98106 This act shall be known and m ay be cited as the "Uniform Health
99107 Care Decisions Act of 2025 ".
100108 SECTION 2. NEW LAW A new section of law to be codified
101109 in the Oklahoma Statutes as Section 3100.1 of Title 63, unless there
102110 is created a duplication in numbering, reads as follows:
103111 As used in this act:
104112 1. "Advance health care directive " means a power of attorney
105113 for health care, health care instruction, or both. The term
106114 includes an advance mental health care directive;
107115 2. "Advance mental health care directive " means a power of
108116 attorney for health care, health care instruction, or both, created
109117 under Section 9 of this act;
110118 3. "Agent" means an individual appointed under a power of
111119 attorney for health care to make a health care decision for the
112120 individual who made the appointment. The term includes a co agent or
113121 alternate agent appointed under Secti on 20 of this act;
114122 4. "Capacity" means having capacity under Section 3 of this
115123 act;
116124 5. "Cohabitant" means each of two individuals who have been
117125 living together as a couple f or at least one (1) year after each

146155 6. "Default surrogate" means an individual authorized under
147156 Section 12 of this act to make a health care decision for another
148157 individual;
149158 7. "Electronic" means relating to technology having electrical,
150159 digital, magnetic, wir eless, optical, electromagnetic, or similar
151160 capabilities;
152161 8. "Family member" means a spouse, domestic partner, adult
153162 child, parent, or grandparent, or an adult descendant of a spouse,
154163 child, parent, or grandparent;
155164 9. "Guardian" means a person appointed under other law by a
156165 court to make decisions regarding the personal affairs of an
157166 individual, which may include health care decisions. The term does
158167 not include a guardian ad litem;
159168 10. "Health care" means care or treatment or a service or
160169 procedure to maintain, monitor, diagnose, or otherwise affect an
161170 individual's physical or mental illness, injury, or condition. The
162171 term includes mental health care;
163172 11. "Health care decision" means a decision made by an
164173 individual or the individual 's surrogate regarding the individual's
165174 health care, including:
166175 a. selection or discharge of a health care professional
167176 or health care institution,

200210 12. "Health care institution " means a facility or agency
201211 licensed, certified, or otherwise authorized or permitted by oth er
202212 law to provide health care in this state in the ordinary course of
203213 business;
204214 13. "Health care instruction " means a direction, whether or not
205215 in a record, made by an individual that indicates the individual 's
206216 goals, preferences, or wishes concerning the provision, withholding,
207217 or withdrawal of health care. The term includes a direction
208218 intended to be effective if a specified condition arises;
209219 14. "Health care professional " means a physician or other
210220 individual licensed, certified, or otherwise authoriz ed or permitted
211221 by other law of this state to provide health care in this state in
212222 the ordinary course of business or the practice of the physician 's
213223 or individual's profession;
214224 15. "Individual" means an adult or emancipated minor;
215225 16. "Mental health care" means care or treatment or a service
216226 or procedure to maintain, monitor, diagnose, or otherwise affect an

244255 psychosocial condition;
245256 17. "Nursing home" means a nursing facility as defined in
246257 Section 1919(a)(1) of the Social Security Act, 42 U.S.C. , Section
247258 1396r(a)(1), as amended, or skilled nursing facility as defined in
248259 Section 1819(a)(1) of the Social Security Act, 42 U.S.C. , Section
249260 1395i–3(a)(1), as amended;
250261 18. "Person" means an individual, estate, business or nonprofit
251262 entity, government or governmental subdivision, agency, or
252263 instrumentality, or other legal entity;
253264 19. "Person interested in the welfare of the individual" means:
254265 a. the individual's surrogate,
255266 b. a family member of t he individual,
256267 c. the cohabitant of the individual,
257268 d. a public entity providing health care case management
258269 or protective services to the individual,
259270 e. a person appointed under other law to make decisions
260271 for the individual under a power of attorney for
261272 finances, or
262273 f. a person that has an ongoing personal or professional
263274 relationship with the individual, including a person
264275 that has provided educational or health care services
265276 or supported decision making to the individual;

292304 20. "Physician" means an individual authorized to practice
293305 medicine from the State Board of Medical Licensure and Supervision
294306 or the State Board of Osteopathic Examiners;
295307 21. "Power of attorney for health care " means a record in which
296308 an individual appoints an agent to make health care decisions for
297309 the individual;
298310 22. "Reasonably available " means being able to be contacted
299311 without undue effort and being willing and able to act in a timely
300312 manner considering the urgency of an individual 's health care
301313 situation. When used to refer to an agent or default surrogate, the
302314 term includes being willing and able to comply with the duties under
303315 Section 17 of this act in a timely manner considering the urgency of
304316 an individual's health care situation;
305317 23. "Record" means information:
306318 a. inscribed on a tangible medium, or
307319 b. stored in an electronic or other medium and
308320 retrievable in perceivable form;
309321 24. "Responsible health care professional " means:
310322 a. a health care professional designated by an individual
311323 or the individual's surrogate to have pr imary
312324 responsibility for the individual 's health care or for
313325 overseeing a course of treatment, or
314326 b. in the absence of a designation under subparagraph a
315327 of this paragraph, or if the professional designated

343356 reasonably available, a health care professional who
344357 has primary responsibility for overseeing the
345358 individual's health care or for overseeing a course of
346359 treatment;
347360 25. "Sign" means with present intent to authenticate or adopt a
348361 record:
349362 a. execute or adopt a tangible symbol, or
350363 b. attach to or logically associate with the record an
351364 electronic symbol, sound, or process;
352365 26. "State" means a state of the United States, the District of
353366 Columbia, Puerto Rico, the United States Virgin Islands, or any
354367 other territory, or possession subject to the jurisdiction of the
355368 United States. The term includes a federally recognized Indian
356369 tribe;
357370 27. "Supported decision making " means assistance, from one or
358371 more persons of an individual 's choosing, that helps the individual
359372 make or communicate a decision, including by helping the individual
360373 understand the nature and consequences of the decision; and
361374 28. "Surrogate" means:
362375 a. an agent,
363376 b. a default surrogate, or
364377 c. a guardian authorized to make health care decisions.

391405 SECTION 3. NEW LAW A new section of law to be codified
392406 in the Oklahoma Statutes as Section 3100.2 of Title 63, unless there
393407 is created a duplication in numberin g, reads as follows:
394408 A. An individual has capacity for the purpose of this act if
395409 the individual:
396410 1. Is willing and able to communicate a decision independently
397411 or with appropriate services, technological assistance, supported
398412 decision making, or other reasonable accommodation; and
399413 2. In making or revoking:
400414 a. a health care decision , understands the nature and
401415 consequences of the decision, including the primary
402416 risks and benefits of the decision,
403417 b. a health care instruction, understands the nature and
404418 consequences of the instruction, including the primary
405419 risks and benefits of the c hoices expressed in the
406420 instruction, and
407421 c. an appointment of an agent under a health care power
408422 of attorney or identification of a default surrogate
409423 under paragraph 1 of subsection B of Section 12 of
410424 this act, recognizes the identity of the individual
411425 being appointed or identified and understands the
412426 general nature of the relationship of the individual
413427 making the appointment or identification with the
414428 individual being appointe d or identified.

441456 B. The right of an individual who has capacity to make a
442457 decision about the individual 's health care is not affected by
443458 whether the individual creates or revokes an advance health care
444459 directive.
445460 SECTION 4. NEW LAW A new section of law to be codified
446461 in the Oklahoma Statutes as Section 3100.3 of Title 63, unless there
447462 is created a duplication in numbering, reads as follows:
448463 A. An individual is presumed to have capacity to make or revoke
449464 a health care decision, heal th care instruction, and power of
450465 attorney for health care unless:
451466 1. A court has found the individual lacks capacity to do so; or
452467 2. The presumption is rebutted under subsection B of this
453468 section.
454469 B. Subject to Sections 5 and 6 of this act, a presumption under
455470 subsection A of this section may be rebutted by a finding that the
456471 individual lacks capacity:
457472 1. Subject to subsection C of this section, made on the basis
458473 of a contemporaneous examination by any of the following:
459474 a. a physician,
460475 b. a psychologist licensed or otherwise authorized to
461476 practice in this state, or
462477 c. an individual with training and expertise in the
463478 finding of lack of capacity who is licensed or
464479 otherwise authorized to practice in this state as:

492508 (2) an advanced practice registered nurse, or
493509 (3) a social worker, or
494510 d. a responsible health c are professional not described
495511 in subparagraph a, b, or c of this paragraph if:
496512 (1) the individual about whom the finding is to be
497513 made is experiencing a health condition requ iring
498514 a decision regarding health care treatment to be
499515 made promptly to avoid los s of life or serious
500516 harm to the health of the individual, and
501517 (2) an individual listed in subparagraph a, b, or c
502518 of this paragraph is not reasonably available;
503519 2. Made in accordance with accepted standards of the profession
504520 and the scope of practice of the individual making the finding and
505521 to a reasonable degree of certainty; and
506522 3. Documented in a record signed by the individual making the
507523 finding that includes an opinion of the cause, nature, extent, and
508524 probable duration of the lack of capacity.
509525 C. The finding under subsection B of this section may not be
510526 made by:
511527 1. A family member of the individual presumed to have capacity;
512528 2. The cohabitant of the individual or a descendant of the
513529 cohabitant; or

541558 surrogate, or a descendant of the surrogate.
542559 D. If the finding under subsection B of this section was based
543560 on a condition the individual no longer has or a responsible health
544561 care professional subsequently has good cause to believe the
545562 individual has capacity, the individual is presumed to have capacity
546563 unless a court finds the individual lacks capacity or the
547564 presumption is rebutted under subsection B of this section.
548565 SECTION 5. NEW LAW A new section of law to be codified
549566 in the Oklahoma Statutes as Section 3100.4 of Title 63, unless there
550567 is created a duplication in numbering, reads as follows:
551568 A. As soon as reasonably feasible, an individual w ho makes a
552569 finding under subsection B of Section 4 of this act shall inform the
553570 individual about whom the finding was made or the individual 's
554571 responsible health care professional of the finding.
555572 B. As soon as reasonably feasible, a responsible health care
556573 professional who is informed of a finding under subsection B of
557574 Section 4 of this act shall inform the individual about whom the
558575 finding was made and the individual 's surrogate.
559576 C. An individual found under subsection B of Section 4 of this
560577 act to lack capacity may object to the finding:
561578 1. By orally informing a responsible health care professional;

589607 professional or the health care institution in which the individual
590608 resides or is receiving care; or
591609 3. By another act that clearly indicates the individual 's
592610 objection.
593611 D. If the individual objects under subsection C of this
594612 section, the finding under subsection B of Section 4 of this act is
595613 not sufficient to rebut a presumption of capacity under subsection A
596614 of Section 4 of this act and the individual must be treated as
597615 having capacity unless:
598616 1. The individual withdraws the objection;
599617 2. A court finds the individual lacks the presumed capacity;
600618 3. The individual is experiencing a health condition requiring
601619 a decision regarding health care treatment to be made promptly to
602620 avoid imminent loss of life or serious harm to the health of the
603621 individual; or
604622 4. Subject to subsection B of this section, the finding is
605623 confirmed by a second finding made by an i ndividual authorized under
606624 paragraph 1 of subsection B of Section 4 of this act who:
607625 a. did not make the first finding,
608626 b. is not a family member of the individual who made the
609627 first finding, and
610628 c. is not the cohabitant of the individual who made the
611629 first finding or a descendant of the cohabitant.

638657 E. A second finding that the indivi dual lacks capacity under
639658 paragraph 4 of subsection D of this section is not sufficient to
640659 rebut the presumption of capacity if the individual is requesting
641660 the provision or continuation of life-sustaining treatment and the
642661 finding is being used to make a decision to withhold or withdraw the
643662 treatment.
644663 F. As soon as reasonably feasible, a health care professional
645664 who is informed of an objection under subsection C of this section
646665 shall:
647666 1. Communicate the objection to a responsible health care
648667 professional; and
649668 2. Document the objection and the date of the objection in the
650669 individual's medical record or communicate the objection and the
651670 date of the objection to an administrato r with responsibility for
652671 medical records of the health care institution providin g health care
653672 to the individual, who shall document the objection and the date of
654673 the objection in the individual 's medical record.
655674 SECTION 6. NEW LAW A new section of law to be codified
656675 in the Oklahoma Statutes as Section 3100.5 of Title 63, unless there
657676 is created a duplication in numbering, reads as follows:
658677 A. An individual found under subsection B of Section 4 of this
659678 act to lack capacity, a respon sible health care professional, the
660679 health care institution providing health care to the individual, or
661680 a person interested in the welfare of the individual may petition

689709 or is located to determine whether the individual lacks capacity.
690710 B. The court in which a petition under subsection A of this
691711 section is filed shall appoint legal counsel to represent the
692712 individual if the individual does not have legal counsel and a
693713 guardian ad litem. The court shall hear the petition as soon as
694714 possible, but not later than seven (7) days after the petition is
695715 filed. As soon as possible, but not later than seven (7) days after
696716 the hearing, the court shall determine whether the individual lacks
697717 capacity. The court may determine the individual lacks capacity
698718 only if the court finds by clear and convincing evidence that the
699719 individual lacks capacity.
700720 SECTION 7. NEW LAW A new section of law to be codified
701721 in the Oklahoma Statutes as Se ction 3100.6 of Title 63, unless there
702722 is created a duplication in numbering, rea ds as follows:
703723 A. An individual may create a health care instruction that
704724 expresses the individual 's preferences for future health care,
705725 including preferences regarding:
706726 1. Health care professionals or health care institutions;
707727 2. How a health care decision will be made and communicated;
708728 3. Persons that should or should not be consulted regarding a
709729 health care decision;
710730 4. A person to serve as guardian for the individual i f one is
711731 appointed; and

738759 5. An individual to serve as a default surrogate.
739760 B. A health care professional to whom an individual
740761 communicates or provides an instruction under subsection A of this
741762 section shall document the instruction and the date of the
742763 instruction in the individual 's medical record or communicate the
743764 instruction and date of the instruction to an administrator with
744765 responsibility for medical records of the health care institution
745766 providing health care to the individual, who shall document t he
746767 instruction and the date of the instruction in the individual 's
747768 medical record.
748769 C. A health care instruction made by an individual that
749770 conflicts with an earlier health care instruction made by the
750771 individual, including an instruction documented in a medical order,
751772 revokes the earlier instruction to the extent of the conflict.
752773 D. A health care instruction may be in the same record as a
753774 power of attorney for health care.
754775 SECTION 8. NEW LAW A new section of law to be codified
755776 in the Oklahoma Statutes as Section 3100.7 of Title 63, unless there
756777 is created a duplication in numbering, reads as follows:
757778 A. An individual may create a power of attorney for health care
758779 to appoint an agent to make health care decisions for the
759780 individual.
760781 B. An individual is disqualified from acting as agent for an
761782 individual who lacks capacity to make health care decisions if:

15881626 C. A responsible health care professional may require an
15891627 individual who assumes authority to act as a default surrogate to
15901628 provide a declaration in a record under penalty of perjury stating
15911629 facts and circumstances reasonably sufficient to establish the
15921630 authority.
15931631 D. If a responsible health care professional reasonably
15941632 determines that an individual who assumed authority to act as a
15951633 default surrogate is not willing or able to comply with a duty under
15961634 Section 17 of this act or fails to comply with the duty in a timely
15971635 manner, the professio nal may recognize the individual next in
15981636 priority under subsection B of this section as the default
15991637 surrogate.
16001638 E. A health care decision made by a default surrogate is
16011639 effective without judicial approval.

16481687 after the solicitation, shall comply with the decision of a majority
16491688 of the members who have communicated their views to the professional
16501689 and the professional reasonably believes are acting consistent with
16511690 their duties under Section 17 of this act.

16851725 A. An individual for whom a health care decision would be made
16861726 may disqualify another individual from acting as default su rrogate
16871727 for the first individual. The disqualification must be in a record
16881728 signed by the first individual or communicated verbally or
16891729 nonverbally to the individual being disq ualified, another
16901730 individual, or a responsible health care professional.
16911731 Disqualification under this subsection is effective even if made by
16921732 an individual who lacks capacity to make an advance directive if the
16931733 individual clearly communicates a desire that the individual being
16941734 disqualified cannot make health care decisions for the indi vidual.
16951735 B. An individual is disqualified from acting as a default
16961736 surrogate for an individual who lacks capacity to make health care
16971737 decisions if:
16981738 1. A court finds that the potential default surrogate poses a
16991739 danger to the individual 's well-being, even if the court does not
17001740 issue a restraining order against the potential surrogate;

17381779 A. An individual may revoke the appointment of an agent, the

17811823 health care directive of an i ndividual that conflicts with another
17821824 advance health care directive of the individual revokes the earlier
17831825 directive to the extent of the conflict.
17841826 D. Unless otherwise provide d in an individual's advance health
17851827 care directive appointing an agent, the appointment of a spouse of
17861828 an individual as agent for the individual is revoked if:
17871829 1. A petition for annulment, divorce, dissolution of marriage,
17881830 legal separation, or termination has been filed and not dismissed or
17891831 withdrawn;

17911833 legal separation, or termination has been issued;

18311874 B. A person may assume without inquiry that an advance health
18321875 care directive is genuine, valid, and still in effect, and may
18331876 implement and rely on it, unless the person has good cause to
18341877 believe the directive is invalid or has been revoked.
18351878 C. An advance health care directive, revocation of a directive,
18361879 or a signature on a dire ctive or revocation may not be denied legal
18371880 effect or enforceability solely because it is in electronic form.
18381881 D. Evidence relating to an advance health care directive,
18391882 revocation of a directive, or a signature on a directive or
18401883 revocation may not be exclu ded in a proceeding solely because the
18411884 evidence is in electronic form.
18421885 E. This act does not affect the validity of an electronic
18431886 record or signature that is valid under Section 15-101 et seq. of
18441887 Title 12A of the Oklahoma Statutes .
18451888 F. If this act conflict s with other law of this state relating
18461889 to the creation, execution, implementation, or revocation of an
18471890 advance health care directive, this act prevails.

18851929 ascertainable by the agent or default surrogate.
18861930 C. If there is not a direction in an advance health care
18871931 directive and the goals, preferences, and wishes of the individual
18881932 regarding a health care decision are no t known or reasonably
18891933 ascertainable by the agent or default surrogate, the agent or
18901934 default surrogate shall make the decision in accordance with the
18911935 agent's or default surroga te's determination of the individual 's
18921936 best interest.
18931937 D. In determining the indi vidual's best interest under
18941938 subsection C of this section, the agent or default surrogate shall:
18951939 1. Give primary consideration to the individual 's
18961940 contemporaneous communications, including verbal and nonverbal
18971941 expressions;

19361981 A. Except as provided in subs ection C of this section, the
19371982 power of an agent or default surrogate commences wh en the individual
19381983 is found under subsection B of Section 4 of this act or by a court
19391984 to lack capacity to make a health care decision. The power ceases
19401985 if the individual later is found to have capacity to make a health
19411986 care decision, or the individual obje cts under subsection C of

19802026 C. A power of attorney for heal th care may provide that the
19812027 power of an agent under subsection B of this section commences on
19822028 appointment.
19832029 D. If no other person is authorized to do so, an agent or
19842030 default surrogate may apply for public or private health insurance
19852031 and benefits on behalf of the individual. An agent or default
19862032 surrogate who may apply for insurance and benefits does not, solely
19872033 by reason of the power , have a duty to apply for the insurance or
19882034 benefits.
19892035 E. An agent or default surrogate may not consent to voluntary
19902036 admission of the individual to a facility for mental health
19912037 treatment unless:
19922038 1. Voluntary admission is specifically authorized by the
19932039 individual in an advance health care directive in a record; and
19942040 2. The admission is for no more than the maximum of the number
19952041 of days specified in the directive.

22822289 3. Compliance with the instru ction or decision would:
22832290 a. require the professional to provide care that is
22842291 contrary to the professional 's religious belief or
22852292 moral conviction if other law permits the professional

25292541 of the profession of the professional; and
25302542 3. The provision of care does not begin in a health care
25312543 institution in which the individual resides or was receiving care.
25322544 E. In an action under this section, a prevailing plaintiff may
25332545 recover reasonable attorney fees, court costs, and other reasonable
25342546 litigation expenses.
25352547 F. A cause of action or remedy under this section is in
25362548 addition to any cause of action or remedy under other law.
