5653 each packet; allowing Board to seal certain records;
5754 clarifying which packet the Governor will receive;
5855 providing for codification; and providing an

6362 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6463 SECTION 1. NEW LAW A new section of law to be codified
6564 in the Oklahoma Statutes as Section 142A -15 of Title 21, unless
6665 there is created a duplication in numbering, reads as follows:
6766 Victims and victims' families shall have the right to

10098 SECTION 2. AMENDATORY 51 O.S. 2021, Section 24A.5, as
10199 last amended by Section 2, Chapter 116, O.S.L. 2024 (51 O.S. Supp.
102100 2024, Section 24A.5), is amended to read as follows:
103101 Section 24A.5. All records of public bodies and public
104102 officials shall be open to any person for inspection, copying, or
105103 mechanical reproduction during regular business hours; provided:
106104 1. The Oklahoma Open Records Act, Se ctions 24A.1 through 24A.30
107105 of this title, does not apply to records specifically required by
108106 law to be kept confidential including:
109107 a. records protected by a state evidentiary privilege
110108 such as the attorney -client privilege, the work
111109 product immunity from discovery and the identity of
112110 informer privileges,
113111 b. records of what transpired during meetings of a public
114112 body lawfully closed to the public such as executive
115113 sessions authorized under the Oklahoma Open Meeting
116114 Act,
117115 c. personal information within drive r records as defined
118116 by the Driver's Privacy Protection Act, 18 United
119117 States Code, Sections 2721 through 2725,

150147 hearsay, preliminary unsubstantiated investigation -

152149 e. any test forms, question banks and answer keys
153150 developed for state licensure examinations, but
154151 specifically excluding test prepar ation materials or
155152 study guides,
156153 f. last names, addresses, Social Security numbers or tax
157154 identification numbers, and proof of identification
158155 submitted to the Oklahoma Lottery Commission by
159156 persons claiming a lottery prize,
160157 g. unless public disclosure is required by other laws or
161158 regulations, vehicle movement records of the Oklahoma
162159 Transportation Authority obtained in connection with

204200 through the Oklahoma Tourism and Recreation

206202 k. a Department of Defense Form 214 (DD Form 214) filed
207203 with a county clerk, including any DD Form 214 filed

209205 l. except as provided for in Section 2 -110 of Title 47 of

211207 (1) any record in connection with a Motor Vehicle
212208 Report issued by the Department of Public Safety,
213209 as prescribed in Section 6 -117 of Title 47 of the

217213 18 U.S.C., Sections 2721 through 2725, which are
218214 stored and maintained by the Department of Public

251246 applicant's personal address, personal phone number,
252247 personal email address, any government -issued
253248 identification numbers, or other contact in formation;
254249 provided, however, lists of persons licensed, the
255250 existence of a license of a person, or a business or
256251 commercial address, or other business or commercial
257252 information disclosable under state law submitted with
258253 an application for licensure shall be public record,
259254 unless the business or commercial address is the same
260255 as the applicant's personal address, except when the
261256 applicant permits in writing the disclosure of the
262257 address,
263258 n. an investigative file obtained during an investigation
264259 conducted by the State Department of Health into
265260 violations of the Long -Term Care Administrator
266261 Licensing Act under Title 63 of the Oklahoma Statutes,

268263 o. documents, evidence, materials, records, reports,

298292 Department pertaining to an evaluation, examination,
299293 investigation, or review made pursuant to the
300294 provisions of the Patient 's Right to Pharmacy Choice
301295 Act, the Pharmacy Audit Integrity Act, or Sections 357
302296 through 360 of Title 59 of the Oklahoma Statutes , or
303297 p. crime scene and autopsy photographs of victims
304298 submitted to the Pardon and Parole Board for clemency
305299 hearing purposes;
306300 2. All Social Security numbers included in a record may be
307301 confidential regardless of the person 's status as a public employee
308302 or private individual and may be redacted or deleted prior to
309303 release of the record by the public body;
310304 3. Any reasonably segregable portion of a record containing
311305 exempt material shall be provided after deletion of the exempt
312306 portions; provided however, the Department of Public Safety shall
313307 not be required to assem ble for the requesting person specific
314308 information, in any format, from driving records relating to any
315309 person whose name and date of birth or whose driver license number
316310 is not furnished by the requesting person.
317311 The Oklahoma State Bureau of Investigation shall not be required
318312 to assemble for the requesting person any criminal history records
319313 relating to persons whose names, dates of birth, and other
320314 identifying information required by the Oklahoma State Bureau of

348341 Investigation pursuant to administrative r ule are not furnished by
349342 the requesting person;
350343 4. Any request for a record which contains individual records
351344 of persons, and the cost of copying, reproducing or certifying each
352345 individual record is otherwise prescribed by state law, the cost may
353346 be assessed for each individual record, or portion thereof requested
354347 as prescribed by state law. Otherwise, a public body may charge a
355348 fee only for recovery of the re asonable, direct costs of record
356349 copying, or mechanical reproduction. Notwithstanding any state or
357350 local provision to the contrary, in no instance shall the record
358351 copying fee exceed twenty -five cents ($0.25) per page for records
359352 having the dimensions of eight and one -half (8 1/2) by fourteen (14)
360353 inches or smaller, or a maximum of One Dollar ($1.00) per copied
361354 page for a certified copy. However, if the request:
362355 a. is solely for commercial purpose, or
363356 b. would clearly cause excessive disruption of the
364357 essential functions of the public body,
365358 then the public body may charge a reasonable fee to recover the
366359 direct cost of record search and copying; however, publication in a
367360 newspaper or broadcast by news media for news purposes shall not
368361 constitute a resale or use of a record for trade or commercial
369362 purpose and charges for providing copies of electronic d ata to the
370363 news media for a news purpose shall not exceed the direct cost of
371364 making the copy. The fee charged by the Department of Public Safety

399391 for a copy in a computerized format of a record of the Department
400392 shall not exceed the direct cost of making t he copy unless the fee
401393 for the record is otherwise set by law.
402394 Any public body establishing fees under this act shall post a
403395 written schedule of the fees at its principal office and with the
404396 county clerk.
405397 In no case shall a search fee be charged when the r elease of
406398 records is in the public interest, including, but not limited to,
407399 release to the news media, scholars, authors and taxpayers seeking
408400 to determine whether those entrusted with the affairs of the
409401 government are honestly, faithfully, and competently performing
410402 their duties as public servants.
411403 The fees shall not be used for the purpose of discouraging
412404 requests for information or as obstacles to disclosure of requested
413405 information;
414406 5. The land description tract index of all recorded instruments
415407 concerning real property required to be kept by the county clerk of
416408 any county shall be available for inspection or copying in
417409 accordance with the provisions of the Oklahoma Open Records Act;
418410 provided, however, the index shall not be copied or mechanically
419411 reproduced for the purpose of sale of the information;
420412 6. A public body must provide prompt, reasonable access to its
421413 records but may establish reasonable procedures which protect the
422414 integrity and organization of its records and to prevent excessive

450441 disruptions of its essential functions. A delay in providing access
451442 to records shall be limited solely to the time required for
452443 preparing the requested documents and t he avoidance of excessive
453444 disruptions of the public body 's essential functions. In no event
454445 may production of a current request for records be unreasonably
455446 delayed until after completion of a prior records request that will
456447 take substantially longer than the current request. Any public body
457448 which makes the requested records available on the Internet shall
458449 meet the obligation of providing prompt, reasonable access to its
459450 records as required by this paragraph; and
460451 7. A public body shall designate certain p ersons who are
461452 authorized to release records of the public body for inspection,
462453 copying, or mechanical reproduction. At least one person shall be
463454 available at all times to release records during the regular
464455 business hours of the public body.
465456 SECTION 3. NEW LAW A new section of law to be codified
466457 in the Oklahoma Statutes as Sec tion 332.22 of Title 57, unless there
467458 is created a duplication in numbering, reads as follows:
468459 A. During a Pardon and Parole Board clemency hearing, autopsy
469460 photographs and victim images displayed in the crime scene
470461 photographs shall not be presented or d isplayed to the public.
471462 B. Two separate clemency packets shall be submitted to the
472463 administrative office of the Board on or before a date set by the
473464 Chair:

501491 1. A clemency hearing packet submitted to the public; and
502492 2. A clemency hearing packet submitted to the Pardon and Parole
503493 Board.
504494 C. The clemency hearing packet submitted to the public by the
505495 applicable parties shall not include autopsy photographs and vic tim
506496 images displayed in the crime scene photographs.
507497 D. The Board shall receive all photographs via the clemency
508498 hearing packet submitted by the parties, including autopsy and
509499 victim images displayed in the crime scene photographs. To further
510500 ensure the confidentiality and privacy of the victim, the Board
511501 shall have the ability to seal from public v iew any submission
512502 included in the public clemency hearing packet that would infringe
513503 on the confidentiality or privacy of the victim as determined by a
514504 majority vote of the Board.
515505 E. The Office of the Governor shall receive the clemency
516506 hearing packet which includes the autopsy and victim images
517507 displayed in the crime scene photographs.
518508 SECTION 4. This act shall become effective November 1, 2025.
