42	42	size; providing language of disclaimer; clarifying
43	43	campaign or election material; creating a fine per
44	44	unique mailer; directing the Oklahoma Ethics
45	45	Commission to enforce this section; providing for
46	46	codification; and providing an effective date.

52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. NEW LAW A new section of law to be codified
54	54	in the Oklahoma Statutes as Section 16 -200 of Title 26, unless there
55	55	is created a duplication in numbering, reads as follows:
56	56	A. Any campaign or election material that is not an official
57	57	government document from a county election board, the State Election
58	58	Board, or a subdivision of this state sent via mail to voters shall
59	59	include a disclaimer. The disclaimer shall clarify, in a minimum of
60	60	size fourteen (14) font, the following:
61	61	"This piece of mail is not an official gov ernment document from
62	62	the State of Oklahoma or any subdivision of this state ."

89	89	For purposes of this section, campaign or election material
90	90	includes mail encouraging voters to app ly for an absentee ballot or
91	91	reminding them of election dates.
92	92	B. Any person or organization that does not include the
93	93	disclaimer described in subsection A of this section shall be
94	94	subject to a one-hundred-dollar fine per mailer campaign, meaning a
95	95	unique mailer sent to multiple addresses. "Per mailer campaign"
96	96	shall not mean individual pieces of mail sent. On the third offense
97	97	of failing to include the disclaimer described in subsection A of
98	98	this section, the fine shall increase to a three-hundred-dollar fine
99	99	per mailer campaign.
100	100	C. The Oklahoma Ethics Commission shall enforce this section
101	101	and be granted rule-making authority to carry out its provisions.
102	102	SECTION 2. This act shall become effective November 1, 2025.
