5552 BE IT ENACTED BY THE PEOPLE OF THE STATE OF O KLAHOMA:
5653 SECTION 1. NEW LAW A new section of law to be codified
5754 in the Oklahoma Statutes as Se ction 2-34 of Title 2, unless there is
5855 created a duplication in numbering, reads as follows:
5956 A. Any individual entering through gates used fo r ingress or
6057 egress to a property designated as an easement shall maintain the
6158 position of the gate upon use.
6259 B. 1. Any individual who violates the provisions of subsection
6360 A of this section shall, upon conviction, be guilty of a misdemeanor
6461 punishable by a fine not more than Five Hundred Dollars ($500.00),
62+by imprisonment in a county jail for not more than ninety ( 90) days,
63+or by both such fine and imprisonment.

92-by imprisonment in a county jail for not more than ninety (90) days,
93-or by both such fine and imprisonment.
9490 2. Any individual convicted of a second offense shall, upon
9591 conviction, be guilty of a misde meanor punishable by a fine not more
9692 than One Thousand Dollars ($1,000.00), by imprisonment in a county
9793 jail for not more than one hundred eighty (180) days, or by both
9894 such fine and imprisonment.
9995 3. Any individual convicted of a third or subsequent offen se
10096 shall, upon conviction, be punished by a fine not more than One
10197 Thousand Five Hundred Dollars ($1,500.00), by i mprisonment in a
10298 county jail for not more than one (1) year, or by both such fine and
10399 imprisonment.
104100 4. Any individual convicted pursuant to t he provisions of this
105101 subsection shall also be liable for damages.
106102 C. The Oklahoma Department of Agriculture, Food, and Forestry
107103 shall promulgate rules necessary to implement the provisions of this
108104 act.
109105 SECTION 2. This act shall become ef fective November 1, 2025.
