4040 An Act relating to schools; creating the Student
4141 Retention Protocol Act of 2025; providing
4242 definitions; requiring certain screenings,
4343 assessments, and evaluations for students operating
4444 below a certain academic threshold; mandating schools
4545 to employ qualified personnel; subjecting
4646 requirements to availability of fund ing; providing
4747 for codification; providing an effective date; and
4848 declaring an emergency.

5454 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHO MA:
5555 SECTION 1. NEW LAW A new section of law to be codified
5656 in the Oklahoma Statutes as Section 1210.500 of Title 70, unless
5757 there is created a duplication in numbering, reads as follows:
5858 A. This section shall be known and may be cited as the "Student
5959 Retention Protocol Act of 2025 ".
6060 B. As used in this act:
6161 1. "At risk of being retained " means students who have been
6262 identified by school personnel as opera ting below the academic
6363 threshold necessary to permit enrollment into an advan cing grade for
6464 the following school year;

9191 2. "Family assessment" means a process for gathering and
9292 organizing information surrounding the family structure,
9393 composition, relation ships, characteristics, interactions, and
9494 dynamics;
9595 3. "Hearing screening" means a test used to evaluate hearing
9696 across different pitches and determine risk for hearing loss;
9797 4. "Occupational evaluation " means a test administered by an
9898 occupational therapist to assess areas of functioning and determine
9999 the need for a treatment pla n or develop such a treatment plan;
100100 5. "Physical therapy evaluation " means the administration,
101101 interpretation, and evaluation of tests and measurements of bodily
102102 functions and structures;
103103 6. "Psychiatric evaluation " means an assessment based on
104104 present problems and symptoms of an individual 's biological, mental,
105105 and social functioning which may or may not result in the diagnosis
106106 of a mental illness; and
107107 7. "Vision screening" means the process or system used to
108108 identify a person having or who may be at ri sk of developing visual
109109 problems that may adversely affect their ability to learn .
110110 C. Students who are at risk of being retained shall receive a
111111 hearing and visual screening and a family assessment conducted by
112112 qualified school personnel. Each school shall employ or contract
113113 with qualified school personnel to conduct such screenings and
114114 assessments.

141141 D. Students who are at risk of being retained shall receive a
142142 psychiatric evaluation selected and completed by a qualified
143143 professional as determined by the State Department of Education.
144144 E. Students at risk of being retained shall receive an
145145 occupational therapy or physical therapy evaluation if the screening
146146 and evaluations from s ubsections C and D of this section do not
147147 result in a diagnosis or recommendation for treatment. An
148148 occupational therapy or physical therapy evaluation shall be
149149 conducted by qualified medical professionals employed by or
150150 contracted with the school distric t.
151151 F. The provisions of this section shall be subject to the
152152 availability of funding.
153153 SECTION 2. This act shall become effective July 1, 2025.
154154 SECTION 3. It being immediately necessary for the preservation
155155 of the public peace, health or safety, an emergency is hereby
156156 declared to exist, by reason whereof this act shall take effect and
157157 be in full force from and after its passage and approval.
