10199 This act shall be known and may be cited as the "Oklahoma Human
102100 Trafficking Justice for Victims and Advocacy Act of 2025".
103101 SECTION 2. AMENDATORY 21 O.S. 2021, Section 748, as
104102 amended by Section 1, Chapter 20, O.S.L. 2022 (21 O.S. Supp. 2024,
105103 Section 748), is amended to read as follows:
106104 Section 748. A. As used in Sections 748 and 748.2 of this
107105 title:
108106 1. "Coercion" means compelling, forcing or intimidating a
109107 person to act by:
110108 a. threats of harm or physical restraint against any
111109 person,
112110 b. any act, scheme, plan, or pattern intended to cause a
113111 person to believe that performing, or failing to
114112 perform, an act would res ult in serious physical,
115113 financial, or emotional harm or distress to or
116114 physical restraint against any person,
117115 c. the abuse or threatened abuse of the law or legal
118116 process,
119117 d. knowingly destroying, concealing, removing,
120118 confiscating or possessing any actua l or purported
121119 passport, labor or immigration document, or other

171168 2. "Commercial sex" means any form of commercial sexual
172169 activity such as sexually explicit performances, prostitution,

202198 3. "Debt bondage" means the status or condition of a debtor
203199 arising from a pledge by the debtor of his or her personal services
204200 or of those of a person under his or her control as a security for
205201 debt if the value of those services as reasonably assessed is not
206202 applied toward the liquidation of the debt or the length and nature
207203 of those services are not respectively limited and defined;
208204 4. "Human trafficking" means modern -day slavery that includes,
209205 but is not limited to, extreme exploitation and the denial of
210206 freedom or liberty of an individual for purposes of deriving benefit
211207 from that individual's commercial sex act or labor;
212208 5. "Human trafficking for labor" means:
213209 a. recruiting, enticing, harboring, maintai ning,
214210 transporting, providing or obtaining, by any means,
215211 another person through deception, force, fraud, threat
216212 or coercion or for purposes of engaging the person in
217213 labor, or
218214 b. benefiting, financially or by receiving anything of
219215 value, from participation in a venture that has
220216 engaged in an act of trafficking for labor ;
221217 6. "Human trafficking for commercial sex" means:
222218 a. recruiting, enticing, harboring, maintaining,
223219 transporting, providing or obtaining, by any means,
224220 another person through deception, for ce, fraud, threat

253248 commercial sex act,
254249 b. recruiting, enticing, harboring, maintaining,
255250 transporting, providing, purchasing or obtaining, by
256251 any means, a minor for purposes of engaging the minor
257252 in a commercial sex act, or
258253 c. benefiting, financially or by receiving anyt hing of
259254 value, from participating in a venture that has
260255 engaged in an act of trafficking for commercial sex;
261256 7. "Legal process" means the criminal law, the civil law, or
262257 the regulatory system of the federal government, any state,
263258 territory, district, comm onwealth, or trust territory therein, and
264259 any foreign government or subdivision thereof and includes legal
265260 civil actions, criminal actions, and regulatory petitions or
266261 applications;
267262 8. "Minor" means an individual under eighteen (18) years of
268263 age; and
269264 9. "Victim" means a person against whom a violation of any
270265 provision of this section has been committed.
271266 B. It shall be unlawful to knowingly engage in human
272267 trafficking.
273268 C. 1. Any person violating the provisions of this section
274269 shall, upon conviction, be guilty of a felony punishable by
275270 imprisonment in the custody of the Department of Corrections for a

303297 term of not less than five (5) years or for life, or by a fine of
304298 not more than One Hundred Thousand Dollars ($100,000.00), or by both
305299 such fine and impriso nment.
306300 2. Any person violating the provisions of this section where
307301 the victim of the offense is under eighteen (18) years of age at the
308302 time of the offense shall, upon conviction, be guilt y of a felony
309303 punishable by imprisonment in the custody of the Dep artment of
310304 Corrections for a term of not less than fifteen (15) ten (10) years
311305 or, for life, or for life without parole , or by a fine of not more
312306 than Two Hundred Fifty Thousand Dollars ($250,000.00), or by both
313307 such fine and imprisonment.
314308 3. The court shall also order the defendant to pay restitution
315309 to the victim as provided in Section 991f of Title 22 of the
316310 Oklahoma Statutes. In addition, the court shall require the
317311 defendant to pay for a psychological evaluation to determine the
318312 extent of counseling necessary for the human trafficking victim and
319313 any necessary psychological counseling deemed necessary to
320314 rehabilitate the victim. Such evaluations and counseling may be
321315 performed by psychiatrists, psychologists, licensed professional
322316 counselors, or social workers.
323317 4. If the person is convicted of human trafficking, the person
324318 shall serve eighty-five percent (85%) of the sentence before being
325319 eligible for parole consideration or any earned credits. The terms
326320 of imprisonment specified in this subsection s hall not be subject to

354347 statutory provisions for suspension, deferral or probation, or state
355348 correctional institution earned credits accruing from and after
356349 November 1, 1989, except for the achievement earned credits
357350 authorized by subsection H of Section 13 8 of Title 57 of the
358351 Oklahoma Statutes. To qualify for such achievement earned credits,
359352 such inmates must also be in compliance with the standards for Class
360353 level 2 behavior, as defined in subsection D of Section 138 of Title
361354 57 of the Oklahoma Statutes.
362355 D. It is an affirmative defense to prosecution for a criminal,
363356 youthful offender, or delinquent offense that, during the time of
364357 the alleged commission of the offense, the defendant or alleged
365358 youthful offender or delinquent was a victim of human traffick ing.
366359 E. The consent of a victim to the activity prohibited by this
367360 section shall not constitute a defense.
368361 F. Lack of knowledge of the age of the victim shall not
369362 constitute a defense to t he activity prohibited by this section with
370363 respect to human traff icking of a minor.
371364 SECTION 3. NEW LAW A new section of law to be codified
372365 in the Oklahoma Statutes as Section 748.1 of Title 21, unless there
373366 is created a duplication in numbering, reads as follows:
374367 A. There is hereby created a sta tewide "Human Trafficking
375368 Awareness and Education Program". The Director of the Human
376369 Trafficking Response Unit within the Office of the Attorney General
377370 shall develop, promote, and coordin ate a public awareness program to

406398 schools and school districts throughout the State of Oklahoma.
407399 B. The Human Trafficking Awareness and Education Program shall
408400 include:
409401 1. Objective criteria, guidelines, and a comprehensive
410402 integrated curriculum for human trafficking programs;
411403 2. Establish and review annually model policies for human
412404 trafficking issues;
413405 3. Develop and implement guideline s, strategies, and criteria
414406 which encourage all school s to be trained in human trafficking
415407 awareness and prevention, and recognizing tactics used by
416408 traffickers to recruit victims through social media, gaming
417409 platforms, and any other digital spaces; and
418410 4. Develop and implement guidelines, strategies, and criteria
419411 to require all law enforcement agencies within this state t o be
420412 trained in human trafficking awareness and prevention, and
421413 recognizing tactics used by traffickers to recruit victims through
422414 social media, gaming platforms, and any other digital space s.
423415 C. Final determination of the materials created and produced b y
424416 the Human Trafficking Response Unit to be used and the means of
425417 implementation of the curriculum shall be made by the Director of
426418 the Human Trafficking Response Unit .

454445 D. The Human Trafficking Response Unit shall promulgate rules
455446 to implement the provisi ons of the Human Trafficking Awareness and
456447 Education Program.
457448 SECTION 4. AMENDATORY 21 O.S. 2021, Section 748.2, as
458449 amended by Section 2, Chapter 20, O.S.L. 2022 (2 1 O.S. Supp. 2024,
459450 Section 748.2), is amended to read as follows:
460451 Section 748.2. A. Human trafficking victims shall:
461452 1. Be housed in an appropriate shelter as soon as practicable;
462453 2. Not be detained in facilities inappropriate to their status
463454 as crime victims;
464455 3. Not be jailed, fined, or otherwise penalized due to h aving
465456 been trafficked;
466457 4. Receive prompt medical care, mental health care , including
467458 counseling services and rehabilitation services , food, resources for
468459 safe housing, and other assistance, as necessary;
469460 5. Have access to legal assistance, information ab out their
470461 rights, and translation services, as necessary; and
471462 6. Be provided protection if the safety of the victim is at
472463 risk or if there is a danger of additional harm by recapture of the
473464 victim by a trafficker, including:
474465 a. taking measures to protect trafficked persons and
475466 their family members from intimidation and threats of
476467 reprisals, and

504494 b. ensuring that the names and identifying information of
505495 trafficked persons and their family memb ers are not
506496 disclosed to the public ;
507497 7. Be treated with fairness and respect for the safety,
508498 dignity, and privacy of the victim and treated as a true crime
509499 victim rather than a defendant in a criminal case;
510500 8. Be informed of financial assistance and other social
511501 services as a result of being a human trafficking victim; and
512502 9. Be informed in writing of all constitutional and statutory
513503 rights, as provided for in the provisions of the Oklahoma Victim's
514504 Rights Act.
515505 B. Any person aggrieved by a violation of subsection B of
516506 Section 748 of this title may bring a civil action against the
517507 person or persons who committed the violation to recover actual and
518508 punitive damages and reasonable attorney fees and costs. The civil
519509 action brought under this section may be instituted in the district
520510 court in this state in the county in wh ich the prospective defendant
521511 resides or has committed any act which subjects him or her to
522512 liability under this section. A criminal case or prosecution is not
523513 a necessary precedent to the civil action. The statute of
524514 limitations for the cause of action shall not commence until the
525515 latter of the victim's emancipation from the defendant, the victim's
526516 twenty-first birthday, or the plaintiff discovers or reasonably
527517 should have discovered that he or she was a victim of human

555544 trafficking and that the defendant caused, was responsible for or
556545 profited from the human trafficking.
557546 C. Upon availability of funds, the Attorney General is
558547 authorized to establish an emergency hotline number for victims o f
559548 human trafficking to call in order to request assistance or resc ue.
560549 The Attorney General is authorized to enter into agreements with the
561550 county departments of health to require posting of the rights
562551 contained in this section along with the hotline number for
563552 publication in locations as directed by the State Department of
564553 Health.
565554 D. Any peace officer who comes in contact with a human
566555 trafficking victim shall inform the victim of the human trafficking
567556 emergency hotline number and give notice to the victim of certain
568557 rights. The notice shall consist of handing the victi m a written
569558 statement of the rights provided for in subsection A of this
570559 section.
571560 E. 1. Any peace officer or employee of a district court,
572561 juvenile bureau or Office of Juvenile Affairs who has reasonable
573562 suspicion that a minor may be a victim of human tr afficking and is
574563 in need of immediate protection shall assume protective custody over
575564 the minor and immediately notify the Department of Human Services.
576565 The minor shall be transferred to th e emergency custody of the
577566 Department pursuant to the provisions o f Section 1-4-201 of Title
578567 10A of the Oklahoma Statutes. While in custody of the Department,

606594 the minor shall be provided with any necessary emergency social
607595 services which include, but shall not be limited to, medical
608596 examination or treatment, or a mental health assessment.
609597 Law enforcement and the Department of Human Services shall
610598 conduct a joint investigation into the claim.
611599 The minor shall remain in the custody of the Department of Human
612600 Services until the investigation has been completed, but for no
613601 longer than two (2) judicial days, for the show -cause hearing. The
614602 Department may release the minor to the custody of a parent or legal
615603 guardian if it determines the minor will not be subject to further
616604 exploitation. If no such determination is made, the m inor shall be
617605 subject to the deprived child provisions of the Oklahoma Children's
618606 Code and made eligible for appropriate child welfare services.
619607 2. The minor shall not be subject to juvenil e delinquency
620608 proceedings or child -in-need-of-supervision proceedi ngs for
621609 prostitution offenses or misdemeanor or nonviolent felony offenses
622610 committed as a result of being a victim of human trafficking.
623-SECTION 5. This act shall become effective November 1, 2025.

653+individual who was a victim of human trafficking for commercial sex
654+or human trafficking for labor, as such terms are defined in Section
655+748 of Title 21 of the Oklahoma Statutes, and who was under eighteen
656+(18) years of age at the time of the offense.
657+B. Such waiver of resident tuition and nonresident tuition
658+shall be limited to a period of five (5) years.
