5454 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5555 SECTION 1. AMENDATORY 10 O.S. 2021, Section 601.6, is
5656 amended to read as follows:
5757 Section 601.6. A. The Office of Juvenile System Oversight
5858 shall have the responsibility of investigating and reporting
5959 misfeasance and malfeasance within the children and youth service
6060 system, inquiring into areas of concern, investigating complaints
6161 filed with the Office of Juvenile System Oversight, and performing
6262 issue-specific systemic monitoring as directed by the Commission on
6363 Children and Youth of the children and youth s ervice system to
6464 ascertain compliance with established responsibilities.

9191 It shall be the duty of the Office of Juvenile System Oversight
9292 to conduct not less than one but not more than two regular,
9393 periodic, but not less than annual, unannounced inspections of
9494 state-operated children's institutions and facilities and to review
9595 the reports of the inspections of the State Fire Marshal , and the
9696 State Department of Health and any agencies which accredit such
9797 institutions and facilities . The Office of Juvenile S ystem
9898 Oversight shall conduct periodic inspections of privately operated
9999 children's facilities on a periodic basis or as needed .
100100 B. The Office of Juvenile System Oversight shall:
101101 1. Have the authority to examine and copy all records and
102102 budgets pertaining to the children and youth service system and to
103103 interview the residents of such facilities and shall have access to
104104 all facilities within the children and youth service system for the
105105 purpose of conducting systemic oversight and complaint
106106 investigations site visits and speaking with the residents of such
107107 facilities;
108108 2. Have the authority to subpoena witnesses and hold public
109109 hearings;
110110 3. Establish, in accordance with the Dispute Resolution Act,
111111 Sections 1801 through 1813 of Title 12 of the Oklahoma Stat utes, a
112112 voluntary program for foster parents to mediate complaints
113113 concerning the rights of foster parents, as provided for in Section
114114 1-9-119 of Title 10A of the Oklahoma Statutes, that relate to

141141 certain actions, inactions or decisions of the Department o f Human
142142 Services, the Department of Juvenile Justice, or child -placing
143143 agencies that may adversely affect the safety and well -being of
144144 children in the custody of the state;
145145 4. Receive any complaint alleging that an employee of the
146146 Department of Human Serv ices or a child-placing agency has
147147 threatened a foster parent with removal of a child from the foster
148148 parent, harassed a foster parent, or refused to place a child in a
149149 licensed or certified foster home, or disrupted a child placement as
150150 retaliation or discrimination towards a foster parent who has:
151151 a. filed a grievance pursuant to Section 1-9-120 of Title
152152 10A of the Oklahoma Statutes,
153153 b. provided information to any state official or
154154 Department employee, or
155155 c. testified, assisted, or otherwise participated in an
156156 investigation, proceeding, or hearing against the
157157 Department or child-placing agency.
158158 The Office of Juvenile System Oversight shall forward the complaints
159159 to the Office of Client Advocacy for investigation pursuant to
160160 subsection D of Section 1 -9-112 of Title 10A of the Oklahoma
161161 Statutes. The Office of Juvenile System Oversigh t shall work with
162162 the Office of Client Advocacy to ensure the complaints are
163163 investigated and resolved in accordance with the grievance
164164 procedures provided in Section 1 -9-120 of Title 10A of the Oklahoma

191191 Statutes. The provisions of this paragraph shall not apply to any
192192 complaint by a foster parent regarding the result of a criminal,
193193 administrative, or civil proceeding for a violation of any law,
194194 rule, or contract provision by tha t foster parent, or the action
195195 taken by the Department or a child -placing agency in conformity with
196196 the result of any such proceeding;
197197 5. Issue reports to the Governor, Speaker of the House of
198198 Representatives, President Pro Tempore of the Senate, Chief Ju stice
199199 of the Supreme Court of the State of Oklahoma, any appropriate
200200 prosecutorial agency, the director of the agency under
201201 consideration, and other persons as necessary and appropriate; and
202202 6. Provide recommendations to the Oklahoma Commission on
203203 Children and Youth on or before May 1 of each year.
204204 C. The Office of Juvenile System Oversight shall not release
205205 information that would identify a person who makes a complaint to
206206 the Office, unless a court of competent jurisdiction orders release
207207 of the information for good cause shown.
208208 SECTION 2. This act shall become effective November 1, 2025.
