56	56	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
57	57	SECTION 1. NEW LAW A new section o f law to be codified
58	58	in the Oklahoma Statutes as Section 3218.7 -2 of Title 70, unless
59	59	there is created a duplication in numbering, reads as follows:
60	60	This act shall be known and may be cited as the "College Fee
61	61	Waiver for Children of Parents with Disabiliti es Act".
62	62	SECTION 2. NEW LAW A new section of law to be codified
63	63	in the Oklahoma Statutes as Section 3218.7 -3 of Title 70, unless
64	64	there is created a duplication in numbering, reads as follows:

91	91	As used in the College Fee Waiver for Ch ildren of Parents with
92	92	Disabilities Act:
93	93	1. "Child" means a biological child, adopted child, or legal
94	94	ward of the parent(s) with a disability;
95	95	2. "Fees" means tuition fees, mandatory student fees,
96	96	registration fees, and any other required costs associat ed with
97	97	enrollment and attendance at an institution of higher education ;
98	98	3. "Institution of higher education " means any institution
99	99	supported wholly or in part by direct legislative appropriations and
100	100	offering courses of education of any kind beyond or in addition to
101	101	the twelfth grade, or its equivalent, as such grade is generally
102	102	understood and accepted in the public school system of Oklahoma,
103	103	whether called a university, college, junior college, school , or
104	104	academy; and
105	105	4. "Parent with a disability " means a child's parent or legal
106	106	guardian who has a disability as defined under the Americans with
107	107	Disabilities Act (ADA) .
108	108	SECTION 3. NEW LAW A new section of law to be codified
109	109	in the Oklahoma Statutes as Section 3218.7 -4 of Title 70, unless
110	110	there is created a duplication in numbering, reads as follows:
111	111	A. Institutions of higher education shall waive all fees for an
112	112	eligible child for up to four (4) years of undergraduate study or
113	113	until the completion of a bachelor 's degree, whichever o ccurs first,
114	114	as long as the child remains in good academic standing as defined by

141	141	the institution of higher education. The waiver shall cover all
142	142	academic terms including fall, spring, and summer semesters.
143	143	B. To be eligible for waiver, a child must:
144	144	1. Be admitted to and enrolled in an institution of higher
145	145	education within this state; and
146	146	2. Provide proof of a parent with a disability through
147	147	documentation such as a Social Security Disability Insurance award
148	148	letter, a statement from a licensed medical professional, or other
149	149	valid documentation confirming the disability under th e Americans
150	150	with Disabilities Act (ADA) criteria.
151	151	The child's eligibility for the waiver shall not be affected by
152	152	the child's living circumstances or whether the child was raised by
153	153	the parent with a disability.
154	154	C. No child shall be discriminated against in the application
155	155	or awarding of fee waivers under this act based on race, color,
156	156	religion, sex, national origin, disability, or any other protected
157	157	Status.
158	158	D. The Oklahoma State Regents for Higher Education shall
159	159	oversee the implementation of this act and establish procedures for
160	160	verifying eligibility and processing fee waivers.
161	161	E. Institutions of higher education shall comply with the
162	162	procedures established by the State Regen ts and submit an annual
163	163	report to the State Regents on the number of students receiving the
164	164	fee waiver including the retention and graduation rates.

191	191	F. The Legislature shall appropriate annual funds to cover the
192	192	cost of this waiver program. Additional funding may be provided
193	193	from private grants, donations, or federal assistance pr ograms.
194	194	G. If any provision of this act or its application is held
195	195	invalid, the remainder of the act or the application of its
196	196	provisions to other persons or circumstances shall not be affected.
197	197	SECTION 4. It being immediately necessary for the preservation
198	198	of the public peace, health or safety, an emergency is hereby
199	199	declared to exist, by reason whereof this act shall take effect and
200	200	be in full force from and af ter its passage and approval.
