52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. AMENDATORY 56 O.S. 2021, Sectio n 246, is
54	54	amended to read as follows:
55	55	Section 246. A. This act shall be know n and may be cited as
56	56	the "Act to Restore Hope, Opportunity and Prosperity for Everyone "
57	57	or the "HOPE Act".
58	58	B. Prior to awarding assistance under Medicaid, the Oklahoma
59	59	Health Care Authority shall verify eligibility information of each
60	60	applicant, excluding those applicants who would be eligible under
61	61	the Tax Equity and Fiscal Responsibility Act of 1982 (TEFRA) and
62	62	excluding those applicants with intellectual disabilities receivin g
63	63	Home and Community Based Medicaid waiver and state -funded services.

92	92	1. Earned and unearned income;
93	93	2. Employment status and changes in employment;
94	94	3. Immigration statu s;
95	95	4. Residency status, including a nationwide best -address source
96	96	to verify individuals are residents of the state;
97	97	5. Enrollment status in other state -administered public
98	98	assistance programs;
99	99	6. Financial resources;
100	100	7. Incarceration status;
101	101	8. Death records;
102	102	9. Enrollment status in public assistance programs outside of
103	103	this state; and
104	104	10. Potential identity fraud or identity theft.
105	105	D. The Authority shall sign a memorandum of understanding with
106	106	any department, agency or division for information det ailed in
107	107	subsection C of this section.
108	108	E. The Authority shall contract with one or more independent
109	109	vendors to provide information detailed in subsection C of this
110	110	section. Any contract entered under this subsection shall establish
111	111	annualized savings tha t exceed the contract 's total annual cost to
112	112	the state.

141	141	eligibility not detailed in this section or from contracting with
142	142	one or more independent vendors to provide additional information

144	144	SECTION 2. AMENDATORY 56 O.S. 2021, Section 247, is
145	145	amended to read as follows:
146	146	Section 247. A. On a quarterly basis, the Oklahoma Health
147	147	Care Authority shall receive and review information concerning
148	148	individuals enrolled in Medicaid that indicates a change in
149	149	circumstances that may affect eligibility , excluding those
150	150	individuals who would be eligible under the Tax Equity and Fiscal
151	151	Responsibility Act of 1982 (TEFRA) and excluding those individuals
152	152	with intellectual disabilities receiving Home and Community Based
153	153	Medicaid waiver and state -funded services.
154	154	B. The information provided to the Authority shall include, but
155	155	is not limited to:
156	156	1. Earned and unearned income;
157	157	2. Employment status and changes in employment;
158	158	3. Residency status;
159	159	4. Enrollment status in other state -administered public
160	160	assistance programs;

193	193	C. The Authority shall sign a memorandum of understanding with
194	194	any department, agency or division for information detailed in
195	195	subsection B of this section.
196	196	D. The Authority shall contract with one or more independent
197	197	vendors to provide inf ormation detailed in subsection B of this
198	198	section. Any contract entered under this subsection shall establish
199	199	annualized savings that exceed the contract 's total annual cost to
200	200	the state.
201	201	E. The Authority shall explore joining any multistate
202	202	cooperative to identify individuals who are also enrolled in public
203	203	assistance programs outside of this state, including the National
204	204	Accuracy Clearinghouse.
205	205	F. Nothing in this section shal l preclude the Authority from
206	206	receiving or reviewing additional information re lated to eligibility
207	207	not detailed in this section or from contracting with one or more
208	208	independent vendors to provide additional information not detailed
209	209	in this section.
210	210	G. If the Authority receives information concerning an
211	211	individual enrolled in Medicaid that indicates a change in

238	238	circumstances that may affect eligibility, the Authority shall
239	239	review the individual 's case using the following procedures:
240	240	1. If the information d oes not result in the Authority finding
241	241	a discrepancy or change in an individu al's circumstances that may
242	242	affect eligibility, the Authority shall take no further action;
243	243	2. If the information results in the Authority finding a
244	244	discrepancy or change in an individual's circumstances that may
245	245	affect eligibility, the Authority shall promptly redetermine
246	246	eligibility after receiving such information;
247	247	3. If the information results in the Authority finding a
248	248	discrepancy or change in an individual 's circumstances that may
249	249	affect eligibility, the individual shall be given an opportunity to
250	250	explain the discrepancy; provided, however, that self -declarations
251	251	by applicants or recipients shall not be accepted as verification;
252	252	4. The Authority shall provide notice to the individual which
253	253	shall describe in sufficient detail the circumstances of the
254	254	discrepancy or change, the manner in which the applicant or
255	255	recipient may respond, and the consequences of failing to take
256	256	action. The applicant or recipient shall have ten (10 ) business
257	257	days to respond in an attempt to resolve the discrepancy or change.
258	258	The explanation provided by the recipient or applicant shall be
259	259	given in writing. After receiving the explanation, the Authority
260	260	may request additional documentation if it det ermines that there is
261	261	risk of fraud, misrepresentation or inadequate documentation;

288	288	5. If the individual does not respond to the notice, the
289	289	Authority shall discontinue assistance for failure to cooperate, in
290	290	which case the Authority shall provide notice of intent to
291	291	discontinue assistance. Eligibility for assistance shall not be
292	292	established or reestablished until the discrepancy or change has
293	293	been resolved;
294	294	6. If an individual responds to the notice and disagrees with
295	295	the findings, the Authority shall r einvestigate the matter. If the
296	296	Authority finds that there has been an error, the Authority shall
297	297	take immediate action to correct it and no further action shall be
298	298	taken. If, after an investigation, the Authority determines that
299	299	there is no error, the A uthority shall determine the effect on the
300	300	individual's case and take appropri ate action. Written notice of
301	301	the Authority action shall be given to the individual; and
302	302	7. If the individual agrees with the findings, the Authority
303	303	shall determine the effect on the individual's case and take
304	304	appropriate action. Written notice of the Authority action shall be
305	305	given to the individual. In no case shall the Authority discontinue
306	306	assistance upon finding a discrepancy or change in circumstances
307	307	until the individual has been given notice of the discrepancy and
308	308	the opportunity to respond as required under the HOPE Act.
309	309	SECTION 3. This act shall become effective November 1, 2025.
