58 | 53 | | SECTION 1. AMENDATORY 70 O.S. 2021, Section 17 -113, is |
---|

60 | 55 | | Section 17-113. A. In determining annual increments for |

61 | 56 | | teacher salaries and in computing Founda tion Aid, time spent in |
---|

258 | 249 | | amounts set forth in the minimum salary schedule specified in |
---|
259 | 250 | | subsection A of this section, the district shall be required to |
---|
260 | 251 | | provide written notification to the teacher prior to his or her |
---|
261 | 252 | | employment or, if already employed by the district, no later than |
---|
262 | 253 | | thirty (30) days prior to the date the district elects to provide |
---|
263 | 254 | | retirement benefits such that the teacher 's salary would be less |
---|
264 | 255 | | than the minimum salary schedule. |
---|
265 | 256 | | C. Any of the degrees referred to in this section shall be from |
---|
266 | 257 | | a college recognized by the State Board of Education. The Board |
---|
267 | 258 | | shall accept teaching experience from out -of-state school districts |
---|
268 | 259 | | that are accredited by the State Board of Education or appropriate |
---|
269 | 260 | | state accrediting agency for the districts. The Board shall accept |
---|
270 | 261 | | teaching experience from out -of-country schools that are accredited |
---|
300 | 290 | | documentation in a language other than English shall be analyzed by |
---|
301 | 291 | | an educational credential evaluation service in accordance with |
---|
302 | 292 | | industry standards and guidelines and approved by the State |
---|
303 | 293 | | Department of Education. The person seeking to have credit granted |
---|
304 | 294 | | for out-of-country teaching experience shall be responsible for all |
---|
305 | 295 | | costs of the analysis by a credential evaluation service. The Board |
---|
306 | 296 | | shall accept teaching experience from primary and secondary schools |
---|
307 | 297 | | that are operated by the United States Department of Defense or are |
---|
308 | 298 | | affiliated with the United States Department of State. |
---|
309 | 299 | | D. For the purpose of state salary increments and retirement, |
---|
310 | 300 | | no teacher shall be granted credit for more than five (5) years of |
---|
311 | 301 | | active duty in the military service , as defined in Section 17-113 of |
---|
312 | 302 | | this title, or out-of-state or out-of-country teaching experience as |
---|
313 | 303 | | a certified teacher or its equivalent. Nothing in this section |
---|
314 | 304 | | shall prohibit boards of education from crediting more years of |
---|
315 | 305 | | experience on district salary schedules than those allowed for state |
---|
316 | 306 | | purposes. |
---|
317 | 307 | | E. The State Board of Education shall recognize, for purposes |
---|
318 | 308 | | of certification and salary increments, all the years of experience |
---|
319 | 309 | | of a: |
---|
320 | 310 | | 1. Certified teacher who teaches in the educational program of |
---|
321 | 311 | | the Department of Corrections, beginning with fiscal year 1981; |
---|
351 | 340 | | by the State Department of Educa tion when the Division of Vocational |
---|
352 | 341 | | Rehabilitation was transferred from the State Board of Career and |
---|
353 | 342 | | Technology Education or the State Board of Education to the Oklahoma |
---|
354 | 343 | | Public Welfare Commission on July 1, 1968; |
---|
355 | 344 | | 3. Vocational rehabilitation c ounselor which were completed |
---|
356 | 345 | | while employed by the Department of Human Services if such counselor |
---|
357 | 346 | | was certified as a teacher or was eligible for certification as a |
---|
358 | 347 | | teacher in Oklahoma; |
---|
359 | 348 | | 4. Certified teacher which were completed while employed by the |
---|
360 | 349 | | Child Study Center located at University Hospital, if the teacher |
---|
361 | 350 | | was certified as a teacher in Oklahoma; and |
---|
362 | 351 | | 5. Certified school psychologist or psychometrist which were |
---|
363 | 352 | | completed while employed as a doctoral intern, psychological |
---|
364 | 353 | | assistant, or psychologist w ith any agency of the State of Oklahoma |
---|
365 | 354 | | if the experience primarily involved work with persons of school - or |
---|
366 | 355 | | preschool-age and if the person was, at the time the experience was |
---|
367 | 356 | | acquired, certified as, or eligible for certification as, a school |
---|
368 | 357 | | psychologist or psycho metrist. |
---|
369 | 358 | | F. The provisions of this section shall not apply to teachers |
---|
370 | 359 | | who have entered into postretirement employment with a public school |
---|
371 | 360 | | in Oklahoma and are still receiving a monthly retirement benefit. |
---|
402 | 390 | | salary above the step level indicated by the State Minimum Salary |
---|
403 | 391 | | Schedule for the 2022 -2023 school year, th e person shall receive a |
---|
404 | 392 | | salary increase amount equal to the amount indicated in subsection A |
---|
405 | 393 | | of this section for the step level indicated for the person, |
---|
406 | 394 | | provided they remain employed by the same district, unless the hours |
---|
407 | 395 | | or the duties of the c ertified personnel are reduced |
---|
408 | 396 | | proportionately. |
---|
409 | 397 | | H. If a school district does not receive Foundation or Salary |
---|
410 | 398 | | Incentive Aid pursuant to Section 18 -200.1 of Title 70 of the |
---|
411 | 399 | | Oklahoma Statutes this title, funds shall be allocated by the State |
---|
412 | 400 | | Board of Education to imp lement the salary increases indicated in |
---|
413 | 401 | | subsection A of this section. |
---|
414 | 402 | | I. Persons employed as classroom instructional employees of |
---|
415 | 403 | | technology center school districts supervised by the State Board of |
---|
416 | 404 | | Career and Technology Education shall receive a salary increase |
---|
417 | 405 | | amount equal to the amount indicated in subsection A of this section |
---|
418 | 406 | | for the step level indicated for the person, provided they remain |
---|
419 | 407 | | employed by the same technology center school district, unless the |
---|
420 | 408 | | hours or the duties of the classroom instructi onal employees are |
---|
421 | 409 | | reduced proportionately. |
---|
453 | 440 | | increase amount equal to the amount indicated in subsection A of |
---|
454 | 441 | | this section for the step level indicated for the person, provided |
---|
455 | 442 | | they remain employed by the same Department of Corrections or Office |
---|
456 | 443 | | of Juvenile Affairs facility, unless the hours or the duties of the |
---|
457 | 444 | | correctional teachers, vocational instructors, or teachers are |
---|
458 | 445 | | reduced proportionately. |
---|
459 | 446 | | K. Persons employed as teachers by the State Department of |
---|
460 | 447 | | Rehabilitation Services shall receive a salary increase amount equal |
---|
461 | 448 | | to the amount indicated in subsection A of this section for the step |
---|
462 | 449 | | level indicated for the person, provided they remain employed by the |
---|
463 | 450 | | State Department of Rehabilitation Services, unless the hours or the |
---|
464 | 451 | | duties of the teachers are re duced proportionately. |
---|
465 | 452 | | SECTION 3. This act shall become effective July 1, 2025. |
---|
466 | 453 | | SECTION 4. It being immediately necessary for the preservation |
---|
467 | 454 | | of the public peace, health or safety, an emergency is hereby |
---|
468 | 455 | | declared to exist, by reason whereof this act shall take effect and |
---|
469 | 456 | | be in full force from and after its passage and approval. |
---|
