4040 An Act relating to public health and safety; creating
4141 the Vaccine Mandate Prohibition Act; prohibiting
4242 certain vaccination mandates by covered entities;
4343 prohibiting certain actions by covered entities;
4444 exempting covered entities from liability in certain
4545 civil actions; providing for codification; and
4646 declaring an emergency .

5252 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5353 SECTION 1. NEW LAW A new section of law to be codifie d
5454 in the Oklahoma Statutes as Section 1 -502.5 of Title 63, unless
5555 there is created a duplication in numbering, reads as follows:
5656 A. This act shall be known and may be cited as t he Vaccine
5757 Mandate Prohibition Act.
5858 B. As used in this section, "covered entity" means:
5959 1. A state agency;
6060 2. A political subdivision;
6161 3. Any entity that accepts funds from the state, the federal
6262 government, or a political subdivision from whatever sou rce derived;

8989 4. Any entity that employs individuals who are required by the
9090 state or a political subdivision to have licensure or certification
9191 issued by a state agency;
9292 5. Any hospital licensed by the State Department of Health; or
9393 6. Any private entit y.
9494 C. A covered entity or agent of a covered entity shall not
9595 require the receipt of any vaccine used to prevent infection by any
9696 current or future variant of SARS -CoV-2 or the development of
9797 Coronavirus disease (COVID -19) for any reason including , but not
9898 limited to, as a condition of employment, professional licensure,
9999 educational admittance, certification or degree, admittance to any
100100 place of business or entertainment, or access to any mode of
101101 transportation.
102102 D. A covered entity or agent of a covered e ntity shall not
103103 discriminate against, punish, demote, or isolate any employee of the
104104 covered entity based on whether the employee has received a vaccine
105105 used to prevent infection by any current or future variant of SARS -
106106 CoV-2 or the development of COVID -19.
107107 E. A covered entity or agent of a covered entity shall not be
108108 liable in a civil action claiming an injury from exposure or
109109 potential exposure to any current or future variant of SARS -CoV-2 or
110110 from the development of COVID -19 if the act or omission alleg ed to
111111 violate a duty of care of the covered entity or agent of the covered
112112 entity was in compliance with this section.

139139 SECTION 2. It being immediately necessary for the preservation
140140 of the public peace, health or safety, an emergency is he reby
141141 declared to exist, by reason whereof this act shall take effect and
142142 be in full force from and after its passage and approval.
