4040 An Act relating to alcoholic beverages; creating Task
4141 Force for the Study of Oklahoma Alcoholic Beverage
4242 Laws; providing for appointmen t of members; requiring

5454 BE IT ENACTED BY THE PEOPLE OF THE ST ATE OF OKLAHOMA:
5555 SECTION 1. NEW LAW A new section of law to be codified
5656 in the Oklahoma Statutes as Section 9-101 of Title 37A, unless there
5757 is created a duplication in numbering, reads as follows:
5858 A. There is hereby created the Task Force for the Study of
5959 Oklahoma Alcoholic Beverage Laws.
6060 B. The task force shall consist of thirteen (13) members who
6161 own a business that holds an Alcoholic Beverages Laws En forcement
6262 Commission license as follows:
6363 1. Three members to be appointed by the Governor;

9090 2. Five members to be appointed by the Speaker of the Oklahoma
9191 House of Representatives; and
9292 3. Five members to be appointed by the President Pro Tempore of
9393 the Oklahoma State Senate.
9494 C. The task force shall conduct an organizational meeting not
9595 later than one hundred and twenty (120) days after the sine die
9696 adjournment of the 1st Regular Session of the 60th Oklahoma
9797 Legislature.
9898 D. The task force shall be author ized to meet as often as
9999 required in order to perform the duties imposed upon the task force
100100 by law.
101101 E. The chair of the task force shall be elected by the members
102102 of the task force. A simple majority of the members of the task
103103 force shall constitute a q uorum for purposes of any action taken by
104104 the task force
105105 F. 1. The task force shall conduct a study of Oklahoma
106106 alcoholic beverage laws. The task force shall look at the
107107 feasibility of and make recommendations for the following :
108108 a. lowering fines and fe es set by statute and by the
109109 Alcoholic Beverage Laws Enforcement Commission ;
110110 b. reduce unnecessary state regulations in the alcoholic
111111 beverage industry;

138138 c. removing requirements that a holder of a license
139139 issued by the Alcoholic Beverage Laws Enforcement
140140 Commission must use one distributor ;
141141 d. allowing a holder of a license issued by the Alcoholic
142142 Beverage Laws Enforcement Commission to choose
143143 distributors;
144144 e. prohibiting distributors from monopolizing one brand
145145 or control or force a holder of a license iss ued by
146146 the Alcoholic Beverage Laws Enforcement Commission to
147147 solely use that distributor by controlling one brand
148148 of product; and
149149 f. allowing a holder of a license issued by the Alcoholic
150150 Beverage Laws Enforcement Commission to maintain and
151151 store records off license premises at a separate
152152 location.
153153 2. The task force shall produce a final report containing a
154154 summary of its findings and recommendations with respect to such
155155 issues. The final report, if approved by the task force, shall be
156156 submitted to the Governor, the Speaker of the Oklahoma House of
157157 Representatives and the President Pro Tempore of the Oklahoma State
158158 Senate not later than December 31, 20 25.
159159 G. Travel reimbursement shall be the responsibility of the
160160 appointing authority.

187187 H. Staff assistance for the task force shall be provided by the
188188 Oklahoma House of Representatives and the Oklahoma State Senate. To
189189 the extent practical, the Alcoholic Beverages Laws Enforcement
190190 Commission having information that would be helpful to the task
191191 force shall provide such assistance and information to the task
192192 force as may be required.
193193 I. The task force shall be subject to the provisions of the
194194 Oklahoma Open Meeting Act and the Oklahoma Open Records Act.
195195 J. The task force shall cease to have any authority to tak e any
196196 official action after January 31, 2025, and shall be dissolved by
197197 operation of law on January 1, 2026.
198198 SECTION 2. This act shall become effective October 1, 2025.
