54 | 54 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

55 | 55 | | SECTION 1. AMENDATORY 10 O.S. 2021, Section 601.6, is |
---|

57 | 57 | | Section 601.6. A. The Office of Juvenile System Oversight |
---|
58 | 58 | | shall have the responsibility of investigating and reporting |
---|
59 | 59 | | misfeasance and malfeasance within the children and youth service |
---|
60 | 60 | | system, inquiring into areas of concern, investigating complaints |
---|
61 | 61 | | filed with the Office of Juvenile System Oversight, and performing |
---|
62 | 62 | | issue-specific systemic monitoring as directed by the Commission on |
---|
63 | 63 | | Children and Youth of the children and youth s ervice system to |
---|
64 | 64 | | ascertain compliance with established responsibilities. |

92 | 92 | | to conduct not less than one but not more than two regular, |

93 | 93 | | periodic, but not less than annual, unannounced inspections of |

94 | 94 | | state-operated children's institutions and facilities and to review |
---|
95 | 95 | | the reports of the inspections of the State Fire Marshal , and the |
---|
96 | 96 | | State Department of Health and any agencies which accredit such |
---|
97 | 97 | | institutions and facilities . The Office of Juvenile S ystem |
---|
98 | 98 | | Oversight shall conduct periodic inspections of privately operated |
---|
99 | 99 | | children's facilities on a periodic basis or as needed . |
---|
100 | 100 | | B. The Office of Juvenile System Oversight shall: |
---|
101 | 101 | | 1. Have the authority to examine and copy all records and |
---|
102 | 102 | | budgets pertaining to the children and youth service system and to |
---|
103 | 103 | | interview the residents of such facilities and shall have access to |
---|
104 | 104 | | all facilities within the children and youth service system for the |
---|
105 | 105 | | purpose of conducting systemic oversight and complaint |
---|
106 | 106 | | investigations site visits and speaking with the residents of such |
---|
107 | 107 | | facilities; |
---|
108 | 108 | | 2. Have the authority to subpoena witnesses and hold public |
---|
109 | 109 | | hearings; |
---|
110 | 110 | | 3. Establish, in accordance with the Dispute Resolution Act, |
---|
111 | 111 | | Sections 1801 through 1813 of Title 12 of the Oklahoma Stat utes, a |
---|
112 | 112 | | voluntary program for foster parents to mediate complaints |
---|
113 | 113 | | concerning the rights of foster parents, as provided for in Section |
---|
114 | 114 | | 1-9-119 of Title 10A of the Oklahoma Statutes, that relate to |
---|

145 | 145 | | 4. Receive any complaint alleging that an employee of the |
---|
146 | 146 | | Department of Human Serv ices or a child-placing agency has |
---|
147 | 147 | | threatened a foster parent with removal of a child from the foster |
---|
148 | 148 | | parent, harassed a foster parent, or refused to place a child in a |
---|
149 | 149 | | licensed or certified foster home, or disrupted a child placement as |
---|
150 | 150 | | retaliation or discrimination towards a foster parent who has: |
---|
151 | 151 | | a. filed a grievance pursuant to Section 1-9-120 of Title |
---|
152 | 152 | | 10A of the Oklahoma Statutes, |
---|
153 | 153 | | b. provided information to any state official or |
---|
154 | 154 | | Department employee, or |
---|
155 | 155 | | c. testified, assisted, or otherwise participated in an |
---|
156 | 156 | | investigation, proceeding, or hearing against the |
---|
157 | 157 | | Department or child-placing agency. |
---|
158 | 158 | | The Office of Juvenile System Oversight shall forward the complaints |
---|
159 | 159 | | to the Office of Client Advocacy for investigation pursuant to |
---|
160 | 160 | | subsection D of Section 1 -9-112 of Title 10A of the Oklahoma |
---|
161 | 161 | | Statutes. The Office of Juvenile System Oversigh t shall work with |
---|
162 | 162 | | the Office of Client Advocacy to ensure the complaints are |
---|
163 | 163 | | investigated and resolved in accordance with the grievance |
---|
164 | 164 | | procedures provided in Section 1 -9-120 of Title 10A of the Oklahoma |

196 | 196 | | the result of any such proceeding; |

197 | 197 | | 5. Issue reports to the Governor, Speaker of the House of |
---|
198 | 198 | | Representatives, President Pro Tempore of the Senate, Chief Ju stice |
---|
199 | 199 | | of the Supreme Court of the State of Oklahoma, any appropriate |
---|
200 | 200 | | prosecutorial agency, the director of the agency under |
---|
201 | 201 | | consideration, and other persons as necessary and appropriate; and |
---|
202 | 202 | | 6. Provide recommendations to the Oklahoma Commission on |
---|
203 | 203 | | Children and Youth on or before May 1 of each year. |
---|
204 | 204 | | C. The Office of Juvenile System Oversight shall not release |
---|
205 | 205 | | information that would identify a person who makes a complaint to |
---|
206 | 206 | | the Office, unless a court of competent jurisdiction orders release |
---|
207 | 207 | | of the information for good cause shown. |
---|
208 | 208 | | SECTION 2. This act shall become effective November 1, 2025. |
