67	68		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
68	69		SECTION 1. AMENDATORY 70 O.S. 2021, Section 6 -190, as
69	70		last amended by Section 1, Chapter 122, O.S.L. 2024 (70 O.S. Supp.

98	98		Section 6-190. A. The board of education of each school
99	99		district shall employ and contract in writing, as required in
100	100		Section 6-101 of this title, only with persons certified to teach by
101	101		the State Board of Education in accordance with the Oklahoma Teacher
102	102		Preparation Act, except as otherwise provided for by Section 6 -101
103	103		of this title and by other law.
104	104		B. The Board shall issue a certificate to teach to any person
105	105		who:
106	106		1. Has successfully completed the teacher education pro gram
107	107		required by the Commission for Educational Quality and
108	108		Accountability;
109	109		2. Has graduated from an accredited institution of higher
110	110		education that has approval or accreditation for teacher education;
111	111		3. Has met all other requirements as may be esta blished by the
112	112		Board;
113	113		4. Has made the necessary application and paid the competency
114	114		examination fee in an amount and as prescribed by the Commission;
115	115		5. Has successfully completed the competency examination
116	116		required in Section 6 -187 of this title; and
117	117		6. Beginning November 1, 2001, has on file with the Board a
118	118		current Oklahoma criminal history record from the Oklahoma State
119	119		Bureau of Investigation as well as a national criminal history
120	120		record check as defined in Section 150.9 of Title 74 of the Oklahoma
121	121		Statutes. Upon receipt of the Oklahoma criminal history record, the

149	148		Board may issue a temporary certificate which sha ll be effective
150	149		until receipt of the national fingerprint -based criminal history
151	150		record. The person applying for a certificate shall be respo nsible
152	151		for the cost of the criminal history records.
153	152		C. The Board shall issue a certificate to teach to any person
154	153		who:
155	154		1. Holds an out-of-state certificate and meets the requirements
156	155		set forth in subsection G of this section;
157	156		2. Holds certification from the National Board for Professional
158	157		Teaching Standards;
159	158		3. Holds an out-of-country certificate and meets the
160	159		requirements set forth in subsection F of this section; or
161	160		4. Has successfully completed a competency examination used in
162	161		the majority of other states or comparable customized exam and meets
163	162		the requirements set forth in subsection H of this section.
164	163		D. Beginning July 1, 2004, any person applying for initial
165	164		Oklahoma certification shall have on file with the Board a current
166	165		Oklahoma criminal history record from the Oklahoma State Bureau of
167	166		Investigation as well as a national criminal history record check as
168	167		defined in Section 150.9 of Title 74 of the Oklahoma Statutes. Upon
169	168		receipt of the Oklahoma criminal history record, the Board may issue
170	169		a temporary certificate which shall be effective until receipt of
171	170		the national fingerprint -based criminal history record. The person

200	198		criminal history records.
201	199		E. Any person holding a va lid certificate, issued prior to
202	200		January 1, 1997, shall be a certified teacher for purposes of the
203	201		Oklahoma Teacher Preparation Act, subject to any professional
204	202		development requirements prescribed by the Oklahoma Teacher
205	203		Preparation Act or by the State Board o f Education.
206	204		F. 1. The Board shall issue a certificate to teach to a person
207	205		who holds a valid out -of-country certificate and meets any
208	206		requirements established by the Board. The certificate to teach
209	207		shall only be for those subject areas and grade le vels most closely
210	208		aligned to the subject areas and grade levels recognized on the out -
211	209		of-country certificate.
212	210		2. A person who meets the requirements of paragraph 1 of this
213	211		subsection shall not be required to take any competency examinations
214	212		in those subject areas and grade levels most closely aligned to the
215	213		subject areas and grade levels recognized on the out -of-country
216	214		certificate.
217	215		3. A person who meets the requirements of paragraph 1 of this
218	216		subsection shall have on file with the Board a current Oklahom a
219	217		criminal history record check from the Oklahoma State Bureau of
220	218		Investigation as well as a national criminal history record check as
221	219		defined in Section 150.9 of Title 74 of the Oklahoma Statutes. Upon
222	220		receipt of the Oklahoma criminal history record check, t he Board may

254	251		4. The Board shall promulgate rules establishing a process by
255	252		which out-of-country certificates will be review ed and evaluated for
256	253		purposes of awarding a certificate to teach pursuant to this
257	254		subsection.
258	255		G. 1. The Board shall issue a certificate to t each to a person
259	256		who holds a valid out -of-state certificate. The certificate to
260	257		teach shall only be for those subject areas and grade levels most
261	258		closely aligned to the subject areas and grade levels recognized on
262	259		the out-of-state certificate.
263	260		2. A person who meets the requirements of paragraph 1 of this
264	261		subsection shall not be required to take any competency examin ations
265	262		in those subject areas and grade levels most closely aligned to the
266	263		subject areas and grade levels recognized on the out -of-state
267	264		certificate.
268	265		3. A person who meets the requirements of this subsection shall
269	266		have on file with the Board a current Oklahoma criminal history

271	268		as a national criminal history record check as defined in Section
272	269		150.9 of Title 74 of the Oklahoma Statutes. Upon receipt of the
273	270		Oklahoma criminal history record check, the Board may issue a

302	298		national fingerprint -based criminal history r ecord check. The
303	299		person applying for a certificate shall be responsible for the cost
304	300		of the criminal history record checks.
305	301		H. 1. The Board shall issue a certificate to teach to a person
306	302		who has successfully completed a competency exam used in a maj ority
307	303		of the other states. The certificate to teach shall only be for
308	304		those subject areas and grade levels that corre spond with a
309	305		certification area used in Oklahoma.
310	306		2. A person who meets the requirements of paragraph 1 of this
311	307		subsection shall have on file with the Board a current Oklahoma
312	308		criminal history record check from the Oklahoma State Bureau of
313	309		Investigation as well as a national criminal history record check as
314	310		defined in Section 150.9 of Title 74 of the Oklahoma Statutes. Upon
315	311		receipt of the Oklahoma criminal history record check, the Board may
316	312		issue a temporary certificate which shall be effective until rec eipt
317	313		of the national fingerprint -based criminal history record check.
318	314		The person applying for a certificate shall be responsible for the
319	315		cost of the criminal history record checks.
320	316		I. 1. The Board may establish new levels of teacher
321	317		certificates: advanced, lead, and master. Each level shall have a
322	318		salary increase requirement stipend paid with state dollars from the
323	319		lottery funds as prov ided in Section 713 of Title 3A of the Oklahoma
324	320		Statutes. The advanced certificate shall include a salary increase

352	347		stipend of Three Thousand Dollars ($3,000.00), the lead certificate
353	348		shall include a salary increase stipend of Five Thousand Dollars
354	349		($5,000.00), and the master certificate shall include a salary
355	350		increase stipend of Ten Thousand Dollars ($10,000.00).
356	351		2. A teacher who works in a school with an enrollment of forty
357	352		percent (40%) or more of students who are economically disadvantaged
358	353		as defined in Section 18-109.5 of this title or a school district
359	354		with an enrollment of fewer than one thousand students shall be paid
360	355		a one-time award in addition to the salary increases stipends
361	356		provided in paragraph 1 of this subsection:
362	357		a. One Thousand Five Hundred Do llars ($1,500.00) for an
363	358		advanced certificate,
364	359		b. Two Thousand Five Hundred Dollars ($2,500.00) for a
365	360		lead certificate, and
366	361		c. Five Thousand Dollars ($5,000.00) for a master
367	362		certificate.
368	363		3. School districts may identify and designate the highest
369	364		quality teachers for advanced, lead, and master certificates.
370	365		Participating districts shall submit designation plans to th e State
371	366		Department of Education for evaluation and approval. Districts
372	367		shall have local control and flexibility in determining how to
373	368		evaluate teachers and assign designations, but, at a minimum, the
374	369		designation system shall include a teacher observation, out -of-
375	370		classroom time, and a student performance component.

403	397		a. Teacher observation shall be based on the district ’s
404	398		selected Oklahoma Tea cher and Leader Effectiveness
405	399		Evaluation System (TLE) evaluation tool or an
406	400		alternate method of evaluation; provided, the method
407	401		is evidenced-based. Alternate methods of evaluation
408	402		shall not replace the requirements of Section 6 -101.16
409	403		of this title.
410	404		b. Each school district that elects to participate in
411	405		assigning advanced, lead, and master teacher
412	406		certificates shall include an out -of-classroom
413	407		component for its assigned teachers to allow for
414	408		professional growth opportunities while staying in the
415	409		classroom. How out-of-classroom time is allotted and
416	410		managed shall be determined by the school district and
417	411		submitted as part of its designation plan to the State
418	412		Department of Education for review and approval.
419	413		c. Student performance measures may be determined by the
420	414		district and may include, but shall not be limited to,
421	415		pre- and post-tests, summative or formative, and
422	416		portfolios. The school district application shall
423	417		show evidence of validity and reliability of the
424	418		measures.
425	419		d. No more than ten percent (10%) of e ach school
426	420		district’s teachers may be designated as advanced,

455	448		Districts which receive Title I funds within the top
456	449		quartile of individual student allotment amounts may
457	450		designate an additional ten percent (10% ) of teachers
458	451		who are employed at school sites which receive the
459	452		Title I funds as advanced, lead, or master teacher s.
460	453		Districts may use additional factors in determining which
461	454		teachers are eligible to receive a designation, such as student
462	455		surveys, teacher leadership responsibilities, teacher mentorship
463	456		responsibilities, family surveys, demonstration of district core
464	457		values, teacher peer surveys, and contributions to the broader
465	458		school community. No more than ten percent (10%) of each school
466	459		district’s teachers may be designated as an advanced, lead, or
467	460		master teacher in any given school year.
468	461		4. If a school district c hooses to participate in this program,
469	462		the state shall provide the increased salary stipend amounts
470	463		indicated for advanced, lead, and master certificates in paragraph 1
471	464		of this subsection above the base pay.
472	465		5. School districts that designate teachers f or advanced, lead,
473	466		and master certificates do not have to participate in annual TLE
474	467		evaluations for the designated teachers.
475	468		6. School districts may designate teachers for advanced, lead,
476	469		or master certificates two times per year, once prior to the
477	470		beginning of the school year, and once prior to the beginning of the

505	497		second semester. Teachers statewide who receive these designations
506	498		shall be placed in professional development cohorts and provided
507	499		additional training opportunities from the State Department of
508	500		Education.
509	501		7. After initial approval by the State Department of Education,
510	502		the Department shall review and validate each participating sch ool
511	503		district’s teacher evaluation system biennially.
512	504		8. The State Department of Education shall annually report the
513	505		school districts participating in the program, the number of
514	506		advanced, lead, and master certificates awarded, and the total
515	507		amount in state funding that was distributed to teachers from the
516	508		Teacher Empowerment Revolving Fund created in Section 6 -190.2 of
517	509		this title.
518	510		9. The selection criteria; designation of advanced, lead, or
519	511		master teachers; and any associated salary increases stipend amounts
520	512		shall not be subject to collective bargaining.
521	513		10. Stipends provided pursuant to this subsection shall not be
522	514		included in the calculation of the teacher ’s salary for purposes of
523	515		meeting the district or statutory minimum salary schedule or for
524	516		purposes of calculating Teachers ’ Retirement System of Oklahoma
525	517		contributions or benefits.
526	518		J. The State Board of Education shall adopt rules to implement
527	519		a renewal schedule and associated fees for advanced, lead, and
528	520		master teaching certificates. The rules shall allow a teacher that

558	549		certificate.
559	550		K. The terms of the contracts issued to those holding advanced,
560	551		lead, and master teaching certificates shall include the following:
561	552		1. Advanced: an additional five (5) days to be used to
562	553		strengthen instructional leadership. A person with an advanced
563	554		teaching certificate shall receive an annual salary increase stipend
564	555		of Three Thousand Dolla rs ($3,000.00) or the district ’s daily rate
565	556		of pay, whichever is higher, in addition to the salary for which the
566	557		teacher qualifies pursuant to Section 18 -114.15 of this title. This
567	558		increase stipend shall be funded by state dollars from the lottery
568	559		funds as provided in Section 713 of Title 3A of the Oklahoma
569	560		Statutes and shall be paid as regular annual compensation directly
570	561		to teachers through school districts;
571	562		2. Lead: an additional ten (10) days to be used to strengthen
572	563		instructional leadership. A pers on with a lead teaching certificate
573	564		shall receive an annual salary increase stipend of Five Thousand
574	565		Dollars ($5,000.00) or the district ’s daily rate of pay, whichever
575	566		is higher, in addition to the salary for which the teacher qualifies
576	567		pursuant to Section 18-114.15 of this title. This increase stipend
577	568		shall be funded by state dollars from the lottery funds as provid ed
578	569		in Section 713 of Title 3A of the Oklahoma Statutes and shall be

608	598		3. Master: an additional fifteen (15) days to be used to
609	599		strengthen leadership. A person with a mast er teaching certificate
610	600		shall receive an annual salary increase stipend of Ten Thousand
611	601		Dollars ($10,000.00) or the district ’s daily rate of pay, whichever
612	602		is higher, in addition to the salary for which the teacher qualifies
613	603		pursuant to Section 18 -114.15 of this title. This increase stipend
614	604		shall be funded by state dollars from the lottery funds as provided
615	605		in Section 713 of Title 3A of the O klahoma Statutes and shall be
616	606		paid as regular annual compensation directly to teachers through
617	607		school districts.
618	608		If a person with an advanced, lead, or master teaching
619	609		certificate changes school districts during the life of the
620	610		certificate, the terms of th e contracts required in this subsection
621	611		shall be subject to approval by the new employing school district.
622	612		L. Beginning in the 2022-2023 school year, the Department shall
623	613		make the teaching certificates provided for in this section
624	614		available for any person who has received a recommendation from his
625	615		or her school district and who meets the eligibility criteria as
626	616		outlined in each school district ’s teacher evaluation system
627	617		provided for in subsection I of this section.
628	618		M. The funding necessary for the admini stration of this section
629	619		shall be provided from the Teacher Empowerment Revolving Fund

658	647		administration of the teaching certificates listed in subsection I
659	648		is not available, the Department shall n ot be required to fulfill
660	649		the requirements listed in subsections I, K, and L of this section.
661	650		N. The State Board of Education shall promulgate rules to
662	651		implement the provisions of Section 6 -180 et seq. of this title.
663	652		SECTION 2. AMENDATORY Section 2, Chapter 359, O.S.L.
664	653		2022, as amended by Section 2, Chapter 122, O.S.L. 2024 (70 O.S.
665	654		Supp. 2024, Section 6-190.2), is amended to read as follows:
666	655		Section 6-190.2. A. There is hereby created in the State
667	656		Treasury a revolving fund for the State Department of Education to
668	657		be designated the “Teacher Empowerment Revolving Fund ”. The
669	658		revolving fund shall be a continuing fund, without legislative
670	659		appropriation, not subject to fiscal year limitations, and shall be
671	660		under the control and manag ement of the State Department of
672	661		Education. Expenditures from the Teacher Empowerment Revolving Fund
673	662		shall be budgeted and expended as provided for in subsection B of
674	663		this section.
