4242 O.S.L. 2024 (70 O.S. Supp. 2024, S ection 1-116),

5252 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5353 SECTION 1. AMENDATORY 70 O.S. 2021, Section 1 -116, as
5454 amended by Section 1, Chapter 281, O.S.L. 2024 ( 70 O.S. Supp. 2024,
5555 Section 1-116), is amended to read as follows:
5656 Section 1-116. As used in this title:
5757 1. "Teacher" means any person who is employed to serve as
5858 district superintendent, principal, supervisor, counselor,
5959 librarian, school nurse, athletic trainer, licensed physical
6060 therapist, physical therapist assistant, occupational therapist,
6161 occupational therapist assistant, or classroom teacher or in any
6262 other instructional, supervisory or administrative capacity. The
6363 person shall not be deemed qua lified unless the person holds a valid

9090 certificate issued by and in accordance with the rules of the State
9191 Board of Education or the rules of the State Board of Career and
9292 Technology Education, to perform the particular services for which
9393 the person is employed;
9494 2. "Superintendent" or "superintendent of schools " means the
9595 executive officer of the board of education and the administrative
9696 head of the school system of a district ma intaining an accredited
9797 school, provided the person holds an administrator 's certificate
9898 recognized by the State Board of Education;
9999 3. "Principal" means any person other than a district
100100 superintendent of schools having supervisory or administrative
101101 authority over any school or school building having two or more
102102 teachers. A teaching principal shall be a principal who devotes at
103103 least one-half (1/2) the time school is in session to classroom
104104 teaching. Teaching principals shall be required to hold
105105 administrative certificates;
106106 4. "Teachers" means, for purposes of complying with the State
107107 Aid Law and other statutes, but not any other provision of law,
108108 which apportion money on the basis of teaching units or the number
109109 of teachers employed or qualified, all pe rsons holding proper
110110 certificates and connected in any capacity with the instruction of
111111 pupils;

138138 5. "Inductee" means any certified teacher who is employed in a
139139 local school to serve as a classroom teacher under the guidance and
140140 assistance of a mentor teach er or teachers;
141141 6. "Student teacher" means any student who is enrolled in an
142142 institution of higher learning approved by the State Board of
143143 Education for teacher training and who is jointly assigned by the
144144 institution of higher learning and a board of educ ation of a school
145145 district to perform practice teaching under the direction of a
146146 regularly employed and certified teacher. A student teacher, while
147147 serving an internship under the supervision of a certified teacher,
148148 shall be accorded the same protection o f the laws as that accorded
149149 the certified teacher and shall be eligible to rec eive compensation
150150 beginning on the first day of the internship for up to one full
151151 school year; provided, however, that such compensation shall not be
152152 considered compensation for purposes of teacher retirement or the
153153 minimum salary schedule;
154154 7. "School nurse" means a person employed full time by a board
155155 of education who is a registered nurse licensed by the Oklahoma
156156 State Board of Nurse Registration and Nursing Education and is
157157 certified the same as a teacher by the State Board of Education.
158158 Provided, that any person who is employed as a full -time school
159159 nurse in any school district in Oklahoma who is not registered on
160160 July 2, 1971, may continue to serve in the same capacity; howe ver,
161161 such person shall, under rules adopted by the State Board of

189189 registered. A school nurse employed by a board of education shall
190190 be accorded the same protection of laws and all other benefits a s a
191191 certified teacher;
192192 8. "Athletic trainer" means a person employed full tim e by a
193193 board of education who is a Certified Athletic Trainer with current
194194 certification from the Board of Certification of the National
195195 Athletic Trainers' Association and is als o currently licensed to
196196 practice in the state in accordance with the State Board of Medical
197197 Licensure and Supervision. An athletic trainer employed by a board
198198 of education shall be accorded the same protection of laws and all
199199 other benefits as a certified teacher; and
200200 9. "Support employee" means an employee who provides those
201201 services which are not performed by certified teachers, principals,
202202 superintendents, or administrators and which are necessary for the
203203 efficient and satisfactory functioning of a sch ool district;
204204 10. "Licensed physical therapist " means a person employed full
205205 time by a board of education who is licensed as required in the
206206 Physical Therapy Practice Act , a member of the American Physical
207207 Therapy Association, and who regularly practices physical therapy.
208208 A licensed physical therapist employed by a board of educat ion shall
209209 be accorded the same protection of laws and all other benefits as a
210210 certified teacher;

237237 11. "Physical therapist assistant " means a person employed full
238238 time by a board of education who assists in the practice of physical
239239 therapy subject to the direction and supervision of a licensed
240240 physical therapist, who meets all the educational requirements, and
241241 who is licensed pursuant to the provisions of the Physical Therapy
242242 Practice Act, and who is a member of the American Physical Therapy
243243 Association. A physical therapist assistant employed by a board of
244244 education shall be accorded the same protection of laws and all
245245 other benefits as a certified teacher ;
246246 12. "Occupational therapist" means a person employed full time
247247 by a board of education who is licensed to practice occupational
248248 therapy pursuant to the provisions of the Occupational Therapy
249249 Practice Act and who is certified by the National Board for
250250 Certification in Occupation al Therapy. An occupational therapist
251251 employed by a board of education shall be accorded the same
252252 protection of laws and all other benefits as a certified teacher ;

254254 13. "Occupational therapist assistant " means a person employed
255255 full time by a board of education who is licensed to provide
256256 occupational therapy treatment under the general supervision of a
257257 licensed occupational therapist pursuant to the provisions of the
258258 Occupational Therapy Practice Act and who is certified by the
259259 National Board for Certi fication in Occupational Therapy . An
