40	40	An Act relating to elections; amending 26 O.S. 2021,
41	41	Section 1-104, which relates to closed primaries;
42	42	establishing that no political pa rty may hold closed
43	43	primaries without paying back cost; directing
44	44	political parties to notify State Election Board of

52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :
53	53	SECTION 1. AMENDATORY 26 O.S. 2021, Section 1 -104, is
54	54	amended to read as follows:
55	55	Section 1-104. A. No registered voter political party shall be
56	56	permitted to limit who may vote in any Primary Election or Runoff
57	57	Primary Election of any that political party except if the political
58	58	party of which his registration form shows him to be a member,
59	59	except as otherwise provided by this section has agreed to pay back
60	60	the cost of that political party 's Primary Election and Runoff
61	61	Primary Election.
62	62	B. 1. A recognized political party may permit registered
63	63	voters designated as Independents pursuant to the provisions of

90	90	Section 4-112 of this title to vote in a Primary Election or Runoff
91	91	Primary Election of the party.
92	92	2. The state chairman chairperson of the party shall, between
93	93	November 1 and 30 of every odd -numbered year, notify the Secretary
94	94	of the State Election Board as to whether or not the party intends
95	95	to permit registered voters designated as Independents to limit who
96	96	may vote in a Primary Election or Runoff Primary Election of the
97	97	party. If the state chairman chairperson notifies the Secretary of
98	98	the State Election Board of the party 's intention to so permit,
99	99	registered voters designated as Independents shall be permitted to
100	100	vote in any Primary Election or Runoff Primary Election of the party
101	101	held in the following limit the party's Primary Election or Runoff
102	102	Primary Election, that party shall return to the state the total
103	103	cost of that party's closed elections held in the next two (2)
104	104	calendar years. If the state chairman chairperson of one party
105	105	notifies the Secretary of the State Election Board of the party 's
106	106	intent to so permit all registered voters to participate in that
107	107	party's Primary Election and Runoff Primary Election , the
108	108	notification period specified in this paragraph shall be extended to
109	109	December 15 for the state chairman chairperson of any other party to
110	110	so notify or to change prior notification. A registered voter
111	111	designated as Independent shall not be permitted to vote in a
112	112	Primary Election or Runoff Primary Election of more than one party.

139	139	3. Failure to so notify the Secretary of the State Election
140	140	Board shall serve to prohibit registered voters designated as
141	141	Independents or another political party from voting in a Pri mary
142	142	Election or Runoff Primary Election of the party.
143	143	4. A group of persons seeking to form a recognized political
144	144	party pursuant to the provisions of Section 1 -108 of this title
145	145	shall, upon filing of the petitions seeking recognition of the
146	146	political party with the Secretary of the State Election Board,
147	147	notify the Secretary of th e State Election Board as to whether or
148	148	not the party intends to permit registered voters designated as
149	149	Independents or another political party to vote in a Primary
150	150	Election or Runoff Primary Election of the party. If the party is
151	151	recognized and the group of persons seeking recognition of the party
152	152	notifies the Secretary of the State Election Board of such
153	153	intention, registered voters designated as Independents or another
154	154	political party shall be permitted to vote in any Primary Election
155	155	or Runoff Primary Election of the party held prior to January 1 of
156	156	the following even-numbered year.
157	157	SECTION 2. This act shall become effective November 1, 2025.
