40	40	An Act relating to public health and safety; creating
41	41	the Vaccine Mandate Prohibition Act; prohibiting
42	42	certain vaccination mandates by covered entities;
43	43	prohibiting certain actions by covered entities;
44	44	exempting covered entities from liability in certain
45	45	civil actions; providing for codification; and
46	46	declaring an emergency .

52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. NEW LAW A new section of law to be codifie d
54	54	in the Oklahoma Statutes as Section 1 -502.5 of Title 63, unless
55	55	there is created a duplication in numbering, reads as follows:
56	56	A. This act shall be known and may be cited as t he Vaccine
57	57	Mandate Prohibition Act.
58	58	B. As used in this section, "covered entity" means:
59	59	1. A state agency;
60	60	2. A political subdivision;
61	61	3. Any entity that accepts funds from the state, the federal
62	62	government, or a political subdivision from whatever sou rce derived;

89	89	4. Any entity that employs individuals who are required by the
90	90	state or a political subdivision to have licensure or certification
91	91	issued by a state agency;
92	92	5. Any hospital licensed by the State Department of Health; or
93	93	6. Any private entit y.
94	94	C. A covered entity or agent of a covered entity shall not
95	95	require the receipt of any vaccine used to prevent infection by any
96	96	current or future variant of SARS -CoV-2 or the development of
97	97	Coronavirus disease (COVID -19) for any reason including , but not
98	98	limited to, as a condition of employment, professional licensure,
99	99	educational admittance, certification or degree, admittance to any
100	100	place of business or entertainment, or access to any mode of
101	101	transportation.
102	102	D. A covered entity or agent of a covered e ntity shall not
103	103	discriminate against, punish, demote, or isolate any employee of the
104	104	covered entity based on whether the employee has received a vaccine
105	105	used to prevent infection by any current or future variant of SARS -
106	106	CoV-2 or the development of COVID -19.
107	107	E. A covered entity or agent of a covered entity shall not be
108	108	liable in a civil action claiming an injury from exposure or
109	109	potential exposure to any current or future variant of SARS -CoV-2 or
110	110	from the development of COVID -19 if the act or omission alleg ed to
111	111	violate a duty of care of the covered entity or agent of the covered
112	112	entity was in compliance with this section.

139	139	SECTION 2. It being immediately necessary for the preservation
140	140	of the public peace, health or safety, an emergency is he reby
141	141	declared to exist, by reason whereof this act shall take effect and
142	142	be in full force from and after its passage and approval.
