4040 An Act relating to schools; requiring proof of
4141 citizenship or legal immigration status to be
4242 provided during school enrollment; stating
4343 documentation that can be used for proof; mandating
4444 district recording and reporting of certain data;
4545 clarifying construction of act; prohibiting the
4646 recording of certain data; providing for
4747 codification; providing an effective date; and
4848 declaring an emergency.

5454 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5555 SECTION 1. NEW LAW A new section of law to be codified
5656 in the Oklahoma Statutes as Section 24-162 of Title 70, unless there
5757 is created a duplication in numberi ng, reads as follows:
5858 A. A parent or guardian, when enrolling his or her child as a
5959 student in an Oklahoma public or charter school, shall provide proof
6060 of United States citizenship or legal immigration status of the
6161 child through presentation of one of t he following:
6262 1. His or her United States passport;
6363 2. His or her Permanent Resident Card;
6464 3. His or her Oklahoma driver license;

9191 4. His or her Social Security card; or
9292 5. His or her birth certificate issued by one of the fifty
9393 United States, Washingt on D.C., or one of the five inhabited United
9494 States territories: American Samoa, Guam, the Northern Mariana
9595 Islands, Puerto Rico, or the U.S. Virgin Islands.
9696 B. Each school district shall record the number of students
9797 enrolled within the district whose p arent(s) or guardian(s) could
9898 not provide proof of citizenship or legal immigr ation status as
9999 outlined in subsection A of this section due to the lack of
100100 citizenship or legal immigration status of the student and shall
101101 submit this information to the State Department of Education through
102102 the Oklahoma student identification system established by subsection
103103 E of Section 18-200.1 of Title 70 of the Oklahoma Statutes.
104104 C. Nothing in this act shall be construed to inhibit any child
105105 from receiving the education he or she is entitled to receive under
106106 United States law or Oklahoma law.
107107 D. Nothing in this act shall be construed to allow the
108108 recording of any student data, except for the lack of documentation
109109 outlined in subsection B of this section, or recording of an
110110 individual student's citizenship status or legal immigration status.
111111 SECTION 2. This act shall become effective July 1, 2025.
112112 SECTION 3. It being immediately necessary for the preservation
113113 of the public peace, health or s afety, an emergency is hereby
