4040 An Act relating to agriculture; providing pesticide

4848 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4949 SECTION 1. NEW LAW A new section of law to be codified
5050 in the Oklahoma Statutes as Section 3 -97 of Title 2, unless there is
5151 created a duplication in numbering, reads as follows:
5252 Notwithstanding any provision to the contrary, for any pesticide
5353 registered with the United States Environmental Protection Agency
5454 under the Federal Insecticide, Fungicide, and Rodent icide Act, 7
5555 U.S.C., Section 136 et seq., the label approved by the United States
5656 Environmental Protection Agency in registering the pesticide, or a
5757 label consistent with the most recent human health assessment
5858 performed under the Federal Insecticide, Fung icide, and Rodenticide
5959 Act, or a label consistent with the United States Envir onmental
6060 Protection Agency carcinogenicity classification for the pesticide
6161 under the Federal Insecticide, Fungicide, and Rodenticide Act, shall

8888 be sufficient to satisfy any requ irements for a warning regarding
8989 health or safety under Oklahoma state law, including without
9090 limitation, the duty to warn, or any other common law duty to warn
9191 if:
9292 1. Approved by the Environmental Protection Agency under the
9393 Federal Insecticide, Fungicid e, and Rodenticide Act and by the
9494 Oklahoma Department of Agriculture , Food, and Forestry at the time
9595 of sale;
9696 2. Consistent with the most recent human health assessment
9797 performed by Environmental Protection Agency under the Federal
9898 Insecticide, Fungicide, and Rodenticide Act at the time of sale ; or
9999 3. Consistent with the Environmental Protection Agency
100100 carcinogenicity classification for the pesticide under the Federal
101101 Insecticide, Fungicide, and Rodenticide Act at the time of sale.
102102 SECTION 2. This act shall become effective November 1, 2025.
