4047 An Act relating to crimes and punishments; amen ding
4148 21 O.S. 2021, Section 1702, which relates to larceny
4249 of lost property; making certain acts unlawful;

4855 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4956 SECTION 1. AMENDATORY 21 O.S. 2021, Section 1702, is
5057 amended to read as follows:
5158 Section 1702. A. One who finds lost property under
5259 circumstances which gives him the person knowledge or means of
5360 inquiry as to the true owner, and who appropriates such property to
5461 his or her own use, or to the use of another person who is not
5562 entitled thereto, without having first made such effort to find the
5663 owner and restore the property to him the owner as the circumstances
5764 render reasonable and just, is guilty of larceny pun ishable as
5865 follows:
59-1. If the value of the property is less than One Thousand
60-Dollars ($ 1,000.00), the person shall be guilty of a misdemeanor
61-punishable by imprisonment in the county jail not to exceed one (1)

93+1. If the value of the property is less than One Thousand
94+Dollars ($ 1,000.00), the person shall be guilty of a misdemeanor
95+punishable by imprisonment in the county jail not to exceed one (1)
8896 year, or by a fine not to exceed Five Hundr ed Dollars ($500.00), or
8997 by both such imprisonment and fine;
9098 2. If the value of the property is One Thousand Dollars
9199 ($1,000.00) or more but less than Two Thousand Five Hundred Dollars
92100 ($2,500.00), the person shall be guilty of a felony punishable by
93101 imprisonment in the custody of the Department of Corrections not to
94102 exceed two (2) years, or in the county jail not to exceed one (1)
95103 year, or by a fine not to exceed One Thousand Dollars ($1,000.00),
96104 or by both such imprisonment and fine;
97105 3. If the value of the property is Two Thousand Five Hundred
98106 Dollars ($2,500.00) or more but less than F ifteen Thousand Dollars
99107 ($15,000.00), the person shall be guilty of a felony punishable by
100108 imprisonment in the custody of the Department of Corrections not to
101109 exceed five (5) years, or in the county jail not to exceed one (1)
102110 year, or by a fine not to exce ed One Thousand Dollars ($1,000.00),
103111 or by both such imprisonment and fine; an d
104112 4. If the value of the property is Fifteen Thousand Dollars
105113 ($15,000.00) or more, the pers on shall be guilty of a felony
106114 punishable by imprisonment in the custody of the Depar tment of
107115 Corrections not to exceed eight (8) years, or by a fine not to
108-exceed One Thousand Dollars ($1,000.00), or by both such
109-imprisonment and fine.

143+exceed One Thousand Dollars ($1,000.00), or by both such
144+imprisonment and fine.
145+B. It shall be unlawful:
137146 1. To remove a shopping cart from the parking area of a retail
138147 establishment with the intent to permanently or temporarily deprive
139148 the owner of the shoppin g cart the use of the cart; or
140149 2. To be in possession of any shopping cart that has been
141150 removed from the parking area of a retail establishment with the
142151 intent to permanently or temporarily deprive the owner of the
143152 shopping cart the use of the cart.
144153 Any person who violates the provisions of this subsection shall,
145154 upon conviction, be guilty of a misdemeanor punishable by
146155 imprisonment in a county jail not to exceed one (1) year, o r by a
147156 fine not to exceed One Thousand Dollars ($1,000.00), or by both such
148157 fine and imprisonment.
149158 SECTION 2. This act shall become effective November 1, 2025.
