15	15	Equalization for K-8 Student Transfers Revolving
16	16	Fund; creating apportionment; stating p urpose of the
17	17	revolving fund; specifying the fund is continuing and
18	18	not subject to fiscal year limitations; providing
19	19	monetary limitations of the fund; stating uses of the
20	20	fund; making expenditures subject to warrants;

22	22	date; and declaring an emergency.

28	28	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
29	29	SECTION 1. NEW LAW A new section of law to be codified
30	30	in the Oklahoma Statutes as Section 8-201 of Title 70, unless there
31	31	is created a duplication in numbering, reads as follows:
32	32	A. There is hereby created in the State Treasury a revolving
33	33	fund for the State Department of Education to be designated the
34	34	"Building Equalization for K -8 Student Transfers Revolving
35	35	Fund"("BEST Fund"). The BEST Fund shall be used to fund the
36	36	building expenses of recei ving districts as defined in Section 8-101
37	37	of this title. The BEST Fund shall be a continuing fund, not
38	38	subject to fiscal year limitation s, and shall consist of all monies Req. No. 10193 Page 2
39	39	received by the State Department of Education as authorized by law ,
40	40	not to exceed Ten Million Dollars ($10,000,000.00) .
41	41	B. All monies accruing to the credit of the fund are hereby
42	42	appropriated and shall be budgeted and distributed by the State
43	43	Department of Education and expended by the receiving districts as
44	44	described in subsection A o f this section. The BEST Fund shall only
45	45	be used by receiving districts for the purpose of erecting,
46	46	remodeling, repairing or maintaining school buildings, for
47	47	purchasing furniture, equipment and computer software to be used on
48	48	or for school district property, for repairing and maintaining
49	49	computer systems and equipment, for paying energy and utility costs,
50	50	for purchasing telecommunications utilities and services, for paying
51	51	fire and casualty insurance premiums for school facilities, for
52	52	purchasing security systems, for paying salaries of security
53	53	personnel, for purchasing school buses, or for one or more, or all,
54	54	of such purposes.
55	55	C. Expenditures from the BEST Fund shall be made upon warrants
56	56	issued by the State Treasurer against claims filed as prescribed by
57	57	law with the Director of the Office of Management and Enterprise
58	58	Services for approval and payment.
59	59	SECTION 2. This act shall become effective July 1, 2025.
60	60	SECTION 3. It being immediately necessary for the preservati on
61	61	of the public peace, health or safety, an emergency is hereby Req. No. 10193 Page 3

63	63	be in full force from and after its passage a nd approval.
