55	52		BE IT ENACTED BY THE PEOPLE OF THE STATE OF O KLAHOMA:
56	53		SECTION 1. NEW LAW A new section of law to be codified
57	54		in the Oklahoma Statutes as Se ction 2-34 of Title 2, unless there is
58	55		created a duplication in numbering, reads as follows:
59	56		A. Any individual entering through gates used fo r ingress or
60	57		egress to a property designated as an easement shall maintain the
61	58		position of the gate upon use.
62	59		B. 1. Any individual who violates the provisions of subsection
63	60		A of this section shall, upon conviction, be guilty of a misdemeanor
64	61		punishable by a fine not more than Five Hundred Dollars ($500.00),
	62	+	by imprisonment in a county jail for not more than ninety ( 90) days,
	63	+	or by both such fine and imprisonment.

94	90		2. Any individual convicted of a second offense shall, upon
95	91		conviction, be guilty of a misde meanor punishable by a fine not more
96	92		than One Thousand Dollars ($1,000.00), by imprisonment in a county
97	93		jail for not more than one hundred eighty (180) days, or by both
98	94		such fine and imprisonment.
99	95		3. Any individual convicted of a third or subsequent offen se
100	96		shall, upon conviction, be punished by a fine not more than One
101	97		Thousand Five Hundred Dollars ($1,500.00), by i mprisonment in a
102	98		county jail for not more than one (1) year, or by both such fine and
103	99		imprisonment.
104	100		4. Any individual convicted pursuant to t he provisions of this
105	101		subsection shall also be liable for damages.
106	102		C. The Oklahoma Department of Agriculture, Food, and Forestry
107	103		shall promulgate rules necessary to implement the provisions of this
108	104		act.
109	105		SECTION 2. This act shall become ef fective November 1, 2025.
