4040 An Act relating to elections; amending 26 O.S. 2021,
4141 Section 1-104, which relates to closed primaries;
4242 establishing that no political pa rty may hold closed
4343 primaries without paying back cost; directing
4444 political parties to notify State Election Board of
4545 intent to hold closed or open primaries; and
4646 providing an effective date.

5252 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :
5353 SECTION 1. AMENDATORY 26 O.S. 2021, Section 1 -104, is
5454 amended to read as follows:
5555 Section 1-104. A. No registered voter political party shall be
5656 permitted to limit who may vote in any Primary Election or Runoff
5757 Primary Election of any that political party except if the political
5858 party of which his registration form shows him to be a member,
5959 except as otherwise provided by this section has agreed to pay back
6060 the cost of that political party 's Primary Election and Runoff

9090 Section 4-112 of this title to vote in a Primary Election or Runoff
9191 Primary Election of the party.
9292 2. The state chairman chairperson of the party shall, between
9393 November 1 and 30 of every odd -numbered year, notify the Secretary
9494 of the State Election Board as to whether or not the party intends
9595 to permit registered voters designated as Independents to limit who
9696 may vote in a Primary Election or Runoff Primary Election of the
9797 party. If the state chairman chairperson notifies the Secretary of
9898 the State Election Board of the party 's intention to so permit,
9999 registered voters designated as Independents shall be permitted to
100100 vote in any Primary Election or Runoff Primary Election of the party
101101 held in the following limit the party's Primary Election or Runoff
102102 Primary Election, that party shall return to the state the total
103103 cost of that party's closed elections held in the next two (2)
104104 calendar years. If the state chairman chairperson of one party

108108 notification period specified in this paragraph shall be extended to

110110 so notify or to change prior notification. A registered voter
111111 designated as Independent shall not be permitted to vote in a
112112 Primary Election or Runoff Primary Election of more than one party.

139139 3. Failure to so notify the Secretary of the State Election
140140 Board shall serve to prohibit registered voters designated as
141141 Independents or another political party from voting in a Pri mary
142142 Election or Runoff Primary Election of the party.
143143 4. A group of persons seeking to form a recognized political
144144 party pursuant to the provisions of Section 1 -108 of this title
145145 shall, upon filing of the petitions seeking recognition of the
146146 political party with the Secretary of the State Election Board,
147147 notify the Secretary of th e State Election Board as to whether or
148148 not the party intends to permit registered voters designated as
149149 Independents or another political party to vote in a Primary
150150 Election or Runoff Primary Election of the party. If the party is
151151 recognized and the group of persons seeking recognition of the party
152152 notifies the Secretary of the State Election Board of such
153153 intention, registered voters designated as Independents or another
154154 political party shall be permitted to vote in any Primary Election
155155 or Runoff Primary Election of the party held prior to January 1 of
156156 the following even-numbered year.
157157 SECTION 2. This act shall become effective November 1, 2025.
