5252 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5353 SECTION 1. AMENDATORY 21 O.S. 2021, Sect ion 1792, is
5454 amended to read as follows:
5555 Section 1792. A. Any person who sha ll willfully trespass or,
5656 enter, or loiter upon property containing a critical infrastructure
5757 facility without permission by the owner of the property or lawful
5858 occupant thereof shall, upon conviction, be guilty of a misdemeanor
5959 punishable by a fine of not less more than One Thousand Dollars
6060 ($1,000.00), or by imprisonment in the county jail for a term of six
6161 (6) months, or by both such fine and imprisonment. If it is
6262 determined the intent of the trespasser is to willfully damage,
6363 destroy, vandalize, defac e, tamper with equipment, or impede or

9090 inhibit operations of the facility, the person shall, upon
9191 conviction, be guilty of a felony punishable by a fine of not less
9292 more than Ten Thousand Dollars ($10,000.00), or by imprisonment in
9393 the custody of the Department of Corrections for a term of one (1)
9494 year, or by both such fine and imprisonment . As used in this
9595 subsection, "loiter" means standing or waiting around idly or
9696 without apparent or rational purpose .
9797 B. Any person who shall willfully damage, destroy, vandalize,
9898 deface or tamper with equipment in a critical infrastructure
9999 facility shall, upon conviction, be guilty of a felony punishable by
100100 a fine of One Hundred Thousand Dolla rs ($100,000.00), or by
101101 imprisonment in the custody of the Department of Corrections for a
102102 term of not more than ten (10) years, or by both such fine and
103103 imprisonment.
104104 C. If an organization is found to be a conspirator with persons
105105 who are found to have c ommitted any of the crimes described in
106106 subsection A or B of this section, the conspiring organization shall
107107 be punished by a fine that is ten times the amount of said fine
108108 authorized by the appropriate provision of this section.
109109 D. As used in this sectio n, "critical infrastructure facility "
110110 means:
111111 1. One of the following, if completely enclosed by a fence or
112112 other physical barrier that is obviously designed to exclude
113113 intruders, or if clearly marked with a sign or signs that are posted

140140 on the property that are reasonably likely to come to the attention
141141 of intruders and indicate th at entry is forbidden without site
142142 authorization:
143143 a. a petroleum or alumina refinery,
144144 b. an electrical power generating facility, substation,
145145 switching station, electrical contro l center or
146146 electric power lines and associated equipment
147147 infrastructure,
148148 c. a chemical, polymer or rubber manufacturing facility,
149149 d. a water intake structure, water treatment facility,
150150 wastewater treatment plant or pump station,
151151 e. a natural gas compresso r station,
152152 f. a liquid natural gas terminal or storage facility,
153153 g. a telecommunications central switching office,
154154 h. wireless telecommunications infrastructure, including
155155 cell towers, telephone poles and lines, including
156156 fiber-optic lines,
157157 i. a port, railroad switching yard, railroad tracks,
158158 trucking terminal or other freight transportation
159159 facility,
160160 j. a gas processing plant, including a plant used in the
161161 processing, treatment or fractionation of natural gas

189189 k. a transmission facil ity used by a federally licensed
190190 radio or television station,
191191 l. a steelmaking facility that uses an electric arc
192192 furnace to make steel,
193193 m. a facility identified and regulated by the United
194194 States Department of Homeland Security Chemical
195195 Facility Anti-Terrorism Standards (CFATS) program,
196196 n. a dam that is regulated by the state or federal
197197 government,
198198 o. a natural gas distribution utility facility including,
199199 but not limited to, pipeline interconnections, a city
200200 gate or town border station, metering station,
201201 aboveground piping, a regulator station and a natural
202202 gas storage facility, or
203203 p. a crude oil or refined products storage and
204204 distribution facility including, but not limited to,
205205 valve sites, pipeline interconnections, pump station,
206206 metering station, below or aboveground pipeline or
207207 piping and truck loading or offloading facility; or
208208 2. Any aboveground portion of an oil, gas, hazardous liquid or
209209 chemical pipeline, tank, railroad facility or other storage facility
210210 that is enclosed by a fence, other physical barrier or is clearly
211211 marked with signs prohibiting trespassing, that are obvi ously
212212 designed to exclude intruders ;

239239 3. Any prison facility; or
240240 4. Any county-owned property including, but not limited to,
241241 courthouses and detention centers .
242242 SECTION 2. This act shall become effective November 1, 202 5.
