4863 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4964 SECTION 1. AMENDATORY 82 O.S. 2021, Section 1020.19, is
5065 amended to read as follows:
5166 Section 1020.19. Upon request of a majority of the landowners
5267 residing within a basin or subbasin, the Board is authorized to
5368 require that water w ells be metered and that such meters as the
5469 Board shall approve be utilized by the applicant and placed under
55-seal, subject to reading by the agents of the Board at any time.
56-The Board may also require that the applicant report the reading of
57-such meters at reasonable intervals
58-A. The Oklahoma Water Resources Board shall require all permit
59-holders authorized to take and use groundwater to implement a system

98+The Board may also require th at the applicant report the reading of

100+A. The Oklahoma Water Resources Board shall require all permit
101+holders authorized to take and use groundwater to implement a system
86102 of measuring groundwater usage from all wells associated with the
87103 permit. The Board shall determin e which measurement systems may be
88104 utilized, which shall include, but not be limited to, pump and
89105 irrigation monitoring telemetry devices capable of reporting usage.
90106 Such measuring systems shall be in pro per operating conditions at
91107 all times when groundwa ter is being produced. Data from the
92108 measuring system shall be utilized for the annual groundwater use
93109 report.
94110 B. To encourage groundwater conservation, beginning January 1,
95111 2026, the Board shall provide a five -year flex allocation of
96112 groundwater usage based off the previously determined allocated
97113 annual use of the basin or subbasin. A five -year flex allocation
98114 shall not require a new permit for existing permit holders. A five -
99115 year flex allocation shall be available for:
100116 1. Existing permit holders for groundwater use permits in
101117 basins or subbasins, based upon the maximum annual yield
102118 determination at the time of the original application;
103-2. New applicants for groundwater use permits in basins or
104-subbasins based upon the current maximum annual yield determination;
105-and
106-3. New and existing applicants and temporary permit holders for
107-groundwater use permits in basins or subbasins where the maximum
108-annual yield has yet to be determined.

146+2. New applicants for groundwater use permits in basins or
147+subbasins based upon the current maximum annual yield det ermination;
148+and
149+3. New and existing applicants and temporary permit holders for
150+groundwater use permits in basins or subbasins where the maximum
151+annual yield has yet to be determined.
135152 C. An applicant for a five-year flex allocation shall be
136153 required to:
137154 1. Submit an annual usage report of the prior year's usage from
138155 a Board-approved water measurement system; and
139156 2. Pay the annual groundwater permit fee.
140157 D. A five-year flex allocation shall allow the permit holder to
141158 exceed the determined annual allocat ion in any year of the five -year
142159 allocation; provided, that the applicant shall adhere to the
143160 cumulative annually determined allocation of the basin or subbasin
144161 over the five-year period. The permit holde r shall not exceed the
145162 permitted annual allocation by over two hundred percent (200%) in
146163 any of the five (5) years.
147164 E. Nothing in this section shall apply to domestic wells .
148165 SECTION 2. This act shall become effective November 1, 2025.
