4338 An Act relating to motor vehicles; amending 47 O.S.
4439 2021, Section 1-171.1, which relates to street -legal

4843 updating statutory reference; authorizing use of
4944 certain vehicles on certain U.S. highways; and

5550 BE IT ENACTED BY THE PEOPLE OF T HE STATE OF OKLAHOMA:
5651 SECTION 1. AMENDATORY 47 O.S. 2021, Section 1 -171.1, is
5752 amended to read as follows:
5853 Section 1-171.1. Street-legal utility vehicle.
5954 A. A "street-legal utility vehicle " is any motor vehicle
6055 having:
6156 1. A bench seat or side-by-side seat for the use of each rider;
6257 2. Four wheels in contact with the ground, but excluding a
6358 tractor;
6459 3. A combustion engine with a piston or rotor displacement of
6560 four hundred cubic centimeters ( 400 cc) or greater and capable of
61+maintaining speeds of forty-five (45) fifty (50) miles per hour or
62+greater;

93-maintaining speeds of forty-five (45) fifty (50) miles per hour or
94-greater;
9589 4. For each occupant, safety belts or safety shoulder harnesses
9690 which shall be of a type and shall be installed pursuant to 49
9791 C.F.R., Section 571.208 et seq.; and
9892 5. All equipment required by the provisions of Sections 12 -201
9993 through 12-232 of Title 47 of the Oklahoma Statutes this title, with
10094 respect to equipment on vehicles.
10195 B. A street-legal utility vehicle operated on the streets and
10296 highways of this state shall be registered a s a motor vehicle.
10397 C. The operator of a street -legal utility vehicle shall not be
10498 required to have an "M" endorsement on the Class D license pursuant
10599 to Section 6-110.1 of Title 47 of the Oklahoma Statutes this title.
106100 The operator shall be at least sixte en (16) years of age and hold a
107101 valid Oklahoma driver license.
108102 SECTION 2. AMENDATORY 47 O.S. 2021, Section 11 -1116, is
109103 amended to read as follows:
110104 Section 11-1116. A. The self-propelled or motor-driven and
111105 operated vehicles desc ribed in this section shall be prohibited from
112106 operating or shall be limited in operation on the streets and
113107 highways of this state.
114108 B. Self-propelled or motor-driven cycles, known and commonly
115109 referred to as "minibikes" and other similar trade names, sha ll be
110+prohibited from operating on the streets and highways of this state,
111+except:
112+1. When used in a parade; or

143-prohibited from operating on the streets and highways of this state,
144-except:
145-1. When used in a parade; or
146139 2. When registered, as required by subsection E of Section 1151
147140 of this title, and operated in this state by food vendor services
148141 upon streets having a speed limit of thirty (30) miles per hour or
149142 less.
150143 All minibikes offered for sale in this state shall bear the
151144 following notice to the customer: "This machine is not manufactured
152145 or sold for operation on the public streets or highways. Since it
153146 is not provided with equipment required by law for street or highway
154147 use, all persons are cautioned that any operation of this vehicle
155148 upon a public street or highway will be in violation of the motor
156149 vehicle laws of this state and will subject the violato r to arrest."
157150 C. Golf carts and utility vehicles, as defined by Section 1102
158151 of this title, shall not be operated on the streets and highways of
159152 this state except:
160153 1. Golf carts or utility vehicles owned by the Oklahoma Tourism
161154 and Recreation Department, and operated by employees or agents of
162155 the Department or employees of independent management companies
163156 working on behalf of the Department, may be operated on the streets
164157 and highways of this state during daylight hour s or under rules
165158 developed by the Okl ahoma Tourism and Recreation Commission, when
166159 the streets and highways are located within the boundaries of a
160+state park. The Department shall have warning signs placed at the
161+entrance and other locations at those state parks allowing golf
162+carts or utility vehicles to be operated on the streets and highways

194-state park. The Department shall have warning signs placed at the
195-entrance and other locations at those state parks allowing golf
196-carts or utility vehicles to be operated on the streets and highways
197189 of this state located within the boundaries of those state parks.
198190 The warning signs shall state that golf carts and utility vehicles
199191 may be operating on streets and highways and that motor vehicle
200192 operators shall take special precautions to be alert for the
201193 presence of golf carts or utility vehicles on the streets and
202194 highways;
203195 2. The municipal governing body has adopted an ordinance
204-governing the operatio n of golf carts and/or or utility vehicles on
196+governing the operation of golf carts and/or utility vehicles on
205197 city streets; provided, such ordinances shall include necessary
206198 vehicle lighting and safety requirements;
207199 3. Golf carts or utility vehicles may operate on state highways
208200 only if making a perpendicular crossing of a state h ighway located
209201 within the boundaries of a municipality which has adopted an
210-ordinance governing the operation of golf carts and/or or utility
202+ordinance governing the operation of golf carts and/or utility
211203 vehicles;
212204 4. The board of county commissioners of a county has approved
213-the operation of golf cart and/or or utility vehicle traffic on
205+the operation of golf cart and/or utility vehicle traffic on
214206 roadways within the county, and:
215207 a. the roadway has a posted speed limit of twenty -five
216208 (25) miles per hour or less,
217209 b. the roadway is located in an unincorporated area, and
210+c. appropriate signage, cautioning motorists of the
211+possibility of golf cart or utility vehicle traffi c,
212+is erected by the board of county commissioners; or

245-c. appropriate signage, cautioning motorists o f the
246-possibility of golf cart or utility vehicle traffic,
247-is erected by the board of county commissioners; or
248239 5. Street-legal utility vehicles that are registered as a motor
249240 vehicle pursuant to subsection B of Section 1 1-171.1 of this act
250241 title may be operated on the streets and highways of this state and
251242 U.S. highways in counties whose population is less than seventy -five
252243 thousand (75,000) according to the latest Federal Decennial Census .
253-Registered street-legal utility vehicles may be operated on
254-stretches of U.S. highways with posted speed limits of fifty (50)
255-miles per hour or less in counties with a population of more than
256-seventy-five thousand (75,000) according to the latest Federal
257-Decennial Census. Provided, however, street -legal utility vehicl es
258-shall not be operated on the National System of Interstate and
259-Defense Highways or U.S. highways.
244+Provided, however, street -legal utility vehicles shall not be
245+operated on the Natio nal System of Interstate and Defense Highways
246+or U.S. highways.
260247 D. All-terrain vehicles shall not be operated on the streets
261248 and highways of this state, except:
262249 1. On unpaved roads which are located within the boundaries of
263250 any property of the Forest Service of the United States Department
264251 of Agriculture;
265252 2. On highways if:
266253 a. the vehicle needs to make a direct crossing of the
267254 highway while the vehicle is traveling upon a
268255 regularly traveled trail and needs to continue travel
256+from one area of the trail to another and, if the
257+vehicle comes to a complete stop, yields the right -of-
258+way to all oncoming traffic that constitutes an
259+immediate hazard, and crosses the highway at an angle
260+of approximately ninety (90) degrees to the direction
261+of the street or highway. This exception shall not
262+apply to divided highways or highways with a posted

296-from one area of the trail to another and, if the
297-vehicle comes to a complete stop, yields the right -of-
298-way to all oncoming traffic that constitutes an
299-immediate hazard, and crosses the highway at an angle
300-of approximately ninety (90) degrees to th e direction
301-of the street or highway. This exception shall not
302-apply to divided highways or highways with a posted
303289 speed limit of more than thirty -five (35) miles per
304290 hour in the area of the crossing,
305291 b. the vehicle needs to travel on a highway in order to
306292 cross a railroad track. In that ev ent, the all-
307293 terrain vehicle may trav el for not more than three
308294 hundred (300) feet on a highway to cross a railroad
309295 track,
310296 c. the operator of the all -terrain vehicle making the
311297 crossing at a highway has a valid driver license, and
312298 d. the operator of the vehicle makes a crossing on a
313299 highway during daylight hours only;
314300 3. On streets and highways within a municipality if the
315301 municipal governing body has adopted an ordinance governing the
316302 operation of golf carts, utility vehicles or all -terrain vehicles on
317303 streets and highways within the municip ality; or
318304 4. On roadways within unincorporated areas of a county if those
319305 roadways are not part of the state highway system or the National
306+System of Interstate and Defense Highways; provided, however, that
307+the driver is a licensed driver.
308+E. Mopeds, as defined by Section 1 -133.2 of this title, may be
309+operated on the streets and highways of this state if:
310+1. The municipal governing body has adopted an ordinance
311+governing the operation of mopeds on city streets; provid ed, such

347-System of Interstate and Defense Highways ; provided, however, that

349-E. Mopeds, as defined by Section 1 -133.2 of this title, may be
350-operated on the streets and highways of this state if:
351-1. The municipal governing body has adopted an ordinance
352-governing the operat ion of mopeds on city streets; provided, such
353338 ordinances shall include nec essary vehicle lighting and safety
354339 requirements; or
355340 2. The board of county commissioners of a county has approved
356341 the operation of mopeds on roadways within the county, not including
357342 roadways within a municipality.
358343 SECTION 3. This act shall become effective November 1, 2025.
