57	52		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
58	53		SECTION 1. AMENDATORY 70 O.S. 2021, Section 17 -113, is
59	54		amended to read as follows:
60	55		Section 17-113. A. In determining annual increments for
61	56		teacher salaries and in computing Founda tion Aid, time spent in
62	57		military service during a period of national emergency shall be
63	58		counted, not to exceed five (5) years prior to the current year. No
64	59		more than five (5) years of such military service shall be used in
65	60		determining eligibilit y or benefits under the Teachers ' Retirement
66	61		System.
	62	+	B. For purposes of this section, the term "military service"
	63	+	shall include the United States Air Force, Army, Coast Guard, Marine

94		-	B. For purposes of this section, the term "military service"
95		-	shall include the United States Air Force, Army, Coast Guard, Marine
96	90		Corps, Navy, Space Force, and the reserve components of these
97	91		services, as well as the federal and state counterparts of both the
98	92		Air National Guard and Army National Guard.
99	93		SECTION 2. AMENDATORY Section 1, Chapter 289, O.S.L.
100	94		2023 (70 O.S. Supp. 202 4, Section 18-114.15), is amended to read as
101	95		follows:
102	96		Section 18-114.15. A. Beginning with the 2023 -2024 school
103	97		year, certified personnel, as defined in Section 26 -103 of Title 70
104	98		of the Oklahoma Statutes this title, in the public schools of
105	99		Oklahoma shall receive in salary and/or fringe benefits not less
106	100		than the amounts specified in the following schedule:

247		-	B. 1. When determining the Minimum Salary Schedule, "fringe
248		-	benefits" shall mean all or part of retirement benefits, excluding
249	240		the contributions made pursuant to subsection A of Section 17 -108.1
250	241		of Title 70 of the Oklahoma Statutes this title and the flexible
251	242		benefit allowance pursuant to Section 26 -105 of Title 70 of the
252	243		Oklahoma Statutes this title from the flexible benefit allowance
253	244		funds disbursed by the State Board of Education and the State Board
254	245		of Career and Technology Education pursuant to Section 26 -104 of
255	246		Title 70 of the Oklahoma Statutes this title.
256	247		2. If a school district intends to provide retirement benefits
257	248		to a teacher such that the teacher 's salary would be less than the
258	249		amounts set forth in the minimum salary schedule specified in
259	250		subsection A of this section, the district shall be required to
260	251		provide written notification to the teacher prior to his or her
261	252		employment or, if already employed by the district, no later than
262	253		thirty (30) days prior to the date the district elects to provide
263	254		retirement benefits such that the teacher 's salary would be less
264	255		than the minimum salary schedule.
265	256		C. Any of the degrees referred to in this section shall be from
266	257		a college recognized by the State Board of Education. The Board
267	258		shall accept teaching experience from out -of-state school districts
268	259		that are accredited by the State Board of Education or appropriate
269	260		state accrediting agency for the districts. The Board shall accept
270	261		teaching experience from out -of-country schools that are accredited
	262	+	or otherwise endorsed by the appropriate national or regional
	263	+	accrediting or endorseme nt authority. Out-of-country certification

298		-	or otherwise endorsed by the appropriate national or regional
299		-	accrediting or endorsement authority. Out -of-country certification
300	290		documentation in a language other than English shall be analyzed by
301	291		an educational credential evaluation service in accordance with
302	292		industry standards and guidelines and approved by the State
303	293		Department of Education. The person seeking to have credit granted
304	294		for out-of-country teaching experience shall be responsible for all
305	295		costs of the analysis by a credential evaluation service. The Board
306	296		shall accept teaching experience from primary and secondary schools
307	297		that are operated by the United States Department of Defense or are
308	298		affiliated with the United States Department of State.
309	299		D. For the purpose of state salary increments and retirement,
310	300		no teacher shall be granted credit for more than five (5) years of
311	301		active duty in the military service , as defined in Section 17-113 of
312	302		this title, or out-of-state or out-of-country teaching experience as
313	303		a certified teacher or its equivalent. Nothing in this section
314	304		shall prohibit boards of education from crediting more years of
315	305		experience on district salary schedules than those allowed for state
316	306		purposes.
317	307		E. The State Board of Education shall recognize, for purposes
318	308		of certification and salary increments, all the years of experience
319	309		of a:
320	310		1. Certified teacher who teaches in the educational program of
321	311		the Department of Corrections, beginning with fiscal year 1981;
	312	+	2. Vocational rehabilitation counselor under the Department of
	313	+	Human Services if the counselor was employed as a certified teacher

349		-	2. Vocational rehabilitation counselor under the Department of
350		-	Human Services if the counselor was employed as a certified tea cher
351	340		by the State Department of Educa tion when the Division of Vocational
352	341		Rehabilitation was transferred from the State Board of Career and
353	342		Technology Education or the State Board of Education to the Oklahoma
354	343		Public Welfare Commission on July 1, 1968;
355	344		3. Vocational rehabilitation c ounselor which were completed
356	345		while employed by the Department of Human Services if such counselor
357	346		was certified as a teacher or was eligible for certification as a
358	347		teacher in Oklahoma;
359	348		4. Certified teacher which were completed while employed by the
360	349		Child Study Center located at University Hospital, if the teacher
361	350		was certified as a teacher in Oklahoma; and
362	351		5. Certified school psychologist or psychometrist which were
363	352		completed while employed as a doctoral intern, psychological
364	353		assistant, or psychologist w ith any agency of the State of Oklahoma
365	354		if the experience primarily involved work with persons of school - or
366	355		preschool-age and if the person was, at the time the experience was
367	356		acquired, certified as, or eligible for certification as, a school
368	357		psychologist or psycho metrist.
369	358		F. The provisions of this section shall not apply to teachers
370	359		who have entered into postretirement employment with a public school
371	360		in Oklahoma and are still receiving a monthly retirement benefit.
	361	+	G. If a person employed as certified p ersonnel, as defined in
	362	+	Section 26-103 of Title 70 of the Oklahoma Statutes this title, by a
	363	+	school district during the 2022 -2023 school year was receiving a

399		-	G. If a person employed as certified p ersonnel, as defined in
400		-	Section 26-103 of Title 70 of the Oklahoma Statutes this title, by a
401		-	school district during the 2022 -2023 school year was receiving a
402	390		salary above the step level indicated by the State Minimum Salary
403	391		Schedule for the 2022 -2023 school year, th e person shall receive a
404	392		salary increase amount equal to the amount indicated in subsection A
405	393		of this section for the step level indicated for the person,
406	394		provided they remain employed by the same district, unless the hours
407	395		or the duties of the c ertified personnel are reduced
408	396		proportionately.
409	397		H. If a school district does not receive Foundation or Salary
410	398		Incentive Aid pursuant to Section 18 -200.1 of Title 70 of the
411	399		Oklahoma Statutes this title, funds shall be allocated by the State
412	400		Board of Education to imp lement the salary increases indicated in
413	401		subsection A of this section.
414	402		I. Persons employed as classroom instructional employees of
415	403		technology center school districts supervised by the State Board of
416	404		Career and Technology Education shall receive a salary increase
417	405		amount equal to the amount indicated in subsection A of this section
418	406		for the step level indicated for the person, provided they remain
419	407		employed by the same technology center school district, unless the
420	408		hours or the duties of the classroom instructi onal employees are
421	409		reduced proportionately.
	410	+	J. Persons employed as correctional teachers or vocational
	411	+	instructors by the Department of Corrections pursuant to Section
	412	+	510.6a of Title 57 of the Oklahoma Statutes or persons employed as
	413	+	teachers by the Office of Juvenile Affairs shall receive a salary

451		-	510.6a of Title 57 of the Oklahoma Statutes or per sons employed as
452		-	teachers by the Office of Juvenile Affairs shall receive a salary
453	440		increase amount equal to the amount indicated in subsection A of
454	441		this section for the step level indicated for the person, provided
455	442		they remain employed by the same Department of Corrections or Office
456	443		of Juvenile Affairs facility, unless the hours or the duties of the
457	444		correctional teachers, vocational instructors, or teachers are
458	445		reduced proportionately.
459	446		K. Persons employed as teachers by the State Department of
460	447		Rehabilitation Services shall receive a salary increase amount equal
461	448		to the amount indicated in subsection A of this section for the step
462	449		level indicated for the person, provided they remain employed by the
463	450		State Department of Rehabilitation Services, unless the hours or the
464	451		duties of the teachers are re duced proportionately.
465	452		SECTION 3. This act shall become effective July 1, 2025.
466	453		SECTION 4. It being immediately necessary for the preservation
467	454		of the public peace, health or safety, an emergency is hereby
468	455		declared to exist, by reason whereof this act shall take effect and
469	456		be in full force from and after its passage and approval.
