40	40	An Act relating to schools; creating the Student
41	41	Retention Protocol Act of 2025; providing
42	42	definitions; requiring certain screenings,
43	43	assessments, and evaluations for students operating
44	44	below a certain academic threshold; mandating schools
45	45	to employ qualified personnel; subjecting
46	46	requirements to availability of fund ing; providing
47	47	for codification; providing an effective date; and
48	48	declaring an emergency.

54	54	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHO MA:
55	55	SECTION 1. NEW LAW A new section of law to be codified
56	56	in the Oklahoma Statutes as Section 1210.500 of Title 70, unless
57	57	there is created a duplication in numbering, reads as follows:
58	58	A. This section shall be known and may be cited as the "Student
59	59	Retention Protocol Act of 2025 ".
60	60	B. As used in this act:
61	61	1. "At risk of being retained " means students who have been
62	62	identified by school personnel as opera ting below the academic
63	63	threshold necessary to permit enrollment into an advan cing grade for
64	64	the following school year;

91	91	2. "Family assessment" means a process for gathering and
92	92	organizing information surrounding the family structure,
93	93	composition, relation ships, characteristics, interactions, and
94	94	dynamics;
95	95	3. "Hearing screening" means a test used to evaluate hearing
96	96	across different pitches and determine risk for hearing loss;
97	97	4. "Occupational evaluation " means a test administered by an
98	98	occupational therapist to assess areas of functioning and determine
99	99	the need for a treatment pla n or develop such a treatment plan;
100	100	5. "Physical therapy evaluation " means the administration,
101	101	interpretation, and evaluation of tests and measurements of bodily
102	102	functions and structures;
103	103	6. "Psychiatric evaluation " means an assessment based on
104	104	present problems and symptoms of an individual 's biological, mental,
105	105	and social functioning which may or may not result in the diagnosis
106	106	of a mental illness; and
107	107	7. "Vision screening" means the process or system used to
108	108	identify a person having or who may be at ri sk of developing visual
109	109	problems that may adversely affect their ability to learn .
110	110	C. Students who are at risk of being retained shall receive a
111	111	hearing and visual screening and a family assessment conducted by
112	112	qualified school personnel. Each school shall employ or contract
113	113	with qualified school personnel to conduct such screenings and
114	114	assessments.

141	141	D. Students who are at risk of being retained shall receive a
142	142	psychiatric evaluation selected and completed by a qualified
143	143	professional as determined by the State Department of Education.
144	144	E. Students at risk of being retained shall receive an
145	145	occupational therapy or physical therapy evaluation if the screening
146	146	and evaluations from s ubsections C and D of this section do not
147	147	result in a diagnosis or recommendation for treatment. An
148	148	occupational therapy or physical therapy evaluation shall be
149	149	conducted by qualified medical professionals employed by or
150	150	contracted with the school distric t.
151	151	F. The provisions of this section shall be subject to the
152	152	availability of funding.
153	153	SECTION 2. This act shall become effective July 1, 2025.
154	154	SECTION 3. It being immediately necessary for the preservation
155	155	of the public peace, health or safety, an emergency is hereby
156	156	declared to exist, by reason whereof this act shall take effect and
157	157	be in full force from and after its passage and approval.
