5463 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5564 SECTION 1. NEW LAW A new section of law to be codified
5665 in the Oklahoma Statutes as Section 4606 of Title 36, unless there
5766 is created a duplication in numbering, reads as follows:
5867 A. The Oklahoma Insurance Commissioner shall have the authority
5968 to implement, establish, create, administer, or otherwise operate an
6069 exchange, promulgate rules, and apply to the United States Secretary
61-of Health and Human Services for a waiver pursu ant to Section 1332
62-of the Patient Protection and Affordable Care Act (42 U.S.C.,
63-Section 18052).

90100 B. "Exchange" means a state, federal, or partnership exchange
91101 or marketplace operating in Oklahoma pursuant to Section 1311 of the
92102 Patient Protection and Affordable Care Act.
93103 SECTION 2. NEW LAW A new section of law to be codified
94104 in the Oklahoma Statutes as Section 4606.1 of Title 36, unless there
95105 is created a duplication in numbering, reads as follows:
96106 A. There is hereby created in the State Treasury a revolving
97107 fund for the Insurance Department, to be desig nated the "State-based
98108 Exchange Revolving Fund". The fund shall be a continuing fund, not
99109 subject to fiscal year limitations, and shall consist of any monies
100110 deposited to the fund for the creation, implementation,
101111 administration, and operation of the Stat e-based Exchange as
102112 authorized in subsection A of Section 1 of this act. All monies
103113 accruing to the credit of the fund are hereby appropriated and may
104114 be budgeted and expended by the Department for the creation,
105-implementation, administration, and operation of the State -based
115+implementation, administration, and operati on of the State Based
106116 Exchange. Warrants for expenditures from the revolving fund shall
107117 be drawn by the State Treasurer, based on claims signed by an
108118 authorized employee or employees of the Insurance Department, and
109119 filed with the Director of the Office o f Management and Enterprise
110120 Services.
111-B. Notwithstanding any law to the contrary, all monies,
112-including but not limited to user fees, paid to or collected by the
113-Insurance Commissioner in relation to the State-based Exchange shall

148+B. Notwithstanding any law to the contrary, all monies,
149+including but not limited to user fees, paid to or collected by the
150+Insurance Commissioner in relation to the State -based Exchange shall
140151 be deposited in the Sta te-based Exchange Revolving Fund. Monies
141152 shall not lapse, unless otherwise specified under federal funding or
142153 federal grant, or a grant or funds from another source, or be
143154 transferred to the State Insurance Commissioner Revolving Fund or
144155 other state funds and shall not be redistributed.
145156 SECTION 3. This act shall become effective July 1, 2025.
146157 SECTION 4. It being immediately necessary for the preservation
147158 of the public peace, health or safety, an emergency is hereby
148159 declared to exist, by reason whereof this act shall take effect and
149160 be in full force from and after its passage and approval.
