40	40	An Act relating to schools; requiring proof of
41	41	citizenship or legal immigration status to be
42	42	provided during school enrollment; stating
43	43	documentation that can be used for proof; mandating
44	44	district recording and reporting of certain data;
45	45	clarifying construction of act; prohibiting the
46	46	recording of certain data; providing for
47	47	codification; providing an effective date; and
48	48	declaring an emergency.

54	54	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
55	55	SECTION 1. NEW LAW A new section of law to be codified
56	56	in the Oklahoma Statutes as Section 24-162 of Title 70, unless there
57	57	is created a duplication in numberi ng, reads as follows:
58	58	A. A parent or guardian, when enrolling his or her child as a
59	59	student in an Oklahoma public or charter school, shall provide proof
60	60	of United States citizenship or legal immigration status of the
61	61	child through presentation of one of t he following:
62	62	1. His or her United States passport;
63	63	2. His or her Permanent Resident Card;
64	64	3. His or her Oklahoma driver license;

91	91	4. His or her Social Security card; or
92	92	5. His or her birth certificate issued by one of the fifty
93	93	United States, Washingt on D.C., or one of the five inhabited United
94	94	States territories: American Samoa, Guam, the Northern Mariana
95	95	Islands, Puerto Rico, or the U.S. Virgin Islands.
96	96	B. Each school district shall record the number of students
97	97	enrolled within the district whose p arent(s) or guardian(s) could
98	98	not provide proof of citizenship or legal immigr ation status as
99	99	outlined in subsection A of this section due to the lack of
100	100	citizenship or legal immigration status of the student and shall
101	101	submit this information to the State Department of Education through
102	102	the Oklahoma student identification system established by subsection
103	103	E of Section 18-200.1 of Title 70 of the Oklahoma Statutes.
104	104	C. Nothing in this act shall be construed to inhibit any child
105	105	from receiving the education he or she is entitled to receive under
106	106	United States law or Oklahoma law.
107	107	D. Nothing in this act shall be construed to allow the
108	108	recording of any student data, except for the lack of documentation
109	109	outlined in subsection B of this section, or recording of an
110	110	individual student's citizenship status or legal immigration status.
111	111	SECTION 2. This act shall become effective July 1, 2025.
112	112	SECTION 3. It being immediately necessary for the preservation
113	113	of the public peace, health or s afety, an emergency is hereby
