55 | 52 | BE IT ENACTED BY THE PEOPLE OF THE STATE OF O KLAHOMA: | |
56 | 53 | SECTION 1. NEW LAW A new section of law to be codified | |
57 | 54 | in the Oklahoma Statutes as Se ction 2-34 of Title 2, unless there is | |
58 | 55 | created a duplication in numbering, reads as follows: | |
59 | 56 | A. Any individual entering through gates used fo r ingress or | |
60 | 57 | egress to a property designated as an easement shall maintain the | |
61 | 58 | position of the gate upon use. | |
62 | 59 | B. 1. Any individual who violates the provisions of subsection | |
63 | 60 | A of this section shall, upon conviction, be guilty of a misdemeanor | |
64 | 61 | punishable by a fine not more than Five Hundred Dollars ($500.00), | |
62 | + | by imprisonment in a county jail for not more than ninety ( 90) days, | |

102 | 98 | county jail for not more than one (1) year, or by both such fine and | |

104 | 100 | 4. Any individual convicted pursuant to t he provisions of this | |
105 | 101 | subsection shall also be liable for damages. | |
106 | 102 | C. The Oklahoma Department of Agriculture, Food, and Forestry | |
107 | 103 | shall promulgate rules necessary to implement the provisions of this | |
108 | 104 | act. | |
109 | 105 | SECTION 2. This act shall become ef fective November 1, 2025. | |
