6464 BE IT ENACTED BY THE PEOP LE OF THE STATE OF OKLAHOMA:
6565 SECTION 1. NEW LAW A new section of law to be codified
6666 in the Oklahoma Statutes as Section 13001 of Title 74, unless there
6767 is created a duplication in numbering, reads as follows:
6868 Sections 1 through 4 of this act shall be known and may be cited
6969 as the "Oklahoma Law Enforcement Event Deconfliction Act ".

9696 SECTION 2. NEW LAW A new section of law to be codified
9797 in the Oklahoma Statutes as Section 13002 of Title 74, unless there
9898 is created a duplication in numbering, reads as follows:
9999 As used in this act:
100100 1. "Conflict" means when data submitted to an event
101101 deconfliction system by one law enforcement party matches data
102102 submitted by one or more other law enforcement parties;
103103 2. "Event" means a law enforcement action, including, but not
104104 limited to, raids, undercover operations, surveillance, or the
105105 execution of arrest or search warrants;
106106 3. "Event deconfliction" means the process of determining when
107107 law enforcement personnel are conducting an event in close proximity
108108 to one another at the same time;
109109 4. "Event deconfliction system" means a system designed to
110110 perform event deconfliction and notify appropriate law enforcement
111111 personnel that a conflict may exist; and
112112 5. "Law enforcement perso nnel" means:
113113 a. a part-time or full-time employee of a federal, state,
114114 tribal, or local law enforcement agency, police
115115 department, or sheriff 's office who is responsible for
116116 the prevention and detection of crime and the
117117 enforcement of federal, state, triba l, or local laws,

145145 b. a civilian part-time or full-time employee of a
146146 federal, state, tribal, or local law enforcement
147147 agency, police department, or sheriff 's office who has
148148 been approved by his or her employer to access an
149149 event deconfliction system.
150150 SECTION 3. NEW LAW A new section of law to be codified
151151 in the Oklahoma Statutes as Section 13003 of Title 74, unless there
152152 is created a duplication in numbering, reads as follows:
153153 A. Law enforcement personnel shall, as soon as is pra cticable
154154 prior to the initiation of an event and no later than one (1) hour
155155 before, submit the information identified in subsection B of this
156156 section to an event deconfliction system.
157157 B. Information submitted to the event deconfliction system
158158 shall include all information required by such system which may
159159 include, but not be limited to, the following:
160160 1. Case number;
161161 2. Type of event;
162162 3. Date and time of the planned event;
163163 4. Location of the event, including the exact street address
164164 and any staging areas;
165165 5. Lead agency name;
166166 6. Name and agency of the contact person for the ev ent,
167167 including cellular telephone number and a secondary point of contact
168168 for the event;

195195 7. Search radius, if not preset by the event deconfliction
196196 system; and
197197 8. Any other information deemed applicable to the event or
198198 investigation.
199199 C. Law enforcement personnel sh all submit the required
200200 information to the event deconfliction system about the following
201201 types of events:
202202 1. The service of a search or arrest warrant;
203203 2. The planned arrest of a person immediately following an
204204 operation or action by law enforcement personnel;
205205 3. Taking delivery of contraband from an individual who is not
206206 intended to be arrested;
207207 4. Conducting an operation whereby law enforcement personnel
208208 approaches an individual at his or her residence and requests
209209 permission to search for any contraband;
210210 5. Predetermined surveillance operations, whether stationary or
211211 mobile;
212212 6. Covert activity by law enforcement personnel , or by
213213 confidential sources acting und er the direction of law enforcement
214214 personnel, that could cause a response fro m citizens or local police
215215 who may reasonably believe a crime is in progress; or
216216 7. Any other high-risk or specialized law enforcement
217217 activities identified in state or local re gulation or protocol that
218218 would benefit from event deconfliction.

245245 D. When law enforcement personnel receives an event conflict
246246 notification, such personnel shall take all steps necessary to
247247 resolve the conflict prior to the date and time of the event
248248 including, but not limited to, contacting the other party identified
249249 in the event notification.
250250 E. Law enforcement personnel who receive an event conflict
251251 notification and fail to make a good faith effort to resolve such
252252 conflict may be subject to civil, admi nistrative, or criminal
253253 penalties.
254254 F. The underlying information and files used by law enforcement
255255 personnel to submit information to an event deconfliction system are
256256 subject to the same data retention policy as all other similar
257257 information held by law enforcement personnel . In addition, nothing
258258 in this act shall be deemed to ch ange or supersede any purge,
259259 validation, or records retention policy established by an event
260260 deconfliction system for information submitted to and held by such
261261 system.
262262 SECTION 4. NEW LAW A new section of law to be codified
263263 in the Oklahoma Statutes as Section 13004 of Title 74, unless there
264264 is created a duplication in numbering, reads as follows:
265265 A. Information submitted to an event deconfliction system is
266266 confidential and is not subject to the federal Freedom of
267267 Information Act or the Oklahoma Open Records Act , nor is it subject
268268 to civil, criminal, or administrative subpoena.

295295 B. Law enforcement personnel authorized to submit information
296296 to or access information held by an event deconfliction system shall
297297 not:
298298 1. Submit information regarding any individual or address for
299299 any purpose not related to a legitimate criminal investigation; or
300300 2. Access information regarding any individual or address for
301301 any purpose not related to a legitimate criminal investigation.
302302 C. No person who is not authorized to submit information to or
303303 access information held by an event deconfliction system shall make
304304 such a submission or query such system for any purpose.
305305 D. Individuals who violate subsection B or C of this section
306306 shall, upon conviction, be guilty of a misdemeanor punishable by a
307307 fine of Five Hundred Dollars ($500.00), or by imprisonment in the
308308 county jail for a term not to exceed one (1) year, or by both such
309309 fine and imprisonment.
310310 SECTION 5. NEW LAW A new section of l aw to be codified
311311 in the Oklahoma Statutes as Section 13005 of Title 74, unless there
312312 is created a duplication in numbering, reads as follows:
313313 The Oklahoma State Bureau of Narcotics and Dangerous Drugs
314314 Control may promulgate such rules and regulations as are necessary
315315 to effectuate the provisions of this act.
316316 SECTION 6. This act shall become effective November 1, 2025.
