42	42	circumstances; providing circumstances whe n warning
43	43	label is adequate; and providing an effective date.

48	48	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
49	49	SECTION 1. NEW LAW A new section of law to be codified
50	50	in the Oklahoma Statutes as Section 3 -97 of Title 2, unless there is
51	51	created a duplication in numbering, reads as follows:
52	52	Notwithstanding any provision to the contrary, for any pesticide
53	53	registered with the United States Environmental Protection Agency
54	54	under the Federal Insecticide, Fungicide, and Rodent icide Act, 7
55	55	U.S.C., Section 136 et seq., the label approved by the United States
56	56	Environmental Protection Agency in registering the pesticide, or a
57	57	label consistent with the most recent human health assessment
58	58	performed under the Federal Insecticide, Fung icide, and Rodenticide
59	59	Act, or a label consistent with the United States Envir onmental
60	60	Protection Agency carcinogenicity classification for the pesticide
61	61	under the Federal Insecticide, Fungicide, and Rodenticide Act, shall

88	88	be sufficient to satisfy any requ irements for a warning regarding
89	89	health or safety under Oklahoma state law, including without
90	90	limitation, the duty to warn, or any other common law duty to warn
91	91	if:
92	92	1. Approved by the Environmental Protection Agency under the
93	93	Federal Insecticide, Fungicid e, and Rodenticide Act and by the
94	94	Oklahoma Department of Agriculture , Food, and Forestry at the time
95	95	of sale;
96	96	2. Consistent with the most recent human health assessment
97	97	performed by Environmental Protection Agency under the Federal
98	98	Insecticide, Fungicide, and Rodenticide Act at the time of sale ; or
99	99	3. Consistent with the Environmental Protection Agency
100	100	carcinogenicity classification for the pesticide under the Federal
101	101	Insecticide, Fungicide, and Rodenticide Act at the time of sale.
102	102	SECTION 2. This act shall become effective November 1, 2025.
