152 | 152 | | 2. "Commercial sex" means any form of commercial s exual |
---|
153 | 153 | | activity such as sexually explicit performances, prostitution, |
---|
154 | 154 | | participation in the production of pornography, performance in a |
---|
155 | 155 | | strip club, or exotic dancing or display; |
---|
156 | 156 | | 3. "Debt bondage" means the status or condition of a debtor |
---|
157 | 157 | | arising from a pledge by the debtor of his or her personal services |
---|
158 | 158 | | or of those of a person under his or her control as a security for |
---|
159 | 159 | | debt if the value of those services as reasonably assessed is not |
---|
160 | 160 | | applied toward the liquidation of the debt or the length and nature |
---|
161 | 161 | | of those services are not respectively limited and defined; |

198 | 198 | | b. benefiting, financially or by receiving anything of |
---|
199 | 199 | | value, from participation in a venture that has |
---|
200 | 200 | | engaged in an act of traf ficking for labor; |
---|
201 | 201 | | 6. "Human trafficking for commercial sex " means: |
---|
202 | 202 | | a. recruiting, enticing, harboring, maintaining, |
---|
203 | 203 | | transporting, providing or obtaining, by any means, |
---|
204 | 204 | | another person through deception, force, fraud, threat |
---|
205 | 205 | | or coercion for purposes of eng aging the person in a |
---|
206 | 206 | | commercial sex act, |
---|
207 | 207 | | b. recruiting, enticing, harboring, maintaining, |
---|
208 | 208 | | transporting, providing, purchasing or obtaining, by |
---|
209 | 209 | | any means, a minor for purposes of engaging the minor |

241 | 241 | | the regulatory system of the federal government, any state, |

242 | 242 | | territory, district, commonwealth, or trust territory therein, and |
---|
243 | 243 | | any foreign government or subdivision thereof and includes legal |
---|
244 | 244 | | civil actions, criminal actions, and regulatory petitions or |
---|
245 | 245 | | applications; |
---|
246 | 246 | | 8. "Minor" means an individual under eighteen (18) years of |
---|
247 | 247 | | age; and |
---|
248 | 248 | | 9. "Victim" means a person against whom a violation of any |
---|
249 | 249 | | provision of this section has been committed. |
---|
250 | 250 | | B. It shall be unlawful to knowingly engage in human |
---|
251 | 251 | | trafficking. |
---|
252 | 252 | | C. 1. Any person violating the provisions of this section |
---|
253 | 253 | | shall, upon conviction, be guilty of a felony punishable by |
---|
254 | 254 | | imprisonment in the custody of the Department of Corrections for a |
---|
255 | 255 | | term of not less than five (5) years or for life, or by a fine of |
---|
256 | 256 | | not more than One Hundred Thousand Dollars ($100,000.00), or by both |
---|
257 | 257 | | such fine and imprisonment. |
---|
258 | 258 | | 2. Any person violating the provisions of this section where |
---|
259 | 259 | | the victim of the offense is under eighteen (18) years of age at the |
---|
260 | 260 | | time of the offense shall, upon conviction, be guilty of a felony |
---|

293 | 293 | | to the victim as provided in Section 991f of Title 22 of the |

294 | 294 | | Oklahoma Statutes. |

295 | 295 | | 4. If the person is convicted of human trafficking, the person |
---|
296 | 296 | | shall serve eighty-five percent (85%) of the se ntence before being |
---|
297 | 297 | | eligible for parole consideration or any earned credits. |
---|
298 | 298 | | 5. The terms of imprisonment specified in this subsection shall |
---|
299 | 299 | | not be subject to statutory provisions for suspension, deferral or |
---|
300 | 300 | | probation, or state correctional institution ea rned credits accruing |
---|
301 | 301 | | from and after November 1, 1989, except for the achievement earned |
---|
302 | 302 | | credits authorized by subsection H of Section 138 of Title 57 of the |
---|
303 | 303 | | Oklahoma Statutes. To qualify for such achievement earned credits, |
---|
304 | 304 | | such inmates must also be in c ompliance with the standards for Class |
---|
305 | 305 | | level 2 behavior, as defined in subsect ion D of Section 138 of Title |
---|
306 | 306 | | 57 of the Oklahoma Statutes. |
---|
307 | 307 | | D. It is an affirmative defense to prosecution for a criminal, |
---|
308 | 308 | | youthful offender, or delinquent offense that, during t he time of |
---|
309 | 309 | | the alleged commission of the offense, the defendant or alleged |
---|
310 | 310 | | youthful offender or delinquent was a victim of human trafficking. |
