5261 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5362 SECTION 1. AMENDATORY 63 O.S. 2021, Section 1 -1956.1, is
5463 amended to read as follows:
5564 Section 1-1956.1. As used in Section 1-1953.1 1-1956.1 et seq.
5665 of this title:
5766 1. "Assisted living center" shall have the same meaning as
5867 provided by Section 1 -890.2 of this title;
59-2. "Authorized electronic monitoring" means the placement of
60-electronic monitoring devices only in the common areas or for
61-intermediate care facilities and bo th the common areas or room of a
62-resident of a nursing facility, assist ed living center or continuum

95+2. "Authorized electronic monitoring" means the placement of
96+electronic monitoring devices only in the common areas or for
97+intermediate care facilities and both the common areas or room of a
98+resident of a nursing facility, assisted living center or continuum
99+of care facility and the tapes or recordings from such devices
90100 pursuant to the provisions of Section 1-1953.1 1-1956.1 et seq. of
91101 this title;
92102 3. "Authorized electronic monitoring devices" means:
93103 a. video surveillance cameras installed only in the
94104 common areas or for intermediate care facilities and
95105 both the common areas or resident's room under the
96106 provisions of Section 1-1953.1 et seq. of this title
97107 in a nursing facility, assisted living center, or
98108 continuum of care facility , or
99109 b. audio devices installed in the room of a resident
100110 under the provisions of Section 1-1953.1 1-1956.1 et
101111 seq. of this title that are designed to acquire
102112 communications or other sounds occurring in the room;
103113 4. "Continuum of care facility" shall have the same meaning as
104114 provided by Section 1 -890.2 of this title;
105115 5. "Intermediate care facility" means an institution that is
106116 primarily for the diag nosis, treatment, or rehabilitation of the
107117 intellectually disabled or persons with related conditions, and
108118 provides in a protected residential setting, ongoing evaluation,
109-planning, twenty-four-hour supervision, coordination, and
110-integration of health or rehabilitative services to help each
111-individual function at his or her greatest ability , not to include
112-services through a home and community -based waiver;

146+planning, twenty-four-hour supervision, co ordination, and
147+integration of health or rehabilitative services to help each
148+individual function at his or her greatest ability;
139149 5. 6. "Nursing facility" means the term as defined in Section
140150 1-1902 of Title 63 of the Oklahoma Statutes;
141151 6. 7. "Representative of a resident" means a court -appointed
142152 guardian or, if there is no court -appointed guardian, the parent of
143153 a minor, a relative or other person, designated in writing by the
144154 resident; provided, that any owner, operator, administrator or
145155 employee of a facility subject to the provisions of the Nursing Home
146156 Care Act, the Continuum of Care and Assisted Living Act, the
147157 Residential Care Act or the Group Homes for the Developmentally
148158 Disabled or Physically Handicapped Persons Act shall not be
149159 appointed guardian or limited guardian of a resident of the nursing
150160 facility, assisted living center , intermediate care facility, or
151161 continuum of care facility unless the owner, operator, administrator
152162 or employee is the spouse of the resident or a relative of the
153163 resident within the second degree of consanguinity and is otherwise
154164 eligible for appointment;
155165 7. 8. "Resident" means a person residing in a nursing facility,
156166 assisted living center , intermediate care facility, or continuum of
157167 care facility; and
158168 8. 9. "Unauthorized electronic monitoring" means electronic ,
159169 mechanical, or other devices that do not meet the provisions of
160-Section 1-1953.1 1-1956.1 et seq. of this title and that are
161-specifically used for the nonconsensual interception of wire or
162-electronic communications.

189200 SECTION 2. AMENDATORY 63 O.S. 2021, Section 1 -1956.2, is
190201 amended to read as follows:
191202 Section 1-1956.2. A. A nursing facility, assisted living
192203 center, or continuum of care facility shall provide written notice
193204 to each resident, or to the representative of a resident, that
194205 authorized electronic monitoring of a resident's room conducted
195206 under the provisions of Section 1-1953.1 1-1956.1 et seq. of this
196207 title is not compulsory and shall only be conducted with the written
197208 consent of the resident or the representative of the resident.
198209 B. A nursing facility, assisted living center , or continuum of
199210 care facility shall not refuse to admit an individual to residency
200211 in the facility or center and shall not remove a resident from a
201212 facility or center because of authorized electro nic monitoring of a
202213 resident's room.
203214 C. A nursing facility, assisted living center , intermediate
204215 care facility, or continuum of care facility shall post at or near
205216 its main entrances a sign that clearly states tha t electronic
206217 monitoring and audio devices may be in use in the facility or
207218 center.
208219 SECTION 3. AMENDATORY 63 O.S. 2021, Section 1 -1956.3, is
209220 amended to read as follows:
210-Section 1-1956.3. A. No person or entity shall intentionally

248+Section 1-1956.3. A. No person or entity shall intentionally
249+hamper, obstruct, tamper with, or destroy an electronic monitoring
238250 device installed in a nursing facility, assisted living center ,
239251 intermediate care facility, or continuum of care facility.
240252 B. Any person or entity that intentionally hampers, obstructs,
241253 tampers with, or destroys a recording or an electronic monitoring
242254 device installed in a nursing facility, assisted living center ,
243255 intermediate care facility, or continuum of care facility shall be
244256 subject to the penalties prescribed in Section 1993 of Title 21 of
245257 the Oklahoma Statutes.
246258 C. No person or entity shall intercept a communication or
247259 disclose or use an intercepted communication of an electronic
248260 monitoring device placed or installed in a common area of a nursing
249261 facility, assisted living center , intermediate care facility, or
250262 continuum of care facility without the express written consent of
251263 the facility, or, for an electronic monitoring device installed in a
252264 resident's room, the express written consent of the resident or the
253265 representative of the res ident.
254266 SECTION 4. AMENDATORY 63 O.S. 2021, Section 1 -1956.5, is
255267 amended to read as follows:
256268 Section 1-1956.5. A. A resident or the representative of a
257269 resident may conduct authorized electronic monitoring of the
258270 resident's room through the use of authorized electronic monitoring
259271 devices placed in the room pursuant to the provisions of Section 1-
260-1953.1 1-1956.1 et seq. of this title at the expense of such person

287300 or representative of the resident and with the written consent of
288301 any other resident living in the room.
289302 B. A resident who conducts authorized electronic monitoring or
290303 the representative of the resident may post and maintain a notice at
291304 the entrance to the resident's room stating that the room is being
292305 monitored by an elec tronic monitoring device.
293306 C. Nothing in Section 1-1953.1 1-1956.1 et seq. of this title
294307 shall be construed to prevent a resident or the representative of
295308 the resident from placing an electronic monitoring device in the
296309 resident's room at the expense of su ch person; however, if such
297310 resident is sharing a room with any other resident, the resident or
298311 the representative of the resident shall obtain written consent from
299312 such other resident or the representative of the resident living in
300313 the room and such conse nt shall be on a form prescribed by the State
301314 Department of Health and shall be placed on file with the
302315 administrator of the facility.
303316 D. If a resident residing in a shared room, or the
304317 representative of a resident residing in a shared room, desires to
305318 utilize an authorized electronic monitoring device and another
306319 resident living in such shared room refuses to consent to the use of
307320 an authorized electronic monitoring device, the nursing facility,
308321 assisted living center , or continuum of care facility shall
309322 accommodate the resident or the representative of the resident
310-desiring to utilize a n authorized electronic monitoring device to

350+desiring to utilize an authorized electronic monitoring device to
337351 move to another room if the resident or resident's representative
338352 requests such a room change within a reasonable amount of tim e.
339353 SECTION 5. AMENDATORY 63 O.S. 2021, Section 1 -1956.6, is
340354 amended to read as follows:
341355 Section 1-1956.6. A. A resident or representative of a
342356 resident who wishes to conduct authorized electronic monitoring
343357 shall be required to notify the nursing facility, assisted living
344358 center, or continuum of care facility on the consent form prescribed
345359 by the State Department of Health.
346360 B. The consent form prescribed by the Department shall require
347361 the resident or the representative of a res ident to obtain the
348362 consent of any other r esident in the room or the representative of a
349363 resident, using the consent form prescribed for this purpose by the
350364 Department, if the resident resides in a room with another resident.
351365 C. Consent may be given only:
352366 1. By the resident or any other resident in the room; or
353367 2. By the representative of the resident or representative of
354368 any other resident in the room.
355369 D. Another resident in the room may:
356370 1. When the proposed electronic monitoring device is a video
357371 surveillance camera, condition consent on th e camera being pointed
358372 away from the consenting resident; and
359-2. Condition consent on the use of an audio electronic
360-monitoring device being limited or prohibited.

400+2. Condition consent on the use of an audio electronic
401+monitoring device being limited or prohibited.
387402 E. Except as provided for in Section 1-1953.7 1-1956.7 of this
388403 title, authorized electronic monitoring may begin only after the
389404 required consent forms specified in Section 1-1953.1 1-1956.1 et
390405 seq. of this title have been completed and returned to the nursing
391406 facility, assisted living center , or continuum of care facility and
392407 placed on file with the administrator of such facility or center.
393408 F. If authorized electronic monitoring is being conducted in
394409 the room of a resident, another resident may not be moved into the
395410 room unless the resident or represent ative of the resident has
396411 consented to the use of existing electronic monitoring, in
397412 accordance with Section 1-1953.1 1-1956.1 et seq. of this title.
398413 G. The Department may include other information that it
399414 considers to be appropriate on any form it is req uired to prescribe
400415 under the provisions of Section 1-1953.1 1-1956.1 et seq. of this
401416 title.
402417 H. The Department shall prescribe the forms required by Section
403418 1-1953.1 1-1956.1 et seq. of this title no later than November 1,
404419 2013, and shall make such forms a vailable on its website.
405420 SECTION 6. This act shall become effective November 1, 2025.
