9797 Section 1151.2a. A. The Con struction Industries Board is

100100 B. 1. The Construction Industries Board is authorized to

103103 2. The Construction Industries Board shall have the authority

369364 SECTION 2. AMENDATORY 59 O.S. 2021, Section 1151.5, is

371366 Section 1151.5. A. Applications for registration shall be made

400394 and provided by the Board and shall be accompanied by the proper
401395 fee.
402396 B. An applicant or qualifying part y whose registration is
403397 denied, or the person has a conviction, or pled guilty or nolo
404398 contendere to a misdemeanor, or otherwise fails to meet the
405399 requirements of application, may obtain a hearing before the
406400 Committee of Roofing Examiners in order to provide i nformation in
407401 support of the application requirements and any other information
408402 showing the applicant ’s ability and willingness to comply with the
409403 requirements of the Roofing Contractor Registration Act, and to
410404 protect the public health, safety and wel fare.
411405 C. To obtain a roofing contractor registration under the
412406 Roofing Contractor Registration Act, a qualifying part y who is
413407 eighteen (18) years of age or older shall submit, on forms the
414408 registrar prescribes:
415409 1. An application under oath containing a state ment:
416410 a. of the qualifying party ’s experience and
417411 qualifications as a roofing contractor, if any,
418412 b. that the qualifying party desires the issuance of a
419413 roofing contractor registration certificate,
420414 c. that the qualifying party has read the Roofing
421415 Contractor Registration Act and will comply with the
422416 provisions of the Roofing Contractor Registration Act
423417 and rules,

451444 d. that the qualifying party will comply with state laws
452445 and local ordinances relating to standards and
453446 permits,
454447 e. that the qualifying party has or has not been
455448 registered or licensed as a roofing contractor in
456449 another state and whether any disciplinary action has
457450 been taken against such registration or license and
458451 whether it is currently in good standing, and
459452 f. that the nonresident qualifying party appoints the
460453 Secretary of State as legal service agent for all
461454 lawful process to be served upon the applicant f or
462455 work performed in this state or as otherwise provided
463456 in the Roofing Contractor Registration Act;
464457 2. The qualifying party ’s name, physical address and proof
465458 thereof, business name, telephone number, address and place of
466459 incorporation, if different, information on any other person who
467460 will be authorized to act as the business entity, and the
468461 applicant’s phone telephone number, if different;
469462 3. The entity’s federal tax ID number, or the employer ’s or
470463 owner’s or qualifying party ’s social security Social Security
471464 number, and the employer ’s account number assigned by the Oklahoma
472465 Employment Security Commission. The social security Social Security
473466 number information shall remain with the registrar as confidential
474467 and privileged except for necessary disclosures to state agencies to

502494 verify compliance with requirements with this act, or upon request
503495 by law enforcement; and
504496 4. A copy of the roofi ng contractor’s certificate of liability
505497 insurance shall be filed with the application and shall be not less
506498 than Five Hundred Thousand Dollars ($500,000.00) for residential
507499 roofing contractor work and shall not be less than One Million
508500 Dollars ($1,000,000.00) for commercial roofing contractor work.
509501 Additionally, the Construction Industries Board shall be listed as a
510502 certificate holder. Any insurance company issuing a liability
511503 policy to a roofing contractor pursuant to the provisions of the
512504 Roofing Contractor Registration Act shall be required to notify the
513505 Construction Industries Board in the event such liability polic y is
514506 cancelled canceled for any reason or lapses for nonpayment of
515507 premiums. All registrations granted under the Roofing Contractor
516508 Registration Act shall be suspended on the date of the policy
517509 cancellation. The registrar must receive proof of insurance prior
518510 to restoring the registration.
519511 In addition, the roofing contractor shall submit proof that the
520512 contractor has secured workers ’ compensation coverage satisfactory
521513 under the Workers’ Compensation Act, or an affidavit of exemption or
522514 self-insurance as authorized pursuant to the Workers ’ Compensation
523515 Act. If the registrar deems it appropriate or necessary, the
524516 registrar may also require other information to be included on the

554545 D. The qualifying party applying for a commercial roofer
555546 endorsement must provide information on the legal entity, including ,
556547 but not limited to, the articles, organizational agreements or
557548 documents establishing the legal entity, including a list of the
558549 officers, members, managers, partners, or other managing agents of
559550 the legal entity. The qualifying party shall also provide a
560551 certificate of good standing or a trade name report from the Office
561552 of the Secretary of State.
562553 E. The registrar shall refuse to register any person if the
563554 registrar determines:
564555 1. The application contains false, misleading, or incomplete
565556 information;
566557 2. The applicant fails to provide a certificate of good
567558 standing or a trade name report from the Office of the Secretary of
568559 State;
569560 3. The applicant, qualifying party, or any member of the legal
570561 entity fails or refuses to provide any information requested by the
571562 registrar;
572563 4. The applicant fails or refuses to pay the required fees;
573564 5. The applicant, qualifying party, or owner or officer or
574565 managing member of the legal entity is ineligible for registration
575566 due to a suspended or revoked registration in this state;

603593 6. The nonresident applicant has a revoked or suspended
604594 registration or license required by law for roofing contracto rs in
605595 another state; or
606596 7. The applicant, qualifying party, or legal entity has failed
607597 or refuses to submit any taxes due in this state.
608598 F. The registrar shall notify the applicant in writing if the
609599 registrar denies a registration or renewal certificate, and shall
610600 provide the applicant an opportunity to respond to or cure any
611601 defect in the written application or renewal for a period of ten
612602 (10) days from the date of the written notification. An applicant
613603 aggrieved by a decision of the registrar denying a registration or
614604 renewal may appeal the decision as provided in the Roofing
615605 Contractor Registration Act, the Construction Industries Board Act ,
616606 or the Administrative Procedures Act, or the applicant may reapply
617607 after a ninety-day waiting period, if otherwise eligible under the
618608 provisions of the Roofing Contractor Registration Act. The
619609 application and renewal fees shall not be refundable.
620610 G. The registrar shall classify as not in good standing the
621611 registration of any roofing contractor who fails to:
622612 1. Maintain liability insurance coverage;
623613 2. Maintain workers ’ compensation coverage satisfactory under
624614 the Workers’ Compensation Act, or provide an affidavit of exemption
625615 or self-insurance as authorized pursuant to the Workers ’
626616 Compensation Act;

654643 3. File, renew, or properly amend any fictitious name
655644 certificate;
656645 4. Maintain an active status of a corporation or registration
657646 as a foreign corpora tion, a limited liability company or
658647 registration as a foreign limited liability company, a limited
659648 liability partnership registration or foreign limited liability
660649 partnership registration, or a limited partnership certificate or
661650 limited partnership or foreign limited partnership certificate of
662651 authority, with the Office of the Secretary of State;
663652 5. File or renew a trade name registration;
664653 6. Maintain or renew a roofing contractor registration as
665654 provided in the Roofing Contractor Registration Act;
666655 7. Notify the registrar of a change in name, address, legal
667656 business entity, qualifying party, legal service agent, or
668657 adjudication by a court of competent jurisdiction for any act or
669658 omission specified in subsection A of Section 1151.14 of this title
670659 or a violation of the Roofing Contractor Registration Act;
671660 8. Maintain a registration as required by law in another state
672661 while registered in this state as a nonresident roofing contractor;
673662 or
674663 9. File and pay all taxes of the qualifying party and legal
675664 entity when due in this state.
676665 H. The registrar shall send a written notice to the qualifying
677666 party when his or her registrati on is not in good standing.

705693 I. Any roofing contractor who has been notified by the
706694 registrar that his or her registration is not in good stan ding shall
707695 cease soliciting or entering new roofing services and projects as of
708696 the date of such notification; however, the roofing contractor shall
709697 be allowed to complete roofing projects where actual physical work
710698 has begun prior to the date of issua nce of the notice that his or
711699 her registration is not in good standing. The roofing contractor
712700 must disclose the chan ge in standing to any homeowner or other
713701 person who has an interest in any job covered under the Roofing
714702 Contractor Registration Act. Upon no tice of a change in standing,
715703 the homeowner shall have the option to cancel the contract. The
716704 roofing contractor will be owed the actual cost incurred for
717705 materials and the market value of labor already incurred on the job.
718706 The roofing contractor mus t obtain an updated authorization from the
719707 homeowner and other parties of interest if there is an agreement to
720708 continue the job as originally negotiated. If the roofing
721709 contractor fails to correct the deficiency specified in the notice
722710 by evidence satisfactor y to the registrar within thirty (30) days of
723711 the date of the notice, or if the roofing contractor solicits or
724712 enters into new roofing services contracts or projects while the
725713 roofing contractor’s registration is not in good standing, or while
726714 such registration is suspended or revoked, the roofing contractor
727715 shall be in violation of the provisions of the Roofing Contr actor
728716 Registration Act.

756743 J. Any registration that remains not in good standing for a
757744 sixty-day period shall be suspended on the sixtieth day f rom the
758745 date of issuance of the notice to the roofing contractor that his or
759746 her registration is not in good standing. Any registration that
760747 remains not in good standing, and is suspended for such cause, shall
761748 be revoked on the ninetieth day from the date of issuance of the
762749 notice to the roofing contractor that his or her registration is not
763750 in good standing. The re gistrar shall notify the roofing contractor
764751 upon suspension or revocation of his or her registration for failure
765752 to comply in bringing such re gistration into good standing as
766753 required by law. The roofing contractor may reinstate his or her
767754 registration to good standing by paying the required fees provided
768755 in Section 1151.12 of this title and complying with all other
769756 requirements for issuanc e of a registration in good standing.
770757 K. Any registrant, qualifying party, or roofing company owner
771758 aggrieved by the decision of the registrar to suspend or revoke a
772759 registration pursuant to this section may appeal such decision as
773760 provided in this act or the Administrative Procedures Act.

808794 obtain a registration certificate in good st anding. The
809795 registration certificate issued on an original application entitles
810796 the person to act as a roofing contractor within this state, subject
811797 to the limitations of the Roofing Contractor Registration Act.
812798 Until January 1, 2015, all registratio ns shall expire on June 30 of
813799 each year and may be renewed from year to year. Beginning no later
814800 than January 1, 2015 , all registrations issued shall be renewed
815801 based on staggered expiration dates of the last day of the birth
816802 month of the qualifying party so that all registrations and
817803 endorsements shall expire on the last day in the birth month of the
818804 qualifying party. The Construction Industries Board is authorized
819805 to prorate registration and renewal fees, as described by rule, so
820806 that beginning January 1, 2015, or thirty (30) days after rules have
821807 been approved, fees for renewals previously due by June 30, 2015,
822808 are prorated and converted to be due the last day of the birth month
823809 of the qualifying party by shortening or lengthening the next
824810 renewal date by up to six (6) months. Beginning the effective date
825811 of this act November 1, 2014, new initial registrations and
826812 endorsements will be issued for up to eighteen (18) months and due
827813 for renewal the last day of the birth month of the qualifying party.
828814 After initial proration or conversion to birth month, no subsequent
829815 registration or endorsement shall be issued for longer than one (1)
830816 year and all endorsements shall expire on the last day in the birth

859844 shall implement rules for the scheduling of expiration and renewal
860845 of registrations and endorsements, including the prorating of fees
861846 and the identification and information of the qualifying party. The
862847 commercial or residential roofer endorsement shall expire on the
863848 expiration date of the supporting registration.
864849 B. An applicant or qualifying party whose regis tration or
865850 endorsement is refused or denied by the registrar may obtain a
866851 hearing before the Committee of Roofing Examiners with written
867852 notice to the registrar of the grounds for appeal and identification
868853 of evidence to be presented in support of the application
869854 requirements and any other information showing the applicant ’s
870855 ability and willingness to comply with the requirements of the act,
871856 and to protect the public health, safety and welfare. Such appeals
872857 to the Committee of Roofing Examiners shall be ma de by the
873858 qualifying party in writing to the registrar within fourteen (14)
874859 days from the date of the written notification of denial or refusa l
875860 to register or endorse.
876861 C. The Construction Industries Board shall issue a commercial
877862 or residential roofer endorsement to any person who:
878863 1. Has been certified by the Committee of Roofing Examiners as
879864 having successfully passed the appropriate exa mination; and
880865 2. Has paid the application and endorsement fee and has
881866 otherwise complied with all of the provisions o f the commercial or

909893 residential roofer endorsement of the Roofing Contractor
910894 Registration Act. The endorsement fee is hereby established as u p
911895 to Two Hundred Dollars ($200.00). Renewal of a commercial or
912896 residential roofer endorsement shall be One Hundred Dollars
913897 ($100.00).
914898 Endorsements renewed more than thirty (30) days following the
915899 date of expiration may only be renewed upon application and payment
916900 of the required fees and payment of late renewal fee in the amount
917901 of One Hundred Dollars ($100.00).
918902 No endorsement shall be renewed unless the licensee has
919903 completed the required hours of continuing education recommended by
920904 the Committee and set forth by rule.
921905 No late fee shall be charged to renew a registration or
922906 endorsement which expired while the applicant was in active military
923907 service, if application for renewal is made within one (1) year of
924908 discharge from active duty status.
925909 SECTION 4. NEW LAW A new section of law to be codified
926910 in the Oklahoma Statutes as Section 1151.25a of T itle 59, unless
927911 there is created a duplication in numbering, reads as follows:
928912 A. Except as otherwise provided in the Roofing Contractor
929913 Registration Act, on and after the effective date of this act , every
930914 roofing contractor, except for those defined in subsection G of this
931915 section, offering to engage in or engaging in performing residential
932916 roofing contractor work in this state shall be re quired to receive a

960943 residential roofing endorsement. To receive a residential roofing
961944 endorsement, the roofing contractor shall be required to take and
962945 successfully pass a residential roofing examination approved under
963946 the provisions of this act with a minimu m score of seventy percent
964947 (70%), and be in compliance with all other provisions of th is act
965948 and rules before acting or being endorsed as a residential roofing
966949 contractor. For applicants who have been registered and in good
967950 standing with the Construction Industries Board on the effective
968951 date of this act, there shall be a twelve-month grandfathering -in
969952 period from the effective date of this act to either pass the exam
970953 or complete an additional ten (10) hours of continuing education
971954 credits approved in advance by the Committee of Roofing Examiners
972955 and the Construction Industries Board, to be granted a residential
973956 roofer endorsement.
974957 B. Examinations for a residential roofer endorsement shall be
975958 uniform and practical in nature and sufficiently strict to test the
976959 qualifications and fitness of the applicants for endorsement.
977960 Examinations shall be in whole or in part in wr iting. Examinations
978961 shall be offered at least monthly; dates, times, and locations shall
979962 be determined by the registrar or third -party vendor with approval
980963 of the registrar.
981964 C. Any applicant initially failing to pass the examina tion
982965 shall not be permitted to take another examination for a period of
983966 thirty (30) days. Any applicant subsequently failing to pass the

1012994 period of ninety (90) days. However, in a declared state of
1013995 emergency, the examination shall be available as often as possible
1014996 as determined by the registrar.
1015997 D. No residential roofer endorsement shall be renewed un less
1016998 the qualifying party has completed the required hours of continuing
1017999 education pursuant to subsection A of this section .
10181000 E. For all new applicants not registered and in good standing
10191001 with the Construction Industries Board prior to the effective date
10201002 of this act, the Construction Industries Board shall issue a
10211003 residential roofer endorsement to qualifying applicant s no sooner
10221004 than thirty (30) days from the date of successful completion of the
10231005 exam. New applicants shall not be allowed to sell, offer, bid ,
10241006 inspect, or perform any residential roofing contractor work in this
10251007 state until a residential roofer endorsement is issued.
10261008 F. For all applicants registered and in good standing with the
10271009 Construction Industries Board prior to the effective date of this
10281010 act:
10291011 1. The residential roofer endorsement shall be issued
10301012 immediately upon compliance with the provisions of thi s section; and
10311013 2. Applicants shall be allowed to continue residential roofing
10321014 contractor work at all times during the residential roofer
10331015 endorsement application process.

10611042 G. The residential roofing endorsement shall not apply to
10621043 roofing labor contractors who:
10631044 1. Only provide roofing construction labor services;
10641045 2. Are working directly for a registered roofing contractor
10651046 that possesses a resid ential roofing endorsement; and
10661047 3. Are not providing any materials.
10671048 SECTION 5. This act shall be come effective July 1, 2026.
