4855 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4956 SECTION 1. AMENDATORY 70 O.S. 2021, Section 6 -101.23, is
5057 amended to read as fo llows:
5158 Section 6-101.23. A. The dismissal, suspension and
5259 nonreemployment provisions of the Teacher Due Process Act of 1990
5360 shall not apply to:
5461 1. Substitute teachers;
5562 2. Adult education teachers; and
5663 3. Teachers who are employed on temporary contracts.
5764 B. The dismissal and suspension provisions of the Teacher Due
5865 Process Act of 1990 shall a pply to teachers who are employed on
59-temporary contracts for a complete school year and to teachers who
60-are employed in positions fully funded by federal or private

93+temporary contracts for a complete school year a nd to teachers who
94+are employed in positions fully funded by federal or privat e
8795 categorical grants, except that such teachers shall be employed only
8896 for the duration of th e temporary contract or the grant.
8997 C. The evaluation provisions in Sections 6 -101.10 and 6-101.11
9098 of this title and in the Teacher Due Process Act of 1990 shall apply
9199 to teachers who are employed on temporary contracts for a complete
92100 school year and to te achers who are employed in positions fully
93101 funded by federal or private categorical g rants, except that such
94102 teachers shall be employed only for the duration of th e temporary
95103 contract or the grant.
96104 D. Teachers other than those specifically excepted in
97105 subsection A of this section who are employed on contracts shall be
98106 afforded all substan tive and procedural rights set forth in the
99107 Teacher Due Process Act of 1990 including the dismissal, suspension,
100108 and nonreemployment provisions applicable to probationary or career
101109 teachers as defined in Section 6 -101.3 of this title.
102110 E. On and after the effective date of this act July 1, 1999,
103111 any teacher who has worked a complete school year under a temporary
104112 contract in a school district shall be granted a year of servi ce
105113 credit toward career status in that district.
106114 F. No teacher shall be hired on a t emporary contract by a
107115 school district for more than four semesters or on multiple
108-temporary contracts by a school district that together are for more
109-than four semesters, except for a:

143+temporary contracts by a school district that together are for more
144+than four semesters, except for a:
136145 1. Teacher hired to replace a teacher who is on an approved
137146 leave of absence and who is expected to return to employment with
138147 the school district; or
139148 2. Teacher who is a retired member of the Teachers ' Retirement
140149 System of Oklahoma; or
141150 3. Teacher who is employed by a school district on an emergency
142151 or provisional certific ate.
143152 G. No teacher shall be offered a temporary contract with a
144153 school district without a full written disclosure at the time a
145154 position is offered by the administration of the school district
146155 which sets forth the terms and conditions of the temporary con tract.
147156 In the event the school district fails to provide such written
148157 disclosure, the teacher shall be considered as employed on a
149158 continuing contract basis.
150159 H. On and after the effective date of this act July 1, 1999, no
151160 teacher who is employed on a con tinuing contract basis by a school
152161 district shall be reemployed on a temporary contract in that school
153162 district.
154163 SECTION 2. This act shall become effectiv e July 1, 2025.
155164 SECTION 3. It being immediately necessary for the pr eservation
156165 of the public peace, health or safety, an emergency is hereby
157-declared to exist, by reason whereof this act shall take effect and
158-be in full force from and after its passage and approval.
