67	68		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOM A:
68	69		SECTION 1. AMENDATORY 59 O.S. 2021, Section 1151.2a, is

100	100		B. 1. The Construction Industries Board is authorized to

103	103		2. The Construction Industries Board shall have the authority
104	104		to administer and enforce th e provisions of the commercial roofer
105	105		endorsement provisions of the Roofing Contractor Registration Act,
106	106		including the authority to:
107	107		a. establish the examination and continuing education
108	108		requirements and procedures for endorsements of
109	109		persons desiring or intending to engage in the
110	110		business or trade of a commercial roofing contractor
111	111		with the advice and input from the Committee of
112	112		Roofing Examiners using assistance from a third -party
113	113		vendor as necessary and appropriate,
114	114		b. establish and enforce the minimum s tandards of
115	115		commercial roofer endorsements in this state and rules
116	116		promulgated pursuant to the commercial roofer
117	117		endorsement provisions of the Roofing Contractor
118	118		Registration Act with the advice and input from the
119	119		Committee of Roofing Examiners,

163	162		f. establish and levy administrative fines against any
164	163		person who violates any of the provisions of the
165	164		commercial roofer endorsement standards of the Roofing
166	165		Contractor Registration Act or any ru le promulgated
167	166		pursuant thereto, not to exceed five percent (5%) of
168	167		the commercial job. For any residential job , on a
169	168		first violation, the Board may issue a warning levy an
170	169		administrative fine not to exceed Five Hundred Dollars

369	364		SECTION 2. AMENDATORY 59 O.S. 2021, Section 1151.5, is
370	365		amended to read as follows:
371	366		Section 1151.5. A. Applications for registration shall be made
372	367		to the Construction Industries Board in writing on forms approved

400	394		and provided by the Board and shall be accompanied by the proper
401	395		fee.
402	396		B. An applicant or qualifying part y whose registration is
403	397		denied, or the person has a conviction, or pled guilty or nolo
404	398		contendere to a misdemeanor, or otherwise fails to meet the
405	399		requirements of application, may obtain a hearing before the
406	400		Committee of Roofing Examiners in order to provide i nformation in
407	401		support of the application requirements and any other information
408	402		showing the applicant ’s ability and willingness to comply with the
409	403		requirements of the Roofing Contractor Registration Act, and to
410	404		protect the public health, safety and wel fare.
411	405		C. To obtain a roofing contractor registration under the
412	406		Roofing Contractor Registration Act, a qualifying part y who is
413	407		eighteen (18) years of age or older shall submit, on forms the
414	408		registrar prescribes:
415	409		1. An application under oath containing a state ment:
416	410		a. of the qualifying party ’s experience and
417	411		qualifications as a roofing contractor, if any,
418	412		b. that the qualifying party desires the issuance of a
419	413		roofing contractor registration certificate,
420	414		c. that the qualifying party has read the Roofing
421	415		Contractor Registration Act and will comply with the
422	416		provisions of the Roofing Contractor Registration Act
423	417		and rules,

451	444		d. that the qualifying party will comply with state laws
452	445		and local ordinances relating to standards and
453	446		permits,
454	447		e. that the qualifying party has or has not been
455	448		registered or licensed as a roofing contractor in
456	449		another state and whether any disciplinary action has
457	450		been taken against such registration or license and
458	451		whether it is currently in good standing, and
459	452		f. that the nonresident qualifying party appoints the
460	453		Secretary of State as legal service agent for all
461	454		lawful process to be served upon the applicant f or
462	455		work performed in this state or as otherwise provided
463	456		in the Roofing Contractor Registration Act;
464	457		2. The qualifying party ’s name, physical address and proof
465	458		thereof, business name, telephone number, address and place of
466	459		incorporation, if different, information on any other person who
467	460		will be authorized to act as the business entity, and the
468	461		applicant’s phone telephone number, if different;
469	462		3. The entity’s federal tax ID number, or the employer ’s or
470	463		owner’s or qualifying party ’s social security Social Security
471	464		number, and the employer ’s account number assigned by the Oklahoma
472	465		Employment Security Commission. The social security Social Security
473	466		number information shall remain with the registrar as confidential
474	467		and privileged except for necessary disclosures to state agencies to

502	494		verify compliance with requirements with this act, or upon request
503	495		by law enforcement; and
504	496		4. A copy of the roofi ng contractor’s certificate of liability
505	497		insurance shall be filed with the application and shall be not less
506	498		than Five Hundred Thousand Dollars ($500,000.00) for residential
507	499		roofing contractor work and shall not be less than One Million
508	500		Dollars ($1,000,000.00) for commercial roofing contractor work.
509	501		Additionally, the Construction Industries Board shall be listed as a
510	502		certificate holder. Any insurance company issuing a liability
511	503		policy to a roofing contractor pursuant to the provisions of the
512	504		Roofing Contractor Registration Act shall be required to notify the
513	505		Construction Industries Board in the event such liability polic y is
514	506		cancelled canceled for any reason or lapses for nonpayment of
515	507		premiums. All registrations granted under the Roofing Contractor
516	508		Registration Act shall be suspended on the date of the policy
517	509		cancellation. The registrar must receive proof of insurance prior
518	510		to restoring the registration.
519	511		In addition, the roofing contractor shall submit proof that the
520	512		contractor has secured workers ’ compensation coverage satisfactory
521	513		under the Workers’ Compensation Act, or an affidavit of exemption or
522	514		self-insurance as authorized pursuant to the Workers ’ Compensation
523	515		Act. If the registrar deems it appropriate or necessary, the
524	516		registrar may also require other information to be included on the

553	544		as a contractor.
554	545		D. The qualifying party applying for a commercial roofer
555	546		endorsement must provide information on the legal entity, including ,
556	547		but not limited to, the articles, organizational agreements or
557	548		documents establishing the legal entity, including a list of the
558	549		officers, members, managers, partners, or other managing agents of
559	550		the legal entity. The qualifying party shall also provide a
560	551		certificate of good standing or a trade name report from the Office
561	552		of the Secretary of State.
562	553		E. The registrar shall refuse to register any person if the
563	554		registrar determines:
564	555		1. The application contains false, misleading, or incomplete
565	556		information;
566	557		2. The applicant fails to provide a certificate of good
567	558		standing or a trade name report from the Office of the Secretary of
568	559		State;
569	560		3. The applicant, qualifying party, or any member of the legal
570	561		entity fails or refuses to provide any information requested by the
571	562		registrar;
572	563		4. The applicant fails or refuses to pay the required fees;
573	564		5. The applicant, qualifying party, or owner or officer or
574	565		managing member of the legal entity is ineligible for registration
575	566		due to a suspended or revoked registration in this state;

603	593		6. The nonresident applicant has a revoked or suspended
604	594		registration or license required by law for roofing contracto rs in
605	595		another state; or
606	596		7. The applicant, qualifying party, or legal entity has failed
607	597		or refuses to submit any taxes due in this state.
608	598		F. The registrar shall notify the applicant in writing if the
609	599		registrar denies a registration or renewal certificate, and shall
610	600		provide the applicant an opportunity to respond to or cure any
611	601		defect in the written application or renewal for a period of ten
612	602		(10) days from the date of the written notification. An applicant
613	603		aggrieved by a decision of the registrar denying a registration or
614	604		renewal may appeal the decision as provided in the Roofing
615	605		Contractor Registration Act, the Construction Industries Board Act ,
616	606		or the Administrative Procedures Act, or the applicant may reapply
617	607		after a ninety-day waiting period, if otherwise eligible under the
618	608		provisions of the Roofing Contractor Registration Act. The
619	609		application and renewal fees shall not be refundable.
620	610		G. The registrar shall classify as not in good standing the
621	611		registration of any roofing contractor who fails to:
622	612		1. Maintain liability insurance coverage;
623	613		2. Maintain workers ’ compensation coverage satisfactory under
624	614		the Workers’ Compensation Act, or provide an affidavit of exemption
625	615		or self-insurance as authorized pursuant to the Workers ’
626	616		Compensation Act;

654	643		3. File, renew, or properly amend any fictitious name
655	644		certificate;
656	645		4. Maintain an active status of a corporation or registration
657	646		as a foreign corpora tion, a limited liability company or
658	647		registration as a foreign limited liability company, a limited
659	648		liability partnership registration or foreign limited liability
660	649		partnership registration, or a limited partnership certificate or
661	650		limited partnership or foreign limited partnership certificate of
662	651		authority, with the Office of the Secretary of State;
663	652		5. File or renew a trade name registration;
664	653		6. Maintain or renew a roofing contractor registration as
665	654		provided in the Roofing Contractor Registration Act;
666	655		7. Notify the registrar of a change in name, address, legal
667	656		business entity, qualifying party, legal service agent, or
668	657		adjudication by a court of competent jurisdiction for any act or
669	658		omission specified in subsection A of Section 1151.14 of this title
670	659		or a violation of the Roofing Contractor Registration Act;
671	660		8. Maintain a registration as required by law in another state
672	661		while registered in this state as a nonresident roofing contractor;
673	662		or
674	663		9. File and pay all taxes of the qualifying party and legal
675	664		entity when due in this state.
676	665		H. The registrar shall send a written notice to the qualifying
677	666		party when his or her registrati on is not in good standing.

705	693		I. Any roofing contractor who has been notified by the
706	694		registrar that his or her registration is not in good stan ding shall
707	695		cease soliciting or entering new roofing services and projects as of
708	696		the date of such notification; however, the roofing contractor shall
709	697		be allowed to complete roofing projects where actual physical work
710	698		has begun prior to the date of issua nce of the notice that his or
711	699		her registration is not in good standing. The roofing contractor
712	700		must disclose the chan ge in standing to any homeowner or other
713	701		person who has an interest in any job covered under the Roofing
714	702		Contractor Registration Act. Upon no tice of a change in standing,
715	703		the homeowner shall have the option to cancel the contract. The
716	704		roofing contractor will be owed the actual cost incurred for
717	705		materials and the market value of labor already incurred on the job.
718	706		The roofing contractor mus t obtain an updated authorization from the
719	707		homeowner and other parties of interest if there is an agreement to
720	708		continue the job as originally negotiated. If the roofing

723	711		the date of the notice, or if the roofing contractor solicits or

725	713		roofing contractor’s registration is not in good standing, or while
726	714		such registration is suspended or revoked, the roofing contractor
727	715		shall be in violation of the provisions of the Roofing Contr actor
728	716		Registration Act.

756	743		J. Any registration that remains not in good standing for a
757	744		sixty-day period shall be suspended on the sixtieth day f rom the
758	745		date of issuance of the notice to the roofing contractor that his or
759	746		her registration is not in good standing. Any registration that
760	747		remains not in good standing, and is suspended for such cause, shall
761	748		be revoked on the ninetieth day from the date of issuance of the
762	749		notice to the roofing contractor that his or her registration is not
763	750		in good standing. The re gistrar shall notify the roofing contractor
764	751		upon suspension or revocation of his or her registration for failure
765	752		to comply in bringing such re gistration into good standing as
766	753		required by law. The roofing contractor may reinstate his or her
767	754		registration to good standing by paying the required fees provided
768	755		in Section 1151.12 of this title and complying with all other
769	756		requirements for issuanc e of a registration in good standing.
770	757		K. Any registrant, qualifying party, or roofing company owner
771	758		aggrieved by the decision of the registrar to suspend or revoke a
772	759		registration pursuant to this section may appeal such decision as
773	760		provided in this act or the Administrative Procedures Act.
774	761		SECTION 3. AMENDATORY 59 O.S. 2021, Section 1151.10, is
775	762		amended to read as follows:
776	763		Section 1151.10. A. Within twenty-five (25) calendar days from
777	764		the date of application, the registrar shall either issue or deny
778	765		the roofing contractor or residential roofing contractor
779	766		registration. No registration shall be issued to a qualifying party

808	794		obtain a registration certificate in good st anding. The
809	795		registration certificate issued on an original application entitles
810	796		the person to act as a roofing contractor within this state, subject
811	797		to the limitations of the Roofing Contractor Registration Act.
812	798		Until January 1, 2015, all registratio ns shall expire on June 30 of
813	799		each year and may be renewed from year to year. Beginning no later
814	800		than January 1, 2015 , all registrations issued shall be renewed
815	801		based on staggered expiration dates of the last day of the birth
816	802		month of the qualifying party so that all registrations and
817	803		endorsements shall expire on the last day in the birth month of the
818	804		qualifying party. The Construction Industries Board is authorized
819	805		to prorate registration and renewal fees, as described by rule, so
820	806		that beginning January 1, 2015, or thirty (30) days after rules have
821	807		been approved, fees for renewals previously due by June 30, 2015,
822	808		are prorated and converted to be due the last day of the birth month
823	809		of the qualifying party by shortening or lengthening the next
824	810		renewal date by up to six (6) months. Beginning the effective date
825	811		of this act November 1, 2014, new initial registrations and
826	812		endorsements will be issued for up to eighteen (18) months and due
827	813		for renewal the last day of the birth month of the qualifying party.
828	814		After initial proration or conversion to birth month, no subsequent
829	815		registration or endorsement shall be issued for longer than one (1)
830	816		year and all endorsements shall expire on the last day in the birth

859	844		shall implement rules for the scheduling of expiration and renewal
860	845		of registrations and endorsements, including the prorating of fees
861	846		and the identification and information of the qualifying party. The
862	847		commercial or residential roofer endorsement shall expire on the
863	848		expiration date of the supporting registration.
864	849		B. An applicant or qualifying party whose regis tration or
865	850		endorsement is refused or denied by the registrar may obtain a
866	851		hearing before the Committee of Roofing Examiners with written
867	852		notice to the registrar of the grounds for appeal and identification
868	853		of evidence to be presented in support of the application
869	854		requirements and any other information showing the applicant ’s
870	855		ability and willingness to comply with the requirements of the act,
871	856		and to protect the public health, safety and welfare. Such appeals
872	857		to the Committee of Roofing Examiners shall be ma de by the
873	858		qualifying party in writing to the registrar within fourteen (14)
874	859		days from the date of the written notification of denial or refusa l
875	860		to register or endorse.
876	861		C. The Construction Industries Board shall issue a commercial
877	862		or residential roofer endorsement to any person who:
878	863		1. Has been certified by the Committee of Roofing Examiners as
879	864		having successfully passed the appropriate exa mination; and
880	865		2. Has paid the application and endorsement fee and has
881	866		otherwise complied with all of the provisions o f the commercial or

910	894		Registration Act. The endorsement fee is hereby established as u p
911	895		to Two Hundred Dollars ($200.00). Renewal of a commercial or
912	896		residential roofer endorsement shall be One Hundred Dollars
913	897		($100.00).
914	898		Endorsements renewed more than thirty (30) days following the
915	899		date of expiration may only be renewed upon application and payment
916	900		of the required fees and payment of late renewal fee in the amount
917	901		of One Hundred Dollars ($100.00).
918	902		No endorsement shall be renewed unless the licensee has
919	903		completed the required hours of continuing education recommended by
920	904		the Committee and set forth by rule.
921	905		No late fee shall be charged to renew a registration or
922	906		endorsement which expired while the applicant was in active military
923	907		service, if application for renewal is made within one (1) year of
924	908		discharge from active duty status.
925	909		SECTION 4. NEW LAW A new section of law to be codified
926	910		in the Oklahoma Statutes as Section 1151.25a of T itle 59, unless
927	911		there is created a duplication in numbering, reads as follows:
928	912		A. Except as otherwise provided in the Roofing Contractor
929	913		Registration Act, on and after the effective date of this act , every
930	914		roofing contractor, except for those defined in subsection G of this
931	915		section, offering to engage in or engaging in performing residential
932	916		roofing contractor work in this state shall be re quired to receive a

961	944		endorsement, the roofing contractor shall be required to take and
962	945		successfully pass a residential roofing examination approved under
963	946		the provisions of this act with a minimu m score of seventy percent
964	947		(70%), and be in compliance with all other provisions of th is act
965	948		and rules before acting or being endorsed as a residential roofing
966	949		contractor. For applicants who have been registered and in good
967	950		standing with the Construction Industries Board on the effective
968	951		date of this act, there shall be a twelve-month grandfathering -in
969	952		period from the effective date of this act to either pass the exam
970	953		or complete an additional ten (10) hours of continuing education
971	954		credits approved in advance by the Committee of Roofing Examiners
972	955		and the Construction Industries Board, to be granted a residential
973	956		roofer endorsement.
974	957		B. Examinations for a residential roofer endorsement shall be
975	958		uniform and practical in nature and sufficiently strict to test the
976	959		qualifications and fitness of the applicants for endorsement.
977	960		Examinations shall be in whole or in part in wr iting. Examinations
978	961		shall be offered at least monthly; dates, times, and locations shall
979	962		be determined by the registrar or third -party vendor with approval
980	963		of the registrar.
981	964		C. Any applicant initially failing to pass the examina tion
982	965		shall not be permitted to take another examination for a period of
983	966		thirty (30) days. Any applicant subsequently failing to pass the

1012	994		period of ninety (90) days. However, in a declared state of
1013	995		emergency, the examination shall be available as often as possible
1014	996		as determined by the registrar.
1015	997		D. No residential roofer endorsement shall be renewed un less
1016	998		the qualifying party has completed the required hours of continuing
1017	999		education pursuant to subsection A of this section .
1018	1000		E. For all new applicants not registered and in good standing
1019	1001		with the Construction Industries Board prior to the effective date
1020	1002		of this act, the Construction Industries Board shall issue a
1021	1003		residential roofer endorsement to qualifying applicant s no sooner
1022	1004		than thirty (30) days from the date of successful completion of the
1023	1005		exam. New applicants shall not be allowed to sell, offer, bid ,
1024	1006		inspect, or perform any residential roofing contractor work in this
1025	1007		state until a residential roofer endorsement is issued.
1026	1008		F. For all applicants registered and in good standing with the
1027	1009		Construction Industries Board prior to the effective date of this
1028	1010		act:
1029	1011		1. The residential roofer endorsement shall be issued
1030	1012		immediately upon compliance with the provisions of thi s section; and
1031	1013		2. Applicants shall be allowed to continue residential roofing
1032	1014		contractor work at all times during the residential roofer
1033	1015		endorsement application process.

1062	1043		roofing labor contractors who:
1063	1044		1. Only provide roofing construction labor services;
1064	1045		2. Are working directly for a registered roofing contractor
1065	1046		that possesses a resid ential roofing endorsement; and
1066	1047		3. Are not providing any materials.
1067	1048		SECTION 5. This act shall be come effective July 1, 2026.
