5752 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5853 SECTION 1. AMENDATORY 70 O.S. 2021, Section 17 -113, is
5954 amended to read as follows:
6055 Section 17-113. A. In determining annual increments for
6156 teacher salaries and in computing Founda tion Aid, time spent in
6257 military service during a period of national emergency shall be
6358 counted, not to exceed five (5) years prior to the current year. No
6459 more than five (5) years of such military service shall be used in
6560 determining eligibilit y or benefits under the Teachers ' Retirement
6661 System.
62+B. For purposes of this section, the term "military service"

9993 SECTION 2. AMENDATORY Section 1, Chapter 289, O.S.L.

247-B. 1. When determining the Minimum Salary Schedule, "fringe
248-benefits" shall mean all or part of retirement benefits, excluding
249240 the contributions made pursuant to subsection A of Section 17 -108.1
250241 of Title 70 of the Oklahoma Statutes this title and the flexible
251242 benefit allowance pursuant to Section 26 -105 of Title 70 of the
252243 Oklahoma Statutes this title from the flexible benefit allowance
253244 funds disbursed by the State Board of Education and the State Board
254245 of Career and Technology Education pursuant to Section 26 -104 of
255246 Title 70 of the Oklahoma Statutes this title.
256247 2. If a school district intends to provide retirement benefits
257248 to a teacher such that the teacher 's salary would be less than the
258249 amounts set forth in the minimum salary schedule specified in
259250 subsection A of this section, the district shall be required to
260251 provide written notification to the teacher prior to his or her
261252 employment or, if already employed by the district, no later than
262253 thirty (30) days prior to the date the district elects to provide
263254 retirement benefits such that the teacher 's salary would be less
264255 than the minimum salary schedule.
265256 C. Any of the degrees referred to in this section shall be from
266257 a college recognized by the State Board of Education. The Board
267258 shall accept teaching experience from out -of-state school districts
268259 that are accredited by the State Board of Education or appropriate
269260 state accrediting agency for the districts. The Board shall accept
270261 teaching experience from out -of-country schools that are accredited
262+or otherwise endorsed by the appropriate national or regional
263+accrediting or endorseme nt authority. Out-of-country certification

298-or otherwise endorsed by the appropriate national or regional
299-accrediting or endorsement authority. Out -of-country certification
300290 documentation in a language other than English shall be analyzed by
301291 an educational credential evaluation service in accordance with
302292 industry standards and guidelines and approved by the State
303293 Department of Education. The person seeking to have credit granted
304294 for out-of-country teaching experience shall be responsible for all
305295 costs of the analysis by a credential evaluation service. The Board
306296 shall accept teaching experience from primary and secondary schools
307297 that are operated by the United States Department of Defense or are
308298 affiliated with the United States Department of State.
309299 D. For the purpose of state salary increments and retirement,
310300 no teacher shall be granted credit for more than five (5) years of
311301 active duty in the military service , as defined in Section 17-113 of
312302 this title, or out-of-state or out-of-country teaching experience as
313303 a certified teacher or its equivalent. Nothing in this section
314304 shall prohibit boards of education from crediting more years of
315305 experience on district salary schedules than those allowed for state
316306 purposes.
317307 E. The State Board of Education shall recognize, for purposes
318308 of certification and salary increments, all the years of experience
319309 of a:
320310 1. Certified teacher who teaches in the educational program of
321311 the Department of Corrections, beginning with fiscal year 1981;
312+2. Vocational rehabilitation counselor under the Department of
313+Human Services if the counselor was employed as a certified teacher

349-2. Vocational rehabilitation counselor under the Department of
350-Human Services if the counselor was employed as a certified tea cher
351340 by the State Department of Educa tion when the Division of Vocational
352341 Rehabilitation was transferred from the State Board of Career and
353342 Technology Education or the State Board of Education to the Oklahoma
354343 Public Welfare Commission on July 1, 1968;
355344 3. Vocational rehabilitation c ounselor which were completed
356345 while employed by the Department of Human Services if such counselor
357346 was certified as a teacher or was eligible for certification as a
358347 teacher in Oklahoma;
359348 4. Certified teacher which were completed while employed by the
360349 Child Study Center located at University Hospital, if the teacher
361350 was certified as a teacher in Oklahoma; and
362351 5. Certified school psychologist or psychometrist which were
363352 completed while employed as a doctoral intern, psychological
364353 assistant, or psychologist w ith any agency of the State of Oklahoma
365354 if the experience primarily involved work with persons of school - or
366355 preschool-age and if the person was, at the time the experience was
367356 acquired, certified as, or eligible for certification as, a school
368357 psychologist or psycho metrist.
369358 F. The provisions of this section shall not apply to teachers
370359 who have entered into postretirement employment with a public school
371360 in Oklahoma and are still receiving a monthly retirement benefit.
361+G. If a person employed as certified p ersonnel, as defined in
362+Section 26-103 of Title 70 of the Oklahoma Statutes this title, by a
363+school district during the 2022 -2023 school year was receiving a

399-G. If a person employed as certified p ersonnel, as defined in
400-Section 26-103 of Title 70 of the Oklahoma Statutes this title, by a
401-school district during the 2022 -2023 school year was receiving a
402390 salary above the step level indicated by the State Minimum Salary
403391 Schedule for the 2022 -2023 school year, th e person shall receive a
404392 salary increase amount equal to the amount indicated in subsection A
405393 of this section for the step level indicated for the person,
406394 provided they remain employed by the same district, unless the hours
407395 or the duties of the c ertified personnel are reduced
408396 proportionately.
409397 H. If a school district does not receive Foundation or Salary
410398 Incentive Aid pursuant to Section 18 -200.1 of Title 70 of the
411399 Oklahoma Statutes this title, funds shall be allocated by the State
412400 Board of Education to imp lement the salary increases indicated in
413401 subsection A of this section.
414402 I. Persons employed as classroom instructional employees of
415403 technology center school districts supervised by the State Board of
416404 Career and Technology Education shall receive a salary increase
417405 amount equal to the amount indicated in subsection A of this section
418406 for the step level indicated for the person, provided they remain
419407 employed by the same technology center school district, unless the
420408 hours or the duties of the classroom instructi onal employees are
421409 reduced proportionately.
410+J. Persons employed as correctional teachers or vocational
411+instructors by the Department of Corrections pursuant to Section
412+510.6a of Title 57 of the Oklahoma Statutes or persons employed as
413+teachers by the Office of Juvenile Affairs shall receive a salary

449-J. Persons employed as correctional teachers or vocational
450-instructors by the Department of Corrections pursuant to Section
451-510.6a of Title 57 of the Oklahoma Statutes or per sons employed as
452-teachers by the Office of Juvenile Affairs shall receive a salary
453440 increase amount equal to the amount indicated in subsection A of
454441 this section for the step level indicated for the person, provided
455442 they remain employed by the same Department of Corrections or Office
456443 of Juvenile Affairs facility, unless the hours or the duties of the
457444 correctional teachers, vocational instructors, or teachers are
458445 reduced proportionately.
459446 K. Persons employed as teachers by the State Department of
460447 Rehabilitation Services shall receive a salary increase amount equal
461448 to the amount indicated in subsection A of this section for the step
462449 level indicated for the person, provided they remain employed by the
463450 State Department of Rehabilitation Services, unless the hours or the
464451 duties of the teachers are re duced proportionately.
465452 SECTION 3. This act shall become effective July 1, 2025.
466453 SECTION 4. It being immediately necessary for the preservation
467454 of the public peace, health or safety, an emergency is hereby
468455 declared to exist, by reason whereof this act shall take effect and
469456 be in full force from and after its passage and approval.
