60	67		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
61	68		SECTION 1. NEW LAW A new section of law to be codified
62	69		in the Oklahoma Statutes as Section 3 -7-111 of Title 27A, unless
63	70		there is created a duplication in numbering, reads as follows:
64		-	A. This act shall be known and may be cited as the “Spring
65		-	Creek Watershed Study Act”.

	98	+	A. This act shall be known a nd may be cited as the “Spring
	99	+	Creek Watershed Study Act”.
	100	+	B. The Legislature finds that:
93	101		1. Increasing pressure from agriculture and residential
94	102		development as well as stream bank erosion and other activities have
95	103		led to declining water quality levels i n the Northeast Oklahoma
96	104		Watershed known as Spring Creek located in Cherokee, Delaware, and
97	105		Mayes counties near Kansas, Oklahoma , resulting in increased concern
98	106		by the residents of the Spring Creek area and citizens of Oklahoma
99	107		as a whole as to the continu ed health of the watershed. The once
100	108		pristine stream is a prime example of how many similar high quality
101	109		Ozark waterbodies that draw millions of visitors to the area each
102	110		year, support water supplies for growing urban ce nters in Oklahoma,
103	111		and provide habitat for important wildlife and fisheries resources
104	112		are threatened without cooperative, voluntary protective action by
105	113		local communities and other stakeholders;
106	114		2. Improved voluntary land management practices including soil
107	115		conservation practices, riparian restoration and protection,
108	116		reforestation, streambank livestock exclusion, and other methods of
109	117		stewardship have great potential to improve and protect the quality
110	118		of water in the Spring Creek watershed while improving t he
111	119		ecological health of the area; a nd
112	120		3. It is in the interest of the citizens of this state as a
113	121		whole and the residents of the Spring Creek watershed that the
114		-	Oklahoma Conservation Commission, in partnership with other local,
115		-	state, and federal agencies and nongovernmental organizations ,
116		-	undertake a comprehensive water quality study of Spring Creek to

	149	+	Oklahoma Conservation Commission, in partnership with other local,
	150	+	state, and federal agencies and nongovernmental organizations
	151	+	undertake a comprehensive water quality study of Spring Creek to
143	152		determine the best course of action to protect and improve the
144	153		health of the aquatic habitat in the watershed.
145	154		C. It is the intent of the Legislature that the findings of
146	155		this study will be used to direct implementation of voluntary,
147	156		incentive-based conservation practices by the Commission in
148	157		partnership with other local, state, and federal agencies and
149	158		subject to availability of resources, in the Spring Creek watershed
150	159		to protect and improve the aquatic habitat and water quality in the
151	160		area.
152	161		SECTION 2. NEW LAW A new section of law to be codified
153		-	in the Oklahoma Statutes as Section 3 -7-~~112~~ of Title 27A, unless
	162	+	in the Oklahoma Statutes as Section 3 -7-113 of Title 27A, unless
154	163		there is created a duplic ation in numbering, reads as follow s:
155	164		A. 1. The Oklahoma Conservation Commission shall undertake a
156	165		comprehensive watershed -based water quality plan designed to improve
157	166		and protect the water quality and aquatic habitat in the Spring
158	167		Creek watershed through the utilization of voluntary, inc entive-
159	168		based programs.
160	169		2. On or before June 1, 202 6, the Commission shall publish an
161	170		electronic report of the findings. The Commission may, from time to
162	171		time, update such findings as conditions change and pertinent
163	172		information becomes available.
164		-	B. The Commission may contract and cooperate with the Natural
165		-	Resources Conservation Service of the United States Department of

	200	+	B. The Commission may contract and cooperate with the Natural
	201	+	Resources Conservation Service of the United States Department of
192	202		Agriculture and the U.S. Environmental Protection Agency to conduct
193	203		activities provided for in this section.
194	204		C. The Commission may app ly for and accept grants, gifts, or
195	205		other sources of public and private funds to carry out the purposes
196	206		of the Spring Creek Watershed Study Act.
197	207		SECTION 3. NEW LAW A new section of law to be codifi ed
198		-	in the Oklahoma Statutes as ~~Section~~ 3 -7-~~113~~ of Title 27A, unless
	208	+	in the Oklahoma Statutes as Sect ion 3-7-114 of Title 27A, unless
199	209		there is created a duplication in numbering, reads as follows:
200	210		There is hereby created in the State Treasury a revolving fund
201	211		for the Oklahoma Conservation Commission to be designated the
202	212		“Spring Creek Watershed Study Cash Fund Revolving Fund”. The fund
203	213		shall be a continuing fund, not subject to fiscal year limitations,
204	214		and shall consist of all monies received by the Commission from
205	215		appropriations by the Legislature to the fund, and any mo ney
206	216		received as gifts, grants, or o ther contributions from public or
207	217		private sources provided for the purpose of implementing the Spring
208	218		Creek Watershed Study Act. All monies accruing to the credit of the
209	219		fund are hereby appropriated and may be budgeted and expended by the
210	220		Commission for the purpose provided for in this act. Expenditures
211	221		from the fund shall be made upon warrants issued by the State
212	222		Treasurer against claims filed as prescribed by law with the
213		-	Director of the Office of Management an d Enterprise Services for
214		-	approval and payment.
215		-	SECTION 4. This act shall become effective November 1, 2025.
