6464 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6565 SECTION 1. NEW LAW A new section of law to be codified
6666 in the Oklahoma Statutes as Section 2 -10-406 of Title 27A, unless
6767 there is created a duplication in numbering, reads as follows:

9595 1. “Biosolids” means solids separated from liquids during the
9696 wastewater treatment process which are treated physically and
9797 chemically to produce a semisolid, nutrient -rich product;
9898 2. “Perfluoroalkyl and polyfluoroa lkyl substances” or “PFAS” or
9999 "PFOAS" means non-polymeric perfluoroalkyl and p olyfluoroalkyl
100100 substances that contain at least two sequential, fully fluorinated
101101 carbon atoms, excluding gases and volatile liquids;
102102 3. “Sewage sludge” means the residual, semi -solid material that
103103 is produced as a byproduct of sewage by municipal, commercial, or
104104 industrial wastewater treatment plants; and
105105 4. “Septage” means a fluid mixture of untreated and partially
106106 treated sewage solids, liquids, and sludge of human or domesti c
107107 origin, which is removed from a septic tank.
108108 B. Notwithstanding any other p rovision of law, and except as
109109 provided in subsection C of this section, no person in this state
110110 shall:
111111 1. Apply to or spread on any land of this state:
112112 a. sludge generated from a municipal, commercial, or
113113 industrial wastewater treatment plant,
114114 b. compost material that included in its production
115115 sludge generated from a municipal, commercial, or
116116 industrial wastewater treatment plant or septage, or
117117 c. any other product or material that is intended for use
118118 as a fertilizer, soil amendment, topsoil replacement,

145145 mulch, or other similar agricultural purpose that is
146146 derived from or contains sludge generated from a
147147 municipal, commercial, or industrial wastewater
148148 treatment plant or septage; or
149149 2. Sell or distribute in this state:
150150 a. compost material that included in its production
151151 sludge generated from a municipal, commercial, or
152152 industrial wastewater treatment plant or septage, or
153153 b. any other product or material that is intended for use
154154 as a fertilizer, soil amendment, topsoil replacement,
155155 mulch, or other similar a gricultural purpose that is
156156 derived from or contains sludge generated from a
157157 municipal, commercial, or industrial wastewater
158158 treatment plant or septage .
159159 C. The prohibited actions in subsection B of this section shall
160160 not apply to:
161161 1. The disposal or placement of materials described in
162162 subsection B of this section at a lined and monitored solid waste
163163 landfill until alternative approved safe processes of disposal are
164164 implemented;
165165 2. The land application of or the sale or distribution of
166166 compost material or other agricultural product derived from or
167167 containing residuals generated as a result of the processing or
168168 cultivation of food, food waste, crops, or vegetative material; the

195195 brewing of malt liquor; the fermenting of wine or hard cider; or the
196196 distilling of spirits, including, but not limited to, blueberries,
197197 apples, grapes, potatoes, seaweed, fish and seafood, and spent grain
198198 or malt. Provided, the exemption under this subsecti on shall only
199199 apply if the agricultural product is not cultivated in soil
200200 previously treated with biosolids and that such product is not mixed
201201 with sludge from a municipal, commercial, or industrial wastewater
202202 treatment plant, septage, sewage, or sanitary wastewater prior to or
203203 during land application or during the production of the agricultural
204204 product;
205205 3. The land application, sale, or distribution of compost
206206 material or agricultural product or material derived from or
207207 containing sludge resulting from th e production of precipitated
208208 calcium carbonate; and
209209 4. The land application, sale, or distribution of compost
210210 material or other agricultural product or material derived from or
211211 containing manure from animals, zoos, or other agricultural sources.
212212 D. The Department of Environmental Quality shall have
213213 jurisdiction to enforce the provisions of this section as they
214214 pertain to prohibition of land application or spreading of materials
215215 described under this section. The Oklahoma Department of
216216 Agriculture, Food, and Forestry shall have jurisdiction to enforce
217217 the provisions of this section regarding agriculture. The

244244 Departments shall enter into a memorandum of understanding to
245245 effectively enforce the provisions of this section.
246246 E. Pursuant to subsection B of thi s section, any actions after
247247 the effective date of this act, resulting in future contamination
248248 from perfluoroalkyl and polyfluoroalkyl substances (PFAS or PFOAS),
249249 from land application of biosolids, sewage sludge, or septage, shall
250250 be civilly liable to thi s state and to the people of Oklahoma for
251251 costs arising from releases of PFAS or PFOAS to the environment from
252252 noncompliance to this act. The funds resulting from such liability
253253 shall be used for the remediation and recovery of affected Oklahoma
254254 lands, crops, livestock, waters , and impacted human health.
255255 SECTION 2. NEW LAW A new section of law to be codified
256256 in the Oklahoma Statutes as Section 2 -10-407 of Title 27A, unless
257257 there is created a duplication in numbering, reads as follows :
258258 A. The Department of Environmental Quality shall assess, study,
259259 and develop a long-term plan for the purposes of prohibiting the
260260 land application of septage in this state and proposing alternate
261261 methods of safely processing PFAS, PFOAS, biosolids, sewag e sludge,
262262 and septage in this state and implementing safe management
263263 processes. The plan shall include, but not be limited to:
264264 1. Identification of the available capacity at wastewater
265265 treatment plants or other treatment or disposal facilities in this
266266 state to manage and safely process sludge that was previously land-
267267 applied prior to the effective date of this act;

294294 2. Determination of the capacity and alternate processes
295295 anticipated to be necessary to manage septage following the
296296 prohibition of land appl ication in this state;
297297 3. Development of recommendations to support and fund
298298 additional management capacity, if necessary; and
299299 4. Development of recommendations concerning a framework for
300300 the long-term prohibition of land application in this state and
301301 alternative safe management, treatment , and processing of biosolids
302302 and sewage sludge.
303303 B. The Department shall submit the final report to the
304304 President Pro Tempore of the Oklahoma State Senate, the Speaker of
305305 the Oklahoma House of Representatives, the Gover nor, and the
306306 relevant legislative committee chairs overseeing environment and
307307 natural resources not later than December 1, 2025. The report shall
308308 include any suggested legislative implementations resulting from the
309309 study.
310310 SECTION 3. NEW LAW A new section of law to be codified
311311 in the Oklahoma Statutes as Sect ion 2-10-408 of Title 27A, unless
312312 there is created a duplication in numbering, reads as follows:
313313 A. The Oklahoma Department of Agriculture, Food , and Forestry
314314 shall develop a comprehensive plan to protect agricultural producers
315315 who are impacted by perfluoroalkyl and polyfluoroalkyl substances
316316 (PFAS) contamination from the land application or spreading of:

343343 1. Sludge generated from a municipal, commercial, or industrial
344344 wastewater treatment plant;
345345 2. Compost material that included in its production sludge
346346 generated from a municipal, commercial, or industrial wastewater
347347 treatment plant; or
348348 3. Any other product or material that is intended for use as a
349349 fertilizer, soil amendment, t opsoil replacement, mulch, or other
350350 similar agricultural purpose that is derived from or contains sludge
351351 generated from a municipal, commercial, or industrial wastewater
352352 treatment plant or septage.
353353 B. The Department shall work directly with impacted
354354 agricultural producers to identify sources of contamination and
355355 institute best practices for immediate and successful PFAS removal,
356356 remediation, and recovery, including any necessary surveys and
357357 testing.
358358 C. The Department shall submit the final report to the
359359 President Pro Tempore of the Oklahoma State Senate, the Speaker of
360360 the Oklahoma House of Representatives, the Governor, and the
361361 relevant legislative committee chairs overseeing environment and
362362 natural resources not later than December 1, 2025. The report shall
363363 include the estimated total cost of PFAS removal, remediation, and
364364 recovery under this section. Upon the convening of the next
365365 legislative session, the reported amount shall be included in the
366366 general appropriations bill for the upcoming fiscal year.

393393 SECTION 4. NEW LAW A new section of law to be codified
394394 in the Oklahoma Statutes as Section 2 -10-409 of Title 27A, unless
395395 there is created a duplication in numbering, reads as follows:
396396 The Oklahoma Department of Agriculture, Food an d Forestry shall
397397 develop policies to provide all necessary state funding and any
398398 applicable federal funding for:
399399 1. Water treatment infrastructure to remove perfluoroalkyl and
400400 polyfluoroalkyl substances (PFAS ). Water for the purpose s of this
401401 section shall include all rivers, streams, creeks, brooks,
402402 reservoirs, ponds, lakes, springs, ground water , aquifers, private
403403 wells, and all bodies of surface waters, artificial or natural,
404404 which are contained within, flow through, or border upon the state
405405 or any portion of it;
406406 2. Perfluoroalkyl and polyfluoroalkyl substances (PFAS )
407407 voluntary testing and investigation which will allow state
408408 regulators to research and identify potentially impacted farms ,
409409 ranches, communities, water sources, or food products; and
410410 3. Financial assistance and voluntary medical monitoring for
411411 impacted families, neighbors, and communities as a result of
412412 perfluoroalkyl and polyfluoroalkyl substances (PFAS ) biosolids, and
413413 sewage sludge land applications .
414414 SECTION 5. It being immediately necessary for the preservation
415415 of the public peace, health or safet y, an emergency is hereby
