40	40	An Act relating to property; centralized mail
41	41	delivery and centralized mail delivery devices in
42	42	certain circumstances are prohi bited; providing
43	43	exceptions; providing requirements for centralized
44	44	mail delivery devices when installation is allowed;
45	45	providing exemption for zoned historical districts;
46	46	prohibiting local government or municipalities from
47	47	adopting any additional requirem ents pertaining to
48	48	centralized mail delivery or the installation of
49	49	centralized mail delivery devices; providing for
50	50	codification; and providing an effective date.

56	56	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
57	57	SECTION 1. NEW LAW A new section of law to be codified
58	58	in the Oklahoma Statutes as Section 1501 of Title 60, unless there
59	59	is created a duplication in numbering, reads as follows:
60	60	A. Except as provided in this section, centralized mail
61	61	delivery and centraliz ed mail delivery devices in new one and two -
62	62	family dwelling neighborhoods, as well as townhouse neighborhoods,
63	63	are prohibited.
64	64	B. The following are not subject to the restrictions of this
65	65	section:

92	92	1. Any existing neighborhood that has centralized deliver y
93	93	device prior to November 1, 2024;
94	94	2. Any condominium or apartment development;
95	95	3. Any commercial property that does not contain one - and two-
96	96	family dwellings or townhouses;
97	97	4. Any one- or two-family dwelling neighborhood or any
98	98	townhouse neighborhood in which the developer or the majority of the
99	99	residents have elected to instal l centralized mail delivery;
100	100	provided, however, delivery to residents within the neighborhood
101	101	shall not be withheld prior to or in the absence of such an
102	102	election.
103	103	Unless there exists an active owner 's association whereby
104	104	members will vote pursuant to this paragraph, only one resident of
105	105	each dwelling, acting on behalf of any other residents of the
106	106	dwelling, may cast a vote in any election under this paragraph; and
107	107	5. Any installation by the United States Postal Service.
108	108	C. Where installation is not prohi bited under this section or
109	109	any other law, centralized mail delivery devices, not exceeding
110	110	sixty-two (62) inches in height, may be located within any county,
111	111	municipal right-of-way, or easement if doing so allows for the safe,
112	112	convenient accessibility of the centralized mail delivery devices,
113	113	provided that the local or municipal government approves the
114	114	location of each installation within its right -of-way or easement.

141	141	D. Other than the enforcement of zoning requirements in a
142	142	historic district and except a s provided under this section, no
143	143	local government or municipality shall adopt any additional
144	144	requirements by ordinance or regulation pertaining to the
145	145	establishment of centraliz ed mail delivery or the installation of
146	146	centralized mail delivery devices.
147	147	SECTION 2. This act shall become effective November 1, 2025.
