1. Any person violating the provisions of this section
253253 shall, upon conviction, be guilty of a felony punishable by
254254 imprisonment in the custody of the Department of Corrections for a
255255 term of not less than five (5) years or for life, or by a fine of
256256 not more than One Hundred Thousand Dollars ($100,000.00), or by both
257257 such fine and imprisonment.
258258 2. Any person violating the provisions of this section where
259259 the victim of the offense is under eighteen (18) years of age at the
260260 time of the offense shall, upon conviction, be guilty of a felony

287287 punishable by death, by imprisonment in the custody of the
288288 Department of Corrections for a term of not less than fifteen (15)
289289 years or for life without parole, or for life , or by a fine of not
290290 more than Two Hundred Fifty Thousand Dollars ($250,000.00), or by
291291 both such fine and imprisonment.
292292 3. The court shall also order the defendant to pay restitution
293293 to the victim as provided in Section 991f of Title 22 of the
294294 Oklahoma Statutes.
295295 4. If the person is convicted of human trafficking, the person
296296 shall serve eighty-five percent (85%) of the se ntence before being
297297 eligible for parole consideration or any earned credits.
298298 5. The terms of imprisonment specified in this subsection shall
299299 not be subject to statutory provisions for suspension, deferral or
300300 probation, or state correctional institution ea rned credits accruing
301301 from and after November 1, 1989, except for the achievement earned
302302 credits authorized by subsection H of Section 138 of Title 57 of the
303303 Oklahoma Statutes. To qualify for such achievement earned credits,
304304 such inmates must also be in c ompliance with the standards for Class
305305 level 2 behavior, as defined in subsect ion D of Section 138 of Title
306306 57 of the Oklahoma Statutes.
307307 D. It is an affirmative defense to prosecution for a criminal,
308308 youthful offender, or delinquent offense that, during t he time of
309309 the alleged commission of the offense, the defendant or alleged
310310 youthful offender or delinquent was a victim of human trafficking.

337337 E. The consent of a victim to the activity prohibited by this
338338 section shall not constitute a defense.
339339 F. Lack of knowledge of the age of the victim shall not
340340 constitute a defense to the acti vity prohibited by this section with
341341 respect to human trafficking of a minor.
342342 SECTION 3. This act shall become effective November 1, 2025.
