49	48		circumstances; authorizing county commissioners to
50	49		discuss budgetary matters in certain circumstances;
51	50		amending 56 O.S. 2021, Section 625.2, which relates
52	51		to the Statewide Independent Living Council; allowing
53	52		the Council to hold meetings via videoconferencing;
54	53		providing procedures; permitting the Council to
55	54		conduct executive sessions by videoconference under
56	55		certain circumstances; and declaring an emergency.

61	62		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
62	63		SECTION 1. AMENDATORY 19 O.S. 2021, Section 326, is
63	64		amended to read as follows:
64	65		Section 326. A. In addition to the special sessi ons for
65	66		equalizing assessments, and all other special sessions now provided
66	67		by law, the county commissioners shall meet and hold sessions for
67	68		the transaction of business in the county courthouse, at the county
68		-	seat, on or before the first Monday of each month, and may remain in

	95	+	seat, on or before the first Monday of each mo nth, and may remain in
96	96		session as long as the public business may require, and the passing
97	97		upon, allowing or rejecting of bills against the county shall be
98	98		taken up and passed upon by the board in the order in which the
99	99		claims have been filed, and in which order such claims must be
100	100		entered upon the calendar, except salary, wage and compensation
101	101		claims of officers and deputies and employees, which salary, wage
102	102		and compensation claims may be considered and paid, on or after the
103	103		termination of the service pay period; provided, that such claims by
104	104		subordinate deputies and employees be first approved by the officer
105	105		having charge of the office or department. The board of county
106	106		commissioners may recess or adjourn its meetings within the session,
107	107		either from time to time or from day to day, or on call of the
108	108		chairman; but, if such board does not sooner adjourn its session for
109	109		any month, such session shall terminate and be adjourned by
110	110		operation of law on the last business day of such month. If the
111	111		board shall have adjourned its session before the last business day
112	112		of any month, the county clerk shall have power to call special
113	113		sessions when the best interests of the county demand it, upon
114	114		giving five (5) days' notice of the time and object of calling the
115	115		commissioners together, by posting up notices in three public places
116	116		in the county, or by publication in some newspaper of general
117	117		circulation in the county; provided, that in the case of a vacancy
118	118		in the office of county clerk, the chairman chair of the board shall

146	145		have power to call a special session f or the purpose of filling such
147	146		vacancy.
148	147		B. The board of county commissioners may meet at times and in
149	148		places within the county other than the county courthouse if it is
150	149		determined that such meetings are beneficial to the general public.
151	150		Such meetings shall be in compliance with the Oklahoma Open Meeting
152	151		Act.
153	152		C. County commissioners may attend and participate in
154	153		conferences, trainings, and educational, press, and social events,
155	154		even if a quorum is present, provided t hat no official action is
156	155		taken and any discussion of the business of the board of county
157	156		commissioners is incidental to the event.
158	157		D. County commissioners may attend and participate in meetings
159	158		and proceedings of the Legislature, even if a quorum is pres ent,
160	159		provided that no official action is taken.
161	160		E. In budget board counties, county commissioners and other
162	161		county elected officers may discuss budgetary matters , provided that
163	162		a quorum of the county budget board is not present and no official
164	163		action is taken.
165	164		SECTION 2. AMENDATORY 56 O.S. 2021, Section 625.2, is
166	165		amended to read as follows:
167	166		Section 625.2. A. There is hereby created the Statewide
168	167		Independent Living Council which shall be established pursuant to

196	194		the federal Rehabilitation Act of 1973, Public Law 93 -112, codified
197	195		at 29 U.S.C., Section 701 et seq., as amended.
198	196		B. The duties of the Council shall be those as set forth in the
199	197		federal Rehabilitation Act of 1973, as amended.
200	198		C. Subject to the availability of state funds other than those
201	199		appropriated to the D epartment of Rehabilitation Services for the
202	200		purpose of providing independent living services to its clients, and
203	201		in accordance with the State Plan for Independent Living, the
204	202		Department of Rehabilitation Services, in joint effort with the
205	203		Statewide Independent Living Council, may contract with independent
206	204		living centers for the purpose of providing independent living
207	205		services to individuals with disabilities and their families.
208	206		D. The Council shall be permitted to ho ld meetings through
209	207		videoconferencing, provided that:
210	208		1. Each member of the Council is audible or visible to each
211	209		other and the public;
212	210		2. The meeting notice and agenda prepared in advance of the
213	211		meeting, as required by the Oklahoma Open Meeting Act, sha ll
214	212		indicate if the meeting will include videoconferencing and shall
215	213		also state:
216	214		a. each Council member appearing remotely, and
217	215		b. the identity of the Council member or members who will
218	216		be physically present at the meeting site, if any;

246	243		3. After the meetin g notice and agenda are prepared and po sted
247	244		as required by law, Council members shall not be permitted to alter
248	245		their method of attendance; provided, however, those members who
249	246		were identified as appearing remotely may be permitted to physically
250	247		appear at the meeting site, if any, for the meeting;
251	248		4. The Council shall be permitted to participate and speak, as
252	249		allowed by rule or policy set by the Council, in a meeting which
253	250		utilizes teleconference or videoconference in the same manner and to
254	251		the same extent as the public is allowed to participat e or speak
255	252		during a meeting where all public body members are physically
256	253		present together at the meeting site;
257	254		5. Unless confidential or privileged by applicable law, any
258	255		documents or other materials provided to memb ers of the Council or
259	256		shared electronically between members of the Council during a
260	257		meeting utilizing teleconferencing or videoconferencing shall also
261	258		be immediately available to the public on the Council's website;
262	259		6. All votes occurring during any meeti ng utilizing
263	260		teleconference or videocon ference shall occur and be recorded by
264	261		roll call votes; and
265	262		7. The Council abides by all other requirements of the Oklahoma
266	263		Open Meeting Act.
267	264		E. The Council is permitted to conduct an executive session by
268	265		videoconference. For such executive sessions, no Council member is
269	266		required to be physically present so long as each Council member is

299	295		if the executive session will inclu de videoconferencing and shall
300	296		also state the identity of each Council member appearing remotely,
301	297		and whether any member will be physically present at the meeting
302	298		site, if any, for the executive session.
303	299		SECTION 3. It being immediately necessary for the preservation
304	300		of the public peace, health or safety, an emergency is hereby
305	301		declared to exist, by reason whereof this act shall take effect and
306	302		be in full force from and after its passage and approval.
