52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:
53	53	SECTION 1. NEW LAW A new section of law to be co dified
54	54	in the Oklahoma Statutes as Section 1 -760 of Title 63, unless there
55	55	is created a duplication in numbering, reads as follows:
56	56	This act shall be known and may be cited as th e "Prevention of
57	57	Maternal Harm Act of 2025 ".
58	58	SECTION 2. NEW LAW A new section of law to be codified
59	59	in the Oklahoma Statutes as Section 1 -760.1 of Title 63, unless
60	60	there is created a duplication in numbering, reads as follows:
61	61	A. Coerced criminal abortion by means of fraud is committed
62	62	when a person knowingl y and intentionally engages in the use of an

89	89	abortion-inducing drug on a pregnant woman, without her knowledge or
90	90	consent, with the intent to cause an abortion.
91	91	B. 1. Except as provided in paragraph 2 of this subsection,
92	92	whoever commits the crime of coerced criminal abortion by means of
93	93	fraud shall be imprisoned for not less than five (5) years nor more
94	94	than ten (10) years, fined not less than Ten Thousand Dollars
95	95	($10,000.00) nor more than Seventy-five Thousand Dollars
96	96	($75,000.00), or both such fine and imprisonment.
97	97	2. Whoever commits the crime of coerced criminal abortion by
98	98	means of fraud when the unborn child is more than three (3) months
99	99	of gestational age shall be impris oned for not less than ten (10)
100	100	years nor more than twenty (20) years, fined not less than Fifty
101	101	Thousand Dollars ($50,000.00) nor more than One Hundred Thousand
102	102	Dollars ($100,000.00), or both such fine and imprisonment .
103	103	C. The prosecution of a person pur suant to this section shall
104	104	not be a defense against the prosecution under any other provision
105	105	of law, including murder or attempted murder, should the person
106	106	commit the crime of coerced criminal abortion by means of fraud and
107	107	the use of an abortion -inducing drug results in the death or serious
108	108	bodily injury of the pregnant woman.
109	109	SECTION 3. AMENDATORY 63 O.S. 2021, Section 2 -210, is
110	110	amended to read as follows:
111	111	Section 2-210. A. Any material, compound, mixture, or
112	112	preparation which contains any quantity of the following substances

246	246	excluded from all schedules of controlled substances under this

249	249	b. BronCare,
250	250	c. Bronchial Congestion,
251	251	d. Bronkaid Tablets,
252	252	e. Bronkaid Dual Action Caplets,
253	253	f. Bronkotabs,
254	254	g. Bronkolixir,
255	255	h. NeoRespin,
256	256	i. Pazo Hemorrhoid Ointment and Suppositories,
257	257	j. Primatene Tablets,
258	258	k. Primatene "Dual Action" Formula,
259	259	l. Quelidrine,
260	260	m. Resp, and
261	261	n. Vatronal Nose Drops.

288	288	2. At the request of any person, the Dir ector may exempt any
289	289	other drug product containing ephedrine from being included as a
290	290	Schedule IV controlled substance if such product:
291	291	a. is labeled and marketed in a manner consistent with
292	292	the pertinent OTC tentative final or final monograph
293	293	issued by the FDA, and
294	294	b. is manufactured and distributed for legitimate
295	295	medicinal use and in a manner that reduces or
296	296	eliminates the likelihood of abuse.
297	297	3. In making a determination regarding a drug product, the
298	298	Director, after notice and hearing, shall consider th e following:
299	299	a. the history and current pattern of abuse,
300	300	b. the name and labeling of the product,
301	301	c. the intended manner of distribution, advertising and
302	302	promotion of the product, and
303	303	d. other factors as may be relevant to and consistent
304	304	with the public health and safety.
305	305	4. The hearing shall be held in accordance with the
306	306	Administrative Procedures Act.
307	307	5. A list of current drug products meeting exemption
308	308	requirements under this subsection may be obtained from the Bureau
309	309	upon written request.
310	310	C. The Board of Pharmacy may except by rule any compound,
311	311	mixture, or preparation containing any depressant substance listed

339	339	part of the Uniform Controlled Dangerous Substances Act, Section 2 -
340	340	101 et seq. of this title, if the compound, mixture, or preparation
341	341	contains one or more active medicinal ingredients not having a
342	342	depressant effect on the central nervous system, and if the
343	343	admixtures are included therein in combinations, quantity,
344	344	proportion, or concentration that vitiate the potential for abuse of
345	345	the substances which have a depressant effect on the central nervous
346	346	system.
347	347	SECTION 4. This act shall become effective November 1, 2025.
