54	54	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
55	55	SECTION 1. NEW LAW A new section of law not to be
56	56	codified in the Oklahoma Statutes reads as follows:
57	57	This act shall be known and may be cited as the "Child
58	58	Trafficking Protection Act of 2025 ".
59	59	SECTION 2. AMENDATORY 21 O.S. 2021, Section 748, as
60	60	amended by Section 1, Chapter 20, O.S.L. 2022 (21 O.S. Supp. 2024,
61	61	Section 748), is amended to read as follows:
62	62	Section 748. A. As used in Sections 748 and 748.2 of this

90	90	1. "Coercion" means compelling, forcing or intimidating a
91	91	person to act by:
92	92	a. threats of harm or physical restraint against any
93	93	person,
94	94	b. any act, scheme, plan, or pattern intended to cause a
95	95	person to believe that performing, or failing to
96	96	perform, an act would result in serious physical,
97	97	financial, or emotional harm or distress to or
98	98	physical restraint against any person,
99	99	c. the abuse or threatened abuse of the law or legal
100	100	process,
101	101	d. knowingly destroying, concealing, removing,
102	102	confiscating or possessing any actual or purported
103	103	passport, labor or immigration document, or ot her
104	104	government identification document, including but not
105	105	limited to a driver license or birth certificate, of
106	106	another person,
107	107	e. facilitating or controlling a person 's access to any
108	108	addictive or controlled substance other than for legal
109	109	medical purposes,
110	110	f. blackmail,
111	111	g. demanding or claiming money, goods, or any other thing
112	112	of value from or on behalf of a prostituted person

140	140	related to the act of prostitution,
141	141	h. determining, dictating or setting the ti mes at which
142	142	another person will be available to engage in an act
143	143	of prostitution with a third party,
144	144	i. determining, dictating or setting the places at which
145	145	another person will be available for solicitation of,
146	146	or to engage in, an act of prostitution with a third
147	147	party, or
148	148	j. determining, dictating or setting the places at which
149	149	another person will reside for purposes of making such
150	150	person available to engage in an act of prosti tution
151	151	with a third party;
152	152	2. "Commercial sex" means any form of commercial s exual
153	153	activity such as sexually explicit performances, prostitution,
154	154	participation in the production of pornography, performance in a
155	155	strip club, or exotic dancing or display;
156	156	3. "Debt bondage" means the status or condition of a debtor
157	157	arising from a pledge by the debtor of his or her personal services
158	158	or of those of a person under his or her control as a security for
159	159	debt if the value of those services as reasonably assessed is not
160	160	applied toward the liquidation of the debt or the length and nature
161	161	of those services are not respectively limited and defined;

188	188	4. "Human trafficking" means modern-day slavery that includes,
189	189	but is not limited to, extreme exploitation and the denial o f
190	190	freedom or liberty of an individual for purposes of deriving benefit
191	191	from that individual 's commercial sex act or labor;
192	192	5. "Human trafficking for labor " means:
193	193	a. recruiting, enticing, harboring, maintaining,
194	194	transporting, providing or obtaining, by an y means,
195	195	another person through deception, force, fraud, threat
196	196	or coercion or for purposes of engaging the person in
197	197	labor, or
198	198	b. benefiting, financially or by receiving anything of
199	199	value, from participation in a venture that has
200	200	engaged in an act of traf ficking for labor;
201	201	6. "Human trafficking for commercial sex " means:
202	202	a. recruiting, enticing, harboring, maintaining,
203	203	transporting, providing or obtaining, by any means,
204	204	another person through deception, force, fraud, threat
205	205	or coercion for purposes of eng aging the person in a
206	206	commercial sex act,
207	207	b. recruiting, enticing, harboring, maintaining,
208	208	transporting, providing, purchasing or obtaining, by
209	209	any means, a minor for purposes of engaging the minor
210	210	in a commercial sex act, or

237	237	c. benefiting, financially or by receiving anything of
238	238	value, from participating in a venture that has
239	239	engaged in an act of trafficking for commercial sex;
240	240	7. "Legal process" means the criminal law, the civil law, or
241	241	the regulatory system of the federal government, any state,
242	242	territory, district, commonwealth, or trust territory therein, and
243	243	any foreign government or subdivision thereof and includes legal
244	244	civil actions, criminal actions, and regulatory petitions or
245	245	applications;
246	246	8. "Minor" means an individual under eighteen (18) years of
247	247	age; and
248	248	9. "Victim" means a person against whom a violation of any
249	249	provision of this section has been committed.
250	250	B. It shall be unlawful to knowingly engage in human
251	251	trafficking.
252	252	C. 1. Any person violating the provisions of this section
253	253	shall, upon conviction, be guilty of a felony punishable by
254	254	imprisonment in the custody of the Department of Corrections for a
255	255	term of not less than five (5) years or for life, or by a fine of
256	256	not more than One Hundred Thousand Dollars ($100,000.00), or by both
257	257	such fine and imprisonment.
258	258	2. Any person violating the provisions of this section where
259	259	the victim of the offense is under eighteen (18) years of age at the
260	260	time of the offense shall, upon conviction, be guilty of a felony

287	287	punishable by death, by imprisonment in the custody of the
288	288	Department of Corrections for a term of not less than fifteen (15)
289	289	years or for life without parole, or for life , or by a fine of not
290	290	more than Two Hundred Fifty Thousand Dollars ($250,000.00), or by
291	291	both such fine and imprisonment.
292	292	3. The court shall also order the defendant to pay restitution
293	293	to the victim as provided in Section 991f of Title 22 of the
294	294	Oklahoma Statutes.
295	295	4. If the person is convicted of human trafficking, the person
296	296	shall serve eighty-five percent (85%) of the se ntence before being
297	297	eligible for parole consideration or any earned credits.
298	298	5. The terms of imprisonment specified in this subsection shall
299	299	not be subject to statutory provisions for suspension, deferral or
300	300	probation, or state correctional institution ea rned credits accruing
301	301	from and after November 1, 1989, except for the achievement earned
302	302	credits authorized by subsection H of Section 138 of Title 57 of the
303	303	Oklahoma Statutes. To qualify for such achievement earned credits,
304	304	such inmates must also be in c ompliance with the standards for Class
305	305	level 2 behavior, as defined in subsect ion D of Section 138 of Title
306	306	57 of the Oklahoma Statutes.
307	307	D. It is an affirmative defense to prosecution for a criminal,
308	308	youthful offender, or delinquent offense that, during t he time of
309	309	the alleged commission of the offense, the defendant or alleged
310	310	youthful offender or delinquent was a victim of human trafficking.

337	337	E. The consent of a victim to the activity prohibited by this
338	338	section shall not constitute a defense.
339	339	F. Lack of knowledge of the age of the victim shall not
340	340	constitute a defense to the acti vity prohibited by this section with
341	341	respect to human trafficking of a minor.
342	342	SECTION 3. This act shall become effective November 1, 2025.
