4040 An Act relating to public safety; directing fire
4141 departments to designate an individual to monitor
4242 fire site for flare ups and hot spots; clarifying
4343 that designee shall be responsible for observing and
4444 ensuring the safety of the affected area; clarifying
4545 designee does not need to be a fire fighter;
4646 requiring designee to monitor sight for certain
4747 amount of time; permitting responsibility to be
4848 shared; prohibiting fire department from leaving
4949 before having a designee; providing for codification;

5656 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5757 SECTION 1. NEW LAW A new se ction of law to be codified
5858 in the Oklahoma Statutes as Section 170 of Title 63, unless there is
5959 created a duplication in numbering, reads as follows:
6060 A. Any fire department operating within the State of Oklahoma
6161 shall, upon concluding extinguishment effo rts at the scene of a
6262 fire, designate an individual to monitor the site for po tential
6363 flare-ups or residual hot spots.
6464 B. The designee shall assume responsibility for observing and
6565 ensuring the safety of the affected area.

9292 C. The designated individual is not required to be a
9393 professional or volunteer firefighter; however, they must have the
9494 ability to conduct site inspections at intervals not exceeding one
9595 (1) hour for a minimum period of twelve (12) hours following the
9696 fire's extinguishment.
9797 D. The responsibility for monitoring may be shared among
9898 multiple individuals, provided t he requirements of subsection C are
9999 met.
100100 E. The fire department shall leave at least one firefighter at
101101 the sight until a designee has been designated.
102102 SECTION 2. This act shall become effective November 1, 2025.
