	50	+	82 O.S. 2021, Section 1020.19, which relates to
	51	+	metering of wells; requiring all permit holders to
	52	+	utilize certain system for use of water; authorizing
	53	+	the Oklahoma Water Resources Board to implement
	54	+	certain allocation to encourage conservation after
	55	+	certain date; specifying requirements for
	56	+	participation; prohibiting excessive use; exempting
	57	+	certain wells from provisions; and providing an
	58	+	effective date.

48	63		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
49	64		SECTION 1. AMENDATORY 82 O.S. 2021, Section 1020.19, is
50	65		amended to read as follows:
51	66		Section 1020.19. Upon request of a majority of the landowners
52	67		residing within a basin or subbasin, the Board is authorized to
53	68		require that water w ells be metered and that such meters as the
54	69		Board shall approve be utilized by the applicant and placed under
55		-	seal, subject to reading by the agents of the Board at any time.
56		-	The Board may also require that the applicant report the reading of
57		-	such meters at reasonable intervals
58		-	A. The Oklahoma Water Resources Board shall require all permit
59		-	holders authorized to take and use groundwater to implement a system

	100	+	A. The Oklahoma Water Resources Board shall require all permit
	101	+	holders authorized to take and use groundwater to implement a system
86	102		of measuring groundwater usage from all wells associated with the
87	103		permit. The Board shall determin e which measurement systems may be
88	104		utilized, which shall include, but not be limited to, pump and
89	105		irrigation monitoring telemetry devices capable of reporting usage.
90	106		Such measuring systems shall be in pro per operating conditions at
91	107		all times when groundwa ter is being produced. Data from the
92	108		measuring system shall be utilized for the annual groundwater use
93	109		report.
94	110		B. To encourage groundwater conservation, beginning January 1,
95	111		2026, the Board shall provide a five -year flex allocation of
96	112		groundwater usage based off the previously determined allocated
97	113		annual use of the basin or subbasin. A five -year flex allocation
98	114		shall not require a new permit for existing permit holders. A five -
99	115		year flex allocation shall be available for:
100	116		1. Existing permit holders for groundwater use permits in
101	117		basins or subbasins, based upon the maximum annual yield
102	118		determination at the time of the original application;
103		-	2. New applicants for groundwater use permits in basins or
104		-	subbasins based upon the current maximum annual yield determination;
105		-	and
106		-	3. New and existing applicants and temporary permit holders for
107		-	groundwater use permits in basins or subbasins where the maximum
108		-	annual yield has yet to be determined.

	146	+	2. New applicants for groundwater use permits in basins or
	147	+	subbasins based upon the current maximum annual yield det ermination;
	148	+	and
	149	+	3. New and existing applicants and temporary permit holders for
	150	+	groundwater use permits in basins or subbasins where the maximum
	151	+	annual yield has yet to be determined.
135	152		C. An applicant for a five-year flex allocation shall be
136	153		required to:
137	154		1. Submit an annual usage report of the prior year's usage from
138	155		a Board-approved water measurement system; and
139	156		2. Pay the annual groundwater permit fee.
140	157		D. A five-year flex allocation shall allow the permit holder to
141	158		exceed the determined annual allocat ion in any year of the five -year
142	159		allocation; provided, that the applicant shall adhere to the
143	160		cumulative annually determined allocation of the basin or subbasin
144	161		over the five-year period. The permit holde r shall not exceed the
145	162		permitted annual allocation by over two hundred percent (200%) in
146	163		any of the five (5) years.
147	164		E. Nothing in this section shall apply to domestic wells .
148	165		SECTION 2. This act shall become effective November 1, 2025.
