4245 An Act relating to alcoholic beverages; amending 37A
4346 O.S. 2021, Section 6 -103, as last amended by Section
4447 1, Chapter 200, O.S.L. 2023 (37A O.S. Supp. 2024,
4548 Section 6-103), which relates to prohibited acts of
4649 retail spirits licensees; expanding exemption for
4750 offering or furnishing any prize, premium, gift , or
4851 similar inducement to a consumer in connection with
4952 the sale of alcoholic beverages for current or former

6467 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6568 SECTION 1. AMENDATORY 37A O.S. 2021, Section 6 -103, as
6669 last amended by Section 1, Chapter 200, O.S.L. 2023 (37A O.S. Supp.
6770 2024, Section 6-103), is amended to read as follows:
6871 Section 6-103. A. No retail spirits licensee shall:

9599 1. Purchase or receive any alcoholic beverage other than from a
96100 wine and spirits wholesaler, beer distributor, winery or small
97101 brewer self-distribution licensee who elec ts to self-distribute;
98102 2. Suffer or permit any retail container to be opened, or any
99103 alcoholic beverage to be consumed on the licensed premises, except
100104 when serving samples as autho rized by Section 2-109 of this title or
101105 otherwise permitted by law; provid ed, the licensee shall not permit
102106 any alcoholic beverage content or retail container unsealed in
103107 connection with sampling authorized by Section 2 -109 of this title
104108 to remain on the licensed premises at the close of business on that
105109 day, excluding spirits;
106110 3. Sell any alcoholic beverages at any hour other than between
107111 the hours of 8:00 a.m. and midnight Monday through Saturday, and
108112 shall not be permitted to be open on Thanksgiving Day or Christmas
109113 Day; provided, a county may, pursuant to the provisions of
110114 subsections B and C of Section 3 -124 of this title, elect to allow
111115 such sales between the hours of noon and midnight on Sunday. Retail
112116 spirits licensees shall be permitted to sell alcoholic beverages on
113117 the day of any General, Primary, Runoff Primary or Sp ecial Election
114118 whether on a national, state, county or city election, provided that
115119 the election day does not occur on any day on which such sales are
116120 otherwise prohibited by law;

143148 4. Sell spirits in a city or town, unless such city or town has
144149 a population in excess of two hundred (200) according to the latest
145150 Federal Decennial Census;
146151 5. Sell any alcoholic beverage on credit; provided, that
147152 acceptance by a licensee of a cash or debit card or a nationally
148153 recognized credit card in lieu of actual cash paym ent does not
149154 constitute the extension of credit; provided, further, as used in
150155 this section:
151156 a. "cash or debit card" means any instrument or device
152157 whether known as a debit card or b y any other name,
153158 issued with or without fee by an issuer for the use of
154159 the cardholder in depositing, obtaining or
155160 transferring funds from a consumer banking electronic
156161 facility, and
157162 b. "nationally recognized credit card " means any
158163 instrument or device, whether known as a credit card,
159164 credit plate, charge plate or by any other name,
160165 issued with or without fee by an issuer for the use of
161166 the cardholder in obtaining money, goods, services or
162167 anything else of value on credit which is accepted by
163168 over one hundred retail locations;
164169 6. Offer or furnish any prize, premium, gift or sim ilar
165170 inducement to a consumer in connection with the sale of alcoholic

193-a. goods or merchandise included by the manufacturer in
194-packaging with alcoholic beverages or for packaging
199+a. that goods or merchandise included by the manufacturer
200+in packaging with alcoholic beverages or for packaging
195201 with alcoholic beverages shall not be included in thi s
196202 prohibition, but no wholesaler or retailer shall sell
197203 any alcoholic beverage prepackaged with other goods or
198204 merchandise at a price which is greater than the price
199205 at which the alcoholic beverage alone is sold;
200206 provided, it shall not be considered induce ment or a
201207 premium for a retail spirits licensee to have an
202208 advertised price posted higher onl ine than the shelf
203209 price on the licensed premises ,
204210 b. retail spirits licensee offering retail packages at a
205211 discount from retail price for current or former
206212 members of the United States Armed Forces, at the
207213 discretion of the licensee; no discount shall make the
208214 retail price lower than six -percent markup, as
209215 applicable in Section 3 -118 of this title; or
210216 7. Pay for alcoholic beverages by a check or draft which is
211217 dishonored by the drawee when presented to such drawee for payment;
212218 and the ABLE Commission may cancel or suspend the license of any
213219 retailer who has given a check or draft, as maker or endorser, which
214220 is so dishonored upon presentation.
215221 B. No retail spirits licensee shall permit any person under
216222 twenty-one (21) years of age to enter into or remain within or about

243250 the licensed premises unless accompanied by the person 's parent or
244251 legal guardian; provided, however, this restriction shall not apply
245252 to an employee of a licensed beer distributor or wine and spirits
246253 wholesaler who:
247254 1. Is at least eighteen (18) years of age;
248255 2. Is accompanied by a coworker at least twenty-one (21) years
249256 of age; and
250257 3. Enters for the sole purpose of merchandising or delivering
251258 product to the licensee in the normal course of business.
252259 SECTION 2. AMENDATORY 37A O.S. 2021, Section 6 -108, is
253260 amended to read as follows:
254261 Section 6-108. No holder of a Retail Wine License or a Retail
255262 Beer License shall:
256263 1. Purchase or receive any alcoholic beverage other than from a
257264 wine and spirits wholesaler, beer distributor, winery or small
258265 brewer self-distribution licensee;
259266 2. Suffer or permit any retail container to be opened, or any
260267 alcoholic beverage to be consumed on th e licensed premises, except
261268 when serving samples as authorized by Section 2 -109 of this title or
262269 as otherwise permitted by law; provided, the licensee shall not
263270 permit any alcoholic beverages content or retail container unsealed
264271 in connection with sampling authorized by Section 2 -109 of this
265272 title to remain on the licensed premises at the close of the
266273 business on that day;

293301 3. Sell any beer or wine a t any hour other than between the
294302 hours of 6:00 a.m. and 2:00 a.m. the following day, Monday through
295303 Sunday. Retail wine and retail beer licensees shall be permitted to
296304 sell beer and wine on the day of any General, Primary, Runoff
297305 Primary or Special Election whether on a national, state, county or
298306 city election;
299307 4. Sell any beer and wine on credit; except as fo llows:
300308 a. the acceptance by a grocery store, convenience store
301309 or drug store of a cash or debit card, or a nationally
302310 recognized credit card, in li eu of actual cash payment
303311 does not constitute the extension of credit; provided,
304312 further, as used in this sec tion:
305313 (1) "cash or debit card" means any instrument or
306314 device whether known as a debit card or by any
307315 other name, issued with or without fee by an
308316 issuer for the use of the cardholder in
309317 depositing, obtaining or transferring funds from
310318 a consumer banking e lectronic facility, and
311319 (2) "nationally recognized credit card " means any
312320 instrument or device, whether known as a credit

343352 credit which is accepted by over one hundred
344353 retail locations, and
345354 b. when the holder of a Retail Wine License, Retail Beer
346355 License or Mixed Beverage License is a private
347356 membership club, marina, golf course or country club
348357 that normally charges food, drinks and other purchases
349358 to the member's monthly dues account in the regular
350359 course of business, in lieu of actual cash payment at
351360 the time of purchase, such practice does not
352361 constitute the extension o f credit;
353362 5. Offer or furnish any prize, premium, gift or similar
354363 inducement to a consumer in connection with the sale of beer or
355364 wine, except that:
356365 a. goods or merchandise included by the manufacturer in
357366 packaging with beer or wine or for packaging with beer
358367 or wine shall not be included in this prohibition, nor
359368 shall a retail wine or retail beer license holder
360369 selling wine or beer at a multiunit d iscount be
361370 included in this prohibition; but no retail wine or
362371 retail beer licensee shall sell any beer or wi ne
363372 prepackaged with other goods or merchandise at a price
364373 which is greater than the price at which the alcoholic
365374 beverage alone is sold ,

393403 packages at a discount from retail price for former
394404 members of the United States Armed Forces, at the
395405 discretion of the licensee; no discount shall make the
396406 retail price lower than six -percent markup, as

398408 6. Pay for beer or wine by a check or draft which is dishonored
