6768 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6869 SECTION 1. AMENDATORY 70 O.S. 2021, Section 6 -190, as
6970 last amended by Section 1, Chapter 122, O.S.L. 2024 (70 O.S. Supp.

9898 Section 6-190. A. The board of education of each school
9999 district shall employ and contract in writing, as required in
100100 Section 6-101 of this title, only with persons certified to teach by
101101 the State Board of Education in accordance with the Oklahoma Teacher
102102 Preparation Act, except as otherwise provided for by Section 6 -101
103103 of this title and by other law.
104104 B. The Board shall issue a certificate to teach to any person
105105 who:
106106 1. Has successfully completed the teacher education pro gram
107107 required by the Commission for Educational Quality and
108108 Accountability;
109109 2. Has graduated from an accredited institution of higher
110110 education that has approval or accreditation for teacher education;
111111 3. Has met all other requirements as may be esta blished by the
112112 Board;
113113 4. Has made the necessary application and paid the competency
114114 examination fee in an amount and as prescribed by the Commission;
115115 5. Has successfully completed the competency examination
116116 required in Section 6 -187 of this title; and
117117 6. Beginning November 1, 2001, has on file with the Board a
118118 current Oklahoma criminal history record from the Oklahoma State
119119 Bureau of Investigation as well as a national criminal history
120120 record check as defined in Section 150.9 of Title 74 of the Oklahoma
121121 Statutes. Upon receipt of the Oklahoma criminal history record, the

149148 Board may issue a temporary certificate which sha ll be effective
150149 until receipt of the national fingerprint -based criminal history
151150 record. The person applying for a certificate shall be respo nsible
152151 for the cost of the criminal history records.
153152 C. The Board shall issue a certificate to teach to any person
154153 who:
155154 1. Holds an out-of-state certificate and meets the requirements
156155 set forth in subsection G of this section;
157156 2. Holds certification from the National Board for Professional
158157 Teaching Standards;
159158 3. Holds an out-of-country certificate and meets the
160159 requirements set forth in subsection F of this section; or
161160 4. Has successfully completed a competency examination used in
162161 the majority of other states or comparable customized exam and meets
163162 the requirements set forth in subsection H of this section.
164163 D. Beginning July 1, 2004, any person applying for initial
165164 Oklahoma certification shall have on file with the Board a current
166165 Oklahoma criminal history record from the Oklahoma State Bureau of
167166 Investigation as well as a national criminal history record check as
168167 defined in Section 150.9 of Title 74 of the Oklahoma Statutes. Upon
169168 receipt of the Oklahoma criminal history record, the Board may issue
170169 a temporary certificate which shall be effective until receipt of
171170 the national fingerprint -based criminal history record. The person

201199 E. Any person holding a va lid certificate, issued prior to
202200 January 1, 1997, shall be a certified teacher for purposes of the
203201 Oklahoma Teacher Preparation Act, subject to any professional
204202 development requirements prescribed by the Oklahoma Teacher
205203 Preparation Act or by the State Board o f Education.
206204 F. 1. The Board shall issue a certificate to teach to a person
207205 who holds a valid out -of-country certificate and meets any
208206 requirements established by the Board. The certificate to teach
209207 shall only be for those subject areas and grade le vels most closely
210208 aligned to the subject areas and grade levels recognized on the out -
211209 of-country certificate.
212210 2. A person who meets the requirements of paragraph 1 of this
213211 subsection shall not be required to take any competency examinations
214212 in those subject areas and grade levels most closely aligned to the
215213 subject areas and grade levels recognized on the out -of-country
216214 certificate.
217215 3. A person who meets the requirements of paragraph 1 of this
218216 subsection shall have on file with the Board a current Oklahom a
219217 criminal history record check from the Oklahoma State Bureau of
220218 Investigation as well as a national criminal history record check as
221219 defined in Section 150.9 of Title 74 of the Oklahoma Statutes. Upon

254251 4. The Board shall promulgate rules establishing a process by
255252 which out-of-country certificates will be review ed and evaluated for
256253 purposes of awarding a certificate to teach pursuant to this
257254 subsection.
258255 G. 1. The Board shall issue a certificate to t each to a person
259256 who holds a valid out -of-state certificate. The certificate to
260257 teach shall only be for those subject areas and grade levels most
261258 closely aligned to the subject areas and grade levels recognized on
262259 the out-of-state certificate.
263260 2. A person who meets the requirements of paragraph 1 of this

303299 person applying for a certificate shall be responsible for the cost
304300 of the criminal history record checks.
305301 H. 1. The Board shall issue a certificate to teach to a person
306302 who has successfully completed a competency exam used in a maj ority
307303 of the other states. The certificate to teach shall only be for
308304 those subject areas and grade levels that corre spond with a
309305 certification area used in Oklahoma.
310306 2. A person who meets the requirements of paragraph 1 of this
311307 subsection shall have on file with the Board a current Oklahoma
312308 criminal history record check from the Oklahoma State Bureau of
313309 Investigation as well as a national criminal history record check as
314310 defined in Section 150.9 of Title 74 of the Oklahoma Statutes. Upon
315311 receipt of the Oklahoma criminal history record check, the Board may
316312 issue a temporary certificate which shall be effective until rec eipt
317313 of the national fingerprint -based criminal history record check.
318314 The person applying for a certificate shall be responsible for the
319315 cost of the criminal history record checks.
320316 I. 1. The Board may establish new levels of teacher
321317 certificates: advanced, lead, and master. Each level shall have a
322318 salary increase requirement stipend paid with state dollars from the
323319 lottery funds as prov ided in Section 713 of Title 3A of the Oklahoma
324320 Statutes. The advanced certificate shall include a salary increase

352347 stipend of Three Thousand Dollars ($3,000.00), the lead certificate
353348 shall include a salary increase stipend of Five Thousand Dollars
354349 ($5,000.00), and the master certificate shall include a salary
355350 increase stipend of Ten Thousand Dollars ($10,000.00).
356351 2. A teacher who works in a school with an enrollment of forty
357352 percent (40%) or more of students who are economically disadvantaged
358353 as defined in Section 18-109.5 of this title or a school district
359354 with an enrollment of fewer than one thousand students shall be paid
360355 a one-time award in addition to the salary increases stipends
361356 provided in paragraph 1 of this subsection:
362357 a. One Thousand Five Hundred Do llars ($1,500.00) for an
363358 advanced certificate,
364359 b. Two Thousand Five Hundred Dollars ($2,500.00) for a
365360 lead certificate, and
366361 c. Five Thousand Dollars ($5,000.00) for a master
367362 certificate.
368363 3. School districts may identify and designate the highest
369364 quality teachers for advanced, lead, and master certificates.
370365 Participating districts shall submit designation plans to th e State
371366 Department of Education for evaluation and approval. Districts
372367 shall have local control and flexibility in determining how to
373368 evaluate teachers and assign designations, but, at a minimum, the
374369 designation system shall include a teacher observation, out -of-
375370 classroom time, and a student performance component.

403397 a. Teacher observation shall be based on the district ’s
404398 selected Oklahoma Tea cher and Leader Effectiveness
405399 Evaluation System (TLE) evaluation tool or an
406400 alternate method of evaluation; provided, the method
407401 is evidenced-based. Alternate methods of evaluation
408402 shall not replace the requirements of Section 6 -101.16
409403 of this title.
410404 b. Each school district that elects to participate in
411405 assigning advanced, lead, and master teacher
412406 certificates shall include an out -of-classroom
413407 component for its assigned teachers to allow for
414408 professional growth opportunities while staying in the
415409 classroom. How out-of-classroom time is allotted and
416410 managed shall be determined by the school district and
417411 submitted as part of its designation plan to the State
418412 Department of Education for review and approval.
419413 c. Student performance measures may be determined by the
420414 district and may include, but shall not be limited to,
421415 pre- and post-tests, summative or formative, and
422416 portfolios. The school district application shall
423417 show evidence of validity and reliability of the
424418 measures.
425419 d. No more than ten percent (10%) of e ach school
426420 district’s teachers may be designated as advanced,

455448 Districts which receive Title I funds within the top
456449 quartile of individual student allotment amounts may
457450 designate an additional ten percent (10% ) of teachers
458451 who are employed at school sites which receive the
459452 Title I funds as advanced, lead, or master teacher s.
460453 Districts may use additional factors in determining which
461454 teachers are eligible to receive a designation, such as student
462455 surveys, teacher leadership responsibilities, teacher mentorship
463456 responsibilities, family surveys, demonstration of district core
464457 values, teacher peer surveys, and contributions to the broader
465458 school community. No more than ten percent (10%) of each school
466459 district’s teachers may be designated as an advanced, lead, or
467460 master teacher in any given school year.
468461 4. If a school district c hooses to participate in this program,
469462 the state shall provide the increased salary stipend amounts
470463 indicated for advanced, lead, and master certificates in paragraph 1
471464 of this subsection above the base pay.
472465 5. School districts that designate teachers f or advanced, lead,
473466 and master certificates do not have to participate in annual TLE
474467 evaluations for the designated teachers.
475468 6. School districts may designate teachers for advanced, lead,
476469 or master certificates two times per year, once prior to the
477470 beginning of the school year, and once prior to the beginning of the

505497 second semester. Teachers statewide who receive these designations
506498 shall be placed in professional development cohorts and provided
507499 additional training opportunities from the State Department of
508500 Education.
509501 7. After initial approval by the State Department of Education,
510502 the Department shall review and validate each participating sch ool
511503 district’s teacher evaluation system biennially.
512504 8. The State Department of Education shall annually report the
513505 school districts participating in the program, the number of
514506 advanced, lead, and master certificates awarded, and the total
515507 amount in state funding that was distributed to teachers from the
516508 Teacher Empowerment Revolving Fund created in Section 6 -190.2 of
517509 this title.
518510 9. The selection criteria; designation of advanced, lead, or
519511 master teachers; and any associated salary increases stipend amounts
520512 shall not be subject to collective bargaining.
521513 10. Stipends provided pursuant to this subsection shall not be
522514 included in the calculation of the teacher ’s salary for purposes of
523515 meeting the district or statutory minimum salary schedule or for
524516 purposes of calculating Teachers ’ Retirement System of Oklahoma
525517 contributions or benefits.
526518 J. The State Board of Education shall adopt rules to implement
527519 a renewal schedule and associated fees for advanced, lead, and
528520 master teaching certificates. The rules shall allow a teacher that

557548 teaching certificate to make a pplication for the standard teaching
558549 certificate.
559550 K. The terms of the contracts issued to those holding advanced,
560551 lead, and master teaching certificates shall include the following:
561552 1. Advanced: an additional five (5) days to be used to
562553 strengthen instructional leadership. A person with an advanced
563554 teaching certificate shall receive an annual salary increase stipend
564555 of Three Thousand Dolla rs ($3,000.00) or the district ’s daily rate
565556 of pay, whichever is higher, in addition to the salary for which the
566557 teacher qualifies pursuant to Section 18 -114.15 of this title. This
567558 increase stipend shall be funded by state dollars from the lottery
568559 funds as provided in Section 713 of Title 3A of the Oklahoma
569560 Statutes and shall be paid as regular annual compensation directly
570561 to teachers through school districts;
571562 2. Lead: an additional ten (10) days to be used to strengthen
572563 instructional leadership. A pers on with a lead teaching certificate
573564 shall receive an annual salary increase stipend of Five Thousand
574565 Dollars ($5,000.00) or the district ’s daily rate of pay, whichever
575566 is higher, in addition to the salary for which the teacher qualifies
576567 pursuant to Section 18-114.15 of this title. This increase stipend
577568 shall be funded by state dollars from the lottery funds as provid ed
578569 in Section 713 of Title 3A of the Oklahoma Statutes and shall be

608598 3. Master: an additional fifteen (15) days to be used to
609599 strengthen leadership. A person with a mast er teaching certificate
610600 shall receive an annual salary increase stipend of Ten Thousand
611601 Dollars ($10,000.00) or the district ’s daily rate of pay, whichever
612602 is higher, in addition to the salary for which the teacher qualifies
613603 pursuant to Section 18 -114.15 of this title. This increase stipend
614604 shall be funded by state dollars from the lottery funds as provided
615605 in Section 713 of Title 3A of the O klahoma Statutes and shall be
616606 paid as regular annual compensation directly to teachers through
617607 school districts.
618608 If a person with an advanced, lead, or master teaching
619609 certificate changes school districts during the life of the
620610 certificate, the terms of th e contracts required in this subsection
621611 shall be subject to approval by the new employing school district.
622612 L. Beginning in the 2022-2023 school year, the Department shall
623613 make the teaching certificates provided for in this section
624614 available for any person who has received a recommendation from his
625615 or her school district and who meets the eligibility criteria as
626616 outlined in each school district ’s teacher evaluation system
627617 provided for in subsection I of this section.
628618 M. The funding necessary for the admini stration of this section
629619 shall be provided from the Teacher Empowerment Revolving Fund

658647 administration of the teaching certificates listed in subsection I
659648 is not available, the Department shall n ot be required to fulfill
660649 the requirements listed in subsections I, K, and L of this section.
661650 N. The State Board of Education shall promulgate rules to
662651 implement the provisions of Section 6 -180 et seq. of this title.
663652 SECTION 2. AMENDATORY Section 2, Chapter 359, O.S.L.
664653 2022, as amended by Section 2, Chapter 122, O.S.L. 2024 (70 O.S.
665654 Supp. 2024, Section 6-190.2), is amended to read as follows:
666655 Section 6-190.2. A. There is hereby created in the State
667656 Treasury a revolving fund for the State Department of Education to
668657 be designated the “Teacher Empowerment Revolving Fund ”. The
669658 revolving fund shall be a continuing fund, without legislative
670659 appropriation, not subject to fiscal year limitations, and shall be
671660 under the control and manag ement of the State Department of
672661 Education. Expenditures from the Teacher Empowerment Revolving Fund
673662 shall be budgeted and expended as provided for in subsection B of
674663 this section.
675664 B. The State Department of Education shall utilize the funds
676665 for the program outlined in Section 6 -190 of this title. Funding
677666 shall be allocated to school districts to provide the increased
678667 salary stipend amounts indicated for advanced, lead, and master
679668 certificates as provided for in subsection I of Section 6 -190 of

710698 SECTION 4. It being immediately necessary for the preservation
711699 of the public peace, health, or safety, an emergency is hereby
