9494 This act shall be known and may be cited as the "Supporting
9595 Affordability and Fairness with Every Bet Act of 2024 " or the "SAFE
9696 Bet Act".
9797 SECTION 2. NEW LAW A new section of law to be codified
9898 in the Oklahoma Statutes as Section 802 of Title 3A, unless there is
9999 created a duplication in numbering , reads as follows:
100100 As used in this act:
101101 1. "Amateur athletic competition " has the meaning given the
102102 term in 36 U.S.C., Section 220501;
103103 2. With respect to a sports wager accepted by a sports wagering
104104 operator, the term "anonymized sports wagering data " means:
105105 a. a unique identifier for the transaction and, if
106106 available, the individual who placed the sports wager,
107107 except that such identifier shall not include any
108108 personally identifiable information of such
109109 individual,
110110 b. the amount and type of sports wager ,
111111 c. the date and time at which the sports wager was
112112 accepted,
113113 d. the location at which the sports wager was placed,
114114 including the Internet protocol address, if
115115 applicable, and
116116 e. the outcome of the sports wager;
117117 3. "Gambling disorder" means:

144144 a. gambling disorder, as the term is used by the American
145145 Psychiatric Association in the publication entitled
146146 Diagnostic and Statistical Manual of Mental Disorders,
147147 5th Edition or a successor edition,
148148 b. pathological gambling,
149149 c. gambling addiction, and
150150 d. compulsive gambling;
151151 4. "Governmental entity" means:
152152 a. a state,
153153 b. a political subdivis ion of a state, and
154154 c. an entity or organization, including an Indian Tribe,
155155 that has governmental authority within the territorial
156156 boundaries of the United States, including Ind ian
157157 lands;
158158 5. "Indian lands" has the meaning given the term in Section 4
159159 of the Indian Gaming Regulatory Act , 25 U.S.C., Section 2703;
160160 6. "Indian Tribe" has the meaning given the term "Indian tribe"
161161 in Section 4 of the Indian Gaming Regulatory Act , 25 U.S.C., Section
162162 2703;
163163 7. "Interactive sports wagering platform " means a person or
164164 entity that offers licensed sports wagering over the Internet,
165165 including through an Internet website and mobile devices, on behalf
166166 of a licensed gaming facility ;

193193 8. "Interstate sports wagering compact " means a compact to
194194 offer sports wagering in accordance with this act between:
195195 a. two or more states with a state sports wagering
196196 program,
197197 b. one or more states with a state sports wagering
198198 program and one or more Indian Tribes , or
199199 c. two or more Indian Tribes ;
200200 9. "Licensed gaming facility " means a person licensed by a
201201 state regulatory entity or an Indian Tribe licensed by a state
202202 regulatory agency for the conduct of gaming ;
203203 10. "Microbet" means a wager placed on an outcome or o ccurrence
204204 within a sporting event which may or may not be related to the
205205 ultimate result of the sporting event ;
206206 11. "Official" means a referee, umpire, judge, reviewer, or any
207207 other individual authorized to administer the rules of a sporting
208208 event;
209209 12. "Proposition bet" means a side wager on a part of a
210210 sporting event that does no t concern the final outcome of the
211211 sporting event;
212212 13. "Reasonable lender standard " means application of
213213 underwriting criteria that would be applied by a lender that is an
214214 insured depository institution , as defined under Section 3 of the
215215 Federal Deposit Insurance Act , 12 U.S.C., Section 1813, for an
216216 unsecured loan extended to a consumer ;

243243 14. "Sporting event" means any athletic competition ;
244244 15. "Sports organization" means:
245245 a. a person or governmental entity that :
246246 (1) sponsors, organizes, schedules, or con ducts a
247247 sporting event, and
248248 (2) with respect to the sporting event and the
249249 participants in the sporting event :
250250 (a) prescribes final rules , and
251251 (b) enforces a code of conduct , and
252252 b. a league or association of one or more persons or
253253 governmental entities described in subparagraph a of
254254 this paragraph;
255255 16. Except as provided in subparagraph b of this paragraph, the
256256 term "sports wager" means the staking or risking by any person of
257257 something of value upon the outcome of a sporting event, including
258258 the outcome of any portion or aspect thereof, upon an agreement or
259259 understanding that the person or another person will receive
260260 something of value in the event of a certain outcome.
261261 a. With respect to an amateur or professional sporting
262262 event, the term "sports wager" includes:
263263 (1) a straight bet,
264264 (2) a teaser,
265265 (3) a variation of a teaser ,
266266 (4) a parlay,

294294 (6) a moneyline,
295295 (7) a betting pool,
296296 (8) exchange wagering,
297297 (9) in-game wagering, including in -game wagering on:
298298 (a) a final or interim game sc ore,
299299 (b) statistics, or
300300 (c) a discrete in-game event,
301301 (10) a sports lottery, and
302302 (11) a proposition bet.
303303 b. The term "sports wager" does not include:
304304 (1) any activity excluded fr om the definition of the
305305 term "bet or wager" under 31 U.S.C., Section
306306 5362, or
307307 (2) any activity that does not violate a provision of
308308 the Interstate Horseracing Act of 1978 , 15
309309 U.S.C., Section 3001 et seq.;
310310 17. "Sports wagering" means the acceptance of a s ports wager by
311311 a sports wagering operator ;
312312 18. "Sports wagering operator " means:
313313 a. a licensed gaming facility that offers sports
314314 wagering, and
315315 b. an interactive sports wagering platform ;

342342 19. "Sports wagering opt-in state" means a state that
343343 administers a state sports wagering program ;
344344 20. "State" means:
345345 a. a state,
346346 b. the District of Columbia , and
347347 c. any commonwealth, territory, or possession of the
348348 United States;
349349 21. "State regulatory entity " means the governmental entity :
350350 a. established or designated by a sports wagering opt -in
351351 state under division (2) of subparagraph a of
352352 paragraph 2 of subsection A of Section 4 of this act,
353353 and
354354 b. responsible, solely or in coordination with one or
355355 more other governmental entities, for the regulation
356356 of sports wagering in the applicable sports wagering
357357 opt-in state;
358358 22. "State social gambling law " means a state law that allows
359359 sports wagering that :
360360 a. is not conducted as a business ,
361361 b. involves two or more players who compete on equal
362362 terms, and
363363 c. does not provide a benefit to:
364364 (1) a player, other than the winnings of the player ,
365365 or

392392 (2) a person who is not involved in a sports wager ;
393393 23. "State sports wagering program " means a program
394394 administered and overseen by a state pursuant to an application
395395 approved by the Attorney General pursuant to Section 4 of this act;
396396 24. "Suspicious transaction " means a transaction or an
397397 arrangement that a sports wagering operator knows or has reason to
398398 know, as determined by a director, officer, employee, or agent of
399399 the sports wagering operator is or would be if completed :
400400 a. a violation of, or part of a plan to violate or evade,
401401 any federal, state, or local law, including
402402 regulations, or
403403 b. sports wagering by or on behalf of an individual
404404 described in Section 5 of this act ;
405405 26. "Suspicious transaction report " means a report submitted to
406406 a state regulatory entity or a sports organization under paragraph
407407 13 of subsection B of Section 5 of this act ; and
408408 27. "Tribal-state compact" means a compact entered into between
409409 a state and an Indian Tribe pursuant to Section 11(d)(3) of the
410410 Indian Gaming Regulatory Act , 25 U.S.C., Section 2710(d)(3).
411411 SECTION 3. NEW LAW A new section of law to be codified
412412 in the Oklahoma Statutes as Section 803 of Title 3A, unless there is
413413 created a duplication in numbering, reads as follows:
414414 A. Except as provided in subsection B of this section, it shall
415415 be unlawful for any person to knowingly accept a sports wager.

442442 B. It shall not be a violation of subsection A of this section
443443 for:
444444 1. A sports wagering operator located in a sports wagering opt -
445445 in state to accept a sports wager in accordance with state law; or
446446 2. A person to accept a sports wager in accordance with an
447447 applicable state social gambling law.
448448 C. 1. If the Attorney General be lieves a person has violated,
449449 is violating, or will violate subsection A of this section, the
450450 Attorney General may bring a civil action in the appropriate court,
451451 which shall have jurisdiction in proceedings in accordance with the
452452 Federal Rules of Civil Pro cedure to enjoin a violation of subsection
453453 A of this section.
454454 2. In the case of an alleged violation of an injunction or
455455 restraining order issued under paragraph 1 of this subsection, trial
456456 shall be, on demand of the accused, by a jury in accordance with the
457457 Federal Rules of Civil Procedure.
458458 D. 1. Any person who violates subsection A of this section
459459 shall be, with respect to any such violation, subject to a civil
460460 penalty of not more than the greater of Ten Thousand Dollars
461461 ($10,000.00) or three times the amount of the applicable sports
462462 wager.
463463 2. A separate violation occurs for ea ch sports wager accepted
464464 in violation of subsection A of this section.

491491 3. The district courts of the United States and appropriate
492492 United States courts of the territories and po ssessions of the
493493 United States shall have jurisdiction to enforce this subsection in
494494 accordance with 28 U.S.C., Section 1355.
495495 4. A violation of subsection A of this section shall not
496496 constitute a crime, and a judgment for the United States and
497497 imposition of a civil penalty pursuant to paragraph 1 of this
498498 subsection shall not give rise to any disability or legal
499499 disadvantage based on conviction for a criminal offense.
500500 E. Civil penalty not exclusive of criminal penalty. A civil
501501 penalty, injunction, or temp orary restraining order imposed under
502502 this section shall be independent of, and not in lieu of, criminal
503503 prosecutions or any other proceedings under any other law of the
504504 United States, including 18 U.S.C., Sections 1084 and 1955.
505505 SECTION 4. NEW LAW A new section of law to be codified
506506 in the Oklahoma Statutes as Section 804 of Title 3A, unless there is
507507 created a duplication in numbering, reads as follows:
508508 A. 1. The state shall submit an application to the Attorney
509509 General at such time, in such manner, and accompanied by such
510510 information as the Attorney General may require to request approval
511511 to administer a state sports wagering program.
512512 2. An application under paragraph 1 of this subsection shall

540540 a. a full and complete des cription of the state sports
541541 wagering program the state proposes to administer
542542 under state law, including:
543543 (1) each applicable state law relating to sports
544544 wagering, and
545545 (2) an identification of the state regulatory entity ,
546546 and
547547 b. an assurance from the state's attorney general or that
548548 the laws of the state provide adequate authority to
549549 carry out the proposed state sports wagering program.
550550 B. In the case of a material change to a state law relating to
551551 sports wagering, the state regulatory entity, or other i nformation
552552 included in an application submitted pursuant to subsection A or E
553553 of this section, not later than thirty (30) days after the date on
554554 which the change is made, the state shall submit to the Attorney
555555 General a notice of such change.
556556 C. Not later than the date on which the period of three (3)
557557 years referred to in subsection D of this section ends, a state
558558 seeking to renew the approval of the state sports wagering program
559559 may submit to the Attorney General a renewal application that
560560 includes the information described in subsection A of this section.
561561 SECTION 5. NEW LAW A new section of law to be codified
562562 in the Oklahoma Statutes as Section 805 of Title 3A, unless there is
563563 created a duplication in numbering, reads as follows:

590590 A. The state sports wagering program shall meet each of the
591591 following standards:
592592 1. Establish or designate a public entity in the applicable
593593 state as the state regulatory entity for the purposes of regulating
594594 sports wagering operators and enforcing sports wagering laws in the
595595 state;
596596 2. a. Provide that in-person sports wagering may be offered
597597 only by a sports wagering operator.
598598 b. (1) With respect to any authorization of sports
599599 wagering on an interactive sports wagering
600600 platform, provide that such sports wa gering, as
601601 available, is available only to :
602602 (a) individuals located in the state, or
603603 (b) in the case of an interstate sports wagering
604604 compact approved by the Attorney General,
605605 individuals located in states and on Indian
606606 lands of Indian Tribes that are part y to the
607607 compact.
608608 (2) Include location verification requirements
609609 reasonably designed to prevent an individual from
610610 placing a sports wager on an interactive sports
611611 wagering platform from a location other than a
612612 location described in division (1) of this
613613 paragraph.

640640 c. (1) Provide that a sports wagering operator shall not
641641 accept a sports wager unless such sports wager or
642642 class of sports wagers is expressly approved by
643643 the state regulatory entity.
644644 (2) Direct the state regulatory entity to establish
645645 criteria for decisions with respect to the
646646 approval of a sports wager or a class of sports
647647 wagers, such as whether the outcome of the event
648648 or contingency on which the sports wager is
649649 placed is:
650650 (a) verifiable,
651651 (b) generated by a reliable and independent
652652 process, and
653653 (c) unlikely to be affected by any sports wager
654654 placed.
655655 d. Prohibit the state regulatory entity from approving,
656656 or a sports wagering operator from accepting, a
657657 proposition bet on:
658658 (1) any amateur athletic competition , or
659659 (2) any intercollegiate sport , as defined in the
660660 Sports Agent Responsibility and Trust Act , 15
661661 U.S.C., Section 7801.
662662 e. Prohibit the state regulatory entity from approving,
663663 or a sports wagering operator from accepting, a sports

690690 wager on any sporting event, once such event has
691691 commenced;
692692 3. a. In this paragraph, the term "necessary to maintain
693693 contest integrity" means that, in the absence of a
694694 restriction, there is a reasonably foreseeable risk
695695 that the outcome of the sporting event or contingency
696696 on which the wager is placed would be affecte d by the
697697 wager.
698698 b. Prohibit a sports wagering operator from accepting a
699699 sports wager in violation of a notice of restriction
700700 received by the sports wagering operator under
701701 subparagraph e of paragraph 2 of subsection B of
702702 Section 5 of this act .
703703 c. (1) With respect to sporting events sponsored,
704704 organized, or conducted by a sports organization,
705705 permit the sports organization to submit to the
706706 state regulatory entity a request to restrict,
707707 limit, or exclude wagers on one or more sporting
708708 events, including by res tricting, limiting, and
709709 excluding sports wagers on one or more
710710 performances of an athlete in one or more
711711 sporting events in which such athlete
712712 participates, if the applicable sports

740740 necessary to maintain con test integrity.
741741 (2) Provide that the state regulatory entity shall
742742 establish reasonable deadlines for the submission
743743 of a request under division (1) of this
744744 subparagraph in advance of the applicable
745745 sporting event.
746746 d. Provide that the state regulatory enti ty shall
747747 promptly:
748748 (1) approve a request described in division (1) of
749749 subparagraph c of paragraph 3 of this subsection
750750 unless the state regulatory entity determines,
751751 considering any information provided by the
752752 sports organization and any other relevant
753753 information, that a restriction is not necessary
754754 to maintain contest integrity ,
755755 (2) provide a written explanation of a determination
756756 under division (1) of this subparagraph to
757757 approve or deny a request ,
758758 (3) make such written explanation available to the
759759 public, and
760760 (4) provide a process by which the sports
761761 organization that submitted t he request may seek
762762 review of such determination.

789789 e. Provide that the state regulatory entity shall
790790 establish a process:
791791 (1) to provide to sports wagering operators prompt
792792 notice of any restriction approved by the state
793793 regulatory entity, and
794794 (2) to make such notice publicly available ;
795795 4. Prohibit a sports wagering operator from accepting sports
796796 wagers from any:
797797 a. individual younger than twenty-one (21) years of age,
798798 b. individual on a self-exclusion list,
799799 c. athlete, coach, official, or employee of a spo rts
800800 organization or any club or team of a sports
801801 organization, with respect to a sporting event
802802 sponsored, organized, or conducted by the sports
803803 organization,
804804 d. employee of a player or an official union of a sports
805805 organization, with respect to a sporting event
806806 sponsored, organized, or conducted by the sports
807807 organization,
808808 e. individual who, with respect to a sporting event
809809 sponsored, organized, or conducted by a sports
810810 organization, is:
811811 (1) credentialed or accredited by the sports
812812 organization, and

839839 (2) prohibited from placing a sports wager by the
840840 terms of such credential or accreditation , or
841841 f. individual convicted of an offense under 18 U.S.C.,
842842 Section 224(a) or Section 224(b);
843843 5. a. (1) With respect to any sports wager accepted on or
844844 before November 1, 2025, provide that a sports
845845 wagering operator shall determine the result of a
846846 sports wager only with data that is licensed and
847847 provided by:
848848 (a) the applicable sports organization , or
849849 (b) an entity expressly authorized by the
850850 applicable sports organization to provide
851851 such information.
852852 (2) With respect to any sports wager accepted after
853853 November 1, 2025, provide that a sports wagering
854854 operator shall determine the result of a sports
855855 wager only with data that is obtained from a
856856 source that the state regulatory entity has :
857857 (a) found to provide:
858858 i. data of substantially similar speed,
859859 accuracy, and consistency to the data
860860 available under division (1) of this
861861 subparagraph, and
862862 ii. only data that is:

889889 (A) legally obtained, and
890890 (B) in full compliance with the terms
891891 of any applicable contract or
892892 license,
893893 (b) expressly authorized to provide such data to
894894 sports wagering operators , and
895895 (c) identified in the application of the state
896896 regulatory entity under Section 4 of this
897897 act.
898898 b. Provide that the statistics, result, outcome, or other
899899 data used by a sports wagering operator for a purpose

10471047 operator as sports wagers on contingencies the
10481048 outcomes of which have not been determined , and
10491049 (3) the amounts owed but unpaid by the sports
10501050 wagering operator on wi nning wagers during the
10511051 period for honoring winning wagers established by

10541054 (1) may not accept more than five deposits from an
10551055 individual during a twenty-four-hour period,

17441744 b. the applicable state and Indian Tribe have entered
17451745 into a Tribal-state compact authorizing the placing of

17481748 B. Nothing in this act preempts or limits the authority of a
17491749 state or an Indian Tribe to enact, adopt, promulgate, or enforce any
17501750 law, rule, regulation, or other measure with respect to sports

17791779 C. Nothing in this act limits or otherwise affects the taxation
17801780 of sports wagering b y a state, an Indian Tribe, or a locality.
17811781 SECTION 7. NEW LAW A new section of law to be codified
17821782 in the Oklahoma Statutes as Section 807 of Title 3A, unless there is
17831783 created a duplication in numbering, reads as follows:
17841784 If a provision of this act, an amendment made by this act, a
17851785 regulation promulgated under this act or under an amendment made by
17861786 this act, or the application of any such provision, amendmen t, or
17871787 regulation to any person or circumstance, is held to be invalid, the
17881788 remaining provisions of this act, amendments made by this act,
17891789 regulations promulgated under this act or under an amendment made by
17901790 this act, or the application of such provisions, amendments, and
17911791 regulations to any person or circumstance :
17921792 1. Shall not be affected by the invalidity; and
17931793 2. Shall continue to be enforced to the maximum extent
17941794 practicable.
17951795 SECTION 8. This act shall become effective November 1, 2025.
