38	45		An Act relating to teachers; amending 70 O.S. 2021,
39	46		Section 6-101.23, which relates to the Teachers Due
40	47		Process Act of 1990; authorizing c ertain temporary
41	48		contracts for teachers with emergency or provisional
42	49		certificates; updating citations; providing an
43	50		effective date; and declaring an emergency .

48	55		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
49	56		SECTION 1. AMENDATORY 70 O.S. 2021, Section 6 -101.23, is
50	57		amended to read as fo llows:
51	58		Section 6-101.23. A. The dismissal, suspension and
52	59		nonreemployment provisions of the Teacher Due Process Act of 1990
53	60		shall not apply to:
54	61		1. Substitute teachers;
55	62		2. Adult education teachers; and
56	63		3. Teachers who are employed on temporary contracts.
57	64		B. The dismissal and suspension provisions of the Teacher Due
58	65		Process Act of 1990 shall a pply to teachers who are employed on
59		-	temporary contracts for a complete school year and to teachers who
60		-	are employed in positions fully funded by federal or private

	93	+	temporary contracts for a complete school year a nd to teachers who
	94	+	are employed in positions fully funded by federal or privat e
87	95		categorical grants, except that such teachers shall be employed only
88	96		for the duration of th e temporary contract or the grant.
89	97		C. The evaluation provisions in Sections 6 -101.10 and 6-101.11
90	98		of this title and in the Teacher Due Process Act of 1990 shall apply
91	99		to teachers who are employed on temporary contracts for a complete
92	100		school year and to te achers who are employed in positions fully
93	101		funded by federal or private categorical g rants, except that such
94	102		teachers shall be employed only for the duration of th e temporary
95	103		contract or the grant.
96	104		D. Teachers other than those specifically excepted in
97	105		subsection A of this section who are employed on contracts shall be
98	106		afforded all substan tive and procedural rights set forth in the
99	107		Teacher Due Process Act of 1990 including the dismissal, suspension,
100	108		and nonreemployment provisions applicable to probationary or career
101	109		teachers as defined in Section 6 -101.3 of this title.
102	110		E. On and after the effective date of this act July 1, 1999,
103	111		any teacher who has worked a complete school year under a temporary
104	112		contract in a school district shall be granted a year of servi ce
105	113		credit toward career status in that district.
106	114		F. No teacher shall be hired on a t emporary contract by a
107	115		school district for more than four semesters or on multiple
108		-	temporary contracts by a school district that together are for more
109		-	than four semesters, except for a:

	143	+	temporary contracts by a school district that together are for more
	144	+	than four semesters, except for a:
136	145		1. Teacher hired to replace a teacher who is on an approved
137	146		leave of absence and who is expected to return to employment with
138	147		the school district; or
139	148		2. Teacher who is a retired member of the Teachers ' Retirement
140	149		System of Oklahoma; or
141	150		3. Teacher who is employed by a school district on an emergency
142	151		or provisional certific ate.
143	152		G. No teacher shall be offered a temporary contract with a
144	153		school district without a full written disclosure at the time a
145	154		position is offered by the administration of the school district
146	155		which sets forth the terms and conditions of the temporary con tract.
147	156		In the event the school district fails to provide such written
148	157		disclosure, the teacher shall be considered as employed on a
149	158		continuing contract basis.
150	159		H. On and after the effective date of this act July 1, 1999, no
151	160		teacher who is employed on a con tinuing contract basis by a school
152	161		district shall be reemployed on a temporary contract in that school
153	162		district.
154	163		SECTION 2. This act shall become effectiv e July 1, 2025.
155	164		SECTION 3. It being immediately necessary for the pr eservation
156	165		of the public peace, health or safety, an emergency is hereby
157		-	declared to exist, by reason whereof this act shall take effect and
158		-	be in full force from and after its passage and approval.
