4040 An Act relating to property; amending 60 O.S. 2021,
4141 Section 833, which relates to property disclosures;
4242 requiring the disclosure of the existence of
4343 polybutylene pipes; and providing an effective date .

4848 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4949 SECTION 1. AMENDATORY 60 O.S. 2021, Section 833, is
5050 amended to read as follows:
5151 Section 833. A. A seller of property located in this state
5252 shall deliver, or cause to be delive red, to the purchaser of such
5353 property one of the following:
5454 1. A written property disclaimer statement on a form
5555 established by rule by the Oklahoma Real Estate Commission whic h
5656 states that the seller:
5757 a. has never occupied the property and makes no
5858 disclosures concerning the condition of the property,
5959 and
6060 b. has no actual knowledge of any defect; or

8787 2. A written property condition disclosure statement on a form
8888 established by rule by the Oklahoma Real Estate Commission which
8989 shall include the informatio n set forth in subsection B of this
9090 section.
9191 B. 1. The disclosure statement shall include an identification
9292 of items and improvements which are included in the sale of the
9393 property and whether such items or improvements are in normal
9494 working order. The disclosures required shall also include a
9595 statement of whether the seller has actual knowledge of defects or
9696 information in relation to the following:
9797 a. water and sewer systems, including the source of
9898 household water, water treatment systems, sprinkler
9999 systems, occurrence of water in the heating and air
100100 conditioning ducts, water seepage or leakage, drainage
101101 or grading problems and flood zone status,
102102 b. structural systems, includ ing the roof, walls, floors,
103103 foundation and any basement,
104104 c. plumbing, electrical, heating and air conditioning
105105 systems,
106106 d. infestation or damage of wood -destroying organisms,
107107 e. major fire or tornado damage,
108108 f. land use matters,
109109 g. existence of hazardous or regulated materials and
110110 other conditions having an environmental impact,

137137 h. existence of prior manufacturing of methamphetamine,
138138 i. existence of polybutylene pipes,
139139 j. any other defects known to the seller, and
140140 j. k. other matters the Oklahoma Real Esta te Commission
141141 deems appropriate.
142142 2. The disclosure statement shall include the following notices
143143 to the purchaser in bold and conspicuous type:
144144 a. "The information and statements contained in this
145145 disclosure statement are declarations and
146146 representations of the seller and are not the
147147 representations of the real estate licensee. ",
148148 b. "The information contained in this disclosure
149149 statement is not intended to be a part of any contract
150150 between the purchaser and the seller. ", and
151151 c. "The declarations and inform ation contained in this
152152 disclosure statement are not warranties, express or
153153 implied of any kind, and are not a substitute for any
154154 inspections or warranties the purchaser may wish to
155155 obtain."
156156 C. Either the disclaimer statement or the disclosure statement
157157 required by this section must be completed, signed and dated by the
158158 seller. The date of completion on either statement may not be more
159159 than one hundred eighty (180) days prior to the date of receipt of
160160 the statement by the purchaser.

187187 D. The Oklahoma Real Estate Commission shall develop by rule
188188 the forms for the residential property condition disclaimer and the
189189 residential property condition disclosure statement. After
190190 development of the initial forms, the Oklahoma Real Estate
191191 Commission may amend by rule the forms as is necessary and
192192 appropriate.
193193 Such forms shall be made available upon request irrespective of
194194 whether the person requesting a disclaimer or disclosure form is
195195 represented by a real estate licensee.
196196 SECTION 2. This act shall be come effective November 1, 2025.
