5560 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5661 SECTION 1. NEW LAW A new section of law to be codified
5762 in the Oklahoma Statutes as Section 3 -3-601 of Title 27A, unless
5863 there is created a duplication in numbering, reads as follows:
5964 This act shall be known and may be cited as the "Urban
6065 Agriculture Cost Share Program".
61-SECTION 2. NEW LAW A new section of law to be codified

64-A. The Oklahoma Conservation Commission is hereby authorized to
65-establish and administer an Urban Agriculture Cost Share Program as

92+SECTION 2. NEW LAW A new section of law to be codified
93+in the Oklahoma Statutes as Section 3 -3-602 of Title 27A, unless
94+there is created a duplication in numbering, reads as follows:
95+A. The Oklahoma Conservation Commission is hereby authorized to
96+establish and administer an Urban Agriculture Cost Share Program as
9397 funds become available. The Cost Share Program shall provide monies
9498 to eligible persons.
9599 B. The purpose of the Urban Agriculture Cost Share Program is
96100 to promote sustainable urban agricultural practices, improve food
97101 security, and enhance green spaces in Oklahoma's urban areas.
98102 C. The Oklahoma Conservation Commission Infrastruc ture
99103 Revolving Fund shall provide funding for the Urban Agriculture Cost
100104 Share Program. When sufficient funds are available in the Oklahoma
101105 Conservation Commission Infrastructure Revolving F und, the
102106 Commission shall develop and disseminate the program guidelines to
103107 the conservation districts containing urban areas. The guidelines
104108 shall detail incentives to eligible persons for initiating and
105109 continuing urban agriculture initiatives.
106110 D. To implement the program, the Commission shall require
107111 conservation districts to enter into contracts for eligible projects
108112 on eligible land detailing the eligible person's responsibilities.
109113 E. For purposes of the Urban Agriculture Cost Share Program:
110114 1. "Eligible person" means any individual, partnership,
111115 corporation, or legally recognized Indian tribe which shall include
112-land held in trust, estate, or trust who as an owner, lessee,
113-tenant, or operator p articipates in the care or management of land
114-within a conservation district;
115-2. "Eligible land" means land that is within five (5) miles of
116-an urban area that is:

142+land held in trust, estate, or trust who as an owner, lessee,
143+tenant, or operator participates in the care or management of land
144+within a conservation district;
145+2. "Eligible land" means land that is wit hin five (5) miles of
146+an urban area that is:
144147 a. privately owned land within the state,
145148 b. land owned by the state or a political subdivision of
146149 the state, or
147150 c. lands temporarily owned by the United States or a
148151 corporation wholly owned by it, which were not
149152 acquired or reserved for conservation purposes,
150153 including lands administered by the Farm Service
151154 Agency, the U.S. Department of Defense, or by any
152155 other government agency;
153156 3. "Eligible projects" means urban agriculture projects that
154157 include, but are not limited to:
155158 a. establishing or expanding community gardens in urban
156159 neighborhoods,
157160 b. rooftop and vertical farming,
158161 c. installing greenhouses, high tunnels, or hoop houses
159162 for food production,
160163 d. installing rainwater harvesting systems and efficient
161164 irrigation for urban farming,
162-e. enhancing soil health through composting and nutrient
163-management in urban areas,
164-f. establishing urban apiar ies,
165-g. planting urban pollinator gardens,
166-h. building livestock infrastructure such as chicken
167-coops or goat enclosu res,

193+f. establishing urban apiaries,
194+g. planting urban pollinator gardens,
195+h. building livestock infrastructure such as chicken
196+coops or goat enclosures ,
195197 i. developing and implementing education programs on
196198 urban farming practices,
197199 j. creating, operating, and maintaining an urban food
198200 waste composting program,
199201 k. urban marketing initiatives for Oklahoma farms to sell
200202 in urban areas, and
201203 l. other projects that accomplish the objectives and
202204 purpose of this Cost Share Program; and
203205 4. "Urban Area" means the areas in Oklahoma which have been
204206 defined by the United States Census Bureau as urban are as based on
205207 certain criteria and utilizing data from the most rec ent Federal
206208 Decennial Census.
207209 SECTION 3. NEW LAW A new section of law to be codified
208210 in the Oklahoma Statutes as Section 3 -3-603 of Title 27A, unless
209211 there is created a duplication in numbering, reads as follows:
210212 When developing the guidelines for an Urban Agriculture Cost
211213 Share Program, the Oklahoma Conservation Commission shall consider:
212-1. Prioritizing projects in geographic areas where residents
213-have low levels of access to retail outlets selling healthy and
214-affordable food;
215-2. Building on existing urban agriculture projects to continue
216-to grow community engagement;

244245 3. Reviewing approved cost -share methods available through
245246 USDA-NRCS to promote urban agriculture, improve urban food security,
246247 and enhance green spaces in urban areas; and
247248 4. Evaluating if other federal, state, or Oklahoma tribal
248249 programs can be enhanced by the inclusion of practices in the
249250 Commission's Urban Agriculture Cost Share Program.
250251 SECTION 4. NEW LAW A new section of law to be codif ied
251252 in the Oklahoma Statutes as Section 3 -3-604 of Title 27A, unless
252253 there is created a duplication in numbering, reads as follows:
253254 A. The Conservation Commission shall require applicants to
254255 submit information, forms and reports as necessary to properly and
255256 efficiently administer the Urban Agriculture Cost Share Program.
256257 B. Persons may apply to a conservation district for cost share
257258 funds for eligible urban agriculture initiatives in the Sta te of
258259 Oklahoma, in accordance with the Cost Share Program year gu idelines
259260 prepared yearly by the Commission. To be eligible for reimbursement
260261 for an urban agriculture cost share project, an eligible person
261262 shall:
262-1. Develop and file for review and approval with the
263-conservation district a project plan that details the urban
264-agriculture project plans, location of project, materials needed,
265-expected expenditure, length of time expected to complete proje ct
266-construction, monitoring or operation plan if applicable, and
267-expected community benefit of project; and

297297 Share Program year as well as any potential continuing
298298 responsibilities that are required to operate and maintain the
299299 project, if applicable.
300300 C. Applications for funds shall be approved or denied by the
301301 conservation district in accordance with promulgated criteria
302302 prepared by the Commission.
303303 SECTION 5. NEW LAW A new section of law to be codified
304304 in the Oklahoma Statu tes as Section 3-3-605 of Title 27A, unless
305305 there is created a duplication in numbering, reads as follows:
306306 Upon the conclusion of each Cost Share Program year, the
307307 Oklahoma Conservation Commi ssion shall prepare and post on the
308308 agency website the statistical data for number and type of urban
309309 agriculture projects, funds expended, and urban community impacts by
310310 urban area of the cost share practices for that program year. This
311311 same information shall also be shared with the state cabinet
312312 Secretaries of Agricul ture and Energy and Environment.
313-SECTION 6. NEW LAW A new section of law to be codified
314-in the Oklahoma Statutes as Section 3-3-606 of Title 27A, unless
315-there is created a duplication in numbering, reads as follows:
316-Nothing in this act or in the contract executed pursuant to
317-Section 4 of this act shall be interpreted or construed to
318-constitute a financial or general obligation of the state. No state

339+SECTION 6. NEW LAW A new section of law to be codified
340+in the Oklahoma Statutes as Section 3 -3-606 of Title 27A, unless
341+there is created a duplication in numbering, reads as follows:
342+Nothing in this act or in the contract executed pursuant to
343+Section 4 of this act shall be interpreted or construed to
344+constitute a financial or general obligation of the state. No state
346345 revenue shall be used to guarantee or pay for any damages to
347346 property or injury to p ersons as a result of the provisions of this
348347 act or the contract.
349348 SECTION 7. AMENDATORY 27A O.S. 2021, Section 3 -2-110, is
350349 amended to read as follows:
351350 Section 3-2-110. A. There is hereby created in the State
352351 Treasury a revolving fund for the Oklahoma Conservation Commission
353352 to be designated the "Oklahoma Conservation Commission
354353 Infrastructure Revolving Fund".
355354 B. The fund shall be a continuing fund, not subject to f iscal
356355 year limitations, and shall consist of all monies received by the
357356 Oklahoma Conservation Commission from the apportionment of gross
358357 production tax revenues as prescribed by Section 1004 of Title 68 of
359358 the Oklahoma Statutes.
360359 C. All monies accruing to the credit of said fund are hereby
361360 appropriated and may be budgeted and expended by the Oklahoma
362361 Conservation Commission for the purpose of the rehabilitation of
363362 watershed dams and, for the Conservation Cost Share Program , the
364-Urban Agriculture Cost Share Program, and the Conservation Reserve
365-Enhancement Program.
366-D. Expenditures from said fund shall be made upon warrants
367-issued by the State Treasurer against claims filed as prescribed by
368-law with the Director of the Office of Management and Enterprise
369-Services for approval and payment.

397395 E. No more than thirty percent (30%) of the monies in the fund
398396 shall be used for the payment of administrative expenses, salary or
399397 any other continuing obligation of the Oklahoma Conservation
400398 Commission; provided, however, s uch monies shall not be used for
401399 salary increases for employees.
402400 SECTION 8. This act shall become effective November 1, 2025.
