111111 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
112112 SECTION 1. NEW LAW A new section of law to be codified
113113 in the Oklahoma Statutes as Section 1289.31 of Title 21, unless
114114 there is created a duplication in numbering, reads as follows:
115115 Sections 1 through 4 of this act shall be known and may be cited
116116 as the "Voluntary Firearm Restriction Act ".
117117 SECTION 2. NEW LAW A new section of law to be codified
118118 in the Oklahoma Statu tes as Section 1289.31a of Title 21, unless
119119 there is created a duplication in numbering, reads as follows:
120120 As used in the Voluntary Firearm Restriction Act:
121121 1. "Bureau" means the Oklahoma State Bureau of Investigation;
122122 2. "Firearm" means a pistol, handgun, rifle or shotgun, or a
123123 device that could be used as a dangerous weapon from which is
124124 expelled a projectile by action of an explosive;
125125 3. "Health care provider " means a person:
126126 a. who provides health care or professional services
127127 related to health care, and
128128 b. is acting within the scope of his or her license,
129129 certification, practice, education, or training; and

156156 4. "Law enforcement agency " means any state, county or
157157 municipal agency or department which maintains custody of persons
158158 accused of, charged with or convicted of any criminal offense .
159159 SECTION 3. NEW LAW A new section of law to be codified
160160 in the Oklahoma Statutes as Section 1289.31b of Title 21, u nless
161161 there is created a duplication in numbering, reads as follows:
162162 A. An individual may voluntarily request to be restricted from
163163 the purchase or possession of firearms.
164164 B. An individual requesting to be restricted under subsection A
165165 of this section may request placement on one of the following
166166 restricted lists:
167167 1. A restricted list that:
168168 a. restricts the individual from purchasing or possessing
169169 a firearm for one hundred eighty (180) days with
170170 automatic removal of the individual from the
171171 restricted list at the end of the one hundred eighty
172172 (180) days, and
173173 b. allows the individua l to request removal thirty (30)
174174 days after the day on which the individual is added to
175175 the restricted list; or
176176 2. A restricted list that:
177177 a. restricts the individual from purch asing or possessing
178178 a firearm indefinitely, and

205205 b. allows the individual to request removal ninety (90)
206206 days after the day on which the individual is added to
207207 the restricted list.
208208 C. 1. Subject to subsections H and I of this section, the
209209 Oklahoma State Bureau of Investigation shall develop a process and
210210 forms for inclusion on, and removal from, a restricted list as
211211 described in subsection B of this section to be maintained by the
212212 Bureau.
213213 2. The Bureau shall make the forms for inclusion and removal
214214 available by download through the website of the Bureau and require,
215215 at a minimum, the following information for the individual described
216216 in subsection A of this section:
217217 a. name,
218218 b. address,
219219 c. date of birth,
220220 d. contact information,
221221 e. signature, and
222222 f. (1) if the individual is entered on the restricted
223223 list as described in paragraph 1 of subsection B
224224 of this section, an acknowledgment of the
225225 statement provided for in paragraph 1 of
226226 subsection H of this section, or
227227 (2) if the individual is entered on the restri cted
228228 list as described in paragraph 2 of subsection B

256256 statement provided for in paragraph 2 of
257257 subsection H of this section.
258258 D. 1. An individual requesting inclusion on a restricted list
259259 under subsection B of thi s section shall:
260260 a. deliver the completed form in person to a law
261261 enforcement agency, or
262262 b. direct the health care provider of the individual
263263 under Section 4 of this act to electronically deliver
264264 the request of the individual to the Bureau.
265265 2. If the completed form is delivered to the law enforcement
266266 agency, the law enforcement agency:
267267 a. shall verify the identity of the individual before
268268 accepting the form,
269269 b. may not accept a form from someone other than the
270270 individual named on the form, and
271271 c. shall transmit the form electronically to the Bureau.
272272 E. Upon receipt of a verified form provided under this section
273273 or pursuant to the provisions of Section 4 of this act requesting
274274 inclusion on a restricted list, the Bureau shall, within twenty -four
275275 (24) hours, add the name of the individual to the restricted list
276276 and submit the name of the individual to the National Instant
277277 Criminal Background Check System (NICS).

304304 F. 1. For an individual added to the restricted list described
305305 in paragraph 1 of subsection B o f this section:
306306 a. the individual may not request removal from the
307307 restricted list unless the individual has been on the
308308 restricted list for at least thirty (30) days,
309309 b. the Bureau shall remove the individual from the
310310 restricted list one hundred eighty (1 80) days after
311311 the day on which the individual was added to the
312312 restricted list, unless the individual:
313313 (1) requests to be removed from the restricted list
314314 after thirty (30) days;
315315 (2) requests to remain on the restricted list, or
316316 (3) directs the health ca re provider of the
317317 individual to request that he or she remain on
318318 the restricted list,
319319 c. a request for an extension shall be made in the same
320320 manner as the original request, and
321321 d. the individual may continue to request, or direct the
322322 health care provider of the individual to continue to
323323 request, extensions every one hundred eighty (180)
324324 days.
325325 2. For an individual added to a restricted list described in
326326 paragraph 2 of subsection B of this section, the individual:

353353 a. may not request removal from the restri cted list
354354 unless the individual has been on the restricted list
355355 for at least ninety (90) days, and
356356 b. shall remain on the restricted list, unless the Bureau
357357 receives a request from the individual to have his or
358358 her name removed from the restricted list.
359359 G. If an individual restricted under this section is licensed
360360 to carry a handgun pursuant to the provisions of the Oklahoma Self -
361361 Defense Act, the handgun license of the individual shall be:
362362 1. Suspended upon entry on the restricted list; and
363363 2. Reinstated upon removal from the restricted list, unless the
364364 permit has been revoked, be en suspended for a reason other than
365365 under the provisions of this section, or has expired.
366366 H. 1. The form for an individual seeking to be placed on the
367367 restricted list describe d in paragraph 1 of subsection B of this
368368 section shall have the following language prominently displayed
369369 before the signature:
370370 "ACKNOWLEDGMENT
371371 By presenting this completed form to a law enforcement agency, I
372372 understand that I am requesting that my name be placed on a
373373 restricted list that restricts my ability to purchase or possess
374374 firearms for a minimum of thirty (30) days, and up to six (6)
375375 months. I understand that by voluntarily making myself a
376376 temporarily restricted person, I may not have a firearm in my
377377

403403 possession and any attempt to purchase a firearm while I am on the
404404 restricted list will be declined. I also understand that any time
405405 after thirty (30) days, I may request removal from the restricted
406406 list and all previous rights will be restored. In ad dition, if I am
407407 in possession of a valid handgun license, my handgun license w ill be
408408 suspended during the time I am on the restricted list, but will be
409409 reinstated upon my removal, unless the permit has expired, been
410410 revoked, been suspended for another reas on, or I become ineligible
411411 to possess a firearm . Additionally, I acknowledge that if I possess
412412 a firearm or attempt to purchase a firearm while outside the State
413413 of Oklahoma, I will be subject to the law of that location regarding
414414 restricted persons."
415415 2. The form for an individual seeking to be placed on the
416416 restricted list descri bed in paragraph 2 of subsection B of this
417417 section shall have the following language prominently displayed
418418 before the signature:
419419 "ACKNOWLEDGMENT
420420 By presenting this completed form to a law enforcement agency, I
421421 understand that I am requesting that my name be placed on a
422422 restricted list that restricts my ability to purchase or possess
423423 firearms indefinitely. I understand that by voluntarily making
424424 myself a temporarily restricted per son, I may not have a firearm in
425425 my possession and any attempt to purchase a f irearm while I am on
426426 the restricted list will be declined. I also understand that any

453453 time after ninety (90) days, I may request removal from the
454454 restricted list and all previou s rights will be restored. In
455455 addition, if I am in possession of a valid handgun license, my
456456 handgun license will be suspended during the time I am on the
457457 restricted list, but will be reinstated upon my removal, unless the
458458 permit has expired, been revoked , been suspended for another reason,
459459 or I become ineligible to possess a firea rm. Additionally, I
460460 acknowledge that if I possess a firearm or attempt to purchase a
461461 firearm while outside the State of Oklahoma , I will be subject to
462462 the law of that location r egarding restricted persons. "
463463 I. 1. An individual requesting removal from a restricted list
464464 shall deliver a completed removal form in person to:
465465 a. the law enforcement agency that processed the
466466 inclusion form if the individual was placed on the
467467 restricted list pursuant to subparagraph a of
468468 paragraph 1 of subsection D of this section, or
469469 b. the local law enforcement agency of the individual if
470470 the individual was placed on the restricted list
471471 pursuant to subparagraph b of paragraph 1 of
472472 subsection D of this section.
473473 2. The law enforcement agency described in paragraph 1 of this
474474 subsection:
475475 a. shall verify the identity of the individual before
476476 accepting the form,

503503 b. may not accept a removal form from someone other than
504504 the individual named on the form , and
505505 c. shall transmit the removal form electronically to the
506506 Bureau.
507507 J. Upon receipt of a verified removal form, the Bureau shall,
508508 after three (3) business days, remove the individual from the
509509 restricted list and remove the information from the National Insta nt
510510 Criminal Background Check System (NICS).
511511 K. For an individual added to the restricted list under
512512 paragraph 1 of subsection B of this section, within thirty (30) days
513513 before the 180-day removal deadline, the Bureau shall notify the
514514 individual at the add ress listed on the inclusion form and, if
515515 applicable, the law enforcement agen cy that processed the inclusion
516516 form, that the individual is due to be removed from the restricted
517517 list, and the date on which the removal will occur, unless the
518518 individual requests an extension of up to one hundred eighty (180)
519519 days.
520520 L. 1. A law enforcement agency that receives a request for
521521 inclusion shall:
522522 a. maintain the completed form and all subsequent
523523 completed forms in a separate file , and
524524 b. for an individual added to t he restricted list under
525525 paragraph 1 of subsection B of this section, destroy
526526 the entire file within five (5) days after the date

554554 not request an extension after notification in
555555 accordance with subsection K of this section.
556556 2. A law enforcement agency that receives a removal request
557557 under subsection I of this section shall destroy the entire file
558558 associated with the individual within five (5) days after the date
559559 on which the information is transmitted to the Bureau.
560560 3. Upon removal of an individual from a restricted list, the
561561 Bureau shall destroy all records related to the inclusion and
562562 removal of the individual within five (5) days after the date on
563563 which the individual was removed.
564564 4. All forms and records created in accordance with the
565565 provisions of this section shall be deemed confidential . The
566566 handling of any records maintained by the Bureau shall comply with
567567 all applicable state and federal privacy laws.
568568 M. The Bureau shall be authorized to promul gate policies and
569569 procedures to implement the provisions of this act .
570570 SECTION 4. NEW LAW A new section of law to be codified
571571 in the Oklahoma Statutes as Section 1289.31c of Title 21, unless
572572 there is created a duplication in numberin g, reads as follows:
573573 A. An individual who is seeking inclusion on a restricted list
574574 under Section 3 of this act may direct the health care provider of
575575 the individual to electronically deliver the inclusion request of
576576 the individual described in Section 3 of this act to the Bureau.

603603 B. In addition to the inclusion form described in Section 3 of
604604 this act, the Bureau shall create a form, available by download
605605 through the website of the Bureau, for:
606606 1. An individual who is directing a health care provider to
607607 electronically deliver the inclusion request of the individual and
608608 require, at a minimum, the following information:
609609 a. the signature of the individual,
610610 b. the name of the health care provider of the
611611 individual, and
612612 c. the acknowledgment of the individual of the statement
613613 as provided for in paragraph 1 of subsection D of this
614614 section; and
615615 2. A health care provider who is delivering an inclusion form
616616 for an individual and require, at a minimum, the following
617617 information for the health care provider:
618618 a. the name of the health care provider,
619619 b. the name of the organization of the health care
620620 provider,
621621 c. the license or certification of the health care
622622 provider, including the license or certification
623623 number,
624624 d. the signature of the health care provider, and

652652 statement in paragraph 2 of subsection D of this
653653 section.
654654 C. 1. An individual who is directing a health care provider to
655655 electronically deliver his or her request to be included on a
656656 restricted list shall, in the presence of the health care provider,
657657 complete the forms described in Section 3 of this act and as
658658 provided for in paragraph 1 of subsection B of this section.
659659 2. The health care provider:
660660 a. shall verify the identity of the individual befor e
661661 accepting the forms,
662662 b. shall not accept forms from someone other than the
663663 individual named on the forms,
664664 c. shall complete the form described in paragraph 2 of
665665 subsection B of this section, and
666666 d. shall deliver the request to the Bureau electronically
667667 and maintain a copy of the completed request in the
668668 health record of the individual.
669669 D. 1. The form described in paragraph 1 of subsection B of
670670 this section shall have the following language prominently displayed
671671 before the signature:
672672 "ACKNOWLEDGMENT
673673 By presenting this completed form to my health care provider, I
674674 understand that I am requesting that my health care provider present

704704 2. The form described in paragraph 2 of subsection B of this
705705 section shall have the following language prominently displayed
706706 before the signature:
707707 "ACKNOWLEDGMENT
708708 By presenting this completed form to the Oklahoma State Bureau
709709 of Investigation, I understand that I am acknowledging that I have
710710 verified the identity of [name of individual seeking inclusion on a
711711 restricted list] and have witnessed [name of individual] sign the
712712 form requesting that [name of individual] be placed on a restri cted
713713 list that restricts the ability of [name of individual] to purchase
714714 or possess firearms. I affirm that [name of individual] is
715715 currently my patient, and I am a licensed health care provider
716716 acting within the scope of my license, certification, practi ce,
717717 education, or training. "
718718 E. The Bureau shall be authorized to promulgate policies and
719719 procedures to implement the provisions of this act.
720720 SECTION 5. This act shall become effective November 1, 2025.
