5252 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5353 SECTION 1. AMENDATORY 56 O.S. 2021, Sectio n 246, is
5454 amended to read as follows:
5555 Section 246. A. This act shall be know n and may be cited as
5656 the "Act to Restore Hope, Opportunity and Prosperity for Everyone "
5757 or the "HOPE Act".
5858 B. Prior to awarding assistance under Medicaid, the Oklahoma
5959 Health Care Authority shall verify eligibility information of each
6060 applicant, excluding those applicants who would be eligible under
6161 the Tax Equity and Fiscal Responsibility Act of 1982 (TEFRA) and
6262 excluding those applicants with intellectual disabilities receivin g
6363 Home and Community Based Medicaid waiver and state -funded services.

9090 C. The information verified by the Authority shall include, but
9191 is not limited to:
9292 1. Earned and unearned income;
9393 2. Employment status and changes in employment;
9494 3. Immigration statu s;
9595 4. Residency status, including a nationwide best -address source
9696 to verify individuals are residents of the state;
9797 5. Enrollment status in other state -administered public
9898 assistance programs;
9999 6. Financial resources;
100100 7. Incarceration status;
101101 8. Death records;
102102 9. Enrollment status in public assistance programs outside of
103103 this state; and
104104 10. Potential identity fraud or identity theft.
105105 D. The Authority shall sign a memorandum of understanding with
106106 any department, agency or division for information det ailed in
107107 subsection C of this section.
108108 E. The Authority shall contract with one or more independent
109109 vendors to provide information detailed in subsection C of this
110110 section. Any contract entered under this subsection shall establish
111111 annualized savings tha t exceed the contract 's total annual cost to
112112 the state.

139139 F. Nothing in this se ction shall preclude the Authority from
140140 receiving, reviewing or verifying additional information related to
141141 eligibility not detailed in this section or from contracting with
142142 one or more independent vendors to provide additional information
143143 not detailed in this section.
144144 SECTION 2. AMENDATORY 56 O.S. 2021, Section 247, is
145145 amended to read as follows:
146146 Section 247. A. On a quarterly basis, the Oklahoma Health
147147 Care Authority shall receive and review information concerning
148148 individuals enrolled in Medicaid that indicates a change in
149149 circumstances that may affect eligibility , excluding those
150150 individuals who would be eligible under the Tax Equity and Fiscal
151151 Responsibility Act of 1982 (TEFRA) and excluding those individuals
152152 with intellectual disabilities receiving Home and Community Based
153153 Medicaid waiver and state -funded services.
154154 B. The information provided to the Authority shall include, but
155155 is not limited to:
156156 1. Earned and unearned income;
157157 2. Employment status and changes in employment;
158158 3. Residency status;
159159 4. Enrollment status in other state -administered public
160160 assistance programs;
161161 5. Financial resources;
162162 6. Incarceration status;

190190 8. Lottery winnings; and
191191 9. Enrollment status in public assistance programs outside of
192192 this state.
193193 C. The Authority shall sign a memorandum of understanding with
194194 any department, agency or division for information detailed in
195195 subsection B of this section.
196196 D. The Authority shall contract with one or more independent
197197 vendors to provide inf ormation detailed in subsection B of this
198198 section. Any contract entered under this subsection shall establish
199199 annualized savings that exceed the contract 's total annual cost to
200200 the state.
201201 E. The Authority shall explore joining any multistate
202202 cooperative to identify individuals who are also enrolled in public
203203 assistance programs outside of this state, including the National
204204 Accuracy Clearinghouse.
205205 F. Nothing in this section shal l preclude the Authority from
206206 receiving or reviewing additional information re lated to eligibility
207207 not detailed in this section or from contracting with one or more
208208 independent vendors to provide additional information not detailed
209209 in this section.
210210 G. If the Authority receives information concerning an
211211 individual enrolled in Medicaid that indicates a change in

238238 circumstances that may affect eligibility, the Authority shall
239239 review the individual 's case using the following procedures:
240240 1. If the information d oes not result in the Authority finding
241241 a discrepancy or change in an individu al's circumstances that may
242242 affect eligibility, the Authority shall take no further action;
243243 2. If the information results in the Authority finding a
244244 discrepancy or change in an individual's circumstances that may
245245 affect eligibility, the Authority shall promptly redetermine
246246 eligibility after receiving such information;
247247 3. If the information results in the Authority finding a
248248 discrepancy or change in an individual 's circumstances that may
249249 affect eligibility, the individual shall be given an opportunity to
250250 explain the discrepancy; provided, however, that self -declarations
251251 by applicants or recipients shall not be accepted as verification;
252252 4. The Authority shall provide notice to the individual which
253253 shall describe in sufficient detail the circumstances of the
254254 discrepancy or change, the manner in which the applicant or
255255 recipient may respond, and the consequences of failing to take
256256 action. The applicant or recipient shall have ten (10 ) business
257257 days to respond in an attempt to resolve the discrepancy or change.
258258 The explanation provided by the recipient or applicant shall be
259259 given in writing. After receiving the explanation, the Authority
260260 may request additional documentation if it det ermines that there is
261261 risk of fraud, misrepresentation or inadequate documentation;

288288 5. If the individual does not respond to the notice, the
289289 Authority shall discontinue assistance for failure to cooperate, in
290290 which case the Authority shall provide notice of intent to
291291 discontinue assistance. Eligibility for assistance shall not be
292292 established or reestablished until the discrepancy or change has
293293 been resolved;
294294 6. If an individual responds to the notice and disagrees with
295295 the findings, the Authority shall r einvestigate the matter. If the
296296 Authority finds that there has been an error, the Authority shall
297297 take immediate action to correct it and no further action shall be
298298 taken. If, after an investigation, the Authority determines that
299299 there is no error, the A uthority shall determine the effect on the
300300 individual's case and take appropri ate action. Written notice of
301301 the Authority action shall be given to the individual; and
302302 7. If the individual agrees with the findings, the Authority
303303 shall determine the effect on the individual's case and take
304304 appropriate action. Written notice of the Authority action shall be
305305 given to the individual. In no case shall the Authority discontinue
306306 assistance upon finding a discrepancy or change in circumstances
307307 until the individual has been given notice of the discrepancy and
308308 the opportunity to respond as required under the HOPE Act.
309309 SECTION 3. This act shall become effective November 1, 2025.
