5463 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5564 SECTION 1. NEW LAW A new section of law to be codified
5665 in the Oklahoma Statutes as Section 11 -103.9c of Title 70, unless
5766 there is created a duplication in numbering, reads as follows:
5867 A. This act shall be known and may be cited as the "Growing
5968 Minds, Active Kids Act".
60-B. It is the intention of the Oklahoma State Legislature
61-through this act to focus on daily recess as essen tial for students
62-as it provides a necessary break from academic work, allowing
63-students to recharge both mentally and physically. Physical
64-activity during recess helps improve focus, reduce stress, and

96+B. It is the intention of the Oklahoma State Legislature
97+through this act to focus on daily recess as essential for students
98+as it provides a necessary break from academic work, allowing
99+students to recharge both mentally and physically. Physical
100+activity during recess helps improve focus, reduce stress, and
91101 support overall physical health. It also encourages social
92102 interaction where children learn important skills like te amwork,
93103 conflict resolution, and communication. By giving students adequate
94104 time to play and unwind, recess fosters better behavior in the
95105 classroom and enhances students' ability to concentrate and learn
96106 effectively.
97107 C. As used in this section:
98108 1. "Daily recess" means a scheduled break or breaks during the
99109 school day that will allow students to engage in unstructured free
100110 play or physical activity;
101111 2. "District board of education" means the governing board of
102112 each school district in Oklahoma; and
103113 3. "Physical activity" means any bodily movement that uses
104114 energy and is produced by skeletal muscles.
105115 D. School districts shall incorporate physical activity into
106116 the school day by providing at least thirty (30) minutes for daily
107117 recess to students in full -day prekindergarten, kindergarten, and
108118 grades one through five. For grades six through eight, at least
109119 thirty (30) minutes for daily recess is strongly recommended. Each
110-district board of ed ucation shall establish the timing of the daily
111-recess. The daily recess required by this subsection may be broken
112-up into segments that best fit the schedules of each school
113-district.

140-1. The daily recess provided for in this subsection shall be in

145156 unless weather or other conditions require it to occur inside.
146157 3. For students with disabilities, the d aily recess shall
147158 comply with the individualized education program (IEP) or Section
148159 504 plan of the student.
149160 4. Virtual charter schools shall be exempt from the
150-requirements of this subsection.
