6067 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6168 SECTION 1. NEW LAW A new section of law to be codified
6269 in the Oklahoma Statutes as Section 3 -7-111 of Title 27A, unless
6370 there is created a duplication in numbering, reads as follows:
64-A. This act shall be known and may be cited as the “Spring
65-Creek Watershed Study Act”.
66-B. The Legislature finds that:

98+A. This act shall be known a nd may be cited as the “Spring
99+Creek Watershed Study Act”.
100+B. The Legislature finds that:
93101 1. Increasing pressure from agriculture and residential
94102 development as well as stream bank erosion and other activities have
95103 led to declining water quality levels i n the Northeast Oklahoma
96104 Watershed known as Spring Creek located in Cherokee, Delaware, and
97105 Mayes counties near Kansas, Oklahoma , resulting in increased concern
98106 by the residents of the Spring Creek area and citizens of Oklahoma
99107 as a whole as to the continu ed health of the watershed. The once
100108 pristine stream is a prime example of how many similar high quality
101109 Ozark waterbodies that draw millions of visitors to the area each
102110 year, support water supplies for growing urban ce nters in Oklahoma,
103111 and provide habitat for important wildlife and fisheries resources
104112 are threatened without cooperative, voluntary protective action by
105113 local communities and other stakeholders;
106114 2. Improved voluntary land management practices including soil
107115 conservation practices, riparian restoration and protection,
108116 reforestation, streambank livestock exclusion, and other methods of
109117 stewardship have great potential to improve and protect the quality
110118 of water in the Spring Creek watershed while improving t he
111119 ecological health of the area; a nd
112120 3. It is in the interest of the citizens of this state as a
113121 whole and the residents of the Spring Creek watershed that the
114-Oklahoma Conservation Commission, in partnership with other local,
115-state, and federal agencies and nongovernmental organizations ,
116-undertake a comprehensive water quality study of Spring Creek to

149+Oklahoma Conservation Commission, in partnership with other local,
150+state, and federal agencies and nongovernmental organizations
151+undertake a comprehensive water quality study of Spring Creek to
143152 determine the best course of action to protect and improve the
144153 health of the aquatic habitat in the watershed.
145154 C. It is the intent of the Legislature that the findings of
146155 this study will be used to direct implementation of voluntary,
147156 incentive-based conservation practices by the Commission in
148157 partnership with other local, state, and federal agencies and
149158 subject to availability of resources, in the Spring Creek watershed
150159 to protect and improve the aquatic habitat and water quality in the
151160 area.
152161 SECTION 2. NEW LAW A new section of law to be codified
153-in the Oklahoma Statutes as Section 3 -7-112 of Title 27A, unless
162+in the Oklahoma Statutes as Section 3 -7-113 of Title 27A, unless
154163 there is created a duplic ation in numbering, reads as follow s:
155164 A. 1. The Oklahoma Conservation Commission shall undertake a
156165 comprehensive watershed -based water quality plan designed to improve
157166 and protect the water quality and aquatic habitat in the Spring
158167 Creek watershed through the utilization of voluntary, inc entive-
159168 based programs.
160169 2. On or before June 1, 202 6, the Commission shall publish an
161170 electronic report of the findings. The Commission may, from time to
162171 time, update such findings as conditions change and pertinent
163172 information becomes available.
164-B. The Commission may contract and cooperate with the Natural
165-Resources Conservation Service of the United States Department of

200+B. The Commission may contract and cooperate with the Natural
201+Resources Conservation Service of the United States Department of
192202 Agriculture and the U.S. Environmental Protection Agency to conduct
193203 activities provided for in this section.
194204 C. The Commission may app ly for and accept grants, gifts, or
195205 other sources of public and private funds to carry out the purposes
196206 of the Spring Creek Watershed Study Act.
197207 SECTION 3. NEW LAW A new section of law to be codifi ed
198-in the Oklahoma Statutes as Section 3 -7-113 of Title 27A, unless
208+in the Oklahoma Statutes as Sect ion 3-7-114 of Title 27A, unless
199209 there is created a duplication in numbering, reads as follows:
200210 There is hereby created in the State Treasury a revolving fund
201211 for the Oklahoma Conservation Commission to be designated the
202212 “Spring Creek Watershed Study Cash Fund Revolving Fund”. The fund
203213 shall be a continuing fund, not subject to fiscal year limitations,
204214 and shall consist of all monies received by the Commission from
205215 appropriations by the Legislature to the fund, and any mo ney
206216 received as gifts, grants, or o ther contributions from public or
207217 private sources provided for the purpose of implementing the Spring
208218 Creek Watershed Study Act. All monies accruing to the credit of the
209219 fund are hereby appropriated and may be budgeted and expended by the
210220 Commission for the purpose provided for in this act. Expenditures
211221 from the fund shall be made upon warrants issued by the State
212222 Treasurer against claims filed as prescribed by law with the
213-Director of the Office of Management an d Enterprise Services for
214-approval and payment.
215-SECTION 4. This act shall become effective November 1, 2025.
