44	44	nonresidents from hunting waterfowl on public lands

52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. AMENDATORY 29 O.S. 2021, Section 4 -130, as
54	54	amended by Section 7, Chapter 6, O.S.L. 2024 (29 O.S. Supp. 2024,
55	55	Section 4-130), is amended to read as follows:
56	56	Section 4-130. A. Except as otherwise provided in the Oklahoma
57	57	Wildlife Conservation Code, no person may hunt or take any waterfowl
58	58	during the open season on waterfowl unless the person has first
59	59	obtained an Oklahoma waterfowl hunting stamp or license from the
60	60	Director or authorized agents of the Director. Each person shall
61	61	have the stamp or license in their possession when hunting or taking
62	62	any waterfowl.

89	89	B. Persons excepted from the Oklahoma waterfowl hunting stamp
90	90	or license requirement of this section are:
91	91	1. Legal residents of Oklahoma under eighteen (18) years of
92	92	age; and
93	93	2. Legal residents of Oklahoma sixty -five (65) years of age or
94	94	older.
95	95	C. The Oklahoma waterfowl hunting stamp fee and waterfowl
96	96	license shall be for:
97	97	1. Residents eighteen (18) years of age or older – Twenty
98	98	Dollars ($20.00); and
99	99	2. Nonresidents eighteen (18) years of age or older – Thirty
100	100	Dollars ($30.00).
101	101	D. 1. The collection a nd remittance procedures applicable to
102	102	hunting license fees under this title shall apply to waterfowl stamp
103	103	or license fees.
104	104	2. The waterfowl stamp or license issued pursuant to this
105	105	section shall expire on June 30 of each year.
106	106	E. The Oklahoma Wildlife Conservation Commission may prescribe,
107	107	by regulation, the form, design and manner of issuance, if any, of
108	108	the waterfowl stamp, which could include the selection of art for
109	109	such stamp from an art contest regulated by the Commission.
110	110	F. 1. Any person arres ted for hunting or taking any waterfowl
111	111	during the open season on waterfowl without a valid Oklahoma
112	112	waterfowl hunting stamp or license as required by the provisions of

139	139	subsection A of this section may purchase a substitute temporary
140	140	thirty-day stamp or license from the arresting game warden in lieu
141	141	of posting bond. Proof of hunter safety certification shall not be
142	142	required for the temporary substitute stamp or license. The fee for
143	143	a substitute stamp or license purchased pursuant to the provisions
144	144	of this subsection shall be:
145	145	a. for legal residents – One Hundred Dollars ($100.00),
146	146	and
147	147	b. for nonresidents – One Hundred Seventy-five Dollars
148	148	($175.00).
149	149	2. The fees from the temporar y stamp and license purchased
150	150	pursuant to the provisions of this subsection shall be deposited in
151	151	the Wildlife Conservation Fund, to be used exclusively in this
152	152	state, for the purpose of developing, managing, preserving,
153	153	restoring and maintaining wetland h abitats and for the conservation
154	154	and management of waterfowl and ecologically related species.
155	155	G. Nonresidents are limited to hunting waterfowl on all public
156	156	land located south of Interstate 40 and east of Interstate 35 on
157	157	Monday through Thursday and are prohibited from hunting waterfowl on
158	158	public land Friday through Sunday.
159	159	H. Any person convicted of violating any of the provisions of
160	160	this section shall be punished by a fine of not less than Twenty -
161	161	five Dollars ($25.00) nor more than One Hundred Dollars ($100.00).

188	188	H. I. Nothing in this title shall prohibit a person from
189	189	hunting waterfowl exclusively on their own property without an
190	190	Oklahoma waterfowl hunting stamp or license.
191	191	SECTION 2. This act shall become effective November 1, 2025.
