42	49		An Act relating to insurance; granting the Oklahoma
43	50		Insurance Commissioner certain authority related to
44	51		the Patient Protection and Affordable Care Act;
45	52		providing definition; creating the State -based
46	53		Exchange Revolving Fund; providing purpose of fund;
47	54		providing for certain monies to be deposited to fund;

54	63		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
55	64		SECTION 1. NEW LAW A new section of law to be codified
56	65		in the Oklahoma Statutes as Section 4606 of Title 36, unless there
57	66		is created a duplication in numbering, reads as follows:
58	67		A. The Oklahoma Insurance Commissioner shall have the authority
59	68		to implement, establish, create, administer, or otherwise operate an
60	69		exchange, promulgate rules, and apply to the United States Secretary
61		-	of Health and Human Services for a waiver pursu ant to Section 1332
62		-	of the Patient Protection and Affordable Care Act (42 U.S.C.,
63		-	Section 18052).

	99	+	Section 18052).
90	100		B. "Exchange" means a state, federal, or partnership exchange
91	101		or marketplace operating in Oklahoma pursuant to Section 1311 of the
92	102		Patient Protection and Affordable Care Act.
93	103		SECTION 2. NEW LAW A new section of law to be codified
94	104		in the Oklahoma Statutes as Section 4606.1 of Title 36, unless there
95	105		is created a duplication in numbering, reads as follows:
96	106		A. There is hereby created in the State Treasury a revolving
97	107		fund for the Insurance Department, to be desig nated the "State-based
98	108		Exchange Revolving Fund". The fund shall be a continuing fund, not
99	109		subject to fiscal year limitations, and shall consist of any monies
100	110		deposited to the fund for the creation, implementation,
101	111		administration, and operation of the Stat e-based Exchange as
102	112		authorized in subsection A of Section 1 of this act. All monies
103	113		accruing to the credit of the fund are hereby appropriated and may
104	114		be budgeted and expended by the Department for the creation,
105		-	implementation, administration, and ~~operation~~ of the State -based
	115	+	implementation, administration, and operati on of the State Based
106	116		Exchange. Warrants for expenditures from the revolving fund shall
107	117		be drawn by the State Treasurer, based on claims signed by an
108	118		authorized employee or employees of the Insurance Department, and
109	119		filed with the Director of the Office o f Management and Enterprise
110	120		Services.
111		-	B. Notwithstanding any law to the contrary, all monies,
112		-	including but not limited to user fees, paid to or collected by the
113		-	Insurance Commissioner in relation to the State-based Exchange shall

	148	+	B. Notwithstanding any law to the contrary, all monies,
	149	+	including but not limited to user fees, paid to or collected by the
	150	+	Insurance Commissioner in relation to the State -based Exchange shall
140	151		be deposited in the Sta te-based Exchange Revolving Fund. Monies
141	152		shall not lapse, unless otherwise specified under federal funding or
142	153		federal grant, or a grant or funds from another source, or be
143	154		transferred to the State Insurance Commissioner Revolving Fund or
144	155		other state funds and shall not be redistributed.
145	156		SECTION 3. This act shall become effective July 1, 2025.
146	157		SECTION 4. It being immediately necessary for the preservation
147	158		of the public peace, health or safety, an emergency is hereby
148	159		declared to exist, by reason whereof this act shall take effect and
149	160		be in full force from and after its passage and approval.
