5575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
56-SECTION 1. NEW LAW A new section of law not to be
57-codified in the Oklahoma Statutes reads as follows:
58-This act shall be known and may be cited as the "Oklahoma
59-Nuclear Energy Feasibility Study Act of 2025".

103+SECTION 1. NEW LAW A new section of law not to be
104+codified in the Oklahoma Statutes reads as follows:
105+This act shall be known and may be cited as the "Oklahoma
106+Nuclear Energy Feasibility Study Act of 2025".
86107 SECTION 2. NEW LAW A new section of law to be codified
87108 in the Oklahoma Statutes as Section 803.1 of Title 17, unless there
88109 is created a duplication in numbering, reads as foll ows:
89110 A. Within ninety (90) days after the passage and approval of
90111 this act, the Oklahoma Corporation Commission shall start the
91112 process to engage an outside consulting firm to provide the service
92113 of conducting a technical and legal feasibility study on pr omoting
93114 nuclear energy generation in this state. This engagement shall be
94115 exempt from the state procurement process and shall follow the
95116 Corporation Commission's process to retain expert witnesses on
96117 behalf of the Commission to ensure the ability to timel y conduct the
97118 study and complete the requirements of this section.
98119 B. The consulting firm shall be well -established in the nuclear
99120 energy industry.
100121 C. The feasibility study shall consider the following:
101122 1. The advantages and disadvantages of nuclear ene rgy
102123 generation in this state, including, but not limited to, the
103124 economic and environmental impact;
104-2. Ways to maximize the use of workers who reside in this state
105-and products made in this state in the construction of nuclear
106-energy generation facilities;
107-3. Evaluations, conclusions, and recommendations on the
108-following:

152+2. Ways to maximize the use of workers who reside in this state
153+and products made in this state in the construction of nuclear
154+energy generation facilities ;
155+3. Evaluations, conclusions, and recommendations on the
156+following:
135157 a. design characteristics and evaluation, including
136158 specific recommendations of optimal designs based on
137159 site characteristics and possible industrial uses,
138160 b. environmental and ecologica l impacts,
139161 c. land and siting criteria, including specific areas
140162 that are best suited for new nuclear energy generation
141163 based on the land and siting criteria, as well as
142164 cities near military bases that may use nuclear
143165 electric generation to meet the milita ry resiliency
144166 requirements of 10 U.S.C., Section 2920,
145167 d. safety criteria,
146168 e. engineering and cost -related criteria, and
147169 f. small modular nuclear reactor and microreactor
148170 capability;
149171 4. Socioeconomic assessment and impact analysis, including, but
150172 not limited to, the following:
151173 a. workforce education, training, and development,
152174 b. local and state tax base,
153175 c. supply chains, and
154-d. permanent and temporary job creation;
155-5. The timeline for development, including areas of potential
156-acceleration or efficiencies and leveraging existing facilities
157-within this state;

203+d. permanent and temporary job creation;
204+5. The timeline for development, including areas of p otential
205+acceleration or efficiencie s and leveraging existing facilities
206+within this state;
184207 6. Literature review of studies that have assessed the
185208 potential impact of nuclear energy generation; and
186209 7. Assessment and recommendation of current and future policies
187210 that may be needed to suppor t or accelerate the adoption of nuclear
188211 energy generation or may improve its cost -effectiveness, including a
189212 survey of federal programs and other methods that could financially
190213 assist a nuclear project in the state.
191214 D. The Oklahoma Corporation Commission, state public utilities,
192215 cooperatives, and municipally owned utilities shall cooperate in
193216 providing information relevant to the feasibility study, as needed,
194217 subject to notifications to stakeholders and reasonable safeguards
195218 to protect confidential informa tion from being made public.
196219 E. Not later than nine (9) months after the effective date of
197220 this act, the Oklahoma Corporation Commission shall deliver a
198221 written report on the feasibility study to the Governor, and the
199222 President Pro Tempore of the Oklahoma State Senate and the Speaker
200223 of the Oklahoma House of Representatives who shall forward the
201224 report to the appropriate committees.

236260 In the event the Oklahoma Corporation Commission is unable to
237261 hire a consulting firm to complete the feasibility study for the
238262 budgeted amount allowed in this section, the Oklahoma Corporation
239263 Commission is authorized to conduct a notice of inquiry and utilize
240264 the information received from the stakeholders in conjunction with
241265 the consulting firm to reduce the cost of gathering information for
242266 the purpose of the study and report.
243267 SECTION 4. It being immediately necessary for the preservation
244268 of the public peace, health or safety, an emergency is hereby
245269 declared to exist, by reason whereof this act shall take effect and
246270 be in full force from and after its passage and approval.
