48 | 48 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

49 | 49 | | SECTION 1. AMENDATORY 60 O.S. 2021, Section 833, is |
---|
50 | 50 | | amended to read as follows: |

51 | 51 | | Section 833. A. A seller of property located in this state |
---|
52 | 52 | | shall deliver, or cause to be delive red, to the purchaser of such |
---|
53 | 53 | | property one of the following: |

55 | 55 | | established by rule by the Oklahoma Real Estate Commission whic h |

95 | 95 | | statement of whether the seller has actual knowledge of defects or |

96 | 96 | | information in relation to the following: |

97 | 97 | | a. water and sewer systems, including the source of |
---|
98 | 98 | | household water, water treatment systems, sprinkler |
---|
99 | 99 | | systems, occurrence of water in the heating and air |
---|
100 | 100 | | conditioning ducts, water seepage or leakage, drainage |
---|
101 | 101 | | or grading problems and flood zone status, |
---|
102 | 102 | | b. structural systems, includ ing the roof, walls, floors, |
---|
103 | 103 | | foundation and any basement, |
---|
104 | 104 | | c. plumbing, electrical, heating and air conditioning |
---|
105 | 105 | | systems, |
---|
106 | 106 | | d. infestation or damage of wood -destroying organisms, |
---|
107 | 107 | | e. major fire or tornado damage, |
---|
108 | 108 | | f. land use matters, |
---|
109 | 109 | | g. existence of hazardous or regulated materials and |

142 | 142 | | 2. The disclosure statement shall include the following notices |

143 | 143 | | to the purchaser in bold and conspicuous type: |

144 | 144 | | a. "The information and statements contained in this |
---|
145 | 145 | | disclosure statement are declarations and |
---|
146 | 146 | | representations of the seller and are not the |
---|
147 | 147 | | representations of the real estate licensee. ", |
---|
148 | 148 | | b. "The information contained in this disclosure |
---|
149 | 149 | | statement is not intended to be a part of any contract |
---|
150 | 150 | | between the purchaser and the seller. ", and |
---|
151 | 151 | | c. "The declarations and inform ation contained in this |
---|
152 | 152 | | disclosure statement are not warranties, express or |
---|
153 | 153 | | implied of any kind, and are not a substitute for any |
---|
154 | 154 | | inspections or warranties the purchaser may wish to |
---|
155 | 155 | | obtain." |

156 | 156 | | C. Either the disclaimer statement or the disclosure statement |
---|
157 | 157 | | required by this section must be completed, signed and dated by the |
---|
158 | 158 | | seller. The date of completion on either statement may not be more |
---|
159 | 159 | | than one hundred eighty (180) days prior to the date of receipt of |
---|
160 | 160 | | the statement by the purchaser. |

194 | 194 | | whether the person requesting a disclaimer or disclosure form is |

195 | 195 | | represented by a real estate licensee. |

196 | 196 | | SECTION 2. This act shall be come effective November 1, 2025. |
