40	49		An Act relating to schools; providing an option for
41	50		public schools to report the departure of certain
42	51		students; requiring State Department of Education to
43	52		create a reporting portal; requiring portal to be
44	53		available online for public school administrators;
45	54		amending 70 O.S. 2021, Section 35e, which relates to
46	55		school dropout reports; clarifying language;
47	56		excluding certain students from the definition of
48	57		school dropout; providing for codification; providing
49	58		an effective date; and declaring an emergency.

54	63		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
55	64		SECTION 1. NEW LAW A new section of law to be codified
56	65		in the Oklahoma Statutes as Section 24 -162 of Title 70, unless there
57	66		is created a duplication in numbering, reads as follows:
58	67		A. When a student leaves a public school to attend a private or
59	68		other school, or to be educated by other means, the public school
60		-	administrator shall have the opt ion to report the student's
61		-	departure has occurred.
62		-	B. The State Department of Educa tion shall create a portal on
63		-	its website for public school administrators to report the
64		-	departures described in subsection A of this section.

	96	+	administrator shall have the option to report the student's
	97	+	departure has occurred .
	98	+	B. The State Department of Education shall cre ate a portal on
	99	+	its website for public school administrators to report the
	100	+	departures described in subsection A of this section.
91	101		SECTION 2. AMENDATORY 70 O.S. 2021, Section 35e, is
92	102		amended to read as follows:
93	103		Section 35e. A. It shall be the duty of the superintendent,
94	104		principal or head teacher of each public or private middle, junior
95	105		high and high school accredited by the State Department of Education
96	106		in the State of Oklahoma to no tify the Department annually as
97	107		scheduled by the Department of the name, address, race and age of
98	108		any pupil dropping out from the school during the preceding year.
99	109		The report shall be made on forms prescribed and furnished by the
100	110		Department.
101	111		B. The State Board of Education shall cause these statistics of
102	112		school dropouts to be tabulated by grade and school district.
103	113		Information of school dropouts shall be made available to the
104	114		Oklahoma Department of Career and Technology Education, the Bureau
105	115		of Indian Affairs, the Military Department of the State of Ok lahoma
106	116		for use in the youth educational programs provided by the Department
107	117		and the State Department of Health.
108	118		C. The State Department of Education shall make an annual
109	119		report to the Legislature prior to the convening of each regular
110		-	session thereof of information received and tabulated pursuant to
111		-	this section.
112		-	D. For the purposes of this section, "school dropout" means any
113		-	student who is under the age of nineteen (19) and has not graduated
114		-	from high school and is not attending any public or private school

	149	+	D. For the purposes of this section, "school dropout" means any
	150	+	student who is under the age of nineteen (19) and has not graduated
	151	+	from high school and is not attending any public or private sch ool
141	152		or is not otherwise receiving an education pursuant to law for the
142	153		full term the schools of the school district in which the student
143	154		resides are in session. School dropouts shall not include students
144	155		whose departures have been reported in accordance w ith Section 1 of
145	156		this act.
146	157		SECTION 3. This act shall become effective July 1, 2025.
147	158		SECTION 4. It being immediately necessary for the preservation
148	159		of the public peace, healt h or safety, an emergency is hereby
149	160		declared to exist, by reason whereof this act shall take effect and
150	161		be in full force from and after its passage and approval.
