52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. AMENDATORY 21 O.S. 2021, Sect ion 1792, is
54	54	amended to read as follows:
55	55	Section 1792. A. Any person who sha ll willfully trespass or,
56	56	enter, or loiter upon property containing a critical infrastructure
57	57	facility without permission by the owner of the property or lawful
58	58	occupant thereof shall, upon conviction, be guilty of a misdemeanor
59	59	punishable by a fine of not less more than One Thousand Dollars
60	60	($1,000.00), or by imprisonment in the county jail for a term of six
61	61	(6) months, or by both such fine and imprisonment. If it is
62	62	determined the intent of the trespasser is to willfully damage,
63	63	destroy, vandalize, defac e, tamper with equipment, or impede or

90	90	inhibit operations of the facility, the person shall, upon
91	91	conviction, be guilty of a felony punishable by a fine of not less
92	92	more than Ten Thousand Dollars ($10,000.00), or by imprisonment in
93	93	the custody of the Department of Corrections for a term of one (1)
94	94	year, or by both such fine and imprisonment . As used in this
95	95	subsection, "loiter" means standing or waiting around idly or
96	96	without apparent or rational purpose .
97	97	B. Any person who shall willfully damage, destroy, vandalize,
98	98	deface or tamper with equipment in a critical infrastructure
99	99	facility shall, upon conviction, be guilty of a felony punishable by
100	100	a fine of One Hundred Thousand Dolla rs ($100,000.00), or by
101	101	imprisonment in the custody of the Department of Corrections for a
102	102	term of not more than ten (10) years, or by both such fine and
103	103	imprisonment.
104	104	C. If an organization is found to be a conspirator with persons
105	105	who are found to have c ommitted any of the crimes described in
106	106	subsection A or B of this section, the conspiring organization shall
107	107	be punished by a fine that is ten times the amount of said fine
108	108	authorized by the appropriate provision of this section.
109	109	D. As used in this sectio n, "critical infrastructure facility "
110	110	means:
111	111	1. One of the following, if completely enclosed by a fence or
112	112	other physical barrier that is obviously designed to exclude
113	113	intruders, or if clearly marked with a sign or signs that are posted

141	141	of intruders and indicate th at entry is forbidden without site
142	142	authorization:
143	143	a. a petroleum or alumina refinery,
144	144	b. an electrical power generating facility, substation,
145	145	switching station, electrical contro l center or
146	146	electric power lines and associated equipment
147	147	infrastructure,
148	148	c. a chemical, polymer or rubber manufacturing facility,
149	149	d. a water intake structure, water treatment facility,
150	150	wastewater treatment plant or pump station,
151	151	e. a natural gas compresso r station,
152	152	f. a liquid natural gas terminal or storage facility,
153	153	g. a telecommunications central switching office,
154	154	h. wireless telecommunications infrastructure, including
155	155	cell towers, telephone poles and lines, including
156	156	fiber-optic lines,
157	157	i. a port, railroad switching yard, railroad tracks,
158	158	trucking terminal or other freight transportation
159	159	facility,
160	160	j. a gas processing plant, including a plant used in the
161	161	processing, treatment or fractionation of natural gas
162	162	or natural gas liquids,

191	191	l. a steelmaking facility that uses an electric arc
192	192	furnace to make steel,
193	193	m. a facility identified and regulated by the United
194	194	States Department of Homeland Security Chemical
195	195	Facility Anti-Terrorism Standards (CFATS) program,
196	196	n. a dam that is regulated by the state or federal
197	197	government,
198	198	o. a natural gas distribution utility facility including,
199	199	but not limited to, pipeline interconnections, a city
200	200	gate or town border station, metering station,
201	201	aboveground piping, a regulator station and a natural
202	202	gas storage facility, or
203	203	p. a crude oil or refined products storage and
204	204	distribution facility including, but not limited to,
205	205	valve sites, pipeline interconnections, pump station,
206	206	metering station, below or aboveground pipeline or
207	207	piping and truck loading or offloading facility; or
208	208	2. Any aboveground portion of an oil, gas, hazardous liquid or
209	209	chemical pipeline, tank, railroad facility or other storage facility
210	210	that is enclosed by a fence, other physical barrier or is clearly
211	211	marked with signs prohibiting trespassing, that are obvi ously
212	212	designed to exclude intruders ;
