40	47		An Act relating to crimes and punishments; amen ding
41	48		21 O.S. 2021, Section 1702, which relates to larceny
42	49		of lost property; making certain acts unlawful;
43	50		providing penalties; and providing an effective date .

48	55		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
49	56		SECTION 1. AMENDATORY 21 O.S. 2021, Section 1702, is
50	57		amended to read as follows:
51	58		Section 1702. A. One who finds lost property under
52	59		circumstances which gives him the person knowledge or means of
53	60		inquiry as to the true owner, and who appropriates such property to
54	61		his or her own use, or to the use of another person who is not
55	62		entitled thereto, without having first made such effort to find the
56	63		owner and restore the property to him the owner as the circumstances
57	64		render reasonable and just, is guilty of larceny pun ishable as
58	65		follows:
59		-	1. If the value of the property is less than One Thousand
60		-	Dollars ($ 1,000.00), the person shall be guilty of a misdemeanor
61		-	punishable by imprisonment in the county jail not to exceed one (1)

	93	+	1. If the value of the property is less than One Thousand
	94	+	Dollars ($ 1,000.00), the person shall be guilty of a misdemeanor
	95	+	punishable by imprisonment in the county jail not to exceed one (1)
88	96		year, or by a fine not to exceed Five Hundr ed Dollars ($500.00), or
89	97		by both such imprisonment and fine;
90	98		2. If the value of the property is One Thousand Dollars
91	99		($1,000.00) or more but less than Two Thousand Five Hundred Dollars
92	100		($2,500.00), the person shall be guilty of a felony punishable by
93	101		imprisonment in the custody of the Department of Corrections not to
94	102		exceed two (2) years, or in the county jail not to exceed one (1)
95	103		year, or by a fine not to exceed One Thousand Dollars ($1,000.00),
96	104		or by both such imprisonment and fine;
97	105		3. If the value of the property is Two Thousand Five Hundred
98	106		Dollars ($2,500.00) or more but less than F ifteen Thousand Dollars
99	107		($15,000.00), the person shall be guilty of a felony punishable by
100	108		imprisonment in the custody of the Department of Corrections not to
101	109		exceed five (5) years, or in the county jail not to exceed one (1)
102	110		year, or by a fine not to exce ed One Thousand Dollars ($1,000.00),
103	111		or by both such imprisonment and fine; an d
104	112		4. If the value of the property is Fifteen Thousand Dollars
105	113		($15,000.00) or more, the pers on shall be guilty of a felony
106	114		punishable by imprisonment in the custody of the Depar tment of
107	115		Corrections not to exceed eight (8) years, or by a fine not to
108		-	exceed One Thousand Dollars ($1,000.00), or by both such
109		-	imprisonment and fine.
110		-	B. It shall be unlawful:

	145	+	B. It shall be unlawful:
137	146		1. To remove a shopping cart from the parking area of a retail
138	147		establishment with the intent to permanently or temporarily deprive
139	148		the owner of the shoppin g cart the use of the cart; or
140	149		2. To be in possession of any shopping cart that has been
141	150		removed from the parking area of a retail establishment with the
142	151		intent to permanently or temporarily deprive the owner of the
143	152		shopping cart the use of the cart.
144	153		Any person who violates the provisions of this subsection shall,
145	154		upon conviction, be guilty of a misdemeanor punishable by
146	155		imprisonment in a county jail not to exceed one (1) year, o r by a
147	156		fine not to exceed One Thousand Dollars ($1,000.00), or by both such
148	157		fine and imprisonment.
149	158		SECTION 2. This act shall become effective November 1, 2025.
