56	56	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
57	57	SECTION 1. NEW LAW A new sectio n of law not to be
58	58	codified in the Oklahoma Statutes reads as follows:
59	59	This act shall be known and may be cited as the "Community
60	60	Quality of Life Enhancement Act ".
61	61	SECTION 2. NEW LAW A new section of law to be codified
62	62	in the Oklahoma Statutes as Section 9101 of Title 62, unless there
63	63	is created a duplication in numbering, reads as follows:
64	64	The Legislature finds that communities within the state would
65	65	benefit from access to additional funding sources to promote a high

93	93	based on an allocation system using a per capita method.
94	94	SECTION 3. NEW LAW A new section of law to be codified
95	95	in the Oklahoma Statutes as Section 9102 of Title 62, unless there
96	96	is created a duplication in numbering, reads as follows:
97	97	Local communities sh all establish a board in order to make
98	98	applications to the Oklahoma Department of Commerce for available
99	99	funds pursuant to the provisions of this act.
100	100	SECTION 4. NEW LAW A new section of law to be codified
101	101	in the Oklahoma Statutes as Section 9103 of Title 62, unless there
102	102	is created a duplication in numbering, reads as follows:
103	103	The monies in the Community Quality of Life Enhancement
104	104	Revolving Fund may be ut ilized by eligible communities for:
105	105	1. Infrastructure improvements that impac t quality of life;
106	106	2. Parks and recreational facilities;
107	107	3. Public transportation enhancements;
108	108	4. Cultural and community centers;
109	109	5. Public art and beautification; and
110	110	6. Environmental conservation projects.
111	111	SECTION 5. NEW LAW A new section of law to be codified
112	112	in the Oklahoma Statutes as Section 9104 of Title 62, unless there
113	113	is created a duplication in numbering, reads as follows:
114	114	The expenditures from the Community Qualify of Life Enhancement
115	115	Revolving Fund and other expend itures governed by this act, if made

142	142	in accordance with the requirements of this act, shall be construed
143	143	as an expenditure of public funds in furtherance of governmental
144	144	functions and for the purpose of conferring general and uniform
145	145	benefits resulting from the expenditures upon the residents and
146	146	other legal entities located in eligible communities.
147	147	SECTION 6. NEW LAW A new section of law to be codified
148	148	in the Oklahoma Statutes as Section 9105 of Title 62, unless there
149	149	is created a duplication in numbering, reads as follows:
150	150	There is hereby created in the State Treasury a revolving fund
151	151	for the Oklahoma Department of Commerce to be designated the
152	152	"Community Quality of Life Enhancement Revolving Fund ". The fund
153	153	shall be a continuing fund, not subject to fiscal year limitations,
154	154	and shall consist of all monies received by the Oklahoma Department
155	155	of Commerce pursuant to Section 7 of this act. All monies accruing
156	156	to the credit of said fund are hereby appropriated and may be
157	157	budgeted and expended by the Oklahoma Department of Commerce for the
158	158	purpose of making allocations to eligible communities to implement
159	159	the provisions of this act. Expenditures from said fun d shall be
160	160	made upon warrants issued by the State Treasurer against claims
161	161	filed as prescribed by law with the Director of the Office of
162	162	Management and Enterprise Services for approval and payment.
163	163	SECTION 7. NEW LAW A new section of law to be codified
164	164	in the Oklahoma Statutes as Section 9106 of Title 62, u nless there
165	165	is created a duplication in numbering, reads as follows:

192	192	A. Funding for the Community Quality of Life Enhancement
193	193	Revolving Fund shall be derived from the income tax revenue which is
194	194	attributable to the increment of twenty -five hundredths of one
195	195	percent (0.0025) of the highest rate of tax imposed on the taxable
196	196	income of individuals pursuant to Section 2355 of Title 68 of the
197	197	Oklahoma Statutes.
198	198	B. The balance of the Community Quality of Life Enhancement
199	199	Fund shall not exceed Two Hundred Fifty Million Dollars
200	200	($250,000,000.00).
201	201	C. All revenue that would otherwise be apportioned to the Fund
202	202	once the maximum fund balance prescribed by this section is reached
203	203	shall be apportioned according to the requirements of Section 2352
204	204	of Title 68 of the Oklahoma Statutes.
205	205	SECTION 8. This act shall become effective July 1, 202 5.
206	206	SECTION 9. It being immediately necessary for the preservation
207	207	of the public peace, health or safety, an emergency is hereby
208	208	declared to exist, by re ason whereof this act shall take effect and
209	209	be in full force from and after its passage and approval.
