5656 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5757 SECTION 1. NEW LAW A new sectio n of law not to be
5858 codified in the Oklahoma Statutes reads as follows:
5959 This act shall be known and may be cited as the "Community
6060 Quality of Life Enhancement Act ".
6161 SECTION 2. NEW LAW A new section of law to be codified
6262 in the Oklahoma Statutes as Section 9101 of Title 62, unless there
6363 is created a duplication in numbering, reads as follows:
6464 The Legislature finds that communities within the state would
6565 benefit from access to additional funding sources to promote a high

9494 SECTION 3. NEW LAW A new section of law to be codified
9595 in the Oklahoma Statutes as Section 9102 of Title 62, unless there

9898 applications to the Oklahoma Department of Commerce for available
9999 funds pursuant to the provisions of this act.

103103 The monies in the Community Quality of Life Enhancement
104104 Revolving Fund may be ut ilized by eligible communities for:
105105 1. Infrastructure improvements that impac t quality of life;
106106 2. Parks and recreational facilities;
107107 3. Public transportation enhancements;
108108 4. Cultural and community centers;
109109 5. Public art and beautification; and
110110 6. Environmental conservation projects.
111111 SECTION 5. NEW LAW A new section of law to be codified
112112 in the Oklahoma Statutes as Section 9104 of Title 62, unless there

114114 The expenditures from the Community Qualify of Life Enhancement
115115 Revolving Fund and other expend itures governed by this act, if made

142142 in accordance with the requirements of this act, shall be construed
143143 as an expenditure of public funds in furtherance of governmental
144144 functions and for the purpose of conferring general and uniform
145145 benefits resulting from the expenditures upon the residents and
146146 other legal entities located in eligible communities.
147147 SECTION 6. NEW LAW A new section of law to be codified
148148 in the Oklahoma Statutes as Section 9105 of Title 62, unless there
149149 is created a duplication in numbering, reads as follows:
150150 There is hereby created in the State Treasury a revolving fund
151151 for the Oklahoma Department of Commerce to be designated the
152152 "Community Quality of Life Enhancement Revolving Fund ". The fund
153153 shall be a continuing fund, not subject to fiscal year limitations,
154154 and shall consist of all monies received by the Oklahoma Department
155155 of Commerce pursuant to Section 7 of this act. All monies accruing
156156 to the credit of said fund are hereby appropriated and may be
157157 budgeted and expended by the Oklahoma Department of Commerce for the
158158 purpose of making allocations to eligible communities to implement
159159 the provisions of this act. Expenditures from said fun d shall be
160160 made upon warrants issued by the State Treasurer against claims
161161 filed as prescribed by law with the Director of the Office of
162162 Management and Enterprise Services for approval and payment.
163163 SECTION 7. NEW LAW A new section of law to be codified
164164 in the Oklahoma Statutes as Section 9106 of Title 62, u nless there

192192 A. Funding for the Community Quality of Life Enhancement
193193 Revolving Fund shall be derived from the income tax revenue which is
194194 attributable to the increment of twenty -five hundredths of one
195195 percent (0.0025) of the highest rate of tax imposed on the taxable
196196 income of individuals pursuant to Section 2355 of Title 68 of the
197197 Oklahoma Statutes.
198198 B. The balance of the Community Quality of Life Enhancement
199199 Fund shall not exceed Two Hundred Fifty Million Dollars
200200 ($250,000,000.00).
201201 C. All revenue that would otherwise be apportioned to the Fund
202202 once the maximum fund balance prescribed by this section is reached
203203 shall be apportioned according to the requirements of Section 2352
204204 of Title 68 of the Oklahoma Statutes.
205205 SECTION 8. This act shall become effective July 1, 202 5.
206206 SECTION 9. It being immediately necessary for the preservation
207207 of the public peace, health or safety, an emergency is hereby
208208 declared to exist, by re ason whereof this act shall take effect and
209209 be in full force from and after its passage and approval.
