91 | 91 | | B. 1. Except as provided in paragraph 2 of this subsection, |

93 | 93 | | fraud shall be imprisoned for not less than five (5) years nor more |

94 | 94 | | than ten (10) years, fined not less than Ten Thousand Dollars |

95 | 95 | | ($10,000.00) nor more than Seventy-five Thousand Dollars |

96 | 96 | | ($75,000.00), or both such fine and imprisonment. |

97 | 97 | | 2. Whoever commits the crime of coerced criminal abortion by |

98 | 98 | | means of fraud when the unborn child is more than three (3) months |

99 | 99 | | of gestational age shall be impris oned for not less than ten (10) |

100 | 100 | | years nor more than twenty (20) years, fined not less than Fifty |

101 | 101 | | Thousand Dollars ($50,000.00) nor more than One Hundred Thousand |

103 | 103 | | C. The prosecution of a person pur suant to this section shall |

104 | 104 | | not be a defense against the prosecution under any other provision |

105 | 105 | | of law, including murder or attempted murder, should the person |

106 | 106 | | commit the crime of coerced criminal abortion by means of fraud and |
---|
107 | 107 | | the use of an abortion -inducing drug results in the death or serious |
---|
108 | 108 | | bodily injury of the pregnant woman. |

294 | 294 | | b. is manufactured and distributed for legitimate |
---|
295 | 295 | | medicinal use and in a manner that reduces or |
---|
296 | 296 | | eliminates the likelihood of abuse. |
---|
297 | 297 | | 3. In making a determination regarding a drug product, the |
---|
298 | 298 | | Director, after notice and hearing, shall consider th e following: |
---|
299 | 299 | | a. the history and current pattern of abuse, |
---|
300 | 300 | | b. the name and labeling of the product, |
---|
301 | 301 | | c. the intended manner of distribution, advertising and |
---|
302 | 302 | | promotion of the product, and |
---|
303 | 303 | | d. other factors as may be relevant to and consistent |
---|
304 | 304 | | with the public health and safety. |
---|
305 | 305 | | 4. The hearing shall be held in accordance with the |
---|
306 | 306 | | Administrative Procedures Act. |
---|
307 | 307 | | 5. A list of current drug products meeting exemption |
---|
308 | 308 | | requirements under this subsection may be obtained from the Bureau |
---|
309 | 309 | | upon written request. |
---|
310 | 310 | | C. The Board of Pharmacy may except by rule any compound, |
---|
311 | 311 | | mixture, or preparation containing any depressant substance listed |
---|
